COMMUNITY FORUM COMMUNITY FORUM The Community Forum provides the public with an opportunity to speak with Council on items that are of concern to them, with the exception of Public Hearing by-laws that have not yet reached conclusion. Each person will be permitted 2 minutes to speak or ask questions (a second opportunity is permitted if no one else is sitting in the chairs in front of the podium). The total time for this Forum is limited to 15 minutes. If a question cannot be answered, the speaker will be advised when and how a response will be given. Council will not tolerate any derogatory remarks directed at Council or staff members. RECOMMENDATIONS: 1. That Maple Ridge Official Community Plan Amending Bylaw No. 6553-2008 be given first reading and be forwarded to Public Hearing; 2. That in accordance with Section 879 of the Local Government Act opportunity for early and on-going consultation has been provided by way of posting Official Community Plan Amending Bylaw No. 6553-2008 on the municipal website and requiring that the applicant host a Development Information Meeting, and Council considers it unnecessary to provide any further consultation opportunities, except by way of holding a public hearing on the bylaw; 3. They have sought to work with the lands to the south but the property owners were not willing to develop at this time, as such, Haney -Pitt Meadows Christian School Association wish to proceed on their own. The resulting road pattern and subdivision layout allows improved access to their school, better neighbourhood traffic circulation and protects development potential to lands to the south. c) Project Description: The applicant is proposing to rezone a portion of the subject properties to allow for 21 R-1 (Residential District) Tots no less than 371m2 in area. A lane is proposed behind Tots 7-11 for ease of vehicular access and fire protection. The proposal also calls for the northern extension of 204B Street connecting to 121B Avenue with the potential for the street to continue north to 122 Avenue in the future. A small piece of land in the southwest corner of the park will be required for road to make this future connection possible. Ward Consulting Group was commissioned by the applicant to perform a traffic impact study of the proposed development. The study was completed in 2006 using forecasts for 2008 and 2013. A revision to the subdivision plan resulted in a revision of the traffic study in late 2007. The report notes that the intersection separation on 203 Street and the lane/121B Avenue intersection location is acceptable. The report recognises that all school and resident traffic going to 203 Street will do so along 121B Avenue and the report notes that there will be delays for traffic entering 203 Street from 121B Avenue but also states that a traffic signal is not warranted at the intersection. The Engineering Department has reviewed this report and has not objected to the reports findings. -3- d) Planning Analysis: gfficial Community Plan: The site is designated Urban Residential and Institution. The proposed R-1 (Residential District) zone correlates with the land's Urban Residential designation. The Official Community Plan indicates that the subject properties are "Major Corridor Residential" because they do not lay within the Regional Town Centre and has frontage on an existing Major Road Corridor (203 Street) as identified on Figure 4. Major Corridor infill policies encourage the compatibility of the site design, setbacks, and lot configuration with the existing pattern of development in the area. The development as proposed is compatible in terms of building massing and type of dwelling units with the surrounding residential properties. The proposed subdivision and road layout required the OCP designations on the subject lands to be realigned. The Christian school's "Institutional" designation needs to be extended westward to encompass some of the current "Urban Residential" designation. A section of the road must be removed from the "Institutional" designation and added to "Urban Residential". A section of park to be removed from the "Park" designation must also be added to "Urban Residential" and "Institutional" for the creation of the intersection between 121B Avenue and 204B Street. The redesignations will ensure consistency between the proposed zoning amendments and the OCP as amended. Zoning Bylaw: A preliminary review of the proposed subdivision plans in relation to the Zoning Bylaw requirements has revealed the need for two variances. Without the lands to the south, the subject site is narrow. To meet the minimum area, the proposed lots are wide and shallow, as opposed to being long and narrow. The wide lot width is reflective of the existing lots to the north and should assist in housing 'fit'. As such, seventeen of the proposed twenty-one lots require a reduction of the minimum lot depth of 24 metres to approximately 22 metres. Since the lots are not as deep as required, the proponent also requires a variance to the rear yard setback for the centre block of lots. As such, a Development Variance Permit application has been received to vary the following: 1. The minimum lot depth from 24 metres to approximately 22 metres for lots 1-8, 12-17 and 19-21; and 2. The minimum building setback 8 metres to 7 metres for Tots 1-8, 12-17 and 19-21. These variances will be reviewed in a future report to Council. e) Development Information Meeting: A development information meeting on February 18, 2008 from 4:30 pm to 7:30 pm at Maple Ridge Christian School was held by staff from MRCS developments Ltd and Pacific Land Resource Group Inc. There was a total of 15 people sign -in and 13 completed comment sheets. Although most -4- Parks & Leisure Services Department: attendees were in favor of the project, two main issues were expressed at the meeting: increased traffic and house design. Traffic There was some opposition from area residents who will see their private dead-end roads opened up which will increase in traffic volumes. The Ward Consulting report notes that the road design is acceptable and although there will be delays for traffic entering 203 Street from 121B Avenue, a traffic signal is not warranted at the intersection. House Design There was a concern regarding basements in this neighbourhood. Because of groundwater and soil types at this location, residences constructed at this site will not include basements. A restrictive covenant registered on title will be a requirement of the subdivision prohibiting the construction of basements. Consistency of housing was also a concern that was discussed at the Development Information Meeting. The wide lots as proposed will allow for more consistency with the houses on the north side of 121B Avenue. f) Interdepartmental Implications: Engineering Department: The Engineering Department has identified that all of the services required in support of the rezoning do not exist to the site. It will, therefore, be necessary for the applicant to enter into a Rezoning Development Agreement and post the required security to complete the necessary works prior to final reading. The Parks & Leisure Services Department have identified that after the subdivision is completed they will be responsible for maintaining the street trees. In the case of this project it is estimated that there will be an additional 21 trees which is based on one tree per lot; final subdivision design will provide exact numbers. The Manager of Parks & Open Space has advised that the maintenance requirement of $25.00 per new tree will increase their budget requirements by $525.00. Fire Department: A referral was sent to the Fire Department and they have no concerns with the development as proposed. The proposed road improvements will enhance emergency response to the school and permit alternative access routes in case of emergencies in the neighbourhood. g) School District Comments: A referral was sent to School District No. 42 on February 25, 2008, no comments have been received to date. -5- Intergovernmental Issues: Local Government Act: An amendment to the Official Community Plan requires the local government to consult with any affected parties and to adopt related bylaws in compliance with the procedures outlined in Section 882 of the Act. The amendment required for this application is considered to be minor in nature. It has been determined that no additional consultation beyond existing procedures is required, including referrals to the Board of the Regional District, the Council of an adjacent Municipality, First Nations, the School District or agencies of the Federal and Provincial Governments. The amendment has been reviewed with the Financial Plan/Capital Plan and the Waste Management Plan of the Greater Vancouver Regional District and determined to have no impact. CONCLUSION: It is recommended that this application be favourably considered and be given first reading and forwarded to Public Hearing. Application AL/113/04, to exclude the subject property at 12476 232nd Street from the Agricultural Land Commission, was denied by Council to proceed to the Agricultural Land Commission. b) Project Description: The subject properties are located near the intersection of 232nd Street and 124th Avenue and have a combined area of 4.87 hectares (12.0 acres). They are situated along the boundary of the Agricultural Land Reserve. If successful, the applicant intends to develop the property in a manner consistent with the urban style of single family housing to the south. To date, 13 letters have been received in response to this application: 12 were opposed, and one expressed more general concerns about the area around the subject properties. -2- c) Planning Analysis: Development Considerations The following land use implications of the proposed exclusion need to be considered: • The issue of where to accommodate long term urban growth was contemplated during the review of the Official Community Plan, which was adopted on November 14, 2006. The background research in support of the Official Community Plan included a residential review component which explored options for housing a growing population. The options included a choice between allowing development to proceed North, thereby joining the urban area with Silver Valley or reaffirming the urban reserve in Thornhill. In their considerations, Council retained the Thornhill urban reserve for this purpose. Specific triggers have been approved to determine when redevelopment in Thornhill would take place; one of these triggers requires the approaching build -out of the residential capacity within the existing urban area. It is noted that any proposed extension of the existing urban area boundary, however incremental, could affect the timing of this trigger, and could impact previous commitments. It is important that property owners are provided with some degree of certainty about the developable land base in Maple Ridge in order to foster a secure investment climate that is consistent with the community's stated direction. • There is no apparent need within the community that would be met by excluding these properties from the Agricultural Land Reserve, should this application prove to be successful. Additional land for residential development is not considered a priority for the District in the short to medium term. A greater priority, which has been endorsed by Council, is to increase residential capacity within the existing urban area, particularly in the Town Centre, through infill and redevelopment. It is noted that Council discussions relating to support for the extension of the urban area boundary are focused on the need for providing employment generating lands within the Community. This application is at odds with these priorities and the land use pattern established in the Official Community Plan. • The subject properties are currently designated for Agricultural use under the existing Official Community Plan. Any change in that use would require an amendment to the Official Community Plan, which in turn would require the approval of Metro Vancouver. The approval of the Greater Vancouver Sewerage and Drainage District would also be required, for and expansion of sewer services at greater densities than are currently provided. • Policy 6-12 (a) of the Official Community Plan states: Maple Ridge will protect the productivity of its agricultural land by a) Adopting a guiding principal of "positive benefit to agricultural" when making land use decisions that could affect the agricultural land base, with favourable recognition of initiatives including but not limited to supportive non-farm uses, infrastructure improvements for farmland, or the inclusion of land elsewhere in the Agricultural Land Reserve; This application does not address this policy consideration for positive benefits to agriculture. -3- CONCLUSION: Council has been provided with options for processing this application. Consistent with the recent and similar applications for these properties (2004 and 2006), the staff recommendation is not to forward the application based upon considerations as outlined within this report. The sanitary sewer extension construction was initially tendered in November of 2008, but because the bid price was higher than the estimated cost, it was necessary to seek the homeowners' approval with a revised cost estimate. On April 16, 2009 the project was re -tendered and the Invitation to Tender closed on May 6. Nine tenders were received and the lowest compliant bid was submitted by Double M Excavating Ltd. at $44,387.58. Two submitted tenders were non-compliant and therefore not considered. Council approval to award the contract is required in order for the work to proceed in order that sanitary sewer service can be provided to the 4 lots at 12851, 12841, 12850 & 12844 Barnsdale Street. RECOMMENDATIONS: THAT Contract EO4-010-065.1: Barnsdale Street Sanitary Sewer Extension Local Area Service be awarded to Double M Excavating Ltd. in the amount of $44,387.58 (including GST); and THAT the Corporate Officer be authorized to execute the contract. DISCUSSION: a) Background Context: On September 9, 2008, in response to a petition by neighbourhood homeowners, Council authorized staff to prepare a bylaw to establish a Local Area Service to provide sanitary sewer service to four lots in the 12800 block of Barnsdale Street, and amend the capital program to provide for construction of the sanitary sewer service. 1103 The sanitary sewer construction was initially tendered in November of 2008, and the lowest compliant bid was $40,124.70 from Span Valley Construction. The tender was not awarded because the price was higher than the original estimate given to the homeowners of the Local Area Service and it was necessary to obtain the approval of the homeowners for the higher cost. As a result of the consultation, the homeowners signed a new petition in February 2009 for the sanitary sewer Local Area Service with an estimated construction cost of $46,143.40. Subsequently, the project was re -tendered in April 2009 and the Invitation to Tender closed on May 6, 2009. Tender result and analysis Nine tenders were received and opened in public, but two of the tenders were non-compliant, and therefore not considered. The final cost of the sanitary sewer construction including design fees, inspection fees, and other ancillary charges will be shared equally among the four homeowners. They will have the option of paying the actual `commuted' cost or have the cost placed on the tax roll, amortized over a period of 15 years at the interest rate set by the MFA and the Finance Department. It is estimated that the final costs for each property will be $11,535.85. The homeowners are responsible for connecting at the property line and installing their own service from the property line to the house. The homeowners will be advised of the construction schedule once the award is made. d) Interdepartmental Implications: The construction of the sanitary sewer system will be coordinated with the Operations Department, including the connection to the existing sanitary sewer line. e) Business Plan/Financial Implications: The bid that is recommended is within the updated estimated construction cost that the residences have approved. The cost of the project will be recovered from the homeowners of the Local Area Service either through a lump sum or through financing it on their property tax bill over a period of time. CONCLUSION: The tender price of $44,387.58 (including GST) by Double M Excavating Ltd. for Barnsdale Street Sanitary Sewer Extension Local Area Service is the lowest compliant tendered price. In conjunction with the Fire Hall renovations, the proposed road needs to be completed to facilitate vehicle and parking access to the renovated Fire Hall. ISL, the District's design consultant, in conjunction with District of Maple Ridge reviewed the ten compliant tenders that were received and Tag Construction Ltd was low bidder. Tag Construuiiuir Ltd. has worked in Maple Ridge before and is a competent firm with many years of construction experience. RECOMMENDATION: That Tender ITT-OPS09-100, be awarded to Tag Construction Ltd. in the amount of $206,134.95 inclusive of GST; and further that the Corporate Officer be authorized to execute the contract. DISCUSSION: a) Background Context Presently Fire Hall Number 1 is going through an extensive renovation to the building. As a part of the renovation new parking will be created to access and egress the site from Brown Avenue. Furthermore, the completion of Brown Avenue to Fletcher Street will provide an alternate for the Fire Trucks returning to the hall. The western portion of the Brown Avenue extension was constructed starting last year and the second half of the works scheduled to be completed this year, when the building Contractor has vacated that space by the end of May. The extension of Brown Avenue has been included in successive transportation plans. Brown Avenue will provide an alternative to Dewdney Trunk Road through the downtown and will include a bicycle path. On May 7, 2009, ten bids were received for the current phase to Fletcher Street. The three lowest bidders were: Tag Construction $206,134.95 Double M Excavating $220,929.99 Sandpiper $234,193.05 1104 All the bids were analyzed for compliance. The low bid provided by Tag Construction met all the tender requirements. b) Desired Outcomes: In summary, the project's intent is to construct 50 meters of Arterial road to the Downtown standard and 20M of storm sewer, with ornamental streetlights, street trees, and textured sidewalks and, on -street parking with the third entrance to the Fire Hall. c) Strategic Alignment Enhancing the downtown and creating more pedestrian friendly amenities is an objective as part of the goal to establish a vibrant downtown area. Construction of the Brown Avenue, road network as an alternative to Dewdney Trunk Road has been planned for a long time, in conjunction with on going property purchases. d) Citizen/Customer Implications: Disruptions to the area will be minimized to the best extent possible as the majority of theconstruction is off the existing roads, and we have conformation from the Contractor that they'll be able to complete the project in August 2009. e) Interdepartmental Implications: Engineering, Pianning, Operations, lniorrnatioin Servicss, Parks and Fire Departments have been consulted in regards to this project, to best fit their schedules and requirements. f) Business Plan/Financial Implications: Tag Construction Ltd's bid of $206,134.95 inclusive of GST and contingency is within the available budgeted funding of $250,000 as per Long Term Capital Project 1-17-08312. Authorization from Council is required to allow the event to occur in Maple Ridge. Road closures are not anticipated for this event. RECOMMENDATION: THAT use of municipal streets be authorized for the 4th Annual Iron Mountain Triathlon on Sunday, June 21, 2009, provided the conditions outlined in Schedule 'A' attached to the staff report dated April 21, 2009 are met. DISCUSSION: a) Background Context: From time to time, the Municipality is requested to allow the use of municipal streets for organized events. Unless there are some unusual safety implications, approval is usually given on condition that the Municipality be indemnified against any liability for injury or damage resulting from the event. The conditions of approval of the event are attached as "Schedule A". The Iron Mountain Triathlon begins at 7:00 am at Whonnock Lake and use of the surrounding streets is required. The triathlon is divided into two events: an Olympic Distance Race (1.5 km swim, 40 km bike, 10 km run) and a Sprint Race (750 m swim, 22 km bike, 5 km run). The attached Run Course Map and Bike Course Map provide the detailed route information. Road closures are not anticipated for this event. RCMP approval has been obtained. b) Strategic Plan: Permitting of Maple Ridge street events promotes community development and often highlights Maple Ridge's natural and built features. c) Citizen/Customer Implications: This event does not require road closures. However, permission to use municipal streets may cause some delays and inconveniences to other road users. Traffic control will be provided by the event organizers. 1105 d) Interdepartmental Implications: The road use permit establishes that the event organizer must obtain the approval of RCMP, for traffic control and must notify the Fire Department and BC Ambulance Services as well as coordinate with Coast Mountain Bus Company (transit service). The organizer must also attain permission to use Ministry of Transportation facilities, Maple Ridge Municipal park facilities and the District of Mission roads. e) Business Plan/Financial Implications: The Business Plan recognizes that the District processes requests for use of municipal streets as part of its services. The financial impact of the specific road use is limited to staff processing effort. f) Policy Implications: Permission to use municipal streets is grantable under the District's policy practices. g) Alternatives: The District could refuse to permit the event to occur. In this event, the organizer would have to cancel the event or arrange for alternatives. Policies without this statement or an altered statement will NOT be accepted. The policy shall also include a Cross Liability Clause. A copy of such policy shall be delivered to the Corporate Officer prior to the event; and 12. refurbish all municipal infrastructure to an equal or better condition than that which existed prior to the event, all within 24 hours of the completed event, to the satisfaction of the District. This year there are 2 races an Olympic Distance Race (1.5K swim, 40K bike, 10K run) and Sprint Race (750m swim, 22K bike, 5K run) and both of these races should be finished by midday with start time at 7:00 AM. Last year many competitors traveled from outside the Lower Mainland from such places as Alberta, Washington State, Oregon State and Vancouver Island and Interior of BC and stayed in hotels and spent money at local businesses. This race is also a fundraiser for the Crohns and Colitis foundation of Canada. In 2009 the Iron Mountain Triathlon also a test race for the course, volunteers and officials for the upcoming World Police and Fire Games Triathlon Race on August 8th 2009 I look forward to working with you to make this event grow bigger and better in 2009 and beyond. The Canada Day celebrations are organized by a volunteer committee in partnership with Ridge Meadows Parks and Leisure Services. The Canada Day Committee will be using Spirit Square in addition to Memorial Peace Park for the festivities. Approval for the following road closures as per the attached map. Bylaws have been prepared for the collection of these levies in 2009. A 5% increase over last year is proposed. The increase will assist in funding future programs for both Dyking Districts. RECOMMENDATIONS: That Road 13 Dyking District Tax Rates Bylaw No. 6670-2009; be given first, second and third readings and that. Albion Dyking District Tax Rates Bylaw No. 6671-2009 be given first, second and third readings. DISCUSSION: No funds have been allocated in the Capital Works budget for these dykes. All works must be funded through the Dyking Districts. Provincial grants can be applied for but these generally require that the recipient pay 33% of all costs. For example, this year an application for a Flood Protection Program grant was submitted for an upgrade of the Albion Dyke. Parks & Leisure Services Fees and Charges EXECUTIVE SUMMARY: As a result of the 2009 admission and rental rate review for Parks and Leisure facilities (excluding Fields); staff recommend a 5% increase for rental rates that fall below current market rates (Indoor Pool, Greg Moore Youth Centre, and Meeting Rooms), with the remaining facility and admission rates increasing by the 2008 average Consumer Price Index for Vancouver (CPI = 2.4%). The notion of a CPI minimum increase was adopted in a policy set by the Parks and Leisure Services Commission in 2008 to ensure small, gradual increases are regularly incorporated into all of our fees and charges. Once the Fees and Charges Bylaw is endorsed by both Councils (June 2009), staff will immediately notify user groups and implement the changes effective January 1St, 2010. The rates encompassed within the attached bylaw have been recommended by the Parks and Leisure Services Commission. RECOMMENDATION: That Maple Ridge Recreation Facility Fees Amending Bylaw No. 6664-2009 be given first, second and third readings. DISCUSSION: a) Background Context: The last fees and charges review of indoor facility rental rates and admissions took place in the Spring of 2008. In Spring 2009, staff reviewed facility rental and admissions data for Lower Mainland recreation facilities, including but not limited to; Port Coquitlam, Coquitlam, Langley, Burnaby, Port Moody and Vancouver to determine current market rental rates. Included with this report is a summary of research showing the average market rate per facility, compared to current Commission rates and the variance between the two - See Attachment #1. Consistent monitoring of market rates and adjustment of Commission rates has begun to narrow any variations, with the resulting stabilization of rental and admission fees that can be observed in this review. In consultation with programming staff and our arena partners, staff adjusted the fee structure for public skating to include 10 and 20 passes, removing the half season and season passes, which had not been popular with customers. Customer Service staff plan to produce the passes in-house to reduce costs. In 2008 Event organizers were able to make use of the new Special Event Trailer - the rental fee ($150.00) was carefully considered between stakeholders and staff to provide affordable access to this valuable new asset. The trailer was rented 13 times in the first year, and provided special event volunteers with diverse items such as tents, barricades, stereo unit, chair and tables etc. Fifty percent of the resulting revenue from the Special Event Trailer is shared with our partner in this initiative, the Ridge Meadows Association for Community Living. Only 40% of minor sport ice time is subsidized by the Commission. The cost of ice for local minor sport groups is increased significantly because the remaining 60% of required time is purchased at full cost from the arenas. Staff will be bringing a report forward to Commission in June outlining the overall cost of ice to local minor sport groups with recommendations related to this issue. Although research has shown that the subsidized rental rate for ice in Maple Ridge and Pitt Meadows is below the average in the Lower Mainland, the proportion of subsidized time provided to local minor sport groups is also below average so that the overall cost of ice for minor sports is higher than the norm. For this reason, staff recommend only a 2.4% CPI increase to subsidized ice costs, considering that the majority of ice time purchased by local minor sports is at a rate that is much higher than the subsidized rate provided by the Commission. In 2009 the British Columbia Recreation and Parks Association has partnered with Civic Info to expand on their tabulation of Fees & Charges through British Columbia; however to date this report has not initiated its new survey, but will be a comparative source of information in 2010. b) Desired Outcome: To regularly review facility rental and admission fees and maintain a balance between rates that are affordable to local user groups, and comparable to the current market to assist in off -setting operating costs. To review the rates on an annual basis to avoid large increases and ensure increases are gradual and reasonable. c) Strategic Alignment: Provide high quality municipal services to our citizens and customers in a cost effective and efficient manner. d) Citizen/Customer Implications: The result of this most recent review is generally a 2.4% increase, which is quite manageable. For many regular user groups, this will mean less than $100.00 per year increase. The group that will be most impacted is Ridge Meadows Minor Hockey as they rent the largest number of hours in the most expensive facility. The impact for this group will be approximately $2,300.00 for one year. The impact of a 5% increase on Indoor Pool fees would be approximately $700.00 each for the Seahorses and the Neptunes Swim Clubs these increases will be divided among a large number of individual members. Increased fees affect all facility users. To mitigate the impact on customers, our goal is to monitor and adjust fees regularly, and to provide customers with as much notice as possible when rates change. In this case, recommended rate increases for admission and rental rates would take effect January 1, 2010. The date of fee implementation has been shifted from September of each year to January, which allows community groups time to adjust their registration fees and plan accordingly. If approved by Commission and both Councils, groups will be notified of the increases in June 2009. It should also be noted that our policy provides for rental fee waivers to groups who subsidize registration fees for families who might otherwise not be able to participate due to their financial circumstances. Implementation of this policy means that groups identify to Parks and Leisure Services how many registration fee waivers they have processed and their value and that amount is taken off of the rental fees charged to the group. Further support is provided to families who cannot afford regular admission fees. Families are able to apply for the "participation" program which provides much reduced admission fees to facilities and breaks on program fees to families facing financial challenges. There are currently close to 2000 people registered in this program in Maple Ridge and Pitt Meadows. e) Business Plan/Financial Implications: If adopted, these rate increases would increase facility rental revenue for indoor facilities by approximately $6000 in 2010. This revenue is used to off -set facility operating costs. f) Policy Implications: This recommendation follows the existing fees and charges policy. g) Alternatives: Maple Ridge Council could suggest additional changes based on their interpretation of the attached data. CONCLUSIONS: The last rental rate increase for indoor facilities was September 1, 2008; these rates included a 5% increase for all facilities except the Arena Dry Floor, Outdoor Pools, Gymnasiums, Multipurpose Rooms, and the Greg Moore Active Area which were increased by the rate of inflation. The last admission rate increase (September 1, 2008) was 5% for Pitt Meadows Family Recreation Centre and Public Skating, with the Maple Ridge Leisure Centre and the Outdoors Pools being increased by the rate of inflation. This report recommends a 5% increase again for Indoor Pools, Greg Moore Youth Centre rooms and meeting rooms, with other facilities and admission rates for all facilities increasing by the 2008 average Consumer Price Index for Vancouver, which is 2.4%. The resulting impact on most groups would be a slight increase with 6 months notice to plan for that increase.
