COMMUNITY FORUM
The Community Forum provides the public with an opportunity to ask questions of
Council on items that are of concern to them, with the exception of Public Hearing
by-laws that have not yet reached conclusion.
Council will not tolerate any derogatory remarks directed at Council or staff
members.
Each person will be permitted 2 minutes to speak or ask questions (a second
opportunity is permitted if no one else is sitting in the chairs in front of the
podium). Questions must be directed to the Chair of the meeting and not to the
individual members of Council. The total time for this Forum is limited to 15
minutes.
If a question cannot be answered, the speaker will be advised when and how a
response will be given.
Other opportunities are available to address Council including public hearings and
delegations. The public may also make their views known to Council by writing or
via email and by attending open houses, workshops and information meetings.
Serving on an Advisory Committee is an excellent way to have a voice in the future
of this community.

The following dates outline Council's consideration of the application and Bylaw 6602-2008
The First Reading report (see attached) was considered on August 26, 2008;
First Reading was granted August 26, 2008
Public Hearing was held September 16, 2008;
Second and Third reading was granted on September 30, 2008.
Application Progress:
The applicant has been working on the terms and conditions to be met prior to final reading of the
Zone Amending Bylaw. The major outstanding item is the civil drawings required for the Rezoning
Servicing Agreement. These plans, however, are nearing completion.
Alternatives:
Council may choose one of the following alternatives:
1. grant the request for extension;
2. deny the request for extension; or
3. repeal third reading of the bylaw and refer the bylaw to Public Hearing.

CONCLUSION:
The applicant has been actively pursuing the completion of this rezoning application and has applied
for a one year extension. It is anticipated that within the next few months final consideration will be
applied for.

Application RZ/087/07 proposes to rezone the property located at 23940 118 Avenue from RS -3
(One Family Rural Residential) to R-1 (Residential District). This application is in support of
subdivision application SD/087/07, which is for a 5 lot subdivision. The proposed size of each lot is
not less than 374 m2 (4025 ft2).
Currently, proposed Lot 1 has an existing house that the applicant would like to retain. Proposed Lot
1 will be meat -hooked to a portion of land on the east side of proposed Lot 2. At the subdivision
stage, this portion of land will have a no -build covenant placed over it to ensure that future
subdivision potential is possible with the properties to east. At the subdivision stage, proposed Lot 1
will also have a right-of-way registered on title to allow for a temporary turnaround in the lane.
The south portion of the subject property will be dedicated as park for the protection of Horseshoe
Creek. The applicant has submitted a geotechnical report to review the slopes to the south. The
report states "the lands may be used safely for the use intended".

c) Planning Analysis:
Official Community Plan:
The subject property is designated Urban Residential and 118 Avenue is identified as a major
corridor. According to the zoning matrix, this designation supports the R-1 (Residential) zone.
The following Official Community Plan Residential Infill and Compatibility Criteria apply to the
proposed rezoning:
3-20 Major Corridor Residential Infill developments must be designed to be compatible with
the surrounding neighbourhood and will be evaluated against the following criteria:
(a) building forms such as single detached dwellings, duplexes, triplexes, fourplexes,
townhouses, apartments, and small lot intensive. residential development subject to
Policy 3-21
(b) maximum building height of two and one-half storeys with an emphasis on ground
oriented units for all developments except for apartments.
The proposed R-1 (Residential! District) zone has a maximum height of 9.5 metres.
(c) a maximum height of four storeys for apartments
This is not applicable as the proposal is for single family Tots.
(d) adherence to Development Permit Guidelines for multi -family and intensive residential
development as outlined in Chapter 8 of the Official Community Plan.
The proposal is not subject to a multi -family or intensive residential development permit
3-21 All Neighbourhood and Major Corridor Residential infill development will respect and
reinforce the physical. patterns and characteristics of established neighbourhoods, with
particular attention to:
(a) the ability of the existing infrastructure to support the new development
The proposed lots will be serviced by municipal services.
(b) the compatibility of the site design, setbacks and lot configuration with the existing
pattern of development in the area.
The proposal is consistent with the surrounding area and carries on the pattern of
development that has occurred to the west.

A Bylaw to amend Map "A" forming part
of Zoning Bylaw No. 3510 -1985 as amended.
WHEREAS, it is deemed expedient to amend Maple Ridge Zoning Bylaw No. 3510 -
1985 as amended;
NOW THEREFORE, the Municipal Council of the Corporation of the District of Maple
Ridge, in open meeting assembled, ENACTS AS FOLLOWS:
1_ This Bylaw may be cited as "Maple Ridge Zone Amending Bylaw No. 6602-2008."

b) Project Description:
The applicant has applied to rezone the subject property from RS -1 (One Family Urban Residential)
to CRM (Commercial/Residential) for the construction of a four storey wood -frame apartment
building with one level of underground parking. The site is located at the southeast end of 224th
Street, adjacent to the Haney Bypass, and is currently vacant. There is no vehicle access or egress
from Haney Bypass at this location. Pedestrian access under the Haney Bypass to the waterfront
and the West Coast Express Station are located just to the west of the site.
The development site slopes from the northeast to the southwest. Most of the units and the
proposed roof top patio will have the advantage of the views of the Fraser River and beyond. The
site will feature terraced retaining walls with landscaping of various heights that will serve to
mitigate noise generated by the adjacent Haney Bypass and CPR right-of-way. The architect has
incorporated sound attenuation measures into the building design and materials. Heritage colours
and traditional materials will be featured in recognition of the heritage character of Port Haney.
The proposed building contains 35 units ranging in size from 62.4m2 (672 ft2) to 98m2 (1056 ft2)
with both one and two bedrooms units. An amenity room on the main floor with an adjacent outdoor
amenity space on the east side of the building and a roof top patio covered with a trellis will be
available for the residents' use.
Underground parking will be provided with access from 224 Street at the northwest corner of the
site. 7 Visitor Parking spaces will be located within the underground parking that will be
accessible outside of the security gate. A long term bicycle storage room will be located in the
underground parking level and racks for 11 bicycles are to be provided at the building exits for
short term storage. The proposed parking for this development has a shortfall of one residential
parking space as required by the Off -Street Parking and Loading Bylaw. Because this property is
located within 930 metres of the municipally owned parking lot, the owner has opted to provide
payment in lieu of providing the required parking space. The amount to be provided to the
District of Maple Ridge is $8000.00 which is the payment -in -lieu fee.

c) Planning Analysis:
Town Centre Development Permit Area - Port Haney and Waterfront Precinct:
This property is subject to the guidelines of Section 8.11 Town Centre Development Permit Area
Guidelines - Port Haney and Waterfront Precinct of the Official Community Plan that aim to regulate
the form and character of development located within this area. This development respects the key
guideline concepts as outlined in this section.
1. Promote Port Haney and the Waterfront as an important heritage, tourism -oriented area.
This multi -family residential building will provide vibrancy to the area and will be highly
visible from the Haney Bypass. Significant landscaping within the site terracing will
surround the site and will continue on the Highways land on the Bypass frontage. It is
located within walking distance of the Civic Core, the waterfront and the West Coast
Express station.
2. Provide a pedestrian -oriented, mixed use commercial and residential environment.
The site is located on a pedestrian link from the downtown to the waterfront and the West
Coast Exchange station with the Haney Bypass underpass located just to the west of the
site. The significant slopes on the site prohibit individual units from directly access the
street, however the main entrance has stairs and ramp access directly to 224 Street and
a rear walkway provides access around the building and to the Haney Bypass. All ground
floor units have exterior doors to at -grade patios and to the common amenity areas.
3. Enhance the heritage quality, character and vibrancy of Port Haney and the Waterfront.
An urban building is proposed with an attractive presence to the street. Although there is
very little existing heritage character in the immediate area, this proposed development
will provide a heritage flavour through use of durable materials, Haney -type brick, heritage
colours and architectural design.
4. Capitalize on important views.
The location of the building on a knoll allows the units to take advantage of the views to
the east, south and west overlooking the Fraser River and beyond. A Rooftop Patio will be
located on the south end of the building roof with excellent views of the Fraser River. The
views from the adjacent restaurant to the north were considered in the building siting and
negative impacts have been avoided.
5. Provide outdoor space.
A large outdoor amenity area will be provided on the east side of the building adjacent to
the common amenity room for residents' use. A pedestrian connection from this area to
the Haney Bypass will be provided. The large Rooftop Patio will provide additional
outdoor space for residents' use.

6. Provide climate appropriate landscaping and green features.
Significant landscaping within the site terracing will surround the site and will continue on
the Highways land on the Bypass frontage. A variety of plantings at various heights on the
south elevation will serve to mitigate noise generated by the adjacent Haney Bypass and
CPR. Several existing evergreen trees have been identified for retention adjacent to the
site and will be incorporated into the new landscaping.
7. Maintain street interconnectivity.
Parking for this development will be located underground with access to 224 Street at the
northwest corner of the site. There are no lanes on this side of 224 Street. There will
continue to be no vehicular access/egress to the Haney Bypass and access to the site will
be solely from 224 Street. The south foot of 224 Street will be finished with curb,
sidewalk, street trees and on -street parking on the east side in front of the building. As
noted above, pedestrian connectivity will be improved.
d) Advisory Design Panel:
The proposed project was reviewed by the Advisory Design Panel on January 8, 2008. The Panel
supported the project as presented with the resolution that the project was to go back to the
Planning Department for reconsideration of the streetscape to avoid exposed retaining walls. The
applicant has provided amended landscape plans with increased planting, including
climbing/trailing plants, both above and below the terraced retaining walls.
e) Intergovernmental Issues:
The Planning Department received the approval of the certified copy of Maple Ridge Bylaw No. 6527
- 2007 from the Ministry of Transportation on May 1st, 2008. Approval for the installation and
maintenance of landscaping on Highways land adjacent to the south property line of this site was
provided by the Ministry of Transportation on May 14, 2009. The Ministry did not provide approval
for a public bench in this location due to public safety concerns resulting from the close proximity to
the highway.
f) Financial Implications:
A refundable security equivalent to 2.5 % of the estimated value of construction will be provided by
the developer to ensure that the development, including the landscaping, is carried out in
accordance with the terms and conditions of the Development Permit. Based on an estimated
construction value of $4,000,000.00 the security will be $100,000.00.
There will be approximately 7 trees added to the municipal street tree inventory on completion of
this project. The costs associated with maintaining these trees will need to be included in a
subsequent operating budget.

CONCLUSION:
As the development proposal largely complies with the Town Centre Development Permit Area
Guidelines - Port Haney and Waterfront Precinct of the Official Community Plan for form and
character, it is recommended that DP/045/06 be given favourable consideration.

Excess Capacity/Extended Services Agreement LC 137/09
EXECUTIVE SUMMARY:
The developer of a property at 20370 Wanstead Street was required to extend the sanitary sewer,
watermain and road along Wanstead Street to serve the development. Part of the development
servicing is considered to be excess or extended servicing in accordance with the Local Government
Act. The extended servicing benefits adjacent properties. Latecomer Agreement LC 137/09
provides the municipality's assessment of the attribution of the costs of the excess or extended
servicing to the benefiting lands.
RECOMMENDATION:
That with respect to the development of lands located at 20370 Wanstead Street, be it resolved:
1. That the cost to provide the excess or extended services is, in whole or in part, excessive
to the municipality and that the cost to provide these services shall be paid by the owner
of the land being developed, and
2. That Latecomer Charges be imposed for such excess or extended services on the parcels
and in the amounts as set out in the staff report dated August 24, 2009, and further
3. That the Corporate Officer be authorized to sign and seal Excess Capacity Latecomer
Agreement LC 137/09 with the developer of the said lands.
DISCUSSION:
a) Background Context:
The attached map identifies the lands which are involved in the development and those
which will benefit from the excess or extended services. The cost breakdown for each
excess or extended service is shown on attached Schedule A.

In addition, a copy of Excess Capacity Latecomer Agreement LC 137/09 is also attached for
information purposes.
b) Strategic Alignment:
Administration of excess or extended services legislation complies with the Smart Managed
Growth element of the Corporate Strategic Plan. The administration procedure supports the
requirement for a developer to construct municipal infrastructure in support of land
development and recognizes that the infrastructure may provide benefit to other land.
c) Policy Implications:
Part 26, Division 11, of the Local Government Act provides that where a developer pays all
or part of the cost of excess or extended services, the municipality. shall determine the
proportion of the cost of the service which constitutes excess or extended service and
determine the proportion of the cost of the service to be attributed to parcels of land which
the municipality considers will benefit from the service. Latecomer Agreement LC 137/09
will provide such determination.
CONCLUSION:
A developer has provided certain services in support of development of his property. Some of the
services benefit adjacent lands therefore, it is appropriate to impose Latecomer Charges on the
benefitting lands. Latecomer Agreement LC 137/09 summarizes the municipality's determination of
benefitting lands and cost attribution and also establishes the term over which such Latecomer
Charges will be applied.

THIS AGREEMENT made the day of , 2009:

(Hereinafter called the "Developer")
AND:
OF THE FIRST PART
CORPORATION OF THE DISTRICT OF MAPLE RIDGE, a Municipal Corporation under
the "Local Government Act", having its offices at 11995 Haney Place, in the
Municipality of Maple Ridge, in the Province of British Columbia
(Hereinafter called the "Municipality")
WHEREAS:
OF THE SECOND PART
A. The Developer has developed certain lands and premises located within the
Municipality of Maple Ridge, in the Province of British Columbia, and more
particularly known and described as:
Lot 451, District Lot 279, Group 1, Plan 114, NWD
(Hereinafter called the "said lands")
B. In order to facilitate the approval of the development of the said lands, the
Developer has constructed and installed the sanitary sewer, watermain and
roadworks shown on the design prepared by AMB Engineering Services, Job No. C-
1023, (Sheets 1 to 4 of 4), dated August 30, 2006, and reviewed as noted by the
Municipality September 20, 2006.
(Hereinafter called the "Extended Services");
C. The extended services have been provided with a capacity to service the said lands
and other than the said lands;
D. The Municipality considers its cost to provide the Extended Services to be excessive;
E. The Developer has provided the Extended Services in the Amount of $64,250.00.

F. The Municipality has determined that the following properties:
Lot 460, District Lot 279, Group 1, Plan 114, NWD;
(the "Benefitting Lands") will benefit from the Extended Services;
G. The Municipality has imposed as a condition of the owner of the Benefitting Lands
connecting to or using the Extended Services, a charge (the "Latecomer Charge") on
the Benefitting Lands in the following amounts:
Lot 460, District Lot 279, Group 1, Plan 114, NWD
• $6,600.00 for connection to the sanitary sewer constructed by the
developer
• $7,906.00 for connection to the watermain constructed by the developer
• $17,619.00 for direct property access to the road constructed by the
developer
plus interest calculated annually from the date of completion of the Extended
Services as certified by the General Manager - Public Works and Development
Services of the Municipality (the "Completion Date") to the date of connection by the
Benefitting Lands to the Extended Services;
H. The Latecomer Charge when paid by the owner of the Benefitting Lands and
collected by the Municipality shall pursuant to Section 939 (7) of the Municipal Act
R.S.B.C. 1996, c.323 be paid to the Developer as provided for in this Agreement.
NOW THEREFORE AS AUTHORIZED BY Section 939 (9) of the Local Government Act R.S.B.C. 1996,
c. 323, The parties hereto agree as follows:
1. The Latecomer Charge, if paid by the owner of the Benefitting Lands and collected by
the Municipality within fifteen (15) years of the Completion Date shall be paid to the
Developer and in such case payment will be made within 30 days of June 30th and
December 31st of the year in which the Latecomer Charge is collected by the Municipality.
2. This Agreement shall expire and shall be of no further force and effect for any
purpose on the earlier of the payment of the Latecomer Charge by the Municipality to the
Developer, or fifteen (15) years from the Completion Date, and thereafter the Municipality
shall be forever fully released and wholly discharged from any and all liability and obligations
herein, or howsoever arising pertaining to the Latecomer Charge, and whether arising before
or after the expiry of this Agreement.
3. The Developer represents and warrants to the Municipality that the Developer has
not received, claimed, demanded or collected money or any other consideration from the
owner of the Benefitting Lands for the provision, or expectation of the provision of the
Extended Services, other than as contemplated and as provided for herein; and further
represents and warrants that he has not entered into any agreement with the owner of the

Benefitting Lands for consideration in any way related to or connected directly or indirectly
with the provision of the Extended Services. The representations and warranties of the
Developer herein shall, notwithstanding paragraph 2 of this Agreement, survive the expiry of
this Agreement.
4. The Developer (if more than one corporate body or person) hereby agrees that the
Municipality shall remit the Latecomer Charge to each corporate body or person in equal
shares.
5. If the Developer is a sole corporate body or person, the Municipality shall remit the
Latecomer Charge to the said sole corporate body or person, with a copy to the following
(name and address of director of corporate body, accountant, lawyer, etc.):
6. In the event that the Developer is not the owner of the said lands, the owner shall
hereby grant, assign, transfer and set over unto the Subdivider, his heirs and assigns, all
rights, title and interest under this Agreement.
IN WITNESS WHEREOF the parties hereto have hereunto affixed their respective Corporate Seals,
attested by the hands of their respective officers duly authorized in that behalf, the day, and
year first above written.

SUBJECT: 28th Annual Haney -Harrison Road Relay
EXECUTIVE SUMMARY:
BC Athletics is requesting permission to use municipal streets for the 28th Annual Haney -Harrison
Road Relay on Saturday, November 7, 2009. A map showing the run routes is attached. Road
closures are not anticipated for this event. Authorization from Council is required to allow the event
to occur in Maple Ridge.
RECOMMENDATION:
THAT use of municipal streets be authorized for the 28th Annual Haney -Harrison Road Relay on
Saturday, November 7, 2009, provided the conditions outlined in Schedule 'A' attached to the staff
report dated September 8, 2009 are met.
DISCUSSION:
a) Background Context:
From time to time the Municipality is requested to allow the use of municipal streets for
organized events. Unless there are some unusual safety implications, approval is usually
given on condition that the Municipality be indemnified against any liability for injury or
damage resulting from the event. The conditions of approval of the event are attached as
"Schedule A."
The Haney -Harrison Road Relay begins at 6:00 am on Brown Avenue at 223 Street.
Participants will travel north on 223 Street to 122 Avenue, travel west on 122 Avenue to 216
Street, travel north on 216 Street to 124 Avenue. Participants will then continue to travel
east on 124 Avenue to 227 Street, travel north on 227 Street to Abernethy Way where they
will travel east to 232 Street. Participants will then travel south on 232 Street to Dewdney
Trunk Road where they will travel east towards Mission and beyond, and finishing in
Harrison.
b) Strategic Plan:
Permitting of Maple Ridge street events promotes community development and often
highlights Maple Ridge's natural and built features.

c) Citizen/Customer Implications:
This event does not require road closures, however, permission to use municipal streets may
cause some delays and inconveniences to other road users. Traffic control will be provided
by the event organizers.
d) Interdepartmental Implications:
The road use permit establishes that the event organizer must obtain the approval of RCMP,
for traffic control and must notify the Fire Department and BC Ambulance Services as well as
coordinate with Coast Mountain Bus Company (transit service).
e) Business Plan/Financial Implications:
The Business Plan recognizes that the District processes requests for use of municipal
streets as part of its services. The financial impact of the specific road use is limited to staff
processing effort.
f) Policy Implications:
Permission to use municipal streets is grantable under the District's policy practices.
g) Alternatives:
The District could refuse to permit the run to occur. In this event, the organizer would have to
cancel the run or arrange for alternatives.
CONCLUSIONS:
From time to time, the District is requested to allow the use of municipal streets for various events
and activities. The Haney -Harrison Road Relay was held in Maple Ridge last year without incident.

Schedule 'A' To Council Memorandum Dated September 8, 2009
28th Annual Haney -Harrison Road Relay
Condition of Approval
Approval for the event is given on condition that the organizers:
1. provide all necessary traffic controls, parking and emergency access acceptable to the
R.C.M.P., and the Corporation of the District of Maple Ridge (the District);
2. notify local Fire Department, and Ambulance Services of the event;
3. make arrangements with Coast Mountain Bus Company for any required rerouting of buses;
4. obtain any required permits from the District of Maple Ridge Parks and Leisure Services
Department for park facility use;
5. obtain any required permits from the School Districts for school facility use;
6. obtain any required permits from the Ministry of Transportation for use of Highways and facilities;
7. notify the District of Mission and obtain any required permits or permission for facility use;
8. make arrangements for all surrounding businesses and residents for access purposes
during the event;
9. advertise the event in a local newspaper and notify all surrounding businesses and residents of
the event (a minimum of one week prior to the event date);
10. must maintain access for emergency services to the effected areas at all times.
11. hold and save harmless the District from and against all claims, and damages arising out
of or in any way connected with the event;
12.obtain and maintain during the term of this event a comprehensive general liability
insurance policy providing coverage of not less than $5,000,000.00, naming the
Corporation of the District of Maple Ridge as an additional named insured and MUST have
the following statement written in the policy:
"Naming the District as an additional insured and providing that the said policy
shall not be cancelled, lapsed or materially altered without 30 days notice in
writing to the District."
Policies without this statement or an altered statement will NOT be accepted. The policy
shall also include a Cross Liability Clause. A copy of such policy shall be delivered to the
Corporate Officer prior to the event; and
13. refurbish all municipal infrastructure to an equal or better condition than that which
existed prior to the event, all within 24 hours of the completed event, to the satisfaction of
the District.
The Corporation of the District of Maple Ridge reserves the right to withdraw permission to use
municipal streets for this and future events should the organizers fail to comply with the above
requirements.

Please find attached information relevant to this year's Haney -to -Harrison Relay, scheduled for Saturday,
November 7, 2009. BC Athletics seeks approval from the District of Maple Ridge to run the initial part of
the event on district roads.
This is the 28th annual running of the event, and the proposed route is the same as last year.
Assembly of runners will still take place on Brown Ave between 224th St and Garden St, and runners will
be walked to the corner of Brown Ave and 223rd St for the start. The attached maps explain the route in
more detail. In addition I draw your attention to the Volunteer map, which highlights locations where we
will have marshalls positioned. The locations labeled 1 D, 1 E and 1G will additionally be manned by Traffic
Control Professionals with appropriate signage.
Approvals are also being requested from Maple Ridge RCMP, Garibaldi Secondary School (where the
first relay exchange takes place), Ministry of Transport, the Maple Ridge Leisure Centre (who will open
their washrooms early for us), Coast Mountain Transit, and Fraser Valley Regional District.
A copy of our Certificate of Insurance, naming the municipality of Maple Ridge as an additional insured is
also attached.

EXECUTIVE SUMMARY:
The Community Charter provides Council with statutory powers to exempt certain types of properties from
municipal property taxation. Maple Ridge has clearly defined Council Policies to assist staff in evaluating and
recommending these property tax exemptions. The policies are based on the fundamental principle that the
Municipality will not grant property tax exemptions to organizations providing services on a private or for profit
basis, or where the service is the responsibility of senior governments. These policies have been reviewed by
Councils over the past several years, most recently in 2008.
All of the applicants that were approved for a permissive tax exemption for the 2009 taxation year have been
carried forward and are being recommended for a 2010 permissive tax exemption. There are no new
recommendations for a 2010 permissive tax exemption.
The Royal Canadian Legion - Maple Ridge Branch #88 applied for a permissive tax exemption for 2009 but the
request was denied. As per municipal policy, the request was considered under the Community Grants program
where they were awarded a $2000 grant. The Branch has again submitted an application for 2010. The
recommendation is to deny this grant and forward the request to be considered for a Community Grant in the
first quarter of 2010.
In accordance with the Community Charter and Municipal Policies 5.16 to 5.23 the properties listed in Bylaw No.
6690 - 2009 are recommended for property tax exemption for the 2010 taxation year.
RECOMMENDATION:
That "Maple Ridge Tax Exemption Bylaw 6690 - 2009" be read a first, second and third time.
DISCUSSION:
a)
Background Context:
The Community Charter provides for a general exemption from taxation over which Council does not
have any legislative powers or authority. This includes properties such as schools, public hospitals,
buildings set apart for public worship and provincial and municipally owned public buildings and land.
B.C. Assessment determines which properties qualify for statutory exemption according to the
Community Charter.
Churches and Private Schools receive these automatic exemptions, over which Council has no control.
However, the statutory exemption only provides for the church or school building and the land on which
it stands, leaving any remaining land and improvements as taxable. In 1985 Council adopted a bylaw
which grants automatic permissive exemptions for these properties. Church properties receive
permissive exemption for an additional church hall and the entire parcel of land, to a maximum of
2.0335 hectares (5 acres). Buildings other than the church and church hall are subject to taxation.

Private Schools receive permissive exemption for additional improvements and the entire parcel of land
not included in the statutory exemption.
The Community Charter also provides Council with statutory powers to exempt other certain properties
from municipal taxation. For example, these can be land and improvements that are used by not for
profit organizations that are deemed to contribute to the well being of the community or private
institutions licensed under other legislation such as the Hospital Act, Community Care Facility Act or
parts of the School Act.
Permissive exemptions can also be granted by Council for heritage properties and portions of a property
used for municipal purposes (e.g. parts of Planet Ice, the curling rink and the Ridge Meadows Senior
Society).
Council has adopted policies with respect to the granting of property tax exemptions. The policies are
intended to prevent the downloading/off loading of services that are the responsibility of senior
governments and to ensure local residents are not subsidizing residents from other municipalities. They
also establish that where a permissive tax exemption is granted that all residents of Maple Ridge have
access to the service provided and make certain that the property tax exemption does not provide for an
unfair competitive advantage. The services provided by the organization are to be an extension of
Municipal services and programs and fall under the responsibility of local government.
A Tax Exemption Bylaw adopted by Council specifically applies to the "General, Debt & Library" and "Fire
Services Improvement" levies on the Property Tax Notice. However at this time, the School Act and the
Hospital District Act also provide for exemptions from other taxing authorities for properties included in
the bylaw.
The proposed taxation exemption bylaw must be publicly posted and included in a newspaper prior to its
adoption. The notice will include a description of each property and the estimated tax exemption for
2010 plus the following two years. The District's Annual Report also includes information on the
permissive exemptions granted.
b) Desired Outcome:
Council must adopt the Tax Exemption Bylaw on or before October 31, 2009 to exempt properties from
municipal property taxation for 2010.
c) Strategic Alignment:
The sources of municipal revenue are limited and therefore, the District supports institutions,
organizations and the community at large to enhance the quality of life to its residents. The granting of
property tax exemptions to those applicants meeting the criteria of the policies are strategically aligned
with:
(i) Financial Management - cost effective and efficient delivery of services
(ii) Community Relations - recognize and support the important contribution of volunteers and not for
profit groups that provide services in Maple Ridge
(iii) Safe & Livable Community - in partnership with community groups, assist in the provision of
leisure and cultural services to ensure access by all citizens
d) Citizen/Customer Implications:
Permissive exemptions are designed to support those services that complement District programs.
Inadequate funding from senior governments sometimes results in agencies turning to local government
for assistance. The sources of municipal funding are limited and providing exemptions to those groups
that fall under the responsibility of senior governments is not feasible.

All of the applicants that were approved for a permissive tax exemption for the 2009 taxation year have
been carried forward and are being recommended for a 2010 permissive tax exemption. There are no
new applications being recommended for the 2010 permissive tax exemption.
An application from the Royal Canadian Legion - Maple Ridge Branch #88 for their property at 12101 -
224th St is not being recommended for a permissive tax exemption. While the Legion is a non-profit
organization, most of this building is considered a commercial operation which would not be eligible for
exemption. A small part of this building is a multi -function room that is used for Legion activities as well
as being made available to community groups. This room could be considered under Tax Exemption
Policy 5.18 - Community Halls however the large multi -function area at 12148 - 224th which is owned
by the District and leased to the Ridge Meadows Seniors Society has already been designated as the
'community hall' in this area.
The Legion also applied for a 2009 exemption which was denied. Their application was considered for
a Community Grant and they were awarded $2,000 in the early part of 2009. This year's application will
also be forwarded for consideration in the 2010 Community Grant program.
e) Interdepartmental Implications:
District Departments have close associations with these organizations that provide service and support
to many community groups that in turn help build and shape our community. A denial of a permissive
tax exemption can have a negative impact on their operation.
f) Business Plan/Financial Implications:
Based on the 2009 assessed values, and using the estimated tax increase for 2010 from the financial
plan, the estimated amount attributable to the 2010 proposed tax exemptions for the Municipal portion
of taxes is $383,130. The total tax revenue estimate in the financial plan is $53,410,843, putting the
proposed exemptions at under 1% of that total.
g) Policy Implications:
The applicants recommended for exemption are in accordance with the adopted policies.
h) Alternatives:
Granting tax exemptions leads to a tax shift to other classes, most notably the Residential Class. An
option for Council is to provide a financial grant to assist those organizations providing community
services that Council wishes to support. Grants are an annual budget decision and are limited to one
year. Council has used this option from time to time. Providing grants does not relieve senior levels of
government from their responsibility to the community. Therefore, the potential for downloading costs to
the Municipality is somewhat reduced.
CONCLUSIONS:
In reviewing the requests for permissive exemptions, Council Members should ensure:
1. The use is consistent with Municipal policies, plans, bylaws, codes and regulations. This will ensure the
goals, policies, and general operating principles of the Municipality as a whole are reflected in the
organizations that receive Municipal support.
2. Exemptions are not given to services that are otherwise provided on a private, for profit basis. This
would provide an unfair competitive advantage.
3. The services provided by the organization should be an extension of Municipal services and programs
and must fall under the responsibility of local government. Senior government program costs must not
be transferred to property taxpayers, as this would represent double taxation and an inequitable tax
burden.

4. Primarily Maple Ridge residents should use the services and the organization's regulations must allow
all Maple Ridge residents to participate.
5. The taxation burden resulting from the exemption must be a justifiable expense to the taxpayers of the
Municipality. The sources of Municipal revenue are limited and request for exemption must be
considered in concert with other needs of the Municipality.

A Bylaw to exempt from taxation, certain properties within
the District of Maple Ridge
WHEREAS, pursuant to provisions of the Community Charter, S.B.C., 2003, Chapter 26, a
Municipal Council may exempt certain land and improvements from taxation, where, in the
opinion of the Municipal Council, the use of the land and improvements qualifies for
exemption;
AND WHEREAS, the Municipal Council deems it expedient to exempt certain land and
improvements;
NOW THEREFORE, the Municipal Council of the Corporation of the District of Maple Ridge
enacts as follows:
This Bylaw shall be cited for all purposes as "Maple Ridge Tax Exemption Bylaw No.
6690 - 2009".
2. That in accordance with Section 224(2)(i) of the Community Charter, the following
