Revitalization and Tax Exemption Agreement Bylaw
Staff report dated February 4, 2013 recommending that second reading of
Maple Ridge Heritage Designation and Revitalization and Tax Exemption
Agreement Bylaw No. 6962-2012 be rescinded, that the bylaw be amended to
delete the "in -trust" fund requirement as described in the report and that the
Bylaw, as amended, be given second reading.

Staff report dated February 4, 2013 recommending that Bylaw No. 6943-
2012 to provide regulations for staff to pursue compliance with the resident

8. COMMUNITY FORUM
COMMUNITY FORUM
The Community Forum provides the public with an opportunity to ask questions of
Council on items that are of concern to them, with the exception of Public Hearing
by-laws that have not yet reached conclusion.
Council will not tolerate any derogatory remarks directed at Council or staff
members.
Each person will be permitted 2 minutes to speak or ask questions (a second
opportunity is permitted if no one else is sitting in the chairs in front of the
podium). Questions must be directed to the Chair of the meeting and not to the
individual members of Council. The total time for this Forum is limited to 15
minutes.
If a question cannot be answered, the speaker will be advised when and how a
response will be given.
Other opportunities are available to address Council including public hearings and
delegations. The public may also make their views known to Council by writing or
via email and by attending open houses, workshops and information meetings.
Serving on an Advisory Committee is an excellent way to have a voice in the future
of this community.

An application has been received to rezone the subject property from RS -2 (One Family Suburban

The subject properties, located in the Albion Area, extend to approximately 2.3 hectares and are
bound by residential development to the north, east and west and parkland and Spencer Creek to
the south. Sufficient setbacks from the stream have been provided for through an earlier
application, and further conservation dedication is not required, as this has been provided by the
existing park area currently surrounding the creek.
c) Project Description:
The applicant is requesting to rezone the subject property from RS -2 (One Family Suburban
Residential) and RS -3 (One Family Rural Residential) to RM -1 (Townhouse Residential), to permit the
construction of a 104 unit townhouse complex in 19 buildings, comprised of three and four bedroom
homes.
The proposed development has 104 units which requires 2 parking spaces per dwelling unit, and 21
visitor parking spaces according to the Maple Ridge Off -Street Parking and Loading Bylaw No. 4350-
1990. Therefore, 208 off-street parking spaces and 24 visitor spaces are proposed. 100% of the
required accessory stalls are provided in a tandem form. This complies with the current Maple Ridge
Off -Street Parking and Loading Bylaw No. 4350-1990, but it is noted that through the approved
2013 Business Plan, Council have directed a review of the tandem provision in the Bylaw, and a
report is expected in May, 2013.

This is a new application from a group that proposed a similar development scheme on these same
two lots and an additional lot to the west of 24108 104 Avenue at 24086 Avenue, beginning in
2009. The earlier application proposed 96 townhouse units on three lots. It was given Third
Reading on April, 2010, and was given a one-year extension to April, 2012. The project was then
revised to two lots and a new layout was submitted, which required a new application as the
previous one had already been to Public Hearing.
d) Planning Analysis:
Official Community Plan:
The subject property is located within the Albion Area Plan, and is subject to the regulations as
outlined in the Official Community Plan. The Area Plan designates the property Medium Density
Residential which allows for a range of housing styles and densities, including townhouses. The
proposed rezoning to RM -1 (Townhouse Residential) is, therefore, in compliance with the regulations
of the Official Community Plan. Pursuant with Council direction, applications within the Albion Area
that are in compliance with the OCP can proceed through the development approvals process. It is
noted, however, that the Albion Area is a pilot area for an Amenity Zoning study, and depending on
the outcome of the study and status of this project an amenity contribution may be required.
Zoning Bylaw:
A preliminary review of the plans in relation to the Zoning Bylaw requirements has revealed that the
proposal generally complies with the bylaw; no variances are required at this time.
Development Permits:
The application site is adjacent to Spencer Creek and is challenged with isolated slopes greater than
25% grade. A Watercourse Protection and Natural Features Development Permit are required for the
preservation, restoration and enhancement of the natural environment of the watercourse areas and
of the natural features on the site. A security will be taken as a condition of the issuance of the
Development Permit to ensure that the Development Permit area guidelines are met.
Pursuant to Section 8.7 of the Official Community Plan, a Multi -Family Development Permit
application is required to ensure the current proposal enhances existing neighbourhoods with
compatible housing styles that meet diverse needs, and minimize potential conflicts with
neighbouring land uses. Accordingly, prior to the issuance of a Building Permit, the Development
Permit must be reviewed and approved. Adherence of this project to the guidelines of this permit
will be provided for Council in a future report.
Advisory Design Panel:
A Multi -Family Development Permit is required and must be reviewed by the Advisory Design Panel
prior to Second Reading.

Development Information Meeting:
A Development Information Meeting is required for this application. Prior to Second Reading the
applicant is required to host a Development Information Meeting in accordance with Council Policy
6.20.
School District No. 42:
Respecting matters related to provision of schools in the area, the School Board has indicated to the
District on several occasions that schools such as Albion Elementary School, are beyond their
capacity and future homeowners could expect their children to attend schools beyond their
immediate neighbourhood
e) Interdepartmental Implications:
In order to advance the current application, after First Reading, comments and input, will be sought
from the various internal departments and external agencies listed below:
a) Engineering Department;
b) Operations Department;
c) Fire Department;
d) Parks Department;
e) School District;
f) Utility companies; and
g) Ministry of Transportation and Infrastructure.
The above list is intended to be indicative only and it may become necessary, as the application
progresses, to liaise with agencies and/or departments not listed above.
This application has not been forwarded to the Engineering Department for comments at this time;
therefore, an evaluation of servicing requirements has not been undertaken. We anticipate that this
evaluation will take place between First and Second Reading.
f) Development Applications:
In order for this application to proceed the following information must be provided, as required by
Development Procedures Bylaw No. 5879 - 1999 as amended:
1. A complete Rezoning Application (Schedule B);
2. A Multi -Family Residential Development Permit Application (Schedule D);
3. A Watercourse Protection Development Permit Application (Schedule F);
4. A Natural Features Development Permit Application (Schedule G); and
5. A Subdivision Application.
The above list is intended to be indicative only, other applications may be necessary as the
assessment of the proposal progresses.

CONCLUSION:
The development proposal is in compliance with the Official Community Plan, therefore, it is
recommended that Council grant First Reading subject to additional information being provided and
assessed prior to Second Reading.

A Bylaw to amend Map "A" forming part
of Zoning Bylaw No. 3510 -1985 as amended
WHEREAS, it is deemed expedient to amend Maple Ridge Zoning Bylaw No. 3510 -
1985 as amended;
NOW THEREFORE, the Municipal Council of the Corporation of the District of Maple
Ridge, in open meeting assembled, ENACTS AS FOLLOWS:
1. This Bylaw may be cited as "Maple Ridge Zone Amending Bylaw No. 6969-2013."
2. Those parcels or tracts of land and premises known and described as:

and outlined in heavy black line on Map No. 1581 a copy of which is attached hereto

EXECUTIVE SUMMARY:
An application has been received under Section 21 (2) of the Agricultural Land Commission Act to
subdivide 1.76 hectares (4.3 acres) of land that is within the Agricultural Land Reserve. The
Applicant's submission conforms with the requirements of the Agricultural Land Commission.
This report evaluates the merits of this subdivision proposal within the policy context of the Official
Community Plan and the Agricultural Plan. Based on this analysis, the recommendation is not to
support this application for subdivision within the Agricultural Land Reserve. However, the
circumstances of this proposal, to provide housing for family members, should be considered. On
this basis, the recommendation is to forward the application to the Agricultural Land Commission
with the expectation that that Commission and the applicant can discuss feasible options, such as a
life -lease, that can meet needs while respecting the integrity of the agricultural land base.
RECOMMENDATION:
That Application 2012 -107 -AL be forwarded to the Agricultural Land Commission with the
expectation that the Commission will work with the applicant towards a satisfactory outcome.

The applicant wishes to subdivide the 1.76 hectare (4.3 acre) subject property into 2 parcels to
provide permanent housing for his descendants. The application is accompanied by a letter from the
applicant expressing his desire to provide this opportunity for the next generation to enjoy a rural
lifestyle.
This proposal conforms with the minimum parcel sizes of the RS -3 One Family Rural Residential
Zone which is 0.8 hectares (2 acres) where municipal water is available.
If this application is forwarded by Council, and receives Agricultural Land Commission approval, the
applicant will have to apply for a subdivision through the municipality. Through this process, the
applicant will have to demonstrate that both of the proposed lots will have on-site septic capability to
current standards. In addition, both properties must comply with municipal requirements with
respect to lot geometry, road frontage and parcel size.
c) Planning Analysis:
Official Community Plan
On November 14, 2006, Council adopted the Official Community Plan, which contains supportive
agricultural policies. On December 16, 2009 Council adopted an Agricultural Plan to support
agriculture within the rural area and the Agricultural Land Reserve. The merits of this application will
be viewed within this policy context.
Section 6.2.2 Sustainable Agriculture
Policy 6-12 states:
Maple Ridge will protect the productivity of its agricultural land by:
a) adopting a guiding principle of "positive benefit to agriculture" when making land use
decisions that could affect the agricultural land base, with favourable recognition of
initiatives including but not limited to supportive non-farm uses, infrastructure improvements
for farmland, or the inclusion of land elsewhere in the Agricultural Land Reserve;

b) requiring agricultural impact assessments (AIAs) and Groundwater Impact Assessment of
non-farm development and infrastructure projects and identifying measures to off -set
impacts on agricultural capability;
c) preserving larger farm units and areas by using appropriate buffers such as roads,
topographic features, watercourses, ditching, fencing, or gradually reduced residential
densities on properties adjacent to agricultural land;
d) discouraging the subdivision of agricultural land into smaller parcels, except where positive
benefits to agriculture can be demonstrated;
e) reinforcing the concept that the Agricultural Land Reserve is intended for agricultural use by
increasing the minimum lot size for ALR properties that are zoned Rural Residential;
f) encouraging the amalgamation of smaller parcels of farmland into larger, more cohesive
parcels.
Policy 6-12 emphasizes the importance of discouraging the subdivision of agricultural land into
smaller parcels, increasing the minimum parcel size of ALR properties with Rural Residential zoning,
and amalgamation to create larger farm parcels. The reason for discouraging subdivision within the
Agricultural Land Reserve is that subdivision tends to increase speculative activity within the
Agricultural Land Reserve, thereby increasing the market value of farmland, and exacerbating the
issue of economic barriers to entry for new farmers.
It is important to recognize that subdivision is not required in order to provide housing for farm help
or for a family member. Both the District and the Agricultural Land Commission have supportive
policies and bylaws to provide detached housing under these circumstances, which would only
require a building permit to proceed'. In addition, alternative tenures are feasible, such as life
leases, that would allow for the construction of a second dwelling to serve property owners needs for
a limited duration. Such a provision would require an approved non-farm use application from the
Agricultural Land Commission.
Section 6.2.1 Economic Development Strategy.
Policy 6-6 of the Official Community Plan describes these alternative tenures in greater detail:
Maple Ridge will develop an Agricultural Plan that:
a) maintains an inventory of local agricultural products and agricultural land use;
b) develops and maintains a database of farm businesses and operators;
c) promotes leasing opportunities of agricultural land;
d) promotes agricultural heritage initiatives;
e) identifies appropriate land uses within agricultural areas and at the rural/urban
interface;
f) promotes urban agriculture;
g) recognizes the positive role that agricultural lands have on the environment;
h) will identify a variety of mechanisms to assist farm operators and to protect agricultural
lands, including but not limited to the creation of trusts, endowments, and life -leases;
i) includes an assessment of the agricultural land base; and

conditionally permitted in the Maple Ridge Zoning Bylaw. In addition, the Zoning Bylaw has provisions for
temporary residential use, specifically for family members. On rural properties of 0.4 ha or greater, a detached

Reserve also are permitted a `manufactured home' for family members of the owner. In addition, where there
is demonstrated legitimate need, the Agricultural Land Commission will allow additional residences for farm

j) develops Development Permit area guidelines to direct non-agricultural development at
the urban/rural interface.
One reason for promoting alternative tenures (Policies 6-6 c and h) relates to the high cost of land,
which is a known barrier for new farmers wishing to start an agricultural business. By supporting
other forms of tenure that can delay or avoid the need for this capital investment by individual
farmers, the municipality can improve its agricultural potential, and bring more of its agricultural land
into full production.
For the above noted reasons, this application does not comply with the Agricultural policies of the
Official Community Plan. However, a revised proposal could be supported, if the applicant is able to
meet the needs of the extended family while respecting the integrity of the agricultural land base.
Agricultural Plan
Issue 5 of the Agricultural Plan notes concerns with the loss of the agricultural land base, describing
the following situations that are pertinent to this application:
• Many small parcels
• High level of rural residential incursion into Agricultural Land Reserve
• Non -farmed areas of the Agricultural Land Reserve tend to be smaller parcels
• Continued conversion pressure from the District of Maple Ridge's urban growth
• Financial pressure on farming
The Plan also notes that more recent priorities given to food safety, food security, and climate
change, includes the development of a local food system. Towards this end, the community would
benefit from greater certainty that the agricultural land base is not undermined by incremental land
use decisions.
The Plan makes the following recommendations that pertain to this application:
b) Continue to implement the OCP policies to protect the agricultural land base by creating
guidelines for reviewing applications for non-farm use, exclusions, fill applications,
transportation and utility applications, subdivisions, and government applications;...
g) Explore retention of lots 2 ha (5 acres) and larger in the Agricultural Land Reserve.
Currently, the minimum parcel size in the RS -3 One Family Rural Residential Zone is 0.8 hectares
(2.0 acres) where community water is available. This zone pertains to most of the land that is within
the Agricultural Land Reserve, including the subject property. The RS -3 (One Family Rural
Residential) zone pre -dates the creation of the Agricultural Land Reserve. Although designated for
Agriculture, there is a concern that this historic zoning contributes to the perception that farming is
not the primary use of this zone. The Agricultural Plan recommends that 2.0 hectares (5 acres) is a
more appropriate minimum parcel size for lands within the Agricultural Land Reserve.
d) Interdepartmental Implications:
Engineering Department.
The Engineering Department would review this proposal for its servicing requirements as part of the
municipal subdivision application should Commission approval be granted.

Alternatives:
The recommendation is to forward this application with the expectation that the original proposal will
be revised. However, Council may also choose to:
• Support the proposal in its entirety and forward to the Agricultural Land Commission
• Deny forwarding the proposal to the Agricultural Land Commission
If Council decides to forward this application to the Agricultural Land Commission, the Commission
will evaluate the merits of this application, and make their decision accordingly. If Council decided
not to forward this application to the Commission, it will be considered denied and will not proceed
further.
CONCLUSION:
This application has been evaluated for its consistency with the policies of the Official Community
Plan, and its implications for the Agricultural Plan. In its current form, the application does not
comply with this policy framework. On this basis, the recommendation is that this application for
subdivision not be supported. However, the circumstances of this proposal, to provide housing for
extended family, should be considered. It is recognized that supportive measures exist within the
policies of the Agricultural Land Commission and the Official Community Plan for this purpose. On
this basis the recommendation is that the application be authorized to go forward to the
Commission, provide the opportunity for the applicant and the Commission to discuss feasible
options that would respect the integrity of the agricultural land base.

APPENDIX C
My wife and I are applying to subdivide our property at 12680 248`h st. Upon successful subdivision of
the land (kept within the ALR), it is our intent to offer our children an opportunity to purchase the
subdivided land. In doing so, we hope to provide our children with the opportunities to raise their
young families much in the same way we have raised our children. Currently, our oldest son and his
new wife are expecting their first child in May, 2013. We believe that with a successful application to
subdivide our property, this goal, our dream, along with our passion and love for rural living will
continue for generations in our community. As well, my wife and I are not getting any younger. I am
now presently a senior citizen and it is with this application to subdivide that we hope to be able to
provide for our children, a wonderful opportunity for them to raise their own children in the same rural
backdrop as we had done. We hope that through the success of this application, our children and

EXECUTIVE SUMMARY:
On January 8, 2013, Council granted First and Second Readings to Maple Ridge Heritage
Designation and Revitalization and Tax Exemption Agreement Bylaw No. 6962 - 2012 (HRA Bylaw),
and advanced it to a Public Hearing scheduled for February 19, 2013. This report concerns
removing the provision in the HRA Bylaw that requires "in -trust" funds to be deposited with the
District for sidewalk construction along 114 Avenue.
RECOMMENDATIONS:
1. That Second Reading for Maple Ridge Heritage Designation and Revitalization and Tax
Exemption Agreement Bylaw No. 6962 - 2012 be rescinded;
2. That Maple Ridge Heritage Designation and Revitalization and Tax Exemption Agreement
Bylaw No. 6962 - 2012 be amended as described in the report dated February 4, 2013,
and be given Second Reading.
DISCUSSION
On January 8, 2013, Council granted First and Second Reading to Maple Ridge Heritage Designation
and Revitalization and Tax Exemption Agreement Bylaw No. 6962 - 2012 (HRA Bylaw), which also
included variances respecting servicing standards, and advanced it to Public Hearing on February
19, 2013. During that meeting, Council had inquired into the requirement that a security ("in -trust"
funds) be provided instead of requiring a sidewalk be constructed along the north side of 114
Avenue.
Following the Council meeting, representatives from Planning, Engineering and Building met and
discussed the matter. The Maple Ridge Subdivision and Development Servicing Bylaw No. 4800 -
1993 (Servicing Bylaw) requires properties subject to rezoning, subdivision or building permit
applications to upgrade utilities, services and roads, including constructing sidewalks along the
abutting portions of street where they do not exist or are sub -standard.

The specifics of this application have been further reviewed and while the general practice is to have
sidewalks constructed as part of the above mentioned types of applications, in this instance the
requirements can be waved for the following reasons:
• The proposal does not involve changing the use of the existing heritage building, adding new
uses, or grant more residential density to build; for example, this HRA Bylaw does not allow
for the construction of an apartment building;
• The proposal is not for a new dwelling or part of an infill subdivision proposal, but rather for
the revitalization and addition to an existing dwelling;
• Constructing a sidewalk would result in the grade being changed alongside the road, thus
potentially altering drainage pattern on the applicant's property; and
• Other mechanisms remain available (e.g. local area improvement, capital works, etc.) to
construct the sidewalk along the entire length of the block.
From the standpoint of safety, it would be best to construct a sidewalk to span the entire block. At
this juncture, it is not possible to determine when other applications may be coming forward for
properties along this block of 114 Avenue and when there will be sufficient funds to build the entire
sidewalk. Another factor is that the Planning Department is tasked to undertake an area plan
review for the Hammond Area. One of the components may be a separate review to establish the
specific standards and financing options for services, roads, sidewalks, etc. in the historic
Hammond Area, consistent with its heritage and character. Given these factors, the Bylaw
requirements for sidewalk construction can be varied and the "in -trust" fund requirement be
deleted.
To delete the "in -trust" fund requirement, the provision in Schedule F to the HRA Bylaw is to be
changed by excluding the clause shown crossed -out below:
The standard for the provision of Curbs and Gutters (C), Street Lighting (SL), Sidewalks (SW)
and Street Tree Planting (ST) immediately adjacent to this proposed development along
205th Street and 114 Avenue shall not be required, provided securities, including "in trust"
these works is deposited by the Owner with the Municipality.
The procedure for changing the HRA Bylaw is to rescind the Second Reading given by Council on
January 8, 2013, amend Schedule F as described above, and to give Bylaw 6962-2012 as
amended, Second Reading. The HRA Bylaw has already been scheduled for Public Hearing on
February 19, 2013 and because this amendment is not significant nor does it change the use or
density, this change does not delay the Public Hearing. This report will be available for viewing in the
information package available to the public prior to the Public Hearing.

CONCLUSION
To remove the requirement for "in -trust" funds to be paid by the applicant for sidewalks, Second
Reading for Maple Ridge Heritage Designation and Revitalization and Tax Exemption Agreement
Bylaw No. 6962 - 2012 (HRA Bylaw) is to be rescinded, Schedule F is to be amended as described
in this report, and the amended bylaw is to be given Second Reading. The HRA Bylaw is already
scheduled for Public Hearing on February 19, 2013.

The applicant proposes to build a new deck at the rear of the property that connects to the main
living space on the second floor. A variance is requested to reduce the rear yard setback from 14.5
to 10.35 metres to accommodate the new deck.
d) Planning Analysis:
Zoning Bylaw
This lot is located on the south side of 118 Avenue. Pedestrian access is from the front and by a
rear loading driveway from the lane south of 118 Avenue. This home has an at -grade basement
entry with an attached garage. Many lots in the area have two storey homes with access from the
at -grade main living area to the rear yard and detached garages. The main living area of this home is
on the second floor and connects to a deck that extends 1.2m into the rear yard. A variance would
allow for the construction of a larger deck that would extend 4.27m from the rear of the house into
the rear yard, which will create more outside living space. The applicant also proposes an additional
stair access on the northeast corner of the deck down to the yard-, extending into the proposed
varied rear yard setback. The stairs extend 3.79m from the rear of the house, and do not extend
beyond the proposed deck's total length of 4.27m. The total width of the deck including the stairs is
6.7m and will not extend beyond the eastern edge of the house into the eastern side yard setback.
e) Citizen Implications:
A larger deck on the second floor of this residence will give the owner visual sightlines into
neighboring yards on either side of the property. The applicant has obtained letters of support from
seven neighbors, including the two neighbors directly adjacent on both the west and east side of the
property respectively. Prior to Council considering this Development Variance permit, the District will
notify all adjacent properties.

CONCLUSION:
The requested variance is supported by the Building Department, and the neighbours appear to be
supportive of the proposal. Any Building Code issues will be addressed at the building permit stage.
Therefore, it is recommended that Development Variance Permit 2012-114-DVP be approved.

EXECUTIVE SUMMARY:
The Maple Ridge Ticket Information Utilization Bylaw No. 6929-2012 (attached as Appendix I) has
been prepared to update the current bylaw. The proposed bylaw establishes a comprehensive and
updated version which includes recent bylaw amendments and new bylaws that have been passed
since the previous Municipal Ticket Information (MTI) Bylaw was adopted. The bylaw also updates
those individual positions that are designated to pursue compliance with the specific bylaws. Fines
are only used when all other avenues of achieving compliance have been exhausted. For the most
part fine amounts have remained the same for several years and therefore some fines amounts are
recommended to be increased.
RECOMMENDATION(S):
That the Maple Ridge Ticket Information Utilization Bylaw No.6929-2012 be given first, second and
third readings.
DISCUSSION:
a) Background Context:
The most recent amendment to the MTI Bylaw was passed in 2008. Since that time, Council
has adopted several new bylaws and amended others. The MTI Bylaw needs to be updated to
reflect these changes so that tickets that are issued will include the correct wording and refer
to the applicable sections.
Municipal Tickets will only be written if all other attempts to achieve voluntary compliance
have been exhausted and consequently the fine amounts should be indicative of this.
b) Desired Outcome(s):
By updating the MTI Bylaw, the District will be able to monitor and pursue compliance of all
current regulatory Bylaws of the District.

Maple Ridge Ticket Information Utilization Bylaw No. 6929-2012
A bylaw to authorize the laying of a Municipal Ticket Information and the issuing of a
summons by means of a ticket.
WHEREAS, Section 264 (1) of the Community Charter empowers the Corporation to,
by bylaw, designate those bylaws for which Municipal Ticket Information may be
used as means of bylaw enforcement;
AND WHEREAS, Section 264 (1) of the Community Charter empowers the Council
to, by bylaw, authorize the use of any word or expression on a Municipal Ticket
Information to designate an offence against a bylaw;
AND WHEREAS, Section 265 (1) of the Community Charter empowers the Council
to, by bylaw, set fine amounts in consultation with the Chief Judge of the Provincial
Court;
AND WHEREAS, the Council deems it expedient to authorize the use of Municipal
Ticket Information for the enforcement of certain bylaws, to authorize the use of
certain words or expressions to designate certain bylaw offences and to set certain
fine amounts;
NOW THEREFORE, the Council of the District of Maple Ridge enacts as follows:
Part 1 Citation
1.1 This bylaw may be cited as Maple Ridge Ticket Information Utilization Bylaw
No. 6929-2012.
Part 2 Severability
2.1 If a portion of this bylaw is held invalid by a Court of competent jurisdiction,
then the invalid portion must be severed and the remainder of this bylaw is
deemed to have been adopted without the severed section, subsequent,
paragraph, subparagraph, clause or phrase.

4.1 The bylaws listed in column 1 of Schedule 1 to this bylaw, as amended, may
be enforced by means of a ticket in the form prescribed for the purpose of
Section 264 (1) of the Community Charter.
4.2 The persons appointed to the job positions or titles listed in Column 2 of
Schedule 1 to this bylaw are designated as Bylaw Enforcement Officers

pursuant to Section 264 (1) of the Community Charter for the purpose of
enforcing the bylaws listed in Column 1 of Schedule 1 opposite the respective
job positions.
4.3 The words or expressions set forth in Column 1 of Schedules 2 through 29 to
this bylaw designate the offence committed under the bylaw section number
appearing in column 2 opposite the respective words or expressions.
4.4 The amounts appearing in Column 3 of Schedules 2 through 29 to this bylaw
are the fines set pursuant to Section 265 of the Community Charter for the
corresponding offences designated in Column 1.
4.5 The amounts appearing in Column 4 of Schedule 9 to this bylaw are the
discounted fines pursuant to Section 265 of the Community Charter for the
corresponding fines set in Column 3, provided that Municipal Ticket
Information is paid within thirty (30) calendar days upon receipt.
4.6 This bylaw shall take effect upon the date of its adoption.

EXECUTIVE SUMMARY:
On June 26, 2012 Council passed a motion that endorsed a "Resident -Exemption and Resident -Only
Parking Policy" to address this issue. In order to establish the permitted regulations as identified in
the adopted Policy an amendment to the Highway and Traffic Bylaw is required. The amending bylaw
will allow this Policy to be implemented.
In addition, some additional wording is necessary to clarify parking restrictions in the downtown area.
These changes will ensure that there is better flow of traffic in the business district which will allow
more customers to visit the businesses in the area.
RECOMMENDATION(S):
That the Maple Ridge Highway and Traffic Amending Bylaw No. 6943-2012 be given first, second
and third reading.
DISCUSSION:
a) Background Context:
The "Resident -Exemption and Resident -Only Parking Policy" was adopted on June 26,
2012. Residents of the area of Cutler Place and 212 Street north of 117 Ave have met the
requirements of the parking policy. The District has now installed "2 Hour Time Limit" parking
signs on these streets. Under the adopted policy "Resident Exempt" permits are provided to
the residents on those streets. In order to pursue compliance of these parking restrictions an
amendment to the Highway and Traffic Bylaw must be made setting out the regulations and
establishing a fee for the parking permits.
The change required to ensure the continual flow of customer traffic in the downtown area
consists of creating a new section in the Highway and Traffic Bylaw to ensure that vehicles
are leaving the time zone parking after the established parking time has expired and allowing
new vehicles to take their place. Currently, many vehicles are simply being driven around the
block and then parking again in the same block or chalk marks placed on the vehicle tires
are being removed. The new wording will allow access to parking on these streets to a
greater number of citizens by clarifying that a vehicle cannot be moved from one location to
another in the same block to avoid the time limit regulations specified in that particular
block.

CONCLUSIONS:
The proposed Amendment Bylaw to the existing Highway and Traffic Bylaw provides the required
regulations for staff to pursue compliance with the new resident parking policy. Businesses will see a
larger volume of customers coming through the downtown core because of the required movement
of vehicles.

Maple Ridge Highway and Traffic Amending Bylaw No. 6943-2012
A bylaw to amend Maple Ridge Highway and Traffic Bylaw No. 6704-2009.
WHEREAS the Council of The Corporation of the District of Maple Ridge deems it expedient to
amend Maple Ridge Highway and Traffic Bylaw No. 6704-2009;
NOW THEREFORE, the Council of the District of Maple Ridge enacts as follows:
1. This bylaw may be cited as Maple Ridge Highway and Traffic Amending Bylaw No. 6943 -
2012.
2. Maple Ridge Highway and Traffic Bylaw No. 6704-2009 is amended by creating a new
Section 16 and renumbering all sections accordingly.
Section 16 Resident Parking Zones
16.1 Every resident parking zone authorized by a bylaw or an order under a
bylaw and established for residents, and existing prior to adoption of
this Bylaw, is authorized.
16.2 The Engineer may, by causing appropriate traffic control devices to be
placed or erected on any portion of a highway, establish such
designated portion of that highway as a resident parking zone and
designate the area thereof and define the rights, duties and
obligations of traffic with respect to that resident parking zone.
16.3 No person may stand, stop or park a vehicle in a resident parking
zone that does not display a valid resident parking permit issued by
the District. A maximum of two (2) resident parking permits will be
issued to the owner or occupier of real property within the resident
parking zone. Resident parking permits will be issued annually upon
proof of real property ownership or occupancy and payment of a fee
as set out in Schedule B.
16.4 A person holding a resident parking permit must display the resident
parking permit by hanging it from the rear view mirror of the vehicle
so that it is clearly visible from outside the passenger compartment
whenever the vehicle is parked in an area where the permit is
required.
3. Maple Ridge Highway and Traffic Bylaw, No. 6704-2009 is amended by creating a
new Section 17 and renumbering all sections accordingly.
Section 17 Traffic Notices
17.1 No person other than the owner or driver of a vehicle may remove
any notice placed or affixed on it by an Enforcement Officer in the
course of their duty and no person may deliberately erase a chalk
mark from a tire marked by an Enforcement Officer or remove any
other object or device used by them in the course of their duty.
17.2 No person shall cause or permit a vehicle to move from one location
to another in the same block after the time limit regulating that
block has expired.

River Road Waterworks and Sanitary Sewer at 236 Street
(CPR Mile 100.32)
EXECUTIVE SUMMARY:
The sanitary sewer and water mains that service the Albion Industrial Park have been systematically
replaced over the past few years. What remains to be replaced are the sanitary sewer and the water
mains under the railway spur that services Kanaka Creek Pole Company. These sanitary sewer and
water mains were identified for replacement in the approved Capital Works Program. The project
includes replacement of approximately 190m sections of sanitary sewer and water main.
The project was tendered on December 14, 2012 and the tender period closed on January 16,
2013. Nine tenders were received and the lowest compliant bid was submitted by Pedre Contractors
Ltd. at $370,337.75 (excluding taxes). Staff have reviewed the tenders and recommend that the
project proceed.
Council approval to award the contract is recommended.
RECOMMENDATION:
THAT Contract (Reference No. ITT-EN13-07; Project No. E04-010-077) River Road Waterworks and
Sanitary Sewer at 236 Street (CPR Mile 100.32), be awarded to Pedre Contractors Ltd. in the
amount of $370,337.75 plus applicable taxes; and
THAT the Corporate Officer be authorized to execute the contract.
DISCUSSION:
a) Background Context:
The water main and sanitary sewer east and west of the railway spur have been replaced and
upsized over the years, except for the sections under the railway spur itself. The two
crossings are aged, undersized and require replacement. The replacement of the two
sections of mains was identified in the Capital Works Program and Council approved funding
for these replacements in the District's Capital Budget. Over the past year, the District has
been working to secure approval from Canadian Pacific Railway. The approval is now in
place.

The work involves replacement of approximately 190m sections of sanitary sewer and water
main.
Subsequent to securing approval from Canadian Pacific Railway the project was tendered on
December 14, 2012 and the tender period closed on January 16, 2013.
Tender results
Nine tenders were received and opened in public. The tender prices are listed below, from
lowest to highest price (excluding taxes).

Staff have reviewed the tenders received and recommend the award to Pedre Contractors
Ltd., who submitted the lowest compliant bid of $370,337.75 excluding taxes.
b) Desired Outcome:
The desired outcome is to provide the necessary replacement infrastructure to service the
employment lands in the Albion Industrial Park.
c) Strategic Alignment:
The Corporate Strategic Plan has directed staff to manage municipal infrastructure including
roads and sewer through infrastructure plans. The plan to upgrade this system has been
developed and it is now appropriate to complete the construction.
d) Citizens/Customer Implications:
The project will improve the water distribution and the sanitary sewer in the area.
Construction will commence soon after the project is awarded and attempts will be made to
minimize the impact to everyday traffic, residents, and businesses in the neighbourhood.
The road is expected to remain open to traffic throughout the construction.
e) Interdepartmental Implications:
The Engineering Department, in developing this project has worked with the Operations
Department.
f) Business Plan/Financial Implications:
Beside the construction cost there will be flagging charges from Canadian Pacific Railway to
the District, which are estimated to be minimal.
The approved Capital Budget provides sufficient funds under LTC 8572 and 8612 to
complete this work ($480,000).
CONCLUSIONS:
The tender price of $370,337.75 excluding taxes, by Pedre Contractors Ltd. for the River Road
Waterworks and Sanitary Sewer at 236 Street (CPR Mile 100.32) project is the lowest tendered
price. Council approval to award the work to Pedre Contractors Ltd. is recommended.

Update
EXECUTIVE SUMMARY:
On October 15, 2012, Municipal Council received a staff report on the District -owned parking lots
which included the following direction to staff:
THAT staff consider alternate uses of the District -owned parking lots, as the opportunity
arises, subject to ensuring there is no loss of public parking as well as Council approval.
The purpose of this report is to provide recommendations on the use of the nine District -owned
parking lots.
Recommendation:
THAT Council approve the recommendations in the February 4, 2013 staff report regarding the use
of the nine District -owned parking lots.
DISCUSSION:
a) Background Context:
The 2008 Maple Ridge Town Centre Parking Study prepared by Bunt & Associates identified three
primary principles that should guide the municipality's role as related to the provision of public
parking:
i. The District has a role in managing parking in the downtown area
ii. The District should try to increase the supply of public parking spaces
iii. Public parking should be available within a reasonable walking distance (200 metres) of
major downtown facilities
These principles will continue to guide District staff as it explores options and opportunities as
related to the provision of public parking.

a) Background Context (cont'd.):
The Maple Ridge town centre enjoys several geographic and topographical advantages over other
local municipalities' town centres in that it is both compact and flat, allowing for relatively easy
pedestrian mobility. In general, parking planners call for maximum walking distances between 100
and 200 metres for retail customers and between 350 and 500 metres for employee parking.
Distances increase even more for special events with the maximum walking distances accepted for
theme parks, stadiums and arenas reaching as high as 600 metres. Using the District's Edge Street
parking lot as a pedestrian `epicenter' of the town centre, (see Appendix B) it becomes readily
evident that the majority of Maple Ridge's primary town centre attractions are well within acceptable
walking distances of the core.
The District's Smart Growth on the Ground Plan and the Town Centre Investment Incentives Program
have been very effective in encouraging development in the Town Centre. Given that some of the
District -owned parking lots are considered prime locations in the Town Centre, staff expects to
continue to receive proposals for alternate uses for those lots. While staff feel it is important to
consider these alternative uses, it also recognizes that it must ensure that there is no loss of public
parking in the process. This could be accomplished by a number of approaches including
incorporating public parking into developments, acquiring land elsewhere with the funds obtained
from the sale of an existing lot or expansion of existing facilities.
As Council is aware, the District currently owns a total of nine (9) parking lots within the Town Centre.

b) Recommendations on the Use of the Nine District -Owned Parking Lots
Staff recommends the following uses for each of the nine lots. Note that these recommendations
address only the use and/or disposition potential of each lot, not their actual operations. Issues and
potential options related to operations (i.e. short term parking versus longer term parking versus
mixed use) will be addressed in a subsequent report.
1. Bella Vita Lot
Recommendation: This lot should be sold at the appropriate time, in support of adjacent
development. Net proceeds should be set aside in support of parking enhancements.
Commentary: This lot is actually an undeveloped, District -owned road allowance that is used by the
adjacent businesses. It cannot be utilized as roadway given the traffic management plan for the
area.
2. 227th Street Lot
Recommendation: This lot should be sold, at the appropriate time, in support of adjacent
development. Net proceeds should be set aside in support of parking enhancements.
Commentary: The District acquired this lot several years ago as part of an exchange for District -
owned land that Bucci Investment Corp needed when it built the Save -On Foods store. As part of
that exchange, there is a covenant in place that gives Bucci the right of first refusal to buy or lease
that property (expires July 2020), should the District get an offer for it. There was also a covenant
that required the District to continue using it as a public parking lot until July 2005. This lot is used
by the adjacent businesses.
3. Edge Street Lot
Recommendation: This lot should be retained and options explored to potentially increase its
capacity.
Commentary: This parking lot could be improved with underground parking or above -ground tiered
parking to provide additional parking spaces. Additional engineering design work will be required to
determine the feasibility of this. Staff has been advised that on average, above -ground parking lots
cost to the order of about $25,000 per space to construct, exclusive of land costs. Underground
parking costs about twice as much. Maintaining the same footprint would likely yield an additional
90 stalls per extra floor at cost of between $1.8 and $2.8 million per floor. Including the bus
exchange footprint would likely gain an additional 70 - 80 stalls per floor AND likely reduce the
construction costs per stall. Net proceeds from the sale of the other parking lots could contribute
towards the costs of these improvements. As these potential changes are considered, the
importance of this parking lot to Haney Place Mall will have to be kept in mind.
4. Dewdney Trunk Road Lot
Recommendation: No changes are recommended.
Commentary: This lot functions well in providing service to the library, the office tower as well as
municipal hall. There is limited potential for expansion of this lot.

5. Underground Parkade
Recommendation: No changes are recommended.
Commentary: This lot functions well in meeting the needs of the town centre facilities. The parking
rates, as well as the allocation of spaces that are reserved for 24 hours should be reviewed at the
appropriate time.
6. Selkirk Avenue Lot, 119th Avenue Lot, Brown Avenue Lot, North Avenue Lot
Recommendation: The municipality should be open to considering development opportunities on
these lots ensuring that:
i) There is no net loss of public parking spaces.
ii) The District does not give up control over the public spaces.
iii) The municipality receives fair market value compensation for the rights that it provides.
iv) Net proceeds from the sale of such rights are to be set aside in support of public parking
Commentary: These lots were acquired through a local improvement paid for by downtown property
owners and currently provide longer-term (monthly) paid parking to the area businesses. From both a
geographical and public utility perspective, these lots are strategically located to serve specific areas
of the town centre, so considerable care must be exercised prior to any disposition as there exist
limited options for replacement of any of these particular lots.
c) Desired Outcome(s):
Since several of the District -owned parking lots are in key areas in the Town Centre, the District's
willingness to consider alternative uses for the parking lots could serve as a catalyst for development
in the area. Staff feel it would be important in this process to ensure that there would be no loss in
public parking spaces and possibly even some gain. The recommendations have been developed in
an attempt to address the issue prior to final consideration of an alternate use. Council's
endorsement of the recommendations as contained within this report will permit staff to move
forward with existing proposals on specific District -owned parking lots. Moving forward, development
of a longer term plan for the use and management of the District -owned lots will help ensure the
District is making the most efficient and effective use of a District resource.
d) Interdepartmental Implications:
A long-term plan for the management and use of the District -owned parking lots is being developed
and will involve staff from various departments.

e) Business Plan/Financial Implications:
The issues outlined in this report impact a number of District departments and, should Council
endorse the recommendations, it can be expected to affect multiple departments and staff and their
respective 2013 business plans.
f) CONCLUSIONS:
The increasing interest in exploring alternate uses of the District -owned parking lots suggests that
having clear direction as to the potential disposition of any/all of these lots is a critical step in
moving forward in discussions with prospective developers. Having Council's endorsement as to the
strategies as related to each lot, will allow for much more efficient and effective discussions and will
provide developers the clear direction they need to formulate their respective business and
development plans.
