MEETING DECORUM
Council would like to remind all people present tonight that serious issues are
decided at Council meetings which affect many people's lives. Therefore, we ask that
you act with the appropriate decorum that a Council Meeting deserves. Commentary
and conversations by the public are distracting. Should anyone disrupt the Council
Meeting in any way, the meeting will be stopped and that person's behavior will be
reprimanded.
Note: This Agenda is also posted on the Municipal Web Site at www.mapleridge.ca
The purpose of a Council meeting is to enact powers given to Council by using bylaws or
resolutions. This is the final venue for debate of issues before voting on a bylaw or
resolution.

Staff report dated December 21, 2007 recommending that Maple Ridge

support of a commercial complex containing a liquor store, pub and
commercial space.
1104 Local Area Service, 267 Street between 118 Avenue & Dewdney Trunk Road
Staff report dated December 21, 2007 recommending that staff prepare a
bylaw to establish a Local Area Service to provide water service to 12 lots on
267 Street between 118 Avenue and Dewdney Trunk Road and to amend to
capital program to provide for the construction of the water main.

QUESTION PERIOD
The purpose of the Question Period is to provide the public with an opportunity to
ask questions of Council on items that are of concern to them, with the exception of
Public Hearing by-laws which have not yet reached conclusion.
Council will not tolerate any derogatory remarks directed at Council or staff
members.
If a member of the public has a concern related to a Municipal staff member, it
should be brought to the attention of the Mayor and/or Chief Administrative Officer
in a private meeting.
The decision to televise the Question Period is subject to review.
Each person will be permitted 2 minutes only to ask their question (a second
opportunity is permitted if no one else is sitting in the chairs in front of the podium).
Questions must be directed to the Chair of the meeting and not to individual
members of Council. The total Question Period is limited to 15 minutes.
If a question cannot be answered, it will be responded to at a later date at a
subsequent Council Meeting.
Other opportunities to address Council may be available through the Clerk's
Department who can be contacted at (604) 463-5221.

BYLAW NO. 6522-2007
A Bylaw to amend the Official Community Plan
WHEREAS Section 882 of the Local Government Act provides that the Council may revise the
Official Community Plan;
AND WHEREAS it is deemed desirable to amend Schedules "B" & "C" to the Official Community Plan;
NOW THEREFORE, the Municipal Council of the Corporation of the District of Maple Ridge, in open
meeting assembled, ENACTS AS FOLLOWS:
1. This Bylaw may be cited for all purposes as "Maple Ridge Official Community Plan
Amendment Bylaw No. 6522-2007
2. Schedule "B" is hereby amended for that parcel or tract of land and premises known and
described as:
Lot B, District Lot 399, Group 1, New Westminster Plan 8914
and outlined in heavy black line on Map No. 739, a copy of which is attached hereto and
forms part of this Bylaw, is hereby redesignated to Conservation.
3. Schedule "C" is hereby amended for that parcel or tract of land and premises known and
described as:
Lot B, District Lot 399, Group 1, New Westminster Plan 8914
and outlined in heavy black line on Map No. 740, a copy of which is attached hereto and
forms part of this Bylaw, is hereby amended by adding Conservation.
4. Maple Ridge Official Community Plan Bylaw No.6425-2006 is'hereby amended accordingly.

EXECUTIVE SUMMARY:
Bylaw 6517-2007 has been considered by Council and at Public Hearing and subsequently
granted 2nd and 3rd reading. The applicant has requested that final reading be granted. The
purpose of the rezoning is to permit the subdivision into 2 lots not less than 371 m2.
RECOMMENDATION:
That Zone Amending Bylaw No. 6517-2007 be adopted.
DISCUSSION:
a) Background Context:
Council considered this rezoning application at a Public Hearing held on December 18, 2007. On
December 18, 2007 Council granted 2nd and 3rd reading to Maple Ridge Zone Amending Bylaw
No. 6517-2007. There were no conditions stipulated for this rezoning application.
CONCLUSION:
As the application is in compliance with the Official Community Plan and requirements for the R-1
(Residential District) C
it is recommended that final reading be given to the bylaw.

Bylaw 6510-2007 has been considered by Council and at Public Hearing and subsequently granted
2nd and 3rd reading. The applicant has requested that final reading be granted. The purpose of the
rezoning is to permit the construction of a new commercial complex containing a liquor store, pub and
commercial space.
RECOMMENDATION:
That Zone Amending Bylaw No. 6510-2007 be adopted.
DISCUSSION:
a) Background Context:
Council considered this rezoning application at a Public Hearing held on November 20, 2007. On
November 27, 2007 Council granted 2nd and 3rd reading to Maple Ridge Zone Amending Bylaw
No. 6510-2007 with the stipulation that the following conditions be addressed:
i) Approval from the Ministry of Transportation;
ii) Registration of a Rezoning Servicing Agreement including the deposit of security as outlined
in the Agreement;
iii) Registration of Section 219 Covenant for a Geotechnical Report that addresses the
suitability of the site for the proposed development;
iv) Road dedication as required;
v) Consolidation of the development site.
The following applies to the above:
i) The Ministry of Transportation approved Bylaw No. 6510-2007 pursuant to section
52(3)(a) of the Transportation Act on December 12, 2007.
ii) A Rezoning Servicing Agreement has been registered as a Restrictive Covenant and the
required security deposit has been received.
iii) A geotechnical report, dated August 1, 2007 and memorandum dated December 12,
2007 was provided by Thurber Engineering Ltd. addressing suitability of the site for the
proposed development along with recommendations for construction. This report has
been registered as a Restrictive Covenant.
iv) Road dedication for Lougheed Highway and 207 Street has been registered at the Land
Title Office.
v) The development site has been consolidated.

CONCLUSION:
As the applicant has met Council's conditions, it is recommended that final reading be given to
the bylaw.

Official Community Plan Bylaw No. 6518-2007 has been considered by Council and at Public
Hearing and subsequently granted 2nd and 3rd reading. The companion Zone Amending Bylaw No.
6519-2007 was defeated on the December 18, 2007 Council Meeting. The applicant has
requested that final reading for Bylaw No. 6518-2007 not be granted. The purpose of the OCP
Amendment is to designate lands along the South Alouette River that were to be dedicated to the
District if the Zone Amending Bylaw No. 6519-2007 was approved as "Conservation".
RECOMMENDATION:
That Official Community Plan Amending Bylaw No. 6518-2007 not be finally adopted.
DISCUSSION:
a) Background Context:
Council considered this Rezoning Application and Official Community Plan Amendment at a Public
Hearing held on December 18, 2007. On December 18, 2007 Council granted 2nd and 31d
reading to Maple Ridge Official Community Plan Amending Bylaw No. 6518-2007 and defeated
the companion Zone Amending Bylaw No. 6519-2007. Some opposition to the proposal was
experienced at the Public Hearing. The applicant has recently submitted a letter requestingthat
the Official Community Plan Amending Bylaw be withdrawn and that Council not approve it.
The applicant was required to apply for the Official Community Plan amendment to redesignate
the parkland being dedicated to the District as a condition of their Zone Amending application. As
the Zone Amending Bylaw was defeated, the applicant is no longer required to dedicate lands to
the District thereby rendering the OCP amendment somewhat redundant. Additionally, dedication
of the conservation area would be required in any future rezoning aplication even in the absence
of an Official Community Plan designation. This process has been in place for sometime and is
followed in all rezoning applications which involve watercourses.
b) Alternative
The Official Community Plan Amending Bylaw could be given final approval even though the Zone
Amending Bylaw was defeated. This would be largely contrary to the development application
process and past practice and has the potential to set a precedent which could be unsettling for

future applicants. The outcome of approving the Official Community Plan Amending Bylaw would
be questionable as the goal of achieving the conservation area in future is part of the existing
development process where there is rezoning required. In other words, if Council is concerned
about ensuring that riverfront land bordering the Alouette River be placed into public ownership if
or as rezoning occurs, the process to ensure that is already in place.
CONCLUSION:
For the reasons discussed above, it is recommended that Bylaw No. 6518-2007 not be approved
for final reading.

WHEREAS Section 882 of the Local Government Act provides that the Council may revise the
Official Community Plan;
AND WHEREAS it is deemed desirable to amend Schedule "B" and "C" of the Official Community

RECOMMENDATIONS:

reading and be forwarded to Public Hearing;
2. That in accordance with Section 879 of the Local Government Act opportunity for early
and on -going consultation has been provided by way of posting Official Community Plan

unnecessary to provide any further consultation opportunities, except by way of holding a
public hearing on the bylaw;

in conjunction with the Capital Expenditure Plan and Waste Management Plan;

b) Project Description:
Application RZ/083/06 proposes to rezone property located at 28461 Dewdney Trunk Road
from A-2 (Upland Agricultural) to A-1 (Small Holding Agricultural) to support the proposed 7 lot
subdivision under file number SD/083/06.
Each proposed lot will be a minimum of 2 ha (4.94 acres) and will be serviced through septic
and well. The applicant has submitted a septic feasibility report and a hydrogeological report
stating the each proposed lots will be sufficiently serviced by septic and well.
As part of the rezoning, park dedication is required since a mainstem of Whonnock Creek
crosses the southeast portion of the property. The park dedication will be a total of 1.56 ha
(3.85 acres) in size. There are also other watercourses and wetlands located on the subject
property which will be protected through a covenant as they are not part of the mainstem of
Whonnock Creek. The proposed covenant area includes tributary along the southwest corner
of property which runs into the mainstem of Whonnock Creek.
c) Planning Analysis:
Official Community Plan:
The subject site is designated Rural Residential under the Official Community Plan. As stated
in the Official Community Plan, Rural Residential properties on well and septic should have a
minimum parcel size of 2 ha (4.94 acres). Therefore, this proposal is consistent with the
Official Community Plan because the minimum parcel size in the A-1(Upland Agricultural) zone
is 2 ha (4.94 acres). for properties on well and water. This proposal is also consistent with the
Official Community Plan's Zoning Matrix.
As park dedication is being proposed, an Official Community Plan amendment is required to
change the designation of the park from Rural Residential to Conservation on Schedule "B"
and "C" of the Official Community Plan.
Zoning Bylaw:
The proposed development complies with the Zoning Bylaw requirements. The proposed lots
meet the minimum lot width, depth, and area as set out in the A-1 (Upland Agricultural) zone.
Any buildings that encroach into the park dedicated areas or covenant areas will be
demolished as a condition of the rezoning.
Subdivision Bylaw:
A review of the plans in relation to the Subdivision and Development Servicing Bylaw has
determined that the proposal complies with the bylaw.
Preliminary testing has been done to ensure all proposed lots can be adequateley serviced
with water and septic systems.

Development Permits:
A mainstem of Whonnok Creek crosses the southeast portion of the property. There are also
other watercourses and wetlands located on the subject property which will be protected
through a covenant. The proposed covenant area includes a tributary along the southwest
corner of property which runs into the mainstem of Whonnock Creek. Therefore, the property
is subject to a Watercourse Protection Development Permit. The Watercourse Protection
Development Permit Area was established for the preservation, protection, restoration and
enhancement of watercourse and riparian areas. The park land dedication as well as the
covenant for watercourse protection will assist in protecting the watercourses on site. Security
will also be taken as part of the Watercourse Protection Development Permit to ensure that
the Development Permit Guidelines are met.
d) Interdepartmental Implications:
Engineering Department:
The Engineering Department reviewed the proposed development and provided their
comments as follows:
1. There are no apparent geotechnical concerns at this site. The lands to the east have
similar topography and are recently subdivided and built on.
2. The flood elevation for Whonnock Creek should be determined to provide reference for a
flood construction elevation on proposed Lot 1.
Wedler Engineering has completed a review of the flood construction elevation on
proposed Lot 1 and have concluded that "the lands may be used safely for the intended
purpose" and that "none of the existing structures nor the proposed septic field for Lot 1
would be affected". The extent of the flood is shown in attached Appendix E.
3. Road dedication is required along the Dewdney Trunk Road frontage. The dedication
needs to be 3 meters to match to the Plan LMP 4447, to the east.
4. At the subdivision stage an Erosion and Sediment Control Plan will be required for road
construction. The Plan must comply with the Watercourse Protection Bylaw. No. 6410-
2006.
The applicant has submitted a conceptual erosion and sediment control plan and on -site
stormwater management plan for preliminary review. Please see Appendix F and G.
5. At subdivision stage the following services will be provided:
a. Road per standard drawing SD R4 and SD R12; the profile must account for road and
ditch drainage not flowing to private properties and for future extension.
b. Mast arm street lights on power poles.
c. Payment for lot driveway culverts at ditch crossing.

Parks & Leisure Servic@1 D ment:
The Parks Department is supportive of the proposed park dedication.
e) School District Comments:
A referral has been sent to the School District regarding the proposed Official Community Plan
amendment. Comments from the School District will be received prior to the Public Hearing.
f) Intergovernmental Issues:
Local Government Act:
An amendment to the Official Community Plan requires the local government to consult with
any affected parties and to adopt related bylaws in compliance with the procedures outlined in
Section 882 of the Act. The amendment required for this application, to change the
designation of the proposed park dedication from Rural Residential to Conservation, is
considered to be minor in nature. It has been determined that no additional consultation
beyond existing procedures is required, including referrals to the Board of the Regional
District, the Council of an adjacent municipality, First Nations, the School District or agencies
of the Federal and Provincial Governments.
The amendment has been reviewed with the Financial Plan/Capital Plan and the Waste
Management Plan of the Greater Vancouver Regional District and determined to have no
impact.

CONCLUSION:
The proposal to rezone the subject property from A-2 (Upland Agricultural) to A-1 (Small Holding
Agricultural) is consistent with the Official Community Plan and the surrounding area; therefore it
is recommended that application RZ/083/06 be favourably considered and that Maple Ridge
Official Community Plan Amending Bylaw No. 6536-2007 and Maple Ridge Zone Amending Bylaw
No.6447-2006 be read a first time and be forwarded to Public Hearing.

b) Project Description:
Application RZ/101/06 proposes to rezone the property located at 12250 McNutt Road from RS-3
(One Family Rural Residential) to RS-2 (One Family Suburban Residential). This application is in
support of subdivision application SD/101/06, which is for a 2 lot subdivision. The proposed size of
each lot is not less than 0.441 ha (1.0 acre). The applicant is proposing to retain the existing
dwelling.
Cooper Creek runs along the west side of the property; therefore, 0.185 ha (0.46 acres) of park
dedication is required along the front portion of the property. District mapping also shows that there
is an indefinite watercourse located on the north property; however, a BC Land Surveyor has
inspected the site and has confirmed that there is no evidence of the watercourse.
To allow access and frontage onto public road, the proposed lots will be panhandle lots. As per the
Panhandle Policy panhandles are permitted under the following conditions:
1. When the lot would allow subdivision to overcome a clearly established topographic difficulty
Due to the location of Cooper Creek, the applicant proposes two panhandle lots to allow
access and frontage onto McNutt Road. Two panhandles is the maximum number of
panhandles permitted for each subdivision under the Panhandle Policy and the panhandles
will be grouped together.
2. Where there is no other subdivision possibility in an established area, and where there is no
possibility of a road being created to eliminate any need of a panhandle subdivision, and
when the lot being created will not affect the established amenity of the area by blocking
views from adjoining parcels.
The subject site is located within a fairly established area made up of single family dwellings.
The subject property is designated Suburban Residential as per the Official Community Plan
and is located outside of the Urban Boundary. Densities higher than what is being proposed
is not supported by the Official Community Plan. Therefore, further subdivision beyond what
is proposed is unlikely. There are no possibilities of a road being created to eliminate the
need for the panhandle lots and the proposal does not affect views from adjoining parcels.
To minimize disturbance of the riparian area, an easement will be placed over both panhandles at
the subdivision stage to allow for a joint access. The access will be wide enough to allow for
emergency vehicle access.
c) Planning Analysis:
Official Community PI n :
The proposal is supported by the Official Community Plan; however, an amendment to
Schedule "B" and "C" of the Official Community Plan is required. This amendment is to ensure
that the portion of the property to be dedicated as park is designated Conservation on
Schedules "B" and "C" of the Official Community Plan.

Zoning B law:
The proposed development complies with the Zoning Bylaw requirements. The applicant is
proposing to subdivide the property into 2 lots which meet the minimum lot width, lot depth,
and lot area requirements of the RS-2 (One Family Suburban Residential) zone. There is an
existing dwelling and garage which the applicant proposes to retain. Both structures meet the
setback requirements of the zoning bylaw.
Subdivision Bylaw:
A review of the plans in relation to the Subdivision and Development Servicing Bylaw has
determined that the proposal complies with the bylaw.
Development Permits:
A Watercourse Protection Development Permit is required for the preservation, protection,
restoration and enhancement of the natural environment of Cooper Creek, as identified on
Schedule "C" of the Official Community Plan. The applicant will need to enter into an
enhancement and restoration agreement with the District and will need to provide security as
a condition of the issuance of the Development Permit to ensure that the Development Permit
Area guidelines are met.
d) Interdepartmental Implications:
Engineering Department:
The Engineering Department reviewed the proposed development and provided their
comments as follows:
i. The Park dedication area might provide sufficient setback from the watercourse bank
for structures, a geotechnical engineer could confirm this.
Northwest Hydraulic Consultants have reviewed the flood hazards for the subject
property and have determined that the floodplain is contained within the proposed
dedicated park area.
ii. The flood construction elevations for the watercourse on the property should be
reviewed by a geotechnical engineer to ensure that there will not be any overflow onto
this property from the tributary that runs east -west on the adjacent property to the north.
Northwest Hydraulic Consultants have determined an appropriate flood construction
level for the property. They also reviewed the existing house and noted that "the
existing structure is considered safe from flood and erosion hazards for the intended
purpose. The existing building does not affect local flood hazards as it lies outside the
100-year floodplain for Cooper Creek."
iii. Any works at the watercourse require notification or approval from the Ministry of
Environment.

iv. Sewage disposal will be by septic tank/field as the municipal sanitary sewer system
doesn't serve this area.
The applicant has submitted to the District a septic feasibility report written by ABM
Engineering Services. The report states that each proposed lot will be able to support a
Type 1 septic system as required by the Subdivision and Development Servicing Bylaw
and that each lot has a reserve field. The applicant has also submitted the Record of
Sewerage System forms to the Fraser Health Authority. At the subdivision stage, the
applicant will be required to register with the Land Titles Office a Septic Covenant in
favour of the District.
v. At the subdivision stage there will be a need for a statutory right-of-way at the
watercourse where the panhandles cross the watercourse. The right-of-way will not
include municipal responsibility for owning or maintaining the driveway and culvert.
vi. The Park area will be dedicated at the rezoning stage. The applicant must confirm that
there are no encroachments of services, either underground or aboveground, as all such
services will have to follow the panhandles.
The proposed park will be dedicated as a condition of the rezoning. Therefore, servicing
will need to be relocated to the proposed panhandle portion of the property as a
condition of the rezoning.
vii. At the subdivision stage there will be matters relating to servicing that will need
reviewing.
viii. Further comments will be provided with the Subdivision Application review
Fire De artment:
The Fire Department reviewed the proposed development and provided their comments as
follows:
Fire Department Acces
i. All fire department access routes must be rated for minimum of 35,000Kg with a
minimum force of 70 P.S.I.
ii. Be a minimum carriage way of 6 metres in width.
iii. Overhead clearance not less than 5 metres.
iv. Required hammerhead turnaround to be 6 m wide and 8 metres in depth

i. Ensure address is visible from the street and visible day or night.
To minimize disturbance of the riparian area, an easement will be placed over both
panhandles to allow for a 6 metre wide joint access at the subdivision stage. The easement
will be further extended 8 metres into the property as requested to allow for sufficient
turnaround space for fire access.

e) Intergovernmental Issues:
Ministry f Environment:
As the proposed subdivision requires a stream crossing, the applicant will be required to
send Section 9 Notification to the Ministry of Environment for Changes in and About a
Stream.
Department of Fisheries and Oceans
An environmental assessment report by Letts Environmental Consultants Ltd. states that
DFO approval may be required if HADD (Harmful Alteration, Disruption, or Destruction) is
not accounted for and avoided.
SchQol District Cornments:
A referral has been sent to the School District regarding the proposed Official Community Plan
amendment.
Local Government Act:
An amendment to the Official Community Plan requires the local government to consult with
any affected parties and to adopt related bylaws in compliance with the procedures outlined in
Section 882 of the Act. The amendment required for this application, amendments to
Schedules "B" and "C", is considered to be minor in nature. It has been determined that no
additional consultation beyond existing procedures is required.
f) Environmental Implications:
As a condition of the rezoning, park dedication is required to protect Cooper Creek.
Recommendations from Letts Environmental Consultants Ltd. are as follows:
1. A 15 metre setback is required for Cooper Creek on the property. This should be
measured from both sides of the top of bank then surveyed.
2. The culvert under the existing driveway should be upsized to accommodate peak flows
and should be recessed into the channel to a depth that equates to approximately
40% of the culvert diameter (or height if box). Any works in or about any watercourse
may require formal approval from Fisheries & Oceans Canada and Notification to the
provincial Ministry of Environment. The culvert inlet and outlet must incorporate
measures to protect the structure and the stream channel against erosion and scour.
All in -channel works must be monitored by the. QEP on record.
3. All existing mature trees (as noted on the arborist report) should be retained wherever
possible.
4. Proper sediment and erosion control measure should be implemented along the entire
setback boundaries, prior to and for the duration of any construction works. The
overall intent of a Sediment & Erosion Control Plan is to prevent the discharge of
prohibited materials to drainage systems. The Sediment and Erosion Control Plan
must outline protective measures that are in accordance with the requirements of the
District's Watercourse Protection Bylaw 6410-2006.
Ill
5. A Stormwater Management Plan should be developed to maintain pre -development
flows, allowing water to percolate at or near source wherever possible. The goal of the
Stormwater Management Plan would be to maintain water quality and quantity and to
reduce and/or eliminate the likelihood or potential for release of deleterious
substances into on any waterbodies.
The Stormwater Management Plan and sediment and erosion control measures will be reviewed as
part of the applicant's Watercourse Protection Development Permit application and Subdivision
application.
CONCLUSION:
The density of the proposed RS-2 (One Family Suburban Residential) zone conforms to the land use
designation in the Official Community Plan and is consistent with the surrounding neighbourhood. It
is therefore recommended that application RZ/101/06 be favourably considered and that Maple
Ridge Zone Amendment Bylaw No. 6541-2007 (Appendix C) and Maple Ridge Official Community
Plan Amending Bylaw No. 6540-2007 (Appendix D) be read a first time and be forwarded to Public
Hearing.

b) Project Description:
A development permit application has been made in support of a development plan for a split
level one and two storey building with a Licensee Retail Store and 600 m2 of commercial retail
space located on the main floor and a 200 seat pub and kitchen located on the second floor. A
semi -enclosed patio is located off of the pub. Access will be off of Lougheed Highway and 207
Street.
The building's exterior will be clad in wood using a combination of timber posts, cedar shingles
and clapboard beveled siding. The roof and fascia will be a durable charcoal gray metal. The
corrugated metal 'silo' on the northwest corner of the site is the feature element to attract those
traveling eastward along Lougheed Highway. The base of the building is designed with a 36" high
concrete 'curb' to deter 'crash and grab' theft. These walls are clad in porcelain tiles and are
capped with checker plate steel windowsills. As a further deterrent to vandals solid aluminum roll
shutters will be installed in the LRS half of the building. There will be a Hammond Mill Centre
pylon sign prominently displayed beside the northwest access facing Lougheed Highway as well
as along 207 Street. Additionally, a stone clad concrete block wall with precast concrete cap and
signage will be located at the corner of 207 Street and Lougheed Highway.
IPM
Planning Analysis:
Official Community Plan:
This property is subject to the guidelines applicable to Section 8.5 Commercial Development Permit
Area Guidelines of the Official Community Plan that aim to regulate the form and character of
development located within commercial areas. This development respects the key guideline
concepts as outlined in this section.
1. Avoid conflicts with adjacent uses through sound attenuation, appropriate lighting,
landscaping, traffic calming and the transition of building massing to fit with adjacent
development.
Various measures have been proposed to reduce the impact of the proposed development on
neighbouring properties. The semi -enclosed patio has a glazed roof which will provide year round
sound and weather protection. The two outward facing sides of the patio have a solid guardrail to
the height of 42" which is clad in wood. Above the guardrail is a further barrier with commercial
openable aluminum frame glazing. On the south side of the patio a large planter will provide a visual
barrier between the patio and the neighbouring properties. Landscaping will be provided on the
south and west property lines to provide safety, sound attenuation and improve the interface
between the commercial use and the adjacent residential properties. The garbage and recycling
building will have a split face concrete block wall on the south and west sides against the residences
to reduce sound travel and an insulated wood frame wall on the north and east sides away from the
residences to provide some sound protection and odour barrier, while still being visually attractive.
In addition the enclosure will have locked steel doors and a roof. An 8 foot wooden fence along the
south property line will act to further reduce noise transfer.
2. Encourage a pedestrian scale through providing outdoor amenities, minimizing the visual
impact of parking areas, creating landmarks and visual interest along street fronts.
Significant landscaping has been provided along Lougheed Highway and 207 Street and the overall
planting design provides visual interest. A public seating area is provided along Lougheed Highway.
There are well defined pedestrian entry points off both Lougheed Highway and 207 Street which
provide connection around this commercial building via a covered walkway. A stone wall with
Hammond Mill Centre inscribed on the corner of 207 Street and Lougheed identifies the building as
a landmark at this significant intersection. All parking for this development is located to the rear of
the building, creating a pedestrian environment along the streetscape.
3. Promote sustainable development with multimodal transportation circulation, and low
impact building design.
Sustainable development is provided through provision of bicycle racks, the use of drought tolerant
plantings and a bio filtration swale for storm water management.
4. Respect the need for private areas in mixed use development and adjacent residential
areas.
The existing development is strictly commercial. The proposed building is sited on the North side
of the property away from the residential buildings to mitigate noise traveling to neighbouring

properties. A fence separates the residential and commercial properties and the property is well
landscaped providing visual interest whilst protecting the privacy and liveability of the
neighbouring residences.
5. The form and treatment of new buildings should reflect the desired character and pattern of
development in the area by incorporating appropriate architectural styles, features,
materials, proportions and building articulation.
This is a unique development that provides visual interest with varied roofs, a multi -stepped facade,
numerous windows, warm exterior materials, and attractive landscaping. The style of the other
buildings in the area is very diverse.
Zoning:
A Development Variance Permit application has been received to vary four requirements to the
Zoning Bylaw. The applicant provided the following rationale for the requested variances:
1. The building height of 7.5 m has been exceeded to accommodate the pitched butterfly roofs.
The height of the roof from the slab elevation is now 9.15 m, an excess of 1.65 m over the
bylaw. The butterfly roofs act as a feature of the building while helping to create a balanced
building form as well as provide visual interest to passersby along Lougheed Highway;
2. A second storey greater than 50% in area of the first storey. The second storey pub and
deck combined are 50.9% of the lower floor, therefore the areas are slightly over the
maximum with the patio;
3. To vary the 3.0 metres front lot line setback to 0.0 m to allow a canopy to extend to the
sidewalk to give additional rain protection to 207 Street;
4. To vary the rear yard setback for the garbage and recycling building from 6.0 m to 1.5 m.
c) Advisory Design Panel:
The proposed project was reviewed by the Advisory Design Panel on September 11, 2007 and was
given general support by the group but recommended that revisions to the proposal be submitted to
Planning staff to address the following:
Location of sidewalk along 207 Street (confirmation with Engineering Dept).
Relocation of garbage and recycling enclosure and screening.
Strengthening of the architecture of the corner at Lougheed Highway and 207 Street.
Following this meeting, project plans were revised as follows:
1) The sidewalk location was confirmed with the Engineering Department;
2) The garbage and recycling building was redesigned to include a roof and concrete walls on
the south and west sides facing residences and an insulated wood frame wall on the north
and east sides away from the residences in order to reduce noise and odours. In addition, a
locked pair of steel doors has been added to deter access by the public and mitigate noise;
and
3) Added more outrigger beams and a trellis 12 feet along 207th and 24 feet along Lougheed
Highway in order to provide significant interest without a traditional tower solution.
d) Intergovernmental Issues:
Future road improvements being considered for this area that are adjacent to this site are located
on lands owned by the Ministry of Transportation. This application was referred to the Ministry of
Transportation for comments and approval granted.
e) Citizen/Customer Implications:
Residents to the south and west of the proposed development have expressed concerns regarding:
1) Noise from the unenclosed pub patio and its location at the rear of the building facing
adjacent townhouse units;
2) Loud music emanating from the building;
3) Noise from vehicle traffic into/out of the parking lot and drunk and disorderly patrons in the
parking lot;
4) Safety of the adjacent townhouse units; and
5) Noise and odors from the garbage & recycling enclosure proposed to be located beside the
adjacent townhouse units.
In response, the project plans were revised as follows:
To address noise concerns, the pub patio has been semi -enclosed with a solid guardrail clad
in wood above which will be commercial openable aluminum frame glazingfor a total barrier
height of 2.1 metres on the west facing wall and 2.4 metres on the east facing wall. In
addition, a permanent roof has been added. Therefore, there will only be one opening on the
west side of the patio, which is necessary to provide natural ventilation;
The fence along the south property line has been changed from 1.8 metres to 2.4 metres to
increase security and will be made out of tongue and groove cedar which will aid in noise
abatement.
• Modified the plantings along the south property line to include barberry which will act as a
planting barrier to discourage crime;
• A 1.5 metres wide by 7.3 metres long planter has been added on the south side of the patio
to provide a visual barrier between the patio and the neighbours; and
The garbage and recycling bins will be completely enclosed in a building providing noise and
odour mitigation from the adjacent townhouse units.
In addition to the Rezoning, Development Permit, and Development Variance Permit applications,
the applicant has also applied to the Liquor Control and Licensing Branch to increase the seating
capacity of the pub from 150 to 200 people and change the pub's hours from 9:OOAM-12:OOAM to
11:30AM-1:30AM. These changes may affect neighbouring residents and some opposition to these
requests is expected. The Director of Licenses, Permits and Bylaws will provide Council with a report
on the proposal changes to the liquor license prior to Final Reading of Zone Amending Bylaw 6510-
2007.

The existing building is recognized to have some social heritage value to the community. As such, a
plaque will be placed in the entrance of the new building commemorating the Maple Ridge Hotel.
The plaque will display photographs and a write-up about the history of the old hotel.
f) Financial Implications:
A refundable security in the amount of 2.5% of the total construction costs will be required with
this Development Permit. Based on an estimated construction value of $2,407,390 the security
will be $60,185.
There will be 12 trees added to the municipal street tree inventory on completion of this project.
The costs associated with maintaining these trees will need to be included in a subsequent
operating budget.
g) Alternatives:
Under Section 919.1 of the Local Government Act and Section 8.1 of the Official Community Plan
the property has been designated a Development Permit Area with special requirements for
commercial development. Council approval is required for the Commercial Development Permit
Area as presented in this report prior to a Building Permit being issued.
CONCLUSION:
As the development proposal complies with the guidelines of the Commercial Development Permit
Area, it is recommended that DP/061/07 be given favourable consideration.

On February 7, 2007, District staff received a preliminary petition signed by a number of residents on
267 Street between 118 Avenue and Dewdney Trunk Road (DTR), expressing interest in pursuing the
possibility of a Local Area Service (LAS) for water service.
Residents have filed a valid formal petition and Council direction is sought regarding preparation of a
bylaw to establish a Local Area Service (LAS).
RECOMMENDATIONS:
THAT staff be authorized to prepare a bylaw to establish a Local Area Service to provide water
service to 12 lots on 267 Street between 118 Avenue and Dewdney Trunk Road; and further
THAT the capital program be amended to provide for the construction of the water main.
DISCUSSION:
a) Background Context:
In February 2007, the District received a preliminary petition signed by 75% of the residents
on 267 Street between 118 Avenue and DTR. This petition requested the following
information:
• the probable cost of the service
• how the costs would be apportioned amongst the benefiting property owners
• options for payment, and
• other information necessary for the residents to decide whether or not to participate.
In response to this preliminary petition, a cost estimate to serve 12 parcels on 267 Street
(shown on the attached sketch 1) and a formal petition were prepared and circulated to
residents. On May 24, 2007, the formal petition was returned and the Corporate Officer has
determined that the formal petition is sufficient and valid. A total of 58.3% of the number of
properties with a value of 61% of total land & improvements signed the petition.
b) Strategic Alignment:
The Corporate Strategic Plan includes Financial Management and Environment as strategic
focus areas.

The financial management focus area encourages the continuation of a user pay philosophy
and the provision of high quality municipal services to our citizens and customers in a cost
effective and efficient manner. This project meets these objectives.
The environment focus area encourages water management by requiring metered water
service connection and therefore encouraging the conservation of water.
c) Citizen/Customer Implications:
Costs of the water service have been estimated at $251,000, to be shared equally among
the 12 existing homes (the per property cost amounts to $20,916.67). When the final costs
are determined, the owners will be offered the option to either pay the actual 'commuted'
cost or have the cost placed on the tax roll and amortized over a period of 15 years at the
interest rate set by the MFA and the Finance Department. Since it is anticipated that funding
for this project will be from internal funds set aside for LAS projects, residents will be able to
pay off the outstanding balance anytime during the term without incurring a penalty.
This service will provide a water system and a connection to the system at the property line.
In order to complete and commission the service, owners will then need to install, at their
cost, a connection from the residence to the water service connection at the property line.
Of the 12 parcels involved in this LAS, approximately 92% are more than 0.8 hectares in
area. Since the OCP designation on 267 Street is Suburban Residential (minimum parcel
size of 0.4 hectares) it is anticipated that some of the parcels within the LAS area may apply
for rezoning and subdivision in the future. The parcel charge is based on one connection per
parcel and does not reflect any future subdivision potential.
d) Interdepartmental Implications:
When the construction of the service is completed, the Finance Department will confirm the
actual costs, impose the final actual costs as a levy and place the notation on the tax roll of
the benefiting property owner.
e) Business Plan/Financial Implications:
Borrowing authority is required to make available sufficient funds to cover the costs of this
LAS through the capital program.
f) Policy Implications:
All the properties identified in this LAS will be included in the Rothsay Service Area. The water
servicing for the area is governed by Maple Ridge Water Service By -Law 6002-2001. All
properties greater than 0.4 hectares must be metered and the cost to install the meter is
borne by the property owner.
g) Alternatives:
The following existing sources of water are being utilized:
1. On -site wells - unlimited and unmonitored drawing of water from wells.
2. Water Hauling Services.
Both of these alternatives are considered inferior to the convenience of the recommended
installation of water service connections.
CONCLUSION:
An extension to the water system has been requested by the residents on 267 Street from 118
Avenue to DTR through a formal LAS petition. Approval to prepare a bylaw to establish a LAS to
provide a water service to 12 lots on 267 Street is recommended.

(a) Background Context:
One business class folio was affected:
BCA reduced the assessment of an office building located at 11965 Fraser St. at the direction of the
Property Assessment Appeal Board (PAAB).
(Net Municipal tax decrease, residential class, $5,080.48)
(b) Business Plan/Financial Implications:
There will be a total decrease of $9,209.67 in tax revenue of which the municipal share is $5,080.48.
CONCLUSIONS:
An appeal to the PAAB resulted in a net decrease of $406,000 to the business class assessment base.

Three folios are affected:
BCA adjusted two residential class folios which were originally assessed as land only to include the value
of recently built homes. BCA reduced the business class assessment of a portion of the Westgate Mall
located at 20395 Lougheed at the direction of the Property Assessment Appeal Board (PAAB).
(Net Municipal tax decrease, business class $15,016.20, net increase residential class, $1,905.55)
(b) Business Plan/Financial Implications:

CONCLUSIONS:
A review by BC Assessment of taxable assessments for residential class has resulted in an increase in the
residential assessment base of $ 524,400.00. An appeal filed with PAAB resulted in a net decrease to the
business class assessment base of $1,200,000.00.

Sewer, Water and Recycling Amending Bylaws
EXECUTIVE SUMMARY
During the 2008-2012 business planning presentations, staff provided an overview of the Sewer and
Water Utilities and the recycling operations. The recommendations, incorporated in the Financial
Plan for 2008, include rate increases of 5% for sewer, 9% for water and 3% for recycling.
The Water Rate Amending Bylaw also includes a minor expansion to the Rothsay Service Area to
include properties added through a Local Area Service with capital work completed in 2007.
Council should note that our water and sewer rate structures are being reviewed and
recommendations will be presented to Council in 2008. If changes to the rate structure are
required, they would not come into effect until 2009 at the earliest.
RECOMMENDATION(S):
That the Maple Ridge Sewer Rate Amending Bylaw No. 6537 - 2007 be read a first, second and third
time.
That the Maple Ridge Water Rate Amending Bylaw No. 6521- 2007 be read a first, second and third
time.
That the Maple Ridge Recycling Charges Amending Bylaw No. 6538 - 2007 be read a first, second
and third time.
DISCUSSION:
a) Background Context:
Sewer Utility
The costs of the Sewer Utility include both local and regional operating, maintenance and
capital costs. In 2008, regional costs represent 70% of the expenditures. As presented at
Business Planning sessions, the total impact to accumulated surplus is minimal over the five
years of the financial plan; however, the first three years draw down the accumulated surplus
in excess of $1.5 million.

Council approved a Local Area Service, as formally petitioned, to serve properties on Rothsay
Street (addresses from 12012 to 12193) with municipal water supply. The work was
completed in 2007 and as a part of the Local Area Service these properties are to be
included in the Rothsay Service Area.
The costs of the Water Utility include both local and regional operating, maintenance and
capital costs. In 2008, regional costs represent 60% of the expenditures. The amount paid
to the Regional District for 2008 is expected to increase about 10%. Maple Ridge shares in
some of the capital costs that the Regional District has planned. Over the next five to six
years, our share is estimated to be approximately $9 million. These costs will be paid
through Development Cost Charges and the Water Utility. Borrowing will likely be required in
2013 as available funds may not be sufficient.
Recycling
The Ridge Meadows Recycling Society maintains weekly blue box collection of all recyclables
in the urban area and extends service to new growth areas, as appropriate. It maintains daily
recycling depot services at its facility and educates the public at schools, public events and
community workshops. It is one of the largest employers of adults with developmental
disabilities in BC.
The cost of providing these services increases as labour, insurance and vehicle costs
increase. In 2008 a $10,000 study to explore the feasibility of a comprehensive organics
collection program will be undertaken.
b) Desired Outcome:
To update the Water, Sewer and Recycling levies to adequately fund operating and capital
expenditures.
c) Citizen/Customer Implications:
For a single family residence, which have these services, will see an increase in:
sewer levies of 5% or $10.30,
water levies of 9% or $26.40 and
recycling charges of 3% or $1.66.
d) Interdepartmental Implications:
Continued work with Engineering, Operations and Finance Departments and the Regional
District is needed to ensure cost predictability and to develop a funding strategy for new and
the eventual replacement of aging sewage and water infrastructure.
e) Business Plan/Financial Implications:
The rate increases were incorporated into the Financial Plan as was recommended to
Council in the 2008-2012 Business Planning presentations and adopted in December.
f) Policy Implications:
The Financial Sustainability Plan Policy and subsequent report on Infrastructure Funding
Strategy will be considered when developing the long range funding strategy to replace sewer
and water infrastructure.
g) Alternatives:
Rates other than what is proposed could be adopted which would impact the accumulated
surplus or Recycling Reserve and would influence future rate increases or the ability to make
future operating or capital expenditures. Any thing other than what is recommended would
be inconsistent with the business plans and Financial Plan adopted in December.
CONCLUSIONS:
The rate increases are inline with Council's Rate Stabilization Policy. Work will need to continue to
ensure that there is a funding strategy to address future capital costs and long term sustainability of
our assets.

Municipal Council byway of a resolution.
b) Citizen/Customer Implications:
Door-to-door canvassing and tag days are the means by which non-profit organizations such as the
Heart and Stroke Foundation are able to raise funds for research and promote awareness.
CONCLUSION:
In order to meet the requirements of the Maple Ridge Highway and Traffic Bylaw No. 3136-1982 and
the Local Government Act, Council's approval is required for all requests for soliciting for donation.
