Council will not tolerate any derogatory remarks directed at Council or staff members. If a member of the public has a concern related to a Municipal staff member, it should be brought to the attention of the Mayor and/or Chief Administrative Officer in a private meeting. The decision to televise the Question Period is subject to review Each person will be permitted 2 minutes only to ask their question (a second opportunity is permitted if no one else is sitting in the chairs in front of the podium). Questions must be directed to the Chair of the meeting and not to individual members of Council. The total Question Period is limited to 15 minutes. If a question cannot be answered, it ,will be responded to at a later date at a subsequent Council Meeting. The applicant has requested that final reading be granted. The purpose of the rezoning is to permit the subdivision into 8 lots not less than 4000m2. RECOMMENDATION: That Zone Amending Bylaw No. 6497-2007 be adopted. DISCUSSION: a) Background Context: Council considered this rezoning application at a Public Hearing held on September 18, 2007. On September 25, 2007 Council granted 2nd and 3rd reading to Maple Ridge Zone Amending Bylaw No. 6497-2007 with the stipulation that the following conditions be addressed prior to final reading: i) Road dedication as required; ii) Park dedication as required. The following applies to the above: The applicant has provided an acceptable road and park dedication plan to the District with a Letter of Undertaking guaranteeing registration of the plan at the Land Titles Office. 1001 CONCLUSION: As the applicant has met Council's conditions, it is recommended that final reading be given to the bylaw. Historically in Maple Ridge residential growth has outpaced other classes. The tax rate is set by taking last years tax rate and dividing by the percentage change in market value of the class of properties and multiplied by the approved tax increase. The largest factor in changes to multiples is the difference in change in market values for properties in each class. They are Council Policies 5.19 though 5.24. The policies discuss Churches, Community Halls, Heritage Sites, Homes for the Care of Children and the Relief of the Aged, the Poor, the Disabled and the Infirm, Municipal Recreational Services, Private Hospitals and Daycares, Private School and Youth Recreation Groups. Council has adopted a revitalization tax exemption bylaw. The revitalization area and objectives for designating that area are noted in the bylaw 6402-2006, and the exemption program is detailed in bylaw 6412-2006. This tax exemption provides a financial incentive for higher density residential buildings, with an enhanced exemption if the building is 'green' (LEEDS Silver or better). For more details on what may qualify please refer to bylaws noted above. THE DISTRICT OF MAPLE RIDGE BYLAW NO. 6570-2008 A Bylaw to establish tax rates for Municipal, Improvement District and Regional District purposes for the year 2008 WHEREAS pursuantto provisions in the Community Charter Council must, by bylaw, establish tax rates; NOW THEREFORE, the Municipal Council of the Corporation of the District of Maple Ridge enacts as follows: 1. This Bylaw may be cited for all purposes as "Maple Ridge Tax Rates Bylaw No. 6570 - 2008". 2. This application is in support of subdivision application SD/012/08, which is for a 2 lot subdivision. The proposed size of each lot is not less than 0.4 ha (approx. 1.0 acre). The applicant is proposing to retain the existing dwelling, which is located on the proposed east lot. The proposed west lot is part of a Local Area Service project for sanitary sewer; however, the east lot is located outside of the Local Area Service project and will not be serviced by sanitary sewer. c) Planning Analysis: Official Community Plan: The west portion of the subject property is designated Estate Suburban Residential and the east portion is designated to Suburban Residential. According to the zoning matrix, both designations support the RS-2 (One Family Suburban Residential) zone. The policies also -2- state that the minimum parcel size for both designation is characterized generally by 0.4 hectare lots. Zoning Bylaw: The proposed 2 lot subdivision layout is compatible with the surrounding area and complies with the minimum lot width, lot depth, and lot area requirements of the RS-2 (One Family Suburban Residential) zone. However, the applicants would like to retain the existing dwelling which does not meet the minimum setback from the front lot line. Therefore a variance will be required to reduce the setback from the front lot line from 7.5 metres to approximately 5.5 metres. All other setbacks have been met. Subdivision Bylaw: The Subdivision and Development Servicing Bylaw's rural road standard for asphalt width is 7.0 metres; therefore, a development variance permit will be required to support the retention of the existing 6.0 metre wide asphalt rural road on Ansel] Street and 125 Avenue. The Engineering Department has determined that the roads in the area are adequate to provide for existing traffic and to provide for the proposed subdivision. d) Interdepartmental Implications: Engineering Department: The Engineering Department reviewed the proposed development and provided their comments as follows: i. There is a Local Area Service project in this area that, if it proceeds, will provide a sanitary sewer connection to the proposed west lot only. The east lot and existing house will continue to use the existing septic tank/field system. The location of the existing system should be determined to ensure that it doesn't encroach onto the west lot and to ensure that the setacks to property lines are met. If the Local Area Service project does not go through to completion then the proposed west lot would have to dispose of sewage via septic tank/field as well. The proposed west lot would pay the Local Area Service costs as the proposed east lot isn't in the Local Area Service area. ii. The Local Area Service sewer construction will require a statutory right-of-way along the west boundary of the property. This will be arranged through the Local Area Service process. iii. The two proposed lots drain to the ditch on 125 Avenue. Any new construction will have to have the buildings and footings high enough so as to not be surcharged from drainage water in the ditch. Lot drainage will be directed by swale to the ditch. The applicants have signed the petition for the Local Area Service for sanitary sewer. The Engineering Department is currently reviewing the design of the project and anticipates that the construction will begin in the summer. If the applicants wish to obtain final reading for -3- Maple Ridge Zone Amending Bylaw No. 6565-2008, the sanitary sewer service must be in place for the proposed west lot or the applicant will need to submit a septic feasibility report to ensure that the proposed west lot can be serviced by on -site services. There is existing on -site service for the existing dwelling on the proposed east lot. The applicant will be required to submit a septic feasibility report for the existing septic system to ensure that it meets the required setbacks of the Sewerage System Standard Practice Manual. CONCLUSION: The density of the proposed RS-2 (One Family Suburban Residential) zone conforms to the land use designation in the Official Community Plan and is consistent with the surrounding neighbourhood. It is therefore recommended that application RZ/012/08 be favourably considered and that Maple Ridge Zone Amending Bylaw No. 6565-2008 (Appendix C) be read a first time and be forwarded to Public Hearing. The site has two street frontages, Edge Street and Brown Avenue with a lane located at the rear (north) of the site. Application RZ/116/07 proposes to rezone the properties located at 22491, 22505, 22515, 22525 Brown Avenue from RS-1 (One Family Urban Residential) to RM-2 (Medium Density Apartment Residential) to permit the construction of a four storey building containing 69 units. The site is located within the Regional Town Centre and will require a green building design covenant once the final design has been established. initially, this development has indicated that it will achieve 13 Leadership in Energy and Environmental Design credits based on the LEEDS rating system. The apartment units range in size from 60.5 M2 (651 ft2) to 90.3 mz (972 ft2) and include a mix of one and two bedroom units, with and without dens. The building is a four storey wood frame apartment structure over a one storey concrete basement parking level. An access ramp to the underground resident parking is located at the west side of the building off of the lane. The underground parking garage provides 97 parking stalls and there are 14 visitor surface parking spaces located at the rear of the building off of the lane. The proposed materials for the building are cultured stone at the base of the building with earth tone Hardie Plank siding with timber and cedar shingles as accent materials. This project takes advantage of the lot by featuring a prominent entrance at the corner of Edge Street and Brown Avenue with the rest of the building facing Brown Avenue. The proponent opted to have the highest turret as the feature element at the entranceway to try to emphasize the corner with a canopy covering the entrance along with lower turrets and balconies along the road frontage. c) Planning Analysis: Official Community Plan: The property is currently designated Urban Residential on Schedule B of the Official Community Plan. The RM-2 (Medium Density Apartment Residential) zone correlates with this designation. Maple Ridge Town Centre Concept Plan: The property is located within the Regional Town Centre and is identified as Apartments Housing on the Maple Ridge Town Centre Concept Plan. To facilitate the implementation of the Concept Plan, Council has directed that it be used as a template for development, until the adoption of an area plan for the Regional Town Centre. Chapter 4 of the Concept Plan - Design Guidelines and Performance Standards, recommends that a variety of multi -family housing options be provided in the Town Centre, with an emphasis on ground - oriented units. Multi -family buildings are to have their primary fagade facing the public street and should incorporate elements that facilitate "eyes on the street" such as windows, doors, patios and -3- balconies that face the street. In addition, the Concept Plan recommends the reduction of the front yard setback to 4.5 metres and includes strategies to incorporate green building technologies into development proposals. The "green building" concept is a key principle of the Concept Plan to encourage smart, managed growth within the Regional Town Centre. The proposal aligns with the Maple Ridge Town Centre Concept Plan in the following ways: • The rezoning application is for a 4 storey multi-fami[y building, with a density of 1.48 times the lot area; • ground -floor units are located along Brown Avenue (south facing), all of which have direct access to the street. • The units facing Brown Avenue and Edge Street each contain a patio or balcony that also overlooks the street; • While a Development Variance Permit is required for the front and side yard setback to be reduced from the required 7.5 metres identified in the RM-2 Medium Density Apartment Residential zone, the building location reflects the recommendation for a reduced front lot line setback in the Concept Plan; • The applicant has submitted a report and checklist outlining which components from the LEED (Leadership in Energy and Environmental Design) Green Building Rating System they feel the project can achieve. The details of the components will be finalized in the Development Permit application stage. However, it is recommended that prior to Final Approval of the rezoning application, a Section 219 Covenant be registered identifying the final green building components that will be incorporated into the Development Permit and subsequent Building Permit plans. Zoning Bylaw: Part 6, Section 604(6)(a) states that all apartment and accessory residential buildings shall be sited not less than 7.5 metres from all property lines. The proposed building as submitted will require the approval of a Development Variance Permit. The development meets the 7.5 m rear yard setback to the east and exceeds the 7.5 side yard setback to the north. In an attempt to create a more engaged street frontage and increase the amount of usable open space on the north side of the property, the building is sited slightly southeast on the lot facing Brown Avenue and Edge Street. As such, a Development Variance Permit application has been received to vary the exterior side lot line and the front lot line which will be discussed in a future report to Council. Off -Street Parking and Loading Bylaw: The project includes a parking provision of 14 stalls on grade at the rear of the site for visitor parking corresponding to the required 0.2 supply rate required for visitor parking for multi -family residential zones. The project also supplies a single level of underground parking beneath the site providing 97 stalls for tenant parking, corresponding to a supply rate of 1.41 stalls per unit for tenants. Currently, the -4- Maple Ridge Off -Street Parking and Loading Bylaw requires that tenant parking be provided at a rate of 1.5 stalls per unit for all apartment uses so the proposal falls short of the bylaw requirement by 7 stalls. The reduction of these stalls is supported by a Parking Impact Study provided by Linheath Incorporated. A variance application has been received and will be discussed in a future report to Council. Development, Permits: This development is subject to a Multi -Family Development Permit as outlined in section 8.7 of the Official Community Plan. Accordingly, prior to the issuance of a building permit, the Development Permit must be reviewed and approved. A Multi -Family Development Permit is required for all new multi -family development on land designated Urban Residential. The purpose of a Multi -Family Development Permit is to enhance existing neighbourhoods with compatible housing styles that meet diverse needs and minimize potential conflicts on neighbouring land uses. An application for the Development Permit has been received and will be the subject of a future Council Report. Advisory Design Panel: The proposed project was reviewed by the Advisory Design Panel on March 11, 2008 at which time the following recommendation was made; That the Advisory Design Panel supports and commends the applicant on the quality of their presentation along with the sustainability criteria stated in the application and supports the proposed variances. The Advisory Design Panel made the following recommendations to go back to the Planning Department • Consideration of Storm water plan at the existing location; • Hydro klosk location to be reconsidered; • Consider the proportion of the bay to the roof and the soffit treatment; • The design element of the east elevation, - As the projects develops the LEEDs checklist can be explored for further points; • The sustainable issues continue to be developed through the design basis. The applicant has received these comments and will review the submission responding to the ADP comments. Responses to these comments will be the subject of the Development Permit in a future Council Report. Development Information Meeting: A development information meeting on February 26, 2008 at Willow Manner Care Centre was held by staff from McLean Homes. There were seven people in attendance and 3 completed comment sheets in favour of the project. None were opposed to this development. -5- d) Interdepartmental Implications: Engineering Department: The Engineering Department has identified that all of the services required in support of the rezoning do not exist to the site. The new residential lots proposed are located at the centre parcel abutting 104th Avenue, while accommodating the two existing dwellings on the subject properties; one located on the west property line of the site and the other just east of the newly proposed lots for approximately 36 total lots. There is also an existing lean-to at the approximate center of the subject site on proposed conservation land that will be removed prior to subdivision. According to the District's mapping system, there are four known tributaries of Spencer Creek on the subject properties. Spencer Creek is identified on Schedule C - Natural Features Map of the Official Community Plan. There are also significant slopes located on the property in the riparian area. The riparian protection area will be dedicated to the District as Conservation as a condition of zoning the site. Approximately 3.08 hectares (7.6 acres) will be dedicated to the District for Conservation purposes. Development Proposal The applicant is proposing to rezone a portion of the subject property to allow for approximately thirty-five R-1 (Residential District) lots no less than 371m2 in size and one RS-1 (One Family Urban Residential) lot no less than 668m2 in size. The RS-1 (One Family Urban Residential) lot is being proposed to allow the existing house to remain while still providing the required park dedication for protection of the slopes of the watercourse. It is the intention that this lot, located west of the creek tributary, will redevelop with the adjacent lands to the west in the future which will come before Council in a separate application. This lot is unable to remain RS-3 (One Family Rural Residential) because this zone requires a minimum lot area of 0.8 hectare (2 acres) and would not allow for adequate dedication for the protection of the natural features area. To preserve the watercourses located on the property the applicant will be dedicating approximately 3.08 hectares of land as Park located on the northern, western and east -central portion of the property which will be designated "Conservation" on the Official Community Plan. Access to the proposed subdivision will be off of 104th Avenue and a new extension of 244 Street that will be built to gain access to the internal lots not facing 1041h Avenue. There is an existing multi -use trail located on 104th Avenue. The development proposes to relocate this trail off of 1041h to the north of the proposed subdivision within the conservation park boundary. WE This trail features a permanent connection extending westward where the adjacent lands can continue with the trail upon re -development. A temporary trail connection returning to 104 Avenue will be provided by the applicant until that westward connection can be realized at which point the temporary access will be decommissioned. c) Planning Analysis: Official Community Plan: The subject properties are subjectto the Albion Area Plan of the Official Community Plan. The site is designated Medium Density and Conservation. The proposed R-1 (Residential District) zone correlates with the Medium Density designation of the Albion Zoning Matrix. It will be necessary to include a larger area, from the northern, eastern and mid -western portion of the site, into the Conservation designation. This is based on the actual environmental and geo-technical assessment for the area. The conservation area will provide the protection for the Spencer Creek tributaries found in this section of the subject property. Zoning Bylaw: A preliminary review of the proposed subdivision plans in relation to the Zoning Bylaw requirements has revealed the need for one variance, lot depth for proposed Lot 10. This lot is the corner, triangle -shaped lot where depth is calculated perpendicular from the front yard setback line and not actual the length of the side lot line. As such, a Development Variance Permit application has been received to vary the following: 1. The minimum lot depth from 24 metres to approximately 21.5 metres for Lot 10. Develooment Permits: The site is subject to Watercourse Protection Development Permit. As per Section 8.9 of the Official Community. Plan, it will be necessary for the applicant to obtain. a Watercourse Protection Development Permit prior to any works occurring within 50 meters of the top of bank of any of the tributaries of Spencer Creek. The applicant will be providing park land dedication for the riparian area for protection of this watercourse as a condition of rezoning the site. The Development Permit will ensure the preservation, protection, restoration and enhancement of watercourse and riparian areas and a Security may be taken as a condition of issuance of the. Development Permit to uphold the conditions outlined in the permit. The applicant will be providing park land dedication for the riparian area for protection of this watercourse as a condition of rezoning the site. Development Information Meeting: A development information meeting on February 20, 2008 from 7:00 pm to 9:00 pm at Albion Elementary School was held by staff of Pacific Land Resource Group Inc. There was a total of 11 people sign -in and 8 completed comment sheets. Attendees were in mixed favour of the project. Three main issues were expressed: Access to the multi -use trail from 104th, development density, and the safety and capacity of 104 Avenue. -4- Multi -use trail In previous plans, the multi -use trail ended at the eastern property line of the subject properties. This has now been amended and the trail exits onto 1041h Avenue. Development Density The proposed R-1 (Residential District) zone is the "in-between" density of the two zones across the street. It is slightly more dense than RS-1b (One Family Urban (medium density) Residential) but less dense than R-3 (Special Amenity Residential District). Where facing the RS-1.b (One Family Urban (medium density) Residential) zone across the street, the proposed.lots have been widened to a 15m frontage to create consistency. The proposed R-1 (Residential District) zone correlates with the Medium Density Residential designation of the Albion Area Plan. 104 Avenue Upgrades A subdivision triggers upgrades to the frontages of the subject property. For this development road upgrades are required along 104th Avenue. The "developer will be required to widen the road to feature a 11.6 m carriageway with a boulevard, sidewalk, street lighting, curb and gutter on the north side of the road. These features will contribute to the pedestrian and vehicular safety of the area. d) Interdepartmental Implications: Engineering Department: The Engineering Department has identified that all of the services required in support of the rezoning do not exist to the site. It will, therefore, be necessary for the applicant to enter into a Rezoning Development Agreement and post the required security to complete the necessary works prior to final reading. Fire Department: A referral was sent to the Fire Department and they have no concerns with the development as proposed. Environment Department: Four tributaries of Spencer Creek are located on the subject property and have a required 30 metre setback from tap -of -bank. It is the intention to dedicate the environmentally sensitive area located within the environmental protection setback area to the Municipality as park. As part of the Watercourse Protection Development Permit the applicant will be required to provide an environmental assessment. The focus of the environmental assessment will be to providing an enhancement and restoration plan for the riparian area, mitigation measures for possible retention and replacement of trees, recommendations for timing of the construction works, and a conceptual Stormwater Management Ilan that meets the current watercourse protection bylaw requirements. 901 e) School District Comments: A referral was sent to School District No. 42 on February 25, 2008; no comments have been received from this referral. f) Intergovernmental Issues: Local Government Act: An amendment to the Official Community Plan requires the local government to consult with any affected parties and to adopt related bylaws in compliance with the procedures outlined in Section 882 of the Act. The amendment required for this application is considered to be minor in nature. It has been determined that no additional consultation beyond existing procedures is required, including referrals to the Board of the Regional District, the Council of an adjacent municipality, First Nations, the School District or agencies of the Federal and Provincial Governments. The amendment has been reviewed with the Financial Plan/Capital Plan and the Waste Management Plan of the Greater Vancouver Regional District and determined to have no impact. CONCLUSION: As the proposed development complies with the Official Community Plan, it is recommended that this application beifavourably considered and be given first reading and forwarded to Public Hearing. This proposal conforms with the minimum parcel sizes of the RS-3 One Family Rural Residential Zone. c) Planning Analysis: Official Community Plan On November 14, 2006, Council adopted the Official Community Plan, which contained supportive agricultural policies. As part of this process, Council committed to creating an Agricultural Plan to address land use issues within the rural area and the Agricultural Land Reserve. The merits of this application will be viewed within this policy context. Section 6.2.2 Sustainable Agriculture. Policy 6-12 states: Maple Ridge will protect the productivity of its agricultural land by: a) adopting a guiding principle of "positive benefit to agriculture" when making land use decisions that could affect the agricultural land base, with favourable recognition of initiatives including but not limited to supportive non -farm uses, infrastructure improvements for farmland, or the inclusion of land elsewhere in the Agricultural Land Reserve; b) requiring agricultural impact assessments (AIAs) and Groundwater Impact Assessment of nonfarm development and infrastructure projects and identifying measures to off -set impacts on agricultural capability; c) preserving larger farm units and areas by using appropriate buffers such as roads, topographic features, watercourses, ditching, fencing, or gradually reduced residential densities on properties adjacent to agricultural land, -2- d) discouraging the subdivision of agricultural land into smaller parcels, except where positive benefits to agriculture can be demonstrated; e) reinforcing the concept that the Agricultural Land Reserve is intended for agricultural use by increasing the minimum lot size for ALR properties that are zoned Rural Residential, f) encouraging the amalgamation of smaller parcels of farmland into larger, more cohesive parcels. The applicant has not assessed this proposal on the basis of the guiding principle of "positive benefit" to agriculture. Policy 6-:.2 also emphasizes the importance of discouraging the subdivision of agricultural land into smaller parcels, increasing the minimum parcel size of ALR properties with Rural Residential zoning, and amalgamation to create larger farm parcels. One of the concerns noted around the subdivision of agricultural land is that further subdivisions tend to increase speculative activity within the Agricultural Land Reserve, thereby increasing the market value of farmland, and exacerbating the issue of economic barriers to entry for new farmers. Appropriate parcel sizes for the RS-3 (One Family Rural Residential) zone may also be reviewed through the Agricultural Plan process. Currently, the minimum parcel size in this zone is 0.8 hectares (2.0 acres). This zone pertains to most of the land that is within the Agricultural Land Reserve, including the subject property. The RS-3 (One Family Rural Residential) zone pre -dates the creation of the Agricultural Land Reserve. Although designated for agriculture, there is a concern that this historic zoning contributes to the perception that farming is not the primary use of this zone. For the above noted reasons, this application should be considered inconsistent with the Agricultural policies of the Official Community Plan. d) Interdepartmental Implications: If this application is ultimately successful, and receives Agricultural Land Commission approval, the applicant will have to apply for a subdivision through the municipality. Through this process, the applicant will have to'demonstrate that both of the proposed lots will have on -site septic capability to current standards. In addition, both properties must comply with municipal requirements with respect to lot geometry, road frontage and parcel size. The property is traversed by 2 watercourses. The District's usual practice for protecting natural features is through an amenity covenant which will be a requirement of any subdivision application. Commission approval is required prior to the registration of any restrictive covenants within the Agricultural Land Reserve at the Land Titles Office. If this proposal is successful, the applicant proposes to donate to the District the portion of the property that is outside of the Agricultural Land Reserve. The involvement of the Parks and Leisure Services Department would be required at that time. -3- e) Alternatives: The staff recommendation is not to forward this application to the Agricultural Land Commission. If Council decides to forward this application, the Commission will evaluate its merits, and make their decision accordingly. CONCLUSION: This application has been assessed for its consistency with the policies of the Official Community Plan, and its implications for the Agricultural Plan. The application is found to be at odds with this policy framework. On this basis, the staff recommendation is not to forward this application to proceed further to the Commission. Athwal, on February 6=h, 2008 was found guilty in the Supreme Court of British Columbia of cutting and removing of trees and vegetation and altering the grade of the lands along Morse Creek without the benefit of first obtaining the required Development Permit contrary to Section 920 (1)(d) of the Local Government Act. As a result he was ordered by the Court through a mandatory injunction to obtain a DP to stabilize and restore the lands within the DP area and Morse Creek to their condition prior to the breach of the Act and Maple Ridge Watercourse Protection Bylaw No. 6410-2006. The Court also found the applicant guilty of the following: 1. Caused or permitted prohibited material and water containing prohibited material to be released directly or indirectly into Morse Creek; 2. Obstructed or impeded the flow of Morse Creek; This ruling is important should Provincial or Federal authorities decide to proceed with their own action against the applicant. A mandatory injunction was obtained by the District against the applicant to ensure that any work completed by the applicant proceed under the supervision of registered professionals (a geotechnicai engineer and an environmental consultant). The work will consist of the planting of trees, vegetation and stabilizing the bank along Morse Creek in accordance with the measures and parameters identified in the expert reports prepared by Golder and Associates Ltd. and Letts Envirowise Ltd. The work is outlined in the following reports and will make up the contents of the Development Permit: 1. Riparian Planting Plan; 2. Sediment and Erosion Control Plan; and 3. Slope Restoration Plan. c) Planning Analysis: Watercourse Protection Development Permit: The Watercourse Protection Development Permit Area was established for the preservation, protection, restoration and enhancement of watercourse and riparian areas. It was this bylaw, -2- along with section 920 (1)(d) of the Local Government Act that the applicant was found to be in breach of by the Supreme Court. The guidelines of the bylaw are as follows: A. Watercourse Protection Area Establishment: 1. Watercourse protection areas are to be established in accordance with their habitat value and the potential impacts proposed by adjacent development. The District of Maple Ridge, the Department of Fisheries and Oceans, and the Ministry of Environment, Lands and Parks must endorse the proposed watercourse protection boundaries. . The District has for many years identified Morse Creek as a watercourse worthy of protection by way of covenant in the past but by dedication recently. Letts Evirowise Ltd. has identified the appropriate 15 metre setback from the original unaltered tap -of -bank.. Notification has been made by Letts Envirowise on behalf of the applicant to both the Ministry of Environment and DFO of the required restoration works. 2. The watercourse protection areas are to be dedicated where possible into public ownership for conservation purposes. Future rezoning and development of this site will result in the' transfer of the restored watercourse protection area into the ownership of the DMR. 3. The boundaries of the watercourse protection areas are to be physically located on the ground by a B.C. Land Surveyor prior to site disturbance. A B.C. Land Surveyor has now located the precise location of the top -of -bank and edge of fill for use with this DP application and any future development of this site. 4. Temporary barrier fencing is to be installed adjacent to watercourse protection areas prior to any construction activity and should be replaced with permanent post and rail fence upon development completion. The environmental monitor and geotechnical consultant will oversee the proposed works of the Riparian Planting, Sediment and Erosion Control and Slope Restoration Plans throughout the restoration process. 5. All lots must provide the required minimum lot dimensions as set out in the Zoning Bylaw exclusive of the watercourse protection boundaries. No alterations to the legal boundaries of the two lots in question will occur at this time. This will occur at the development stage of any future project. B. Erosion Control: 6. All work is to be undertaken and completed in such a manner as to prevent the release of sediment to any ravine, watercourse or storm sewer. An erosion and sediment control plan that involves implementation prior to land clearing and site preparation and the careful timing of construction is to be provided in accordance with the requirements of the District's Watercourse Protection Bylaw 6410-2006. -3- A detailed Erosion and Sediment Control Plan has been prepared by Letts Envirowise Ltd. The plan calls for sediment control facilities to remain in place until the project is complete. The contractor and environmental consultant shall monitor the protective works which consist of., a temporary gravel access road; on site drainage rock pit, perimeter siltation fencing, and construction drainage swales; all exposed soils shall be protected with poly or straw. 7. Silt fencing should be erected to prevent the movement of silt into the watercourse protection area prior to any disturbance to the soil on the site. The ESC plan requires that silt fencing be installed prior to any restoration works proceeding and in accordance with the plans provided. S. Cutting and filling adjacent to watercourse protection areas is to be kept to a minimum incorporating appropriate structural fill material and blending graded areas with natural slope, as supported by the Hillside Policies of the OCP. Extensive filling has already occurred on this portion of Morse Creek and the works outlined in the Slope Restoration Plan will restore the area to a stabile profile of2.5 H:1V or flatter. 9. The District may require environmental impact studies enhancement works, and monitoring in support of development proposed to be located within a Watercourse Protection Area. Supporting documentation, technical studies, and recommendations with respect to impacts of studies, and recommendations with respect to impacts of the proposed development may include the following: a. A Geotechnical Slope Stability Report; b. Riparian Planting Report; and c. Sediment and Erosion Control Plan. C. Vegetation Management 10. Natural vegetation is to be retained wherever possible to ensure minimal disruption to the environment and to protect against slope failure. Land clearing adjacent to the watercourse protection areas is to be restricted to a phased construction schedule. The vast majority of natural vegetation was eliminated by the illegal filling that occurred on the east bank of Morse Creek. Once a stable slope is re-established, a total riparian planting area of 2,114 sq. m (22,730 sq ft) will be created and replanted with 1,628 native trees and scrubs. 11. Habitat restoration landscaping of all bare or sparse riparian areas within the watercourse protection area may be required. Vegetation species should be native of the area and be selected for erosion control and fish and wildlife habitat values. The Riparian Rehabilitation Plan consists of native trees and scrubs and consists of- Bigleaf Maples, Eastern red Cedars, Dogwoods, Douglas Fit, Red Alder, Vine Maple Beacked Hazelnut and Mountain Ash. Shrubs are various berry producing species, ferns and willows started from cuttings. -4- 12. Stormwater outflows to the stream or leave area should have water quality and erosion control features so as to minimize their impacts on fish habitat and in compliance with the Districts stormwater management plans. The Erosion and Sediment Control Plan will deal with these items. D. Monitorin . 13. The implementation of required environmental mitigative measures as designed and their maintenance is to be monitored by a qualified environmental monitor. Although the applicant is free to choose a contractor of his choice to perform the work, performance is a real concern. As such, the Court granted a mandatory injunction requiring the applicant to stabilize and restore the lands within the Development Permit area and Morse Creek in accordance with the riparian planting plan and slope stabilization plan and sediment control plan prepared by the geotechnical and environmental consultants. The applicant has already sought to make cost reduction efforts to these original studies and has been informed this was not possible. The Court further ordered that the applicant must perform and complete all the works set out in the Restoration Plans by June 15th, 2008 and obtain from the Registered Professionals certification that all the works set out in the various plans are completed to their satisfaction, no later than June 30, 2008. To further ensure that this matter is dealt with in an efficient manner, the Superior Court judge has reserved any further action that may be necessary will be dealt with by him. This would significantly reduce any delays of any future court action on the part of the District to seek enforcement of the Supreme Court Order. d) Intergovernmental Issues: Department of Fisheries and Oceans DFO has been informed of the District's efforts to resolve this issue and has also issued their own Orders to the applicant to restore the watercourse. Their representative has also attended the court proceedings and has reported back to his superiors. e) Financial Implications: Performance Security: 1_ In support of the restoration works required in or around Morse Creek the amount of security that will be required is $ 36,720.00. 2. Performance security for site development will be achieved through provisions of the Watercourse Protection Bylaw. -5- CONCLUSION: The issuance of this Development Permit, with assistance from the Supreme Court of British Columbia, will rectify and restore an important watercourse in the District. To this end a restoration strategy has been prepared by registered professionals. The Development Permit is the proper mechanism to implement the suggested works. Therefore, it is recommended that Watercourse Development Permit 023/08 be approved for issuance. Should the applicant not live up to his obligations as outlined in the Supreme Court Order, the District will proceed back to Court and seek a Contempt of Court charge. GEOTECHNICAL RECOMMENDATIONS FOR SLOPE RESTORATION As requested, Thurber Engineering Ltd_ (TEL) has carried out a geotechnical. investigation for the remediation of the Morse Creek slope at 12157 and 12175 224 Street, Maple Ridge. This report presents the results of our site visit and geotechnical investigation and provides our recommendations. Use of this report is subject to the enclosed Statement of General Conditions. 1. INTRODUCTION TEL was retained by Mr. Jagdev Athwal (owner of the subject properties) to provide geotechnical recommendations for the restoration of the Morse Creek slope along the west side of his property in Maple Ridge. Authorization to proceed with the investigation was given by Ms. Aiyssa Bradley, of Lidstone, Young, Anderson of Vancouver on behalf of the District of Maple Ridge on March 4, 2008 via email. 2. BACKGROUND Based on the review of the available information and discussions with Mr. Jagdev Athwal, we understand that, in summer 2006, regrading of the property was carried out using earthmoving equipment (no specific reference was obtained about the type of the machine used)_ The clayey soil excavated from the site, together, with some borrowed soil from offsite, was pushed onto the east slope of the Morse Creek which runs in a north - south direction. This fill contained organics (as observed on the site) and was placed without proper compaction. The fill pushed back the limits of the existing crest of the bank towards the west by several metres and interfered with the normal flow of Morse Creek. This resulted in a change of the flow patterns and silting of the water in the Creek. Date: March 10, 2008 Pans- i of F TI- URBER ENG IINEE141NG LTD. YEAiiS We understand that the District accused Mr. Athwal of damaging the watercourse in a Development Permit Area. The damage was caused by the dumping of dirt into Morse Creek which flows adjacent to his properties on 224 Street. In the ruling by the Supreme Court on February 6, 2008, Honourable Justice Truscott ruled that Mr. Athwal had altered his lands at 12175 and 12157 — 224 Street by altering the grades. These portions of the lands are covered by the District's Official Community Plan Bylaw 5434. No Development Permits were obtained by Mr. Athwal. Furthermore, Mr. Athwal was found to have violated Section 3 of the District's Watercourse Protection Bylaws 5807 (1999) and 6410 (2006) by releasing prohibited rnaterial into Morse Creek. He also violated Section 4 of 'Bylaws 5807 and 6410 due to the obstruction that resulted from the dumping of the materials into the creek. A Court Order was issued requiring Mr. Athwai to stabilize and restore his lands within the Development Permit Area and Morse Creek to their condition prior to the breach and to complete all of the work by June 15, 2008_ On behalf of the District, Lidstone, Young, Anderson retained Golder Associates Ltd. (Golder) and Letts Envirowise Ltd. (LETTS) to review the condition of the existing slope and the condition of the creek and to obtain recommendations for the restoration of the slope. Reports by these companies were submitted in December 2006 and July 2007, respectively_ The Court Order -required that Mr. Athwal retain Golder to complete the required slope stabilization plan. However, Golder declined this arrangement and TEL was retained by Mr. Athwal and approved by the District to complete the work. 3. FEBRUARY 26, 2008 SITE VISIT P. site visit was carried ^ut by i'�1r_ Gurpreet Bala of TEL on February 26J, 2008 and the following observations made: Overall the site was relatively flat with few zones of depression in which water ponded (Photo 1). The vegetation on the site primarily comprised of grass, weeds and some bushes. Though not of any significance, some vehicle ruts were also observed. Along one cross-section approximately through the centreline of the property, the top of the Morse Creek was about 5.8 m lower than the top of the bank elevation/ the general lot elevation. The slope above Morse Creek comprised loosely placed clayey fill with some organics. Discussions with Mr. Athwal indicated that, this fill was primarily pushed from the slope edge while grading the site. The surface texture of the slope had lumps of dumped soil. Grass had grown over most of the slope. • The crest of the original slope could not be established in the field. The existing slope of the Creek contained two separate zones of slumps measuring about 9 m and 4 m in width (Photos 2 and 3). Two shallow erosion gullies were also present on the slope close to the centre and the north end of the slope (Photos 2 and 4). These gullies would have probably formed due to the surface runoff from the lot towards the Creek. However, no water was observed to be flowing during the site visit. The existing slope was measured at 1.75H:1V to 2HAV at two sections. At two locations, the pushed fill material was observed to be resting against the trees on the slope of the creek. A few tilted and fallen trees were also observed towards the north end of the slope (Photo 2). The remainder of the slope, 2 years after construction, appeared to be stable. = No signs of the dumped soil being eroded by the Creek flow were observed_ 4. GEOTECRIdINCA r RA.aCOS.79— .C3JiAl_. Based on the history of construction, of the Creek slope and site observations, it is inferred that the slope is marginally stable and will likely deteriorate progressively with time in future due to the ingress of moisture and associated slope movements. The shallow slumps observed would likely retrogress towards the crest of the slope, leading to more slumps. YEAMS The erosion gullies would most likely form into permanent drainage channels until the site is regraded so that the surface water flows away from the slope during heavy rainfall events. These gullies would be the main source of further erosion and silting of the Creek. Unless controlled, the gullies would widen and trigger slumping of the dumped mass on the creek slope. No data regarding water levels and flows in the Creek during different periods of the year was available for review. Thus, no comment can be made on erosion of the dumped mass along the slope by the flow in the Creek. In our opinion, all of the loosely place uncompacted fill should be removed from the slope. The slope being steep, unstable and relatively high (6 m to S m), removal of the fill should be carried out with caution. The vegetation cover that was removed or was damaged due to fill placement should be restored as the vegetation will increase the stability of the slope. As discussed in the earlier sections, the present slope is considered to be unstable and subject to erosion. The Court Order requires stabilization and restoration of the lands within the Development Permit Area and Morse Creek. We recommended that all of the till material within the fill removal limits shown on Dwg. 19-5305-0-1 to be removed_ As the slope is deemed unstable and comprises loosely placed fill, the excavation/ removal of the fill shall be carried out in stages and in the form of benches. A 2 tier bench excavation is considered suitable although the procedures shall be refined in the field as removal proceeds. The procedure should be approved by TEL personal present on the site during the operation. All loose fill should be removed to the limits of the pre -disturbed location of the slope face. The final attained slope should be flatter than 2_5► .-1 y and any additional fill required to build the slope face should granular soil. The fill should be placed and compacted to attain at least 95% of Standard Proctor Maximum Dry Density, as determined in the laboratory. Quality control on the compacted density should be maintained by field density tests using a nuclear densometer. RECOMMENDATION: THAT the use of municipal streets be authorized for the 11th Annual Vistas Run on Sunday May 25, 2008, provided the conditions outlined in Schedule 'A' attached to the staff report dated April 7, 2008 are met. DISCUSSION: a) Background Context: From time to time, the Municipality is requested to allow the use of municipal streets for organized events. Unless there are some unusual safety implications, approval is usually given on condition that the Municipality be indemnified against any liability for injury or damage resulting from the event. The conditions of approval of the event are attached as "Schedule A". The race is scheduled to begin at 9:00 AM and anticipated to end at approximately 10:30 am. However, volunteers will be arriving at 7:00 am and leaving at approximately 1:00 pm. The run route will start at Webster's Corner Elementary School and proceed south on 256 Street, west on 112 Avenue to the Kanaka Regional Park entrance. The 5-km runners will do a single loop through the park, and then back up 256 Street to the school. The 10-km runners continue through Kanaka Creek Regional Park, exiting the park on 251 Street at Cliff Park, proceed north on 251 Street, east on 117 Avenue, north on 252 Street. They will travel west on Dewdney Trunk Road to 250 Street, south to 119 Avenue, and continue south on 248 Street to Ferguson Avenue, re-entering the park before returning to the school via 256 Street. A map of the route is outlined in Form 'A'. 1106 b) Strategic Alignment: Administrating Maple Ridge street events allows the District to manage road infrastructure and associated risks but . yet allows events that promote community development, commemorate and celebrate community accomplishments and highlight Maple Ridge's natural and built features. c) Citizen/Customer Implications: Permission to use municipal streets may cause some minor delays and inconveniences to other road users. However, traffic control will be provided by the Vistas Run volunteers. d) Governmental implications: The road use permit establishes that the event organizer must obtain the approval of RCMP for traffic control and must notify the Fire Department and BC Ambulance Services as well as coordinate with Coast Mountain Bus Company (transit service). e) Business Plan/Financial implications: The Business Plan recognizes that the District processes requests for use of municipal streets as part of its services. The financial impact of the specific road use is limited to staff processing effort. f) Policy Implications: Permission to use municipal streets is grantable under the District's policy practices. g) Alternatives: The District could refuse to permit the event to occur at this location. In this event, the organizer may have to cancel the event. However, this event has a history in this community. CONCLUSIONS: From time to time, the District is requested to allow the use of municipal streets for various events and activities. The Vistas Run for the Ridge Meadows Hospice Society event has been held in Maple Ridge for several years. The organizers have requested permission to hold the event on municipal streets for 2008. Date and Time: Sunday, May 25, 2008, Race start time: 9.00am Distance: 5km and 10km Participation: 400 Route: Beginning on 256th Street, on the south side of Dewdney Trunk, proceeding south to 112 Avenue Diversion, where it heads west to the entrance to Kanaka Creek Regional Park. The 5 km route then heads east back through the park, then north on 256th back to the starting point. The 10 km route will run through the park, exiting at 251stm then head north to Dewdney. Runners will run west along the south side of Dewdney, turning south at 250th. From there they will turn west on 11 a Avenue, south on 248th, through the gully, and east on Ferguson where they will re-enter Kanaka Regional Park. They then run east through the park, turning north on 256th, back to the starting point. Runners will be on the course from approximately 9:00 am till 10:30 am. Prior to the race the volunteers will begin arriving by 7:00am. The last volunteers should be leaving the school between noon and 1:00pm. Parking: Webster's Corner School has 32 marked stalls. On the wide shoulder in front of the school there is room for approximately 20 vehicles, plus dozens more along 256th Street. There is a large grass lot on the southeast corner at 256th and Dewdney that the owner, Mr. Robson, allows us to use. DISCUSSION: a) Background Context: From time to time, the District is requested to allow the use of municipal streets for organized events. The conditions of approval of the event are attached as "Schedule A". There are two courses: a 5 kilometer and a 10 kilometer. Both courses start and conclude at Fairview Elementary School located at 12209 206 Street. 5 kilometer course: Participants travel south on 206 Street to Dewdney Trunk Road (DTR) and travel west on the north side of DTR to 203 Street (the event coordinator will have marshals along DTR to ensure participants stay on the sidewalk & curb). They will travel north on 203 Street to 123 Avenue and travel east on 123 Avenue to Laity Street. They will travel south on Laity Street to Wicklund Avenue where they will do a quick turnaround and continue south on Laity Street to DTR and travel west on DTR to 206 Street and continue north to Fairview Elementary where the run will conclude. 1107 10 kilometer course: Participants travel south on 206 Street to DTR and travel west on the north side of DTR to 203 Street (the event coordinator will have marshals along DTR to ensure participants stay on the sidewalk & curb). Participants will travel north on 203 Street to 132 Avenue where marshals will be positioned to ensure participants travel east on 132 Avenue on the north side of the street. They will travel north on Neaves Road and will be assisted by marshals in crossing 132 Avenue and Neaves Road. Participants will travel on the east side of Neaves Road heading north towards the dykes and travel east on the dykes to Laity Street and 128 Avenue. The clean up and finish of the event will be complete by approximately 12:00 PM. b) Strategic Alignment: Permitting of Maple Ridge street events promotes community development and often highlights Maple Ridge's natural and built features. c) Citizen/Customer Implications: Permission to use municipal streets may cause some delays and inconveniences to other road users. However, traffic control will be provided by the event organizers. d) Governmental implications: The road use permit establishes that the event organizer must obtain the approval of RCMP, for traffic control and must notify the Fire Department and BC Ambulance Services as well as Coordinate with Coast Mountain Bus Company (transit service) on any rerouting requirements. e) Business Plan/Financial Implications: The Business Plan recognizes that the District processes requests for use of municipal streets as part of its services. The financial impact of the specific road use is limited to staff processing effort. f) Policy Implications: Permission to use municipal streets is grantable under the District's policy practices. g) Alternatives: The District could refuse to permit the run to occur. In this event, the organizer would have to cancel the run. CONCLUSIONS: From time to time, the District is requested to allow the use of municipal streets for various events and activities. In addition, the organizers will be distributing an information letter to affected businesses and residents. d) Governmental Implications: The road use permit establishes that the event organizer must obtain the approval of RCMP for traffic control and must notify the Fire Department and BC Ambulance Services as well as coordinate with Coast Mountain Bus Company (transit service). e) Business Plan Implications: The Business Plan recognizes that the District processes requests for use of municipal streets as part of its services. The financial impact of the specific road use is limited to staff processing effort. f) Policy Implications: Permission to use municipal streets is grantable under the District's policy practices. g) Alternatives: The District could refuse to permit the event to occur at this location. In this event, the organizer may have to cancel the event. CONCLUSIONS: From time to time, the District is requested to allow the use of municipal streets for various events and activities. Policies without this statement or an altered statement will NOT be accepted. The policy shall also include a Cross Liability Clause. Both routes head north on 224th thru the Dewdney intersection then weave their way predominantly thru the quiet residential streets of Maple Ridge. After proceeding north on 224th for about 1 kilometers, the 5k route turns west (left) at 124th avenue. Runners and walkers continue for approximately 1 1/2 kilometers until reaching 216th street. Participants then head South for about 1/2 kilometer more to Mountain View Crescent where they then start heading back eastward to the finish via 122 avenue, south (right) on 222 street, east again on Dewdney and down the hoarse stretch back south on 224#h to Memorial Peace Park where the run concludes. k-4' The IOk route continues north on 224th until reaching 232nd avenue where participants turn east (left) into the tranquil and picturesque rural part of Maple Ridge. Runners continue east for about 1 1/2 kilometers turning southbound on 216th thru to the four-way stop intersection on 128 h where they turn west (right) and head towards Laity Street. Runners then continue up Laity street for about 1 km until reaching 120 avenue "Shady Lane" where they head eastbound (left) back towards 216th. Here runners cross a main intersection on 216th and join up with the other 5k runners on the east side of the street before heading south again for approximately 1/7 km until reaching at Mountain View Crescent. Similar to the 5k rout, runners then head east on Mountain View Crescent and 122nd avenue, south (right) on 222 street, east again on Dewdney and down the home stretch back south on 224th to Memorial Peace Park where the l0k race also concludes. 2. Course Marshals & Traffic Control: Both the 5k and 1 Ok routs will be clearly marked and delineated with traffic cones to ensure that participants stay on the sidewalk, curb and/or shoulder wherever possible. Marshals will be placed all throughout the course as indicated on the attached rout map and marked with the symbol TC in yellow circles. With the co-operation of CPL Rob Lennon, 3 auxiliary staff members will be requested to provide traffic control support at key intersections and locations on RUN THE RIDGE the course. Depending on the final number of auxiliary staff available, additional private/professional traffic control personal may be hired to provide further support if needed and recommended by the RCMP Traffic services department. 3. Timing: Preparation for this event will begin at 5:30 AM and the 1 Ok race will start promptly at 9:00 AM with the 5k run/walk starting at 9:20 AM. The staggered start will help ensure that both races conclude at approximately the same time reducing the amount of traffic control necessary at the Dewdney and 224 h intersection. The cleanup on the course will begin at approximately 11 am and be complete by no later than noon. The awards ceremony for both races is scheduled to start promptly at 1 lam and should run for approximately 1 hour. The event including all remaining cleanup at Memorial Peace Park is expected to finish no later than 1:30pm. It is anticipated and encouraged however that participants and their families, particularly those from out of town, stay around to relax and enjoy the hospitality of the local business and restaurants for the remainder of the afternoon. We are also currently making inquiries with the Leisure Center again this year to see if their facilities will be made available to all participants to use before and after the race. Construction of Fire Hall No. 4 in the Albion area; 2. Expansion of the existing municipal cemetery; 3. Construction of a new animal shelter on the existing location; 4. Drainage improvements on River Road between Carshill Street and Darby Street; 5. Acquisition of land for future school and park sites. This does not necessarily mean that we will borrow externally as we have some reserves on hand. Payments on this debt are already included in the financial plan and will not result in a further increase in property taxes Council directed at its April 8, 2008 meeting that approval of the electors of these bylaws be obtained through the alternative approval process. Approval of the Inspector of Municipalities was required before that process could begin. The Inspector's approval has now been received. DISCUSSION 1. Approval of the Electors The District is seeking the approval of the electors through the alternative approval process to incur certain liabilities in relation to the five projects listed below and intends to adopt the loan authorization bylaws to enable these projects to proceed. 1. Construction of Fire Hall No. 4 in the Albion area; 2. Expansion of the existing municipal cemetery; 3. Construction of a new animal shelter on the existing location; 4. Drainage improvements on River Road between Carshill Street and Darby Street; 5. Acquisition of land for future school and park sites. The loan authorization bylaws required the approval of the Inspector of Municipalities following third reading by Council. As this approval has been received, the District may now proceed with the alternative approval process. 2. Alternative Approval Process The alternative approval process is the same process used to obtain approval of the electors for the Downtown Core Loan Authorization Bylaw in 2004 and the Size of Council Bylaw in 2005. Electors who are opposed to any of the loan authorization bylaws may complete an elector response form indicating this opposition and submit the form to Municipal Hall. Approval of the electors to proceed with each bylaw is obtained if, at the end of the time for receiving elector responses indicating that Council may not proceed with the bylaw unless assent of the electors is obtained, the number of responses is no more than 10% of the number of electors. Individuals signing the form must meet the eligibility criteria identified on the form. 3. Notice of Elector Approval Section 86 (2) of the Community Charter states that "Notice of an alternative approval process must be published in accordance with section 94 [public notice] and must include the following. Page 2 (a) a general description of the proposed bylaw, agreement or other matter to which the approval process relates; (b) a description of the area to which the approval process applies; (c) the deadline for elector responses in relation to the approval process; (d) a statement that the council may proceed with the matter unless, by the deadline, at least 10% of the electors of the area indicate that the council must obtain the assent of the electors before proceeding, (e) a statement that (i) elector responses must be given in the form established by the council, (ii) elector response forms are available at the municipal hall, and (iii) the only persons entitled to sign the forms are the electors of the area to which the approval process applies; (f) the number of elector responses required to prevent the council from proceeding without the assent of the electors, determined in accordance with subsection (3); (g) other information required by regulation to be included". Notice has been prepared (attached as Appendices 1-5) for each bylaw that meets all requirements of the Community Charter. Section 86 (3) of the Community Charter states that "For each alternative approval process, the Council must (a) establish the deadline for receiving elector responses, which must be at least 30 days after the second publication of the notice under subsection (2) (b) establish elector response forms, which. (1) may be designed to allow for only a single elector response on each form or for multiple elector responses, and (ii) must be available to the public at the municipal hall from the time of first publication until the deadline, (c) make a fair determination of the total number of electors of the area to which the approval process applies The following discussion addresses these requirements. 4. Elector Response Forms According to section 86 (7) of the Community Charter, the elector response form must include "the person's full name and residential address and, if applicable, the address of the property in relation to which the person is entitled to register as a non-resident property elector". The elector response forms have been prepared (attached as Appendices 6-10) to meet this requirement. A person must not sign any alternative approval process elector response form more than once and may not withdraw his or her name from the alternative approval process elector response form after the deadline for submission of the petitions has passed. Accurate copies of the elector response form may be made and used for signing. 5. Deadline for Receiving Elector Responses It is anticipated that the notices prepared under section 86 (2) of the Community Charter will be published in the May 16, 2008 edition of the local newspaper of record of the District. From that date, information packages including the notices, staff reports and elector response forms will be available upon request at Municipal Hall, and on the District website. We'll also provide copies of the response forms to the Leisure Centre, the ACT, and the Library. The notices will be published for a second time in the May 23, 2008 edition of the local newspaper of record. Page 3 Respecting these dates and the Charter provisions, it is recommended that the deadline for receiving elector responses at Municipal Hall be established as Monday, June 23, 2008 at 4:00 PM. This date is 31 calendar days after the last notice is published on May 23, 2008. Elector response forms may not be submitted by email or facsimile. After the deadline has passed, the corporate officer must determine and certify whether elector approval has been obtained for each loan authorization bylaw. If the corporate officer determines that it has, then the loan authorization bylaw will be submitted to Council for reconsideration and adoption. 6. Number of Electors The area to which the approval process applies is the entire District. In order to establish the number of electors in the District, several sources were considered. A discussion of these sources follows. Elections BC Elections BC has maintained a continuous voters list for more than 70 years. Eligible citizens can register as voters through on --line registration, by visiting their local Service B.C. office or by submitting a registration form by mail, fax or email. Regular updates are also received from ICBC, Vital Statistics and Elections Canada. Elections BC staff conduct ongoing analysis of the quality of the data in the list. This combination of registration activities and analysis allows Elections BC to maintain a voters list that achieves a high level of currency and accuracy. The majority of Lower Mainland municipalities who have conducted an alternative approval process have used this source to determine the number of voters. Metro Vancouver also uses this source. Staff recommends that this source be used for the alternative approval process. As of April 7, 2008 the number of voters on their list for the District of Maple Ridge is 47,567. The number of electors who must submit signed elector response forms in order to prevent the Council from adopting the loan authorization bylaws without the assent of the electors by voting using this number would be 4,757 (10% of voters). Elections Canada Elections Canada was contacted to obtain the number of voters registered from Maple Ridge for federal elections. Elections Canada was unable to provide that information. Numbers are available only for the entire federal riding which encompasses Maple Ridge, Mission and Pitt Meadows. The Sheltair Group Methodology in 2004 and 2005 when the District sought approval of the electors through the alternative approval process for the Downtown Core Loan Authorization Bylaw and the Size of Council Bylaw, the methodology of The Sheltair Group was used to estimate the number of voters. A copy of Sheltair's report, which describes that methodology, is attached as Appendix 1.1. Since that time, Elections BC has improved their data collection through a comprehensive maintenance and improvement program. As identified previously in this report, the majority of municipalities in the lower mainland are using Elections BC as their source for voter estimates. Given the complicated nature of Sheltair's methodology, and the improvements made to the data available from Elections BC, staff is not recommending this methodology be used. Page 4 CONCLUSION: Considering the above discussion, it is recommended that: 1. Data was obtained from two sources and a separate calculation was conducted to determine the population that is: a) 18 years or older b) Canadian citizens c) a resident of BC for the last 6 months d) a resident of Maple Ridge for the last 30 days, and e) not otherwise disqualified (a person in custody or a person confined to a psychiatric institution). 1) Elections Canada Data The number of electors on lists from Elections Canada in June 2004 was 44,258 for the District of Maple Ridge. This estimate was obtained from the Dewdney-Allouette Electoral District office for Elections Canada (1- 866-499-8026) and obtained on June 7, 2004. Data for the entire Electoral District, which includes Pitt Meadows, Maple Ridge, and Mission, is also available on their -web site. The voters list is currently being updated due to the upcoming June 28th federal election. Therefore the above figure is an interim number which will changeover the next few weeks. A revised estimate will be available on or after June 22nd. The information in the National Register of Electors is used to produce the preliminary voters lists for federal elections, by-elections and referendums. About 20 percent of elector information changes every year. This was based on using the BC Stats population estimate for 2003 of 71,400 and factoring up the population by the population growth rate of 2.25% projected _for 2003-2004 for the Maple Ridge Local Health Area (which includes Pitt Meadows). The proportion of the population aged 18 years of age and older was estimated to be 73.2% of the population for the District of Maple Ridge in 2001 based on Census data. This was compared to the value for the Maple Ridge Local Health Area for 2001, which was approximately equal at 73.9%. Since the population is aging, the BC Stats projection by age cohort for the Maple Ridge Local Health Area was used to approximate the proportion of the population in June 2004 that were 18 years of age and older. This value of the proportion of the population that was 18 years of age and older was estimated to be approximately 75.7% in June 2004. This proportion of 75.7% was multiplied by the estimated population of 73,000 in 2004 to obtain an estimate of 55,300 people that were 18 years of age and older. b) Reduce the amount by the share of those who are not Canadian Citizens Then it is necessary to reduce this amount by the proportion of the population that are not Canadian citizens. Based on the data from the 2001 census, 95.6% of the population were Canadian Citizens. c) Reduce the amount by the share who are not residents of BC for the last 6 months and not a resident of Maple Ridge for last 30 days Approximately 1.2% of the population in Maple Ridge moved to Maple Ridge from outside BC or outside Canada in the year prior to the 2001 census. Dividing this by. 12 for the 12 months in the year was done to obtain an estimate of the population that was not a resident of Maple Ridge in the last 30 days. d) Take into account the ineligible voters who are disqualified (a person in custody or a person confined to a psychiatric institution) This calculation was not done. However, there are approximately 900 persons who lived in collective dwellings in 2001 in Maple Ridge. Some of these may be a person in custody or a person confined to a psychiatric institution. e) Result and limitations Following the above calculations, the total estimated population of eligible voters in June 2004 is 52,320 before rounding. As this is a ballpark estimate of eligible voters, a rounded number of 52,000 is suggested to reflect a reduced level of accuracy that can be expected for the calculation. The lower rounded number would also help account for the fact that the disqualified individuals .(a person in custody or a person confined to a psychiatric institution are not included) were not factored into the estimate. Due to the difficulty of obtaining a detailed estimated for a particular month and for the period of residency, many assumptions were made to conduct the calculation. The most difficult assumptions which may vary considerably from the actual result would be the number of Canadian citizens and the calculations around period of residency. These calculations were based on rates from historical data from the 2001 census which may differ from actual amounts for 2004. These limitations should be noted when using the estimate provided. The Sheltair calculations give an order of magnitude calculation of the total population that would be eligible to vote in Maple Ridge. It would be an upper estimate of the actual numbers. It should be noted that the Elections Canada estimate does not reflect those electors who choose not to be on the list of electors. There will also be a margin of error due to the challenges with keeping the Elections Canada list up to date and keeping track of people who move. Therefore the Elections Canada number is likely a lower -bound for the number of eligible voters. The estimate conducted using BC _ Stats data, data from the last census, and a number of assumptions yielded an estimate of 52,000. The 52,000 estimate would be a reasonable upper -bound and can be used in conjunction with the Elections Canada estimate to provide a reasonable range for the number of eligible voters. (Letter attached) The Commission considered the subject at their meeting of April 10, 2008. The Commissions recommendation follows: RECOMMENDATION: That the request of Maple Ridge Elementary School PAC for funding assistance for their school playground equipment be respectfully declined, noting that three neighborhood parks are situated very close to and surrounding the school site in the same neighborhood. DISCUSSION: a) Background Context: The Maple Ridge Elementary PAC are aware of the recent Provincial playground equipment grant awards provided to two Pitt Meadows Elementary schools, as well as the additional municipal funding that was used to assist with those two projects. This' application for assistance differs from the Pitt Meadows projects in that the funding had already been incorporated into the 5 year capital plan to replace the PME playground, as the existing playground equipment at Pitt Meadows Elementary was required to be moved as part of the cenotaph and spirit square project. In this case, because two schools were fortunate enough to be awarded Provincial grants for this, the municipal budget was brought forward one year to permit completion of both school projects at no additional costs to Pitt Meadows residents. It is also the case that there are no neighborhood parks close to Davie Jones School other than on the other side of the CP Rail line. In the case of the Maple Ridge Elementary project the school is also benefitting from a provincial playground grant, and has requested municipal funding. The reasons for declining the request are a) there is no funding in the budget, and b) The request does not fit within the current policy (see below). b) Desired Outcome: Currently there are no funds identified in the Maple Ridge 5 year capital budget for this purpose c) Policy: 1151 This request does not meet the criteria for allocation of funds in the Commission's policy in this regard, as there are playground opportunities in fairly close proximity to Maple Ridge Elementary School which is located at approx 115 Avenue / between 208 Street and 209 Street (policy attached) For example: Camwood Park is located at approx 117 Avenue / between 208 Street and 209 Street (just north of Maple Ridge Elementary school. Jordan Park is located at approx 116 Avenue / 210 Street (just east of the school) Hammond Stadium Park is also located at 115 Avenue and 206 Street {just west of the school). CONCLUSIONS: Parks staff visited the parks sites in the immediate area of the school, and confirmed that the neighborhood park standard has been met in this particular case. Staff have also confirmed that the school currently has a mix of both new and older play structures, as the playground that was previously located at Maple Ridge Primary (when it was closed), was also moved to Maple Ridge Elementary. As you may be aware, there is a lack of playground equipment available in Maple Ridge Elementary's catchment for the intermediate school age child. The small parks east of the school and In this area have mature playgrounds geared for the pre- school child. It would be worth noting that approximately 75% of Maple Ridge Elementary population lives east of the school, where there are no playground facilities available to them. The PAC, the MRE Playground Committee and the school Administration are ' aggressively fundraising for this project.. However, we feel that we will fall short of our goal due to the time constraint. An opportunity of this nature would be a very difficult one to lose. The Provincial government has seen a fundamental need for children to be active for their overall growth and .development. The amending bylaw is attached for Council consideration. In order to complete the change the Joint Leisure Services Agreement with the City of Pitt Meadows also needs to be amended. The draft amended wording for the agreement is also attached (para. 4 (f) and (g)). We have also taken the liberty of adjusting the references to Pitt Meadows from "District of Pitt Meadows" to "City of Pitt Meadows" which occur in various places in the agreement. These are the only changes being proposed. RECOMMENDATION(S): That Parks and Leisure Services Commission Amending Bylaw No. 6568-2008 be read a first, second and third time; and further, that the Mayor and Clerk be authorized to execute the revised Joint Parks and Leisure Services Agreement attached to the 2008 04 21 report on this subject once and if final reading is given to the amending bylaw. DISCUSSION: a) Background Context: The Commission wishes to extend the opportunity to Chair Commission meetings to all members including at large members. Providing that opportunity is felt by the Commission to be appropriate to enhance the level of at large member involvement. Four at large members are appointed to the Commission by Maple Ridge Council and two are appointed by the Pitt Meadows Council. Three members of each Council (including both Mayors) and three members of the School Board (including the Board Chair) also serve on the Commission. b) Desired Outcome(s): The desired outcome is to ensure the Commission is functioning at optimal levels. 1152 c) Strategic Alignment: Providing citizens with opportunities for meaningful involvement in the governance of various aspects of the Municipal operations is part of Council's strategic direction. d) Policy Implications: Citizen at large appointees serve as Chair in several other Municipal Advisory Committees. It is acknowledged that the Commission does differ from the Advisory Committees in that it does have some independent decision making authority for items delegated to it by the Councils. Having said that key responsibilities like authorizing capital expenditures and adopting the annual budget remain with the Councils. All members of the Commission already have a vote on all matters coming before the Commission. CONCLUSIONS: A suggestion was made at the January Commission meeting that all members of the Commission should be eligible to stand for election to the positions of Commission Chair and Vice Chair. The District's Agricultural Advisory Committee Supports the request for funding. RECOMMENDATION: That staff be directed to work with the Maple Ridge and Pitt Meadows Agricultural Association to develop a fee for service agreement in which the District would provide up to $12,000 each year for three years, subject to annual budget reviews, in return for the Association accepting responsibility for a variety of agriculturally oriented education activities including the operation of an annual country fair, noting that this agreement is in addition to any funding support available to the Association through the annual Festivals budget and the Association's lease of the Maple Ridge Fair Grounds at no cost. DISCUSSION: a) Background Context. As Council is aware the organization has had a very long history in the community and the Municipality has always made an effort to ensure the Fair has a permanent site, In fact the old "Aggie" grounds were located in the heart of Maple Ridge where all our public facilities are now located. The Association moved its event from downtown Maple Ridge in 1956 when the current Fairgrounds were purchased for that specific purpose. The Association finds itself at a crossroads at this point given its dependency on admissions and the uncertainty of the weather. They are primarily concerned about ensuring that young people in our community continue to have the opportunity to learn about the importance of agriculture in all our lives. They do that through the annual "Country Fest" where 4H participants come to compete and the public gets to see farm animals "up close and personal". They have also been visiting schools and bringing farm animals to children to help them understand agriculture better. Unfortunately for events like this to survive without a consistent source of funding, which is not weather dependent, the Association, like many other Fairs, has had to risk booking expensive musical acts (which may or may not draw crowds depending on the weather) and run beer gardens to make ends meet. The Association would prefer to focus on agricultural education and wish to reach out to families. To do so they are requesting that Maple Ridge and Pitt Meadows contribute proportionately toward an annual grant of $15,000 ($12,000 from Maple Ridge and 1153 $3,000 from Pitt Meadows). Funding from other sources has already been obtained (i.e. from Gaming and from the Metro Vancouver Agricultural Advisory Committee). They have provided evidence of many significantly higher grants provided to other Agricultural Fairs by the communities in which they are held. To be clear the Association is requesting this ongoing amount be provided on top of the in kind support provided through the festival grant program administered by Parks and Leisure Services which amounts to just under $5,000 and the $3500 amount being provided this year through the UBCM tourism program to generate greater regional interest. The former is primarily in kind support necessary to prepare the site for the Country Festival with a small amount of direct funding made available (about $1,600). The UBCM funding will need to be channeled to regional advertising since that is its purpose and it is only available for 2008 as far as we know. To reach out to families the Association will also be moving to a free admission format similar to Pitt Meadows Day, the Christmas Festival and other family oriented events in the community. Since the focus is to be on Agricultural Education it is suggested that Council consider entering into a three year fee for service agreement with the Association for the amount requested with deliverables such as: 1. providing a low cost "Country Festival" which is easily accessible to families and supports 4H activities along with promoting agriculture 2. providing agriculturally oriented educational opportunities to schools commensurate with the resources available to the organization 3. providing support in collaboration with the CEED Centre and others for community gardens and school gardens 4. participating in the Agricultural advisory Committee This approach is consistent with the fee for service agreements already in place with ARMS and KEEPS for their environmental education work. It may be appropriate to administer the relationship through the Agricultural Advisory Committee to ensure the work of the Association is complementary to the work of the committee. b) Desired Outcome: The desired outcome is local support for and understanding of agriculture in Maple Ridge. c) Interdepartmental Implications: Parks and Leisure services Staff would work with the staff supporting the Agricultural Advisory Committee to develop the fee for service agreement. Administration of the agreement would fall to the Agriculture Advisory Committee in the long term. d) Business Plan/Financial Implications: Council is aware that the grants budget has been extended in 2008 to cover this additional expense should Council choose to proceed. e) Alternatives: The alternative is to reduce the amount of funding requested to a total of $12,000 including the UBCM funding and the $1,600 available in cash from the festival grants program. That is not recommended since the UBCM funds are needed for a specific purpose beyond the Association's regular activities (a greater amount of regional advertising) and the festival grants funding is quite minimal. CONCLUSIONS: The Maple Ridge and Pitt Meadows Agricultural Association supports agriculture through the provision of educational activities including the annual country fair. The Fair has been a tradition in the community for over 100 years. The Association has requested funding to provide educational activities beyond what they have previously provided and to reach out to families. Other Fairs enjoy an even greater level of financial support from the Municipalities in which they are located. In light of this it is recommended that Council authorize staff to develop an appropriate multi year fee for service agreement with the group, similar to the agreements already in place with other organizations like the Historical Society, for the provision of a service the Municipality wishes to see available to its citizens and visitors. Action: MAYOR Re: Sustainable funding for Maple Ridge Pitt Meadows Agricultural Association Dear Mayor and Council, The Maple Ridge Pitt Meadows Agricultural Association is writing to ask for your consideration of the following-. The agricultural association is the oldest operating organization in Maple Ridge and Pitt Meadows and the preservation of this event is perhaps the only way of also preserving our own agricultural history. With all of the many changes to the make-up of our community, the increased residential and the struggles to ensure that the public understands the importance of our agricultural capacity - our mandate of continuing education in this field is now more important than ever. The association directors and membership are amongst the most financially responsible organizations in the district and to date have demonstrated a remarkable ability to operate independently in a sustainable manner. While the association is extremely appreciative of the District's support through in -kind contributions, it should also be recognized that, in a history of some 107 years of operation, we have never asked for or received financial assistance. The fair association has always worked wonders with its small budget primarily because of the association's ability to attract and hold onto volunteers. This incredible volunteer base has kept the event going long after other similar events in other communities have had to ask for assistance. With the exception of a small annual honorarium for the manager the event is entirely volunteer driven (1,500 hrs were reported to Festivals in 2007 but is probably a low estimate). In spite of the fact that the Fair association is committed to seeking sponsorship from a variety of sources (and is committed to serious and ongoing efforts in that regard), the Association has now reached a point where our future depends on achieving sustained community funding -annual financial commitments from our local governments. By our calculations, the Fair association requires $15,000 in sustained funding to ensure the future success of this agricultural event. In keeping with the shared funding formula between Maple Ridge and Pitt Meadows used by the Parks and Leisure Services Department, we are requesting that the District consider 80% of this figure (the remaining 20% to be requested from the City of Pitt Meadows.) This letter then is to formally request consideration of sustained funding for this important community event in the amount of $12,000/year to assist the association to achieve its mandate - the promotion and education of agriculture and agricultural activities to our citizens. This year, when we asked for assistance, our written proposal was directed through the festival budget which could not support our request. Although music will always provide an important ambience to our family oriented event, we are primarily an educational event as opposed to a music festival. It would seem that this one -of -a -kind event does not fit in with available categories and that is undoubtedly because the event, its mandate, and its contribution to a more sustainable community are entirely unique. We have collected some information from surrounding municipalities and their relationship and support of the importance of organizations that are promoting agriculture which may be helpful to the decision -making process. We would like to share with you that Abbotsford Agrifair receives $60,000 annually and will receive an additional $10,000 because the event this year falls on B.C. Day. This organization has been operating in the red for quite a few years but still is supported by the municipality. Chilliwack Exhibition for many years received $30,000 annually up to 2001, was reduced to V5,000 up to 2006.was then given $5,000 and has just announced (March 25th Chilliwack Times) that in 2008 they will receive $50,000 and $60,000 in 2009. The article also states that the General Manager of community development explained that this funding along with a $35,000 in an Agricultural Reserve Fund would allow the 2008 exhibition to break even, but $43,000 would have to be found for 2009. This organization is also in financial trouble but is still supported by Chilliwack council which again demonstrates the municipal commitment to the promotion of agriculture. I was advised by the President of Aldergrove Fair, which is a very small fair, that they are receiving a total of $12,500 ( cash and grants with the assistance of two councilor's who sit on their board) from the Township of Langley. A sustainable future for the citizens of Maple Ridge will hopefully include an event where the importance of agriculture is front and center. What better way to engage the public in learning about the benefits of agriculture than to help provide an attractive, entertaining, and productive event where they are invited to be engaged in actively promoting the benefits of agriculture and agricultural activities. The Fair Board's desire to create a sustainable education -based venue that promotes agriculture and agricultural activities fits well With the District's commitment to the environment and generally going green. Indeed, it may be events like the newly revitalized Fair (now christened Maple Ridge Country Fest) that will help lead people back to fully supporting activities that someday may mean the difference between eating or not.
