Council will not tolerate any derogatory remarks directed at Council or staff members. If a member of the public -has a concern related to a Municipal staff member, it should be brought to the attention of the Mayor and/or Chief Administrative Officer in a private meeting. The decision to televise the Question Period is subject to review. Each person will be permitted 2 minutes only to ask their question (a second opportunity is permitted if no one else is sitting in the chairs in front of the podium). Questions must be directed to the Chair of the meeting and not to individual members of Council. The total Question Period is limited to 15 minutes. If a question cannot be answered, it will be responded to at a later date at a subsequent Council Meeting. This Bylaw shall be cited for all purposes as "Maple Ridge Municipal Officials Indemnification Amending Bylaw No. 6577-2008". 2. That Maple Ridge Municipal Officials Indemnification Bylaw No.6548-2008 be amended by a) deleting Section 3.b) and replacing it with: °3.b) has promptly after being served with a document initiating an action or prosecution delivered a copy of the same to the District's Corporate Officer;" b) deleting Section 4 in its entirety; and c) renumbering the subsequent sections accordingly. DISTRICT OF MAPLE RIDGE BYLAW NO. 6533-2007 A bylaw to regulate Untidy and Unsightly Premises in the District of Maple Ridge The Council of the District of Maple Ridge, in open meeting assembled, enacts as follows: I. Name of Bylaw - This bylaw may be cited as "District of Maple Ridge Regulation of Untidy and Unsightly Premises Bylaw No. 6533-2007. 2. Definitions - The following words and phrases shall have these designated meanings: "Bylaw Enforcement Officer" means a peace officer or person appointed by the Council as a Bylaw Enforcement Officer, Building Inspector or Director of Licences, Permits & Bylaws; "Council" means the Council of the District of Maple Ridge; "Discarded Materials" means derelict, discarded, or unused materials, filth or rubbish whether or not used for commercial purposes or as part of a trade or calling, including but not limited to dead animals, paper products, crockery, glass, metal, plastics, plastic containers, wire, ropes, machinery, tires, inoperable vehicles, vehicle parts, appliances, and any other scrap or salvage; "District" means the Corporation of the District of Maple Ridge; "Graffiti" means drawing, printing or writing scratched, sprayed, painted or scribbled on a wall, fence, or other surface which is visible from a highway, park or other public place, but does not include a sign for which a permit has been issued by the District. "Noxious Weeds" includes weeds designated as such under the Weed Control Regulation pursuant to the Weed Control Act (British Columbia); "Order" means an order issued pursuant to section 9 of this Bylaw; "Property" means any parcel of land in the District "Parcel" means any lot, block or other area in which land is held or into which it is subdivided, but does not include a highway; "Special Container" means a specially designed garbage receptacle fitted with equipment that enables it to be dumped mechanically by a garbage truck; and "Standard Container" means a metal or plastic container or plastic bag weighing no more than 75lbs when full and not exceeding 3.5 cubic feet in volume. 1002 Prohibitions 3. No Owner or Occupier of Property shall cause, permit or allow the Property to become or remain untidy or unsightly. 4. No Owner or Occupier of Property shall cause permit or allow Graffiti on the Property. 5. Unsightly Real Property - Every owner or occupier of Property must remove, or cause to be removed, from the Property any unsightly accumulations of filth, rubbish, or Discarded Materials. 6. Every Owner or Occupier of Property must remove, or cause to be removed, any Graffiti from the Property. 7. Adequate Containers (a) Every Owner or Occupier of Property shall acquire and maintain in good order and repair a sufficient number of Standard Containers or Special Containers in which to store all rubbish generated on the Property. (b) No Owner or Occupier of Property may cause, permit or allow rubbish to overflow the Standard Containers or Special Containers on the Property. (c) Every Owner or Occupier of Property must ensure that all Standard Containers and Special Containers are kept lidded or closed when not being emptied or filled, and at all times secured against disturbance by animals. (d) [f a Special Container is used, the Occupier must ensure that the lid on the Special Container is locked at all times. (e) Every Owner or Occupier of Property shall keep the area on the Property used for the storage of Standard Containers and Special Containers clean, sanitary and free from ponding water and loose rubbish. 8. Overgrowth - No Owner or Occupier of Property may cause, permit or allow the Property to become overgrown with any brushwood or Noxious Weeds, or grasses in excess of 30 centimetres in height. 9. Removal Orders (1) A Bylaw Enforcement Officer may, by notice in writing sent by express mail to the Owner or Occupier, and posted on a Property, order the Owner or Occupier of a Property, at his or her expense and within 7 days of delivery of the notice to: (a) remove from the Property any accumulation of filth, Discarded Materials, or rubbish described in the Order; (b) clear from the Property any brushwood, Noxious Weeds, or other growths described in the Order; (c) take any other measures described in the Order to remedy unsightliness on the Property; or (d) remove from the Property any Graffiti described in the Order (2) Upon any failure by the Owner or Occupier of Property to comply with an Order under this section, the District may, by its own forces or those of a contractor, immediately enter on the Property and carry out the work described in the Order at the expense of the Owner or Occupier and, whether the Order was directed at the Owner or the Occupier of the Property, or both, recover the costs in the same manner and with the same remedies as ordinary taxes on land and improvements under the Community Charter. (3) Should an Owner or Occupier of Property wish to contest an Order, that person must within 5 days of the posting or mailing of the Notice, inform the District's Clerk in writing that he or she wishes to appear before the Council to contest the Order. Upon hearing the Owner or Occupier, staff and any other affected persons, the Council may affirm, vary or revoke the Order. 10. Offence and Penalty - Every person who offends against any of the provisions of this Bylaw, or who suffers or permits any act or thing to be done in contravention, or who refrains from doing anything required to be done by any of the provisions of this Bylaw, or who does any act or thing which violates any of the provisions of this Bylaw, shall be liable on summary convection to a penalty not exceeding $10,000 and not less than $1,000. 11. Inspection - The Bylaw Enforcement Officer may, in accordance with section 16 of the Community Charter, enter on any Property at any reasonable time to ascertain whether the requirements of this bylaw, or any Order issued pursuant to this bylaw, are being observed. 12. Severability - If any section or phrase of this Bylaw is for any reason held to be invalid by a decision of any court of competent jurisdiction, the decision shall not affect the validity of the remaining portions of this Bylaw. 13, Repeal of Existing Bylaw - Bylaw No. 6239-2004 is hereby repealed. WHEREAS the Community Charter empowers Council to, by bylaw, designate those bylaws for which Municipal Ticket Information may be used as a means of bylaw enforcement; WHEREAS it is deemed expedient to further amend Maple Ridge Ticket Information System Utilization Bylaw No 4432 -1990 as amended; NOW THEREFORE the Municipal council of the Corporation of the District of Maple Ridge in open ineeting assembled, ENACTS AS FOLLOWS: 1. This Bylaw shall be cited for all purposes as "Maple Ridge Ticket Information System Utilization Amending Bylaw No. 6551 - 2008" 2. This Bylaw may be cited for all purposes as "Albion Dyking District Tax Rates Bylaw No. 6576 - 2008". 2. The following rates are hereby imposed and levied for the year 2008 for those lands within the boundaries of Albion Dyking District: For purposes of dyke maintenance and improvements and equipment repair and maintenance: (a) a rate of $2.157 per $1000 of assessment of land and improvements in all categories 3. If any section, subsection, clause or other part of this Bylaw is for any reason held to be invalid by the decision of a court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this Bylaw. This Bylaw may be cited for all purposes as "Maple Ridge Road 13 Dyking District Tax Rates Bylaw No. 6578—2008". 2. The following rates are hereby imposed and levied for the.year 2008 for those lands within the boundaries of Maple Ridge Road 13 Dyking District: For purposes of dyke maintenance and improvements and equipment repair and maintenance: (a) a rate of $0.356 per $1000 of assessment of land and improvements in all categories (b) a rate of $12.00 per acre of land with a minimum charge of $5.00. 3. WHEREAS the Council may by bylaw establish and regulate the fixing of fees for admissions and/or use of sports, recreation and community use facilities; AND WHEREAS, the Council has imposed fees and now wishes to amend those fees; NOW THEREFORE, the Council of the District of Maple Ridge enacts as follows: 1. This Bylaw may be cited as "Maple Ridge Recreation Facility Fees Amending Bylaw No. 6571- 2008". 2. That Maple Ridge Recreation Facility Fees By-law No. 4117 - 1988 as amended, be further amended by deleting Schedules "A", "B", "C", "D", "E", "H", "J" and "K" in their entirety and replacing with Schedule "A", "B", "C", "D", "E", "H", "J", "K" as attached hereto, and adding Schedule "L". 3. A copy of the request is attached. Authorization from Council is required in accordance with the "Maple Ridge Highway and Traffic By- law 3136-1982" to allow the event to occur in Maple Ridge. RECOMMENDATION: THAT use of municipal streets be authorized for the annual Canada Day Event on Tuesday July 1, 2008, provided the conditions outlined in Schedule 'A' attached to the staff report dated May 20, 2008 are met. DISCUSSION: (a) Background Context: From time to time, the Municipality is requested to allow the use of municipal streets for organized events. Unless there are some unusual safety implications, approval is usually given on condition that the Municipality be indemnified against any liability for injury or damage resulting from the event. The conditions of approval of the event are attached as Schedule "A". 1102 The Canada Day festivities are scheduled from 10:00 am to 4:00 pm in Memorial Peace Park. Set up will begin at 8:00 am and clean up will be complete by 6:00 pm. The following road closures are required: • Haney Place road surrounding Memorial Peace Park; • McIntosh Avenue from Fraser Street to 224 Street; and • Fraser Street from McIntosh Avenue to Dewdney Trunk Road. Barricades will be set up by the organizers to manage this closure. (b) Strategic Plan: Permitting of Maple Ridge street events allows the District to manage road infrastructure and associated risks but yet allows events that promote community development and highlight Maple Ridge's natural and built features. (c) Citizen/Customer Implications: Permission to use municipal streets may cause some minor delays and inconveniences to other road users. However, traffic control will be provided by the organizers. In addition, the organizers will be distributing an information letter to affected businesses and residents. (d) Governmental Implications: The road use permit establishes that the festival organizer must obtain the approval of RCMP, for traffic control and must notify the Fire Department and BC Ambulance Services as well as coordinate with Coast Mountain Bus Company (transit service) for any required rerouting or schedule change. (e) Business Plan Implications: The Business Plan recognizes that the District processes requests for use of municipal streets as part of its services. The financial impact of the specific road use is limited to staff processing effort. (f) Policy Implications: Permission to use municipal streets is grantable under the District's policy practices. (g) Alternatives: The District could refuse to permit the event to occur at this .location. In this event, the organizer may wish to select an alternative location within or outside the municipality. However, this event has a history in this community. CONCLUSIONS: From time to time, the District is requested to allow the use of municipal streets for various events and activities. Canada Day festivities have been held in Maple Ridge for several years and the organizers have requested permission to hold the event on municipal streets for 2008. The work includes: • the completion of the road surface of the Cottonwood Drive Link from 117B Avenue to 118A Avenue complete with concrete sidewalk, curb and gutter, streetlights, water main and storm drainage. • Traffic calming measures (curb extensions) on 119 Avenue at Cottonwood Drive and at 236 Street as per the residents' input during the Open Houses held last year. • Widening of Dewdney Trunk Road at the Cottonwood Drive intersection to accommodate a left turn bay complete with traffic signal system. The project was tendered on May 9, 2008. Although 19 contractors responded to the invitation to bid, the District received only seven tenders. The tenders received range from $538,867.58 to $842,757,30. The lowest bidder is Double M Excavating Ltd. with a bid of $538,867.58; the second lowest is Tag Construction Ltd at $581,201.25. RECOMMENDATION: THAT Contract E02-010-098, Road Improvements on Cottonwood Drive from DTR to 117B Avenue, be awarded to Double M Excavating Ltd. in the amount of $538,867.58; and THAT the Corporate Officer be authorized to execute the contract. DISCUSSION: a) Background Context: The road improvements on Cottonwood Drive from DTR to 117B Avenue consist of three pa rts: Part 1- Cottonwood Drive Link (117B Avenue to 118A Avenue); consists of road construction, concrete sidewalk complete with handrail, curb and gutter, streetlights, watermain, catch basins and cedar tree planting. The completion of the Cottonwood Drive Link from 117B to 118A Avenue has been planned and identified in the District's Capital Plan. Both the south and north end of this section of road has been constructed in 1103 anticipation of this connection. The completion of this road link was done in phases. The first phase was the bulk fill and stabilization of the side slope that was completed in December 2007, The next phase will be the construction of the road surface and completion of the road link this summer. Part 2 - At the Open House held last year, the residents requested that the District provide traffic calming measures on 119 Avenue in anticipation of increased traffic flow. Curb extensions are proposed along 119 Avenue at Cottonwood Drive and at 236 Street. Part 3 - Intersection improvements at DTR and Cottonwood Drive consist of widening DTR to accommodate a left turn lane to Cottonwood Drive, traffic signal lights and full curb returns. It was specifically noted in the tender that this work needs to be done first because DTR is scheduled to be milled and overlayed on the last week of July 2008. The road improvements at this intersection must be finished by July 25, 2008. Public Consultation and 2007 Construction The first Open House was held February 8, 2007 to view the project and present different options for the road improvements. The second Open House was held July 19, 2007 to present the bulk fill final design that was tendered, awarded to GAIA Contractors and was completed in December 2007. The third and last Open House was held April 24, 2008 to present the final design for the road construction at the Cottonwood Drive Link and road improvements on 119 Avenue and at the DTR intersection. 2008 Construction The project was tendered on May 9, 2008. Although 19 contractors responded to the invitation to bid, only seven contractors submitted bids. The bids have been reviewed and staff recommend that Double M Excavating be awarded the contract for this project. b) Strategic Alignment: This connecting road along Cottonwood Drive from 117B Avenue to 118 Avenue has been identified as an important link to the area's traffic network. Completion of this roadway will provide traffic circulation alternatives for the surrounding area between DTR and Lougheed Highway via 116 Avenue. The road improvements at the intersection of DTR and Cottonwood Drive Road combined with the traffic signal will make it easier to go west on DTR from Cottonwood Drive. The intersection also will have full curb returns and improve safety at what is now a narrow driveway letdown. c) Citizens/Customer Implications: Construction will start as soon as the project is awarded and attempts will be made to minimize the impact to the neighborhood during construction. d) Business Plan/Financial Implications: LTC 1793 in the 2008 approved Capital Budget provides sufficient funds to complete this work. CONCLUSIONS: The tender price of $538,867.58, including GST, by Double M Excavating Ltd. for the road improvements at Cottonwood Drive from DTR to 117B Avenue is the lowest tendered price. Geothermal heating and cooling and extensive use of natural lighting and sensors are some of the environmentally friendly features that are included. The project was tendered in April, 2008 and we received 7 bids. Funding for this project will be provided by the Fire Department Capital Acquisition Reserve and other projects will be reprioritized. Rezoning Bylaw 6572-2008, which proposes to change the designation of certain properties behind Firehall #1, was forwarded to public hearing on May 27, 2008. The contract for the renovations and expansion will not be issued until this bylaw is adopted. RECOMMENDATION(S): That subject to the adoption of Rezoning Bylaw 6572-2008, contract. 01084 for Firehall #1 Renovations and Expansion, be awarded to Mierau Contractors Ltd. for $7,750,000 and the Corporation of the District of Maple Ridge be authorized to execute the contract for the project DISCUSSION: This project involves the renovations of approximately 900 square metres and a two storey addition of about 1,200 metres to Firehall #1 at 227t" Street and Dewdney Trunk Road. The firehall was built in 1972 and went through some seismic upgrades in 1997. The renovations will include hazardous material abatement, expansion of the apparatus bay, storage additions and interior space modifications. Access will be re -configured off of Brown Avenue and the building will be upgraded to post -disaster levels. The renovated building will include "green" technologies, including geothermal heating and cooling. This means that between 90% to 100% of the building's heating and cooling needs will be met through this new system, rather than the conventional systems. The firehall will continue to be operational throughout the construction period, though some of the apparatus may have to be temporarily moved to one of the other firehalls. it is estimated that the project will take up to 18 months to complete. 1131 FUNDING: The budget for this project was set at $6.1 million some time ago. About $500,000 has been expended to date. Due to the volatility in construction costs, we decided to wait until we saw the results of the bids before revising the estimates. With a contract price of $7,750,000 and after allowing 5% for other fees and contingencies, we estimate that an additional $2.5 million in funding is required. The source of funding for this project is the Fire Department Capital Acquisition Reserve, an account specifically set up for the Fire Department's capital needs. The balance in this account at the end of 2007 was $7.1 million. Each year, the account receives a transfer from general revenue (estimated at $1 million for 2008 and another $1 million in 2009). The renovations and expansion to Firehall #1 is deemed to be the highest priority capital project for the Fire Department and there is sufficient funding to proceed with this. Other projects will have to be reprioritized. Specifically, the renovations to Firehall #3 will have to be postponed and the construction of Firehall #4 deferred to 2009, though we will begin to do the design work later this year. While it would be nice to not have to defer these projects, we also have to be realistic about our ability to do these projects at the same time as the Firehall #1 project. A cashflow projection for the reserve is attached and our financial plan will be amended in due course. ALTERNATIVE: Council may wish to defer this project, hoping for improved pricing as the economy cools. This option was not recommended for two main reasons. Firstly, there is no guarantee that pricing will improve and may indeed become less favourable. Secondly, the improvements to the firehall are needed for operational reasons. CONCLUSION: The improvements will result in our main firehall being able to meet our needs well into the future. Further, the special attention to "green" initiatives will result in a building that our community can be pro of an a as a model for others.
