In the event the Owner has not performed all of the Remedial Action requirements within 30 days after notice of this resolution is delivered to the Owner, the City may, by its own forces or those of a contractor engaged by the City, enter the Property and perform the Remedial Action requirements. In the event the City takes the above referenced action, the City may recover the expense from the Owner, together with costs and interest, in the same manner as municipal taxes in accordance with sections 17, 258, and 259 of the Community Charter. BWSS provides education, advocacy, and support services to assist survivors of gender-based violence across B.C. We work from a feminist perspective to eliminate gender-based violence (GBV) and promote gender equity. For over forty years, we have been working towards ending violence against women, girls, femmes, LGBTQ2S and non-binary survivors of violence across the province. Our specialized services include crisis intervention, legal advocacy, long term counselling and support, and information and referral services to meet survivor’s individual complex needs. We also provide GBV prevention and intervention services, as well as community education & training programs to end gender-based violence. We are seriously concerned about the lack of a municipal plan to end gender-based violence. Gender-based violence has reached epidemic proportions around the world, leading to what the United Nations has called “a shadow pandemic.” In 2022, 184 women and girls were violently killed in Canada due to their gender. According to the Canadian Femicide Observatory for Justice and Accountability, this represents an alarming 27 percent increase when compared to 2019. Over the past five years, over 850 women and girls were killed in Canada. That means, on average, at least one person every two days in Canada is killed due to their gender. Additional statistics are equally alarming: • At least 19 percent of femicides in Canada in 2022 were of Indigenous women, despite Indigenous women comprising only 5 percent of the female population in Canada. • Home is often the most dangerous place for women, with 87 percent of gender-related homicides of women and girls occurring at a residence. • For five consecutive years, rates of reported family violence and intimate partner violence have been increasing across Canada. In the past 11 years, two-thirds of gender- related homicides were perpetrated by an intimate partner, 28 percent by a family member, 5 percent by a friend or acquaintance, and 1 percent by a stranger. • Women, youth, and children fleeing domestic, intimate partner, and/or family violence face huge barriers to safety. Over a 24-hour period in 2022, at least 571 women, youth and children across BC who are unsafe in their homes were unable to access life-saving Transition Housing Programs and PEACE Programs. In November 2022, federal, provincial, and territorial governments in Canada announced the endorsement of a 10-year National Action Plan to End Gender-Based Violence. Declaring gender-based violence to be “one of the most pervasive, deadly, and deeply rooted human rights violations of our time,” the National Action Plan is built on five key pillars that will be implemented through bilateral agreements based on regional realities: Support for victims, survivors and their families; Prevention; Responsive justice system; Implementing Indigenous- led approaches; and Social infrastructure and enabling environment. Like the closely aligned Missing and Murdered Indigenous Women, Girls, and 2SLGBTQQIA+ People National Action Plan, this National Action Plan requires a strong role for municipal governments. Municipal governments maintain jurisdiction over key public infrastructure and services, such as housing, transit, childcare, and public safety. Dozens of municipalities such as Toronto, Ottawa, and Renfrew County have recently made important declarations on gender- based violence as an epidemic; however, no municipality in B.C. has taken any similar steps. We call on you to develop a municipal action plan to end all gender-based violence. This requires a multi-stakeholder and intersectional response to identify core needs of survivors, with a particular emphasis on Indigenous, Black, newcomer immigrant/refugee, racialized, queer and trans, disabled, sex working, and rural survivors. It also requires a comprehensive plan across departments and organizations to ensure adequate housing, transition services, and wrap around supports for women, gender-diverse people, youth, and children fleeing violence. We strongly urge you to take immediate action on a municipal plan to end gender-based violence. The lives of many in your region depend on it. The subject site is bounded by single-family residential properties. The proposed lots will have access from Glenhurst Street. At this time the current application has been assessed to determine its compliance with the Official Community Plan (OCP) and provide a land use assessment only. Detailed review and comments will need to be made once the complete application packages have been received. A more detailed analysis and further reports will be required prior to second reading. Such assessment may impact proposed lot boundaries and yields, OCP designations and bylaw particulars, and may require application for further development permits. Any subdivision layout provided is strictly preliminary and could change after servicing details and analysis reports are reviewed. The final subdivision layout must be approved by the Approving Officer. d)PlanningAnalysis: Official Communiꢀ Plan: The OCP designates the subject property as Urban Residential - Neighbourhood Residential, and development of the property is subject to the Neighbourhood Residential Infill policies of the OCP. These policies require that development be compatible with the surrounding neighbourhood, with particular attention be given to site design, setbacks, and lot configuration with the existing pattern of development in the area. Under this designation and subject to Policy 3-19 (1)(a)ii, a rezoning from RS-1to R-4 is supportable as follows: notwithstanding item i above, RS-1 (Single Detached Residentiaꢀ zoned parent parcels that are unable to satisfy the 80% requirement may be eligible ꢁr R-4 (Single Detached (Infill) Urban Residential) zoning subject to satisꢂing Policy 3-21 Zoning Bylaw: The current application proposes to rezone the property located at 12035 Glenhurst Street from RS- 1 to R-4 (see Appendix C) to permit the subdivision of two lots (see Appendix D). The minimum lot area for the current RS-1 zone is 668.0 m2 (7,190 sq. ft.), and for the proposed R-4 zone is 450.0 m2 (4,844 sq. ft.). The minimum lot width for the proposed R-4 zone is 12.0 m (39 ft.) and the minimum lot depth is 24.0 m (79 ft.). The proposed subdivision meets the minimum lot area and lot width requirements of the R-4 zone, Proposed Lot A will be 509.67 m2 (5,486 sq. ft.) in size and proposed Lot B will 624.46 m2 (6,721 sq. ft.) in size. This will allow the property owner additional time to redeem their property from tax sale. RECOMMENDATION That Extension of Tax Sale Redemption Period Bylaw No. 7965-2023 be given first, second and third readings. DISCUSSION a) Background Context: Under the Local Government Act, the City conducts a tax sale each year and offers for sale by public auction any property on which taxes are delinquent. Delinquent taxes are unpaid property taxes from two years prior to the current year. On October 3, 2022 the property at 11655 Burnett Street sold by public auction at the tax sale due to delinquent taxes and the City, at a bid price of $50,000.00, was declared the purchaser. Under the Local Government Act, a property sold at tax sale may be redeemed by the owner within one year from the day of the annual tax sale, by paying the total of the upset price (full amount of delinquent taxes plus fees) and accrued interest. During the redemption period, the property continues to be assessed and taxed in the name of the registered owner. For the property at 11655 Burnett Street, the redemption period ends on October 3, 2023. The owner has retained an agent to come into good standing for their delinquent amount. At present, the full amount has not been paid but the agent is diligently working with City staff to address the balance. 3495856 Page 1 of 2 b) Discussion/ Analysis Section 660 (6) of the Local Government Act gives Council authority, by bylaw, to extend the redemption period by one year if the municipality is the purchaser. Staff recommends extending the redemption period by one year to give the registered owner another year to redeem the property. Under this bylaw, the redemption period would be extended until October 3, 2024. The owner still has time to redeem the property before the end of the current redemption period, but the extension would give the owner additional time to do so, and they have worked with the City in good faith to address the delinquent balance. c) Financial Implications: There are no financial implications for the City associated with this report or the proposed bylaw. The tax sale debt owed to the City is secured. The registered owner continues to be responsible for all financial liabilities associated with the property during the original and extended redemption periods. CONCLUSION The extension of the tax sale redemption period would give the property owner until October 3, 2024 to redeem their property from tax sale. Without the extension, the City will be required to take possession of their property after October 3, 2023.
