CALL TO ORDER – 7:00 pm The Mayor called the meeting to order and provided the land acknowledgement. The Corporate Officer explained the procedure and rules of order of the Public Hearing and advised that the bylaws will be considered at the next Council Meeting on March 26, 2024. The Mayor then called upon Planning Department staff to present the following items on the agenda: 2. BUSINESS

The subject application is to rezone the subject property from RS-3 (Single Detached Rural Residential) to RS-2 (Single Detached Suburban Residential), to permit the future subdivision of approximately fifteen single-family lots. An OCP amendment is required to redesignate portions of the subject properties from Suburban Residential to Park. The Corporate Officer advised this item was posted in the March 1st and March 8th, 2024, editions of the local newspaper and that 19 notices were mailed out and that 24 pieces of correspondence were received in relation to this application. The Manager of Development & Environmental Services gave a detailed presentation providing information on the application. The Mayor called for first round of public input. The Mayor called for second round of public input. Ken Holland, Maple Ridge resident, spoke in support noting Council looked at this RS-2 subdivision in 2009 and 2016 and both times both times upheld OCP policies in the suburban residential areas. Water is currently there, and the lots are all on septic so 100 years from now you could fit in more houses. Varying house and lot sizes are an advantage, the lots are strata so the City would not have to maintain nor clean the streets, and this item should not be here due to a clerical error. The Mayor called for a third round of public input. There being no further comment, the Mayor declared the Public Hearing on this item closed. 2.2 Application 2023-373-RZ Units 102, 104, 106 and 116 – 22633 Selkirk Avenue Lot 4 District Lot 401 Group 1 New Westminster District Plan EPP65496 The subject application is to allow an accessory pharmacy use in a proposed new medical clinic/pharmacy in Phase 4 of the Brickwater Building. The Corporate Officer advised this item was posted in the March 1st and March 8th, 2024, editions of the local newspaper and that 522 notices were mailed out and that 3 pieces of correspondence was received in relation to this application.

The Manager of Development & Environmental Services gave a detailed presentation providing information on the application. The Mayor called for first round of public input. James Kim, Surrey resident, works at the other pharmacy in Brickwater building in Phase 1, spoke in opposition, as there was a bylaw implemented just two years ago to prevent this happening and this sets a precedent in a couple of years for other pharmacies or another business coming back seeking bylaw amendments and coming back to Public Hearing. There are 10 other pharmacies within 400 meters and this bylaw is in place for reason. The Mayor called for second round of public input. Christine Ferguson, Maple Ridge resident, resides in same complex and questioned if parking would be available for a walk-in clinic along with the traffic impact for the pharmacy. There is already a pharmacy in the same complex and 4 to 5 walk-in clinics in close proximity in the neighbourhood, including an emergency clinic across the street. Parking and traffic issues are not advantageous to other residents in the building. Karim Gulrani, operates a clinic on 227 Street for the last 6 years, spoke in opposition as this bylaw is already implemented. The Mayor called for a third round of public input. Dr. Nageswara Kolla, Maple Ridge resident, spoke in support as he is a physician working at another clinic in that building for the last 3 years. When he started in Maple Ridge he brought in 3 physicians and has 4 more coming from the UK, but are struggling in current space which is why they chose to find more space. This space is good for almost 8 to 10 physicians and thought a pharmacy was a good idea so they can have a pharmacist on site. They have parking for employees and will be leasing space from the strata and for public there is ample space being built so that shouldn’t be a problem. Sandeep Nimmagadda, Surrey resident, spoke in support as he is the pharmacist owner for the proposed site. The building is commercial if there was no pharmacy or walk in another business occupy the site and they would have to deal with parking and they are currently in conversations with the strata about leasing parking. The Bylaw was initially implemented because of OAT to restrict pharmacies and the number of methadone users in community which are creating a nuisance by throwing trash and discarding needles. They will not have OAT treatment and will opt out when they apply for the licence to the College of Pharmacists of BC. Dr. Nageswara Kolla, noted the clinic will have two more specialists so it’s not just primary care. There will be specialists from US or UK, with many physicians retiring in Maple Ridge this will benefit the population. There being no further comment, the Mayor declared the Public Hearing on this item closed.

WHEREAS Section 4 77 of the Local Government Act provides that the Council may revise the Official
Community Plan;
AND WHEREAS it is deemed expedient to amend Schedule 11B11 to the Official Community Plan;
NOW THEREFORE, the Municipal Council of the City of Maple Ridge, enacts as follows:

EXECUTIVE SUMMARY:
An application has been received to rezone the subject properties, located at 11795 and 11839 267 Street,
from RS-3 (Single Detached Rural Residential) to RS-2 (Single Detached Suburban Residential), to permit a
future subdivision of approximately fifteen single-family lots. The minimum lot size for the proposed RS-2
zone is 1 acre (0.4 ha).
This application was granted third reading on July 26, 2022. Since third reading of the application, it was
noted that the second reading report did not reflect the required environmental dedication to provide
acceptable environmental protection to a Kanaka Creek mainstem (Pokey Creek) and Kanaka Creek
Regional Park. Due to this significant change to the Park -Conservation area, which impacts the land use,
the Official Community Plan and Zone Amending Bylaws are required to be amended and the application
must return to Public Hearing. As such, it is recommended that _second and third readings of the Bylaws
be rescinded, and that Official Community Plan Amending Bylaw No. 7834-2022 as amended, be granted
second reading and be forwarded to Public Hearing and Zone Amending Bylaw No. 7539-2079 as
amended, be granted second reading and forwarded to Public Hearing.
Changes to the application from the second reading report and as presented at the July 19, 2022 Public
Hearing include: an expanded environmental Park -Conservation area along the southeast and southern
portions of 11975 267 Street, a decrease in bare land strata lots from 12 lots to 11 lots, and an increase in
fee-simple lots from 3 to 4 lots. The total number of lots proposed in this development is unchanged at
15 single-family lots. The draft subdivision plan and number of lots provided in this report is preliminary
and is subject to change until final subdivision approval by the Approving Officer.
RECOMMENDATIONS:
1. That, in accordance with Section 475 of the local Government Act, opportunity for early and
on-going consultation has been provided by way of posting Official Community Plan
Amending Bylaw No. 7834-2022 on the municipal website, and Council considers it
unnecessary to provide any further consultation opportunities, except by way of holding a
Public Hearing on the bylaw;
2. That second and third readings of Official Community Plan Amending Bylaw No. 7834-2022 be
rescinded;

6. That Council authorize the applicant to proceed with municipal approved streamside servicing
& restoration related works in and around the watercourse(s) in advance of final reading of
Zone Amending Bylaw No. 7539-2019 and in advance of issuance of a Watercourse Protection
Development Permit. These works must be in compliance with Provincial environmental agency
requirements, their review process & all potential approval requirements. This is in addition to
all approved municipal watercourse protection development permit conditions and drawings
following third reading. Should Council authorization be granted, it is subject to the following
conditions to the acceptance of the Director of Planning:
i. Approval of final servicing design drawings by City staff;
ii. Approval of final dedicated areas, as confirmed by a survey sealed a BC Land Surveyor
for conservation purposes & approved restrictive covenants for the Protection of
Environmental Setback Areas (ESA);
iii. Written confirmation, designation and supervision of the Qualified Environmental
Professional (QEP) for the duration of streamside works acknowledging that the QEP
has the authority to stop any work(s) that, in the opinion of the QEP, have the potential
to negatively impact the health and functionality of ESA areas;
iv. Receipt of a letter of confirmation from the applicable senior environmental agencies
that they are satisfied with the proposed works including the approved servicing plans;
v. Receipt of a letter of confirmation from the applicant assuming all risk associated with
the related streamside works;
vi. Receipt of Watercourse Protection Development Permit securities for enhancement and
restoration works; and
vii. Commencement of accepted enhancement and restoration works within 30 days of
Environmental Setback Areas disturbance.
7. That the following terms and conditions be met prior to final reading:
i. Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt
of the deposit of a security, as outlined in the Agreement;
ii. Road dedication and upgrading to the Rural Local Road standard, on 118 Avenue and
267 Street, as required;
iii. Road dedication and cash-in-lieu of constructing the future road going north-south
along the west side of Proposed Fee-Simple Lot 4 (future 266A Street);

iv. Park dedication as required, including construction of walkways; and a letter
confirming removal of all debris and garbage from park land;
v. Consolidation of the properties;

vii. Registration of a Restrictive Covenant for the protection of an Agricultural Landscape
Buffer adjacent to Agricultural Land Reserve lands to the west;
viii. Registration of a Statutory Right-of-Way plan for a municipal storm sewer;
ix. Registration of a Restrictive Covenant for Tree Protection;
x. Registration of a Restrictive Covenant for Stormwater Management;
xi. Registration with Fraser Health for septic disposal, and registration of a Restrictive
Covenant for the protection of the septic field areas;
xii. Registration with the Ministry of Environment Water Protection and Sustainability
Branch for water wells;
xiii. A Professional Engineer's certification that adequate water quantity for domestic and
fire protection purposes can be provided;
xiv. In addition to the Ministry of Environment Site Disclosure Statement, a disclosure
statement must be submitted by a Professional Engineer advising whether there is any
evidence of underground fuel storage tanks on the subject properties. If so, then a
Stage 1 Site Investigation Report is required to ensure that the subject properties are
not contaminated sites; and
xv. That a voluntary contribution be provided, in keeping with the Council Policy 6.31 with
regard to Community Amenity Contributions.

The subject properties, located at 11795 and 11839 267 Street, are designated Suburban Residential (see
Appendix A, B, and C for maps). 11795 267 Street borders Kanaka Creek Regional Park/Agricultural Land
Reserve lands along the western property line and Kanaka Creek Regional Park also intersects at the
southeast corner. A mainstem watercourse to Kanaka Creek traverses the subject properties along the
eastern edge. The subject properties are within the vicinity of the Whonnock Aquifer.
This rezoning application proposes a 15 lot subdivision of RS-2 (Single Detached Suburban Residential)
lots, 4 of which will be fee-simple lots, and 11 will be bare land strata lots. Each of the two subject
properties currently has an existing house, and both dwellings are proposed to be retained with this
proposal.
The proposed road layout for this development will enable the development potential for adjacent
properties that are also designated Suburban Residential as indicated on the attached draft Subdivision
Plan (Appendix D) via future 266A Street.

2. Background
The amendments to Zone Amending Bylaw No. 7539-2079 and Official Community Plan Amending Bylaw
No. 7834-2022 to reflect the required environmental dedication to provide an acceptable environmental
protection to the Kanaka Creek mainstem watercourse (Pokey Creek), Kanaka Creek Regional Park, and
significant slopes on the property, are illustrated as follows. The lands identified are required to be
dedicated to the City as Park as a condition of this Rezoning application.

Due to the changes in the Park dedication boundaries the number of bare land strata lots has decreased
from the original second reading report from 12 lots to 11 lots. A fourth fee-simple lot has been included
in this proposal which was previously indicated as a future lot. The total number of lots proposed in this
development is unchanged from the original proposal at 15 single-family lots.
3. Planning Analysis:
i) Official Community Plan (OCP):
The subject properties are currently designated Suburban Residential, the Suburban Residential
designation supports the proposed RS-2 zone. The RS-2 zone permits a single detached
residential use in locations outside of the Urban Area Boundary, that may have municipal water
service but which are not connected to the municipal sanitary sewer system. An OCP amendment
is required to amend the Park boundary (see Official Community Plan Amending Bylaw No. 7834-
2022 as Appendix E).

Zoning Bylaw:
The application proposes to rezone the subject properties to RS-2 (Single Detached Suburban
Residential) to permit a future subdivision of 15 single-family lots, consisting of 4 fee-simple lots
and 11 bare land strata lots (see Zone Amending Bylaw No. 7539-2019 as amended as Appendix
F). Zoning Bylaw regulations for the RS-2 zone include a minimum lot area of 1 acre (0.4 ha), lot
width of 36.0m and lot depth of 60.0m. The number of lots and final subdivision layout may be
different than shown in this report after further technical review, the final subdivision plan is
subject to the approval of the City's Approving Officer.
Proposed Variances:
A Development Variance Permit application will be required for all requested variances to the
regulations of the RS-2 zone in the Zoning Bylaw. The requested variances will be the subject of a
future Council report.
Development Permits:
Pursuant to Section 8.9 of the OCP, a Watercourse Protection Development Permit application is
required for all developments and building permits within 50 metres of the top of bank of all
watercourses and wetlands. The purpose of the Watercourse Protection Development Permit is to
ensure the preservation, protection, restoration and enhancement of watercourse and riparian
areas.
An application for a Watercourse Protection Development Permit has been submitted and is
under review by Environment staff. Protection of environmentally sensitive areas (watercourse and
steep slopes), park dedication, pervious areas and stormwater management must be incorporated
into the site design (see Appendix G).
As part of the Watercourse Protection Development Permit, the Qualified Environmental
Professional (QEP) must provide a final cost estimate for the enhancement and restoration plan,
including the invasive management plan and maintenance/monitoring. A security deposit is
required for these works.
Development Information Meeting:
Due to COVID related restrictions at the time, a public comment opportunity was presented in
lieu of an in-person Development Information Meeting. Between December 8 and December 20,
2021, seven participants provided feedback (see Appendix G).
A summary of the main comments was provided by the applicant:
• Traffic impact to the rural neighbourhood, by new residents driving to/from work;
• Light impact by the light fixtures on and in the dwellings; and
• Seeking clarification If this development has any impact to the regional park.
The following responses were provided by the applicant in response to the issues raised by the
public:

• Not disputing traffic impact. Clarification was provided that the feedback will be
forwarded on to Council for further consideration;
• Lighting will mostly be centered around the dwelling units on the lots, and a
natural buffer will be created towards the park area; and
• Clarification was provided on the implemented buffers along the perimeter, and
no comments were received after.
Parkland Requirement:
As there are more than two additional lots proposed to be created, the developer is required to
comply with the park dedication requirements of Section 510 of the Local Government Act prior to
subdivision approval. Dedication of Park lands as a fee-simple lot(s) to the City is required as a
condition of final reading of the rezoning bylaw.
4. Agricultural Impact:
Agricultural lands are adjacent to the development site on the west side of 11795 267 Street. A 15m wide
buffer zone must be provided along the west property line of proposed bare land strata lots 1 to 5 in
respect of the agricultural lands. The buffer is in accordance with best practices on development adjacent
to agricultural lands. This vegetated agricultural setback area will be required to be placed into a
Restrictive Covenant, including appropriate fencing and signage for the boundary.

Interdepartmental Implications:
Engineering Department:
The Engineering Department has indicated that the following servicing upgrades will be required
through the Rezoning Servicing Agreement:
a) Road dedication and upgrading to the Rural Local Road standard on 118 Avenue and 267
Street, as modified to include a roadside trail along 118 Avenue, to meet the design
criteria of the Subdivision and Development Bylaw No. 4800-7 993;
b) Road dedication and cash-in-lieu of constructing the future road going north-south along
the west side of Proposed Fee-Simple Lot 4 (future 266A Street);
c) Utility servicing as required to meet the design criteria of the Subdivision and Development
Servicing Bylaw No. 4800-7993; and
d) Frontage upgrades to the applicable road standard.
Parks. Recreation and Culture Department:
A trail connection is required along 118 Avenue in coordination with Metro Vancouver Parks, to
provide access to future trails within Kanaka Creek Regional Park. Additional park dedication has
been provided along the top of bank of Kanaka Creek to provide stronger protections and potential
for future trail connections.

The riparian area and watercourse along and near the junction of the Kanaka Creek mainstem on
the subject properties is considered to be of high significance to the City. There are also concerns
about steeper slopes and geotechnical buffer zones along the top of bank and ravine bank adjacent
to the Kanaka mainstem and Pokey Creek on the southern half of the site. To address these
concerns a combination of restrictive covenant and environmental dedication will be used to
provide greater protection around the more sensitive areas located on site and better tree retention
on the south side of the site near the boundary of the Kanaka Creek Park area. The environmental
dedication along the entire southern portion of the site and portions of the east side is to ensure
these areas receive greater protection given its proximity to the Kanaka Creek Regional Park area
boundary. Careful management of drainage volumes and flows on-site will reduce potential risks
and impacts to the sensitive areas.
This site is located on the Whonnock Aquifer, a ground water impact assessment will be required at
the Subdivision stage to ensure protection of existing area wells and ground water.
Intergovernmental Implications:
Metro Vancouver:
Due to the Metro Vancouver owned lands adjacent to the subject properties this application was
referred to Metro Vancouver for comment. Metro Vancouver staff provided their comments on the
proposal which have been incorporated into the City's environmental and park requirements for the
application.
Local Government Act:
An amendment to the OCP requires the local government to consult with any affected parties and
to adopt related bylaws in compliance with the procedures outlined in Section 477 of the Local
Government Act. The amendment for new Park boundary as required for this application, is
considered to be minor in nature. It has been determined that no additional consultation beyond
existing procedures is required, including referrals to the Board of the Regional District, the Council
of an adjacent municipality, First Nations, the School District or agencies of the Federal and
Provincial Governments.
iii) School District No. 42:
Pursuant to Section 476 of the Local Government Act, consultation with School District No. 42 is
required at the time of preparing or amending the OCP. The referral response from School District
No. 42 received on February 21 , 2024 (attached as Appendix I) provides the impacts of the
proposed application on the catchment area schools -Webster's Corner Elementary and Garibaldi
Secondary which are currently at 71% and 96% utilization respectively.

CONCLUSION:
It is recommended that second and third reading of Official Community Plan Amending Bylaw No. 7834-
2022, and Zone Amending Bylaw No. 7539-2079 be rescinded. Further, it is recommended that second
reading be granted to Official Community Plan Amending Bylaw No. 7834-2022 as amended and Zone
Amending Bylaw No. 7539-20 79 as amended, and that application 2019-055-RZ be forwarded to Public
Hearing, and that the applicant be authorized to proceed with streamside works in and around the
watercourse(s) in compliance with Provincial environmental agency requirements and all approved
watercourse protection development permit drawings, following third reading of the application.

proposeto.develop.ar~ about-9 kms from downtown M9ple Ri_dge {as the crow flies:), and the nearest .supermarket ]s a G
km drive away. There aren't any other amenities nearby·and anywhere that the re~idents oi this subdivi~ion need to _go,
they need to drive.
Furthermore, Whattends to happen with 1 acre lot subdivisions, much of the area will be cleared of trees and sµrubs ·to
make·way .for'-exp·ansive ;lawns, which often tend to be·m0wecd.-and watered. Trees .are carbon sfnks .and should be
preserved as niuch as possible. Mowing.-lawns:is a wasteful use of ,energy, ·and watering lawns is .a-Very wasteful use ,of
wat~r'in-periods of..drci~fj'ht. We are being told that we .should exped:increasingly ·drier and hotter·summers, so·{his is a
bad .idea.

EXECUTIVE SUMMARY:
On April 26, 2022, Council adopted Zone Amending Bylaw No. 7790-2021 which prohibits pharmacies as
an accessory use in commercial establishments within the Town Centre Area which have a Gross Leasable
Area less than or equal to 700 m2 (7,535 ft2). The subject application proposes a site-specific text
amendment to that regulation to allow an accessory Pharmacy use in a proposed new medical
clinic/pharmacy in the Phase 4 of the Brickwater Building located at Units 102, 104, 106 and 116 -22633
Selkirk Avenue.
The proposed medical clinic/pharmacy is approximately 436 m2 (4,690 ft2) in size and will initially be
staffed with 4-5 general practitioners with future plans for a walk-in clinic and family practice. The
accessory Pharmacy use will be located next to the medical clinic and is accessible via the medical clinic
and an exterior entrance.
There are currently ten pharmacies located within 400 m of the subject property, including one existing
pharmacy located within the Brickwater Building. Much of the growth in Maple Ridge is targeted for the
Town Centre Area and the area has experienced, and will continue to experience, a significant amount of
redevelopment bringing an increase in residential population in the area who will require access to health
services.
RECOMMENDATION:
That Zone Amending Bylaw No. 7982-2024 be given first and second reading, and be
forwarded to Public Hearing.

Amendments to the Zoning Bylaw to address Council's concerns regarding the number of pharmacies
within the community began during the September 14, 2021 Council Meeting when a notice of motion
was put forward to request the options available to Council to limit pharmacies in the Town Centre Area.
This notice of motion was discussed by Council during the September 28, 2021 Council Meeting at which
time Council directed staff to hold pharmacy related applications in abeyance pending the review of a
staff report and bylaw to limit Pharmacy use in the Town Centre.
At the November 2, 2021 Council Workshop, staff presented a report outlining four possible options to
regulate pharmacy use in the City, and provided Zone Amending Bylaw No. 7790-2021 to limit the
proliferation of pharmacies for Council consideration at the February 15, 2022 Committee of the Whole
Meeting. Staff provided additional regulatory land use options at the March 1, 2022 Committee of the
Whole Meeting in response to Council's comments during the February 15, 2022 meeting.
Zone Amending Bylaw No. 7790-2021 received first and second reading on March 8, 2022, went to Public
Hearing on April 19, 2022, and was adopted by Council on April 26, 2022. Zone Amending Bylaw
No. 7790-2027 made the following amendments to the City's Zoning Bylaw:
1. Introduction of the definition of "Pharmacy".
2. Prohibits Pharmacy as a Principal Use.
3. Permits Pharmacy as an Accessory Use within the Town Centre Area when the commercial
establishment has a Gross Leasable Area greater than 700m2 {7,535 ft2).
4. Prohibits Pharmacy as an Accessory Use within the Town Centre Area when the commercial
establishment has a Gross Leasable Area less than 700m2 (7,535 ft2).
5. Permits Pharmacy as an Accessory Use outside of the Town Centre Area if located more
than 400m to another Pharmacy use.
3. Project Description:
The proposed medical clinic/pharmacy will occupy approximately 436 m2 (4,690 ft2) within four
commercial units of Phase 4 of the Brickwater Building currently under construction (see Appendix A & B
for subject maps). Initially the clinic will be staffed with 4-5 general practitioners, with a long-term vision
to accommodate 6-7 general practitioners providing a comprehensive range of services, including both a
walk-in clinic and family practice.

Planning Analysis:
Official Community Plan:
The City's Official Community Plan and Town Centre Area Plan include policies that speak to the priority
function of commercial uses that support the residential population of the Town Centre with the provision
of necessary services, such as medical care, and that these uses will be encouraged to develop or remain
in and around the Central Business District of the Town Centre.
ii) Zoning Bylaw:
Section 402.28 of Zoning Bylaw No. 7600-2019 prohibits Pharmacy as an accessory use in a commercial
establishment within the Town Centre Area that has a gross leasable area of less than 700 m2 (7,535 ft2).
The subject properties are located within the Town Centre Area and have a gross leasable area less than
700 m2 (7,535 ft2). Proposed Zone Amending Bylaw No 7982-2024 is a site-specific text amendment to the
Zoning Bylaw to allow an accessory Pharmacy use at the subject property's location. The proposed Bylaw
applies to the property and is not tied to a specific owner or operator.
There are ten pharmacies located within 400 m of the subject property's location as shown on the map
included as Appendix D. Of those ten pharmacies located within 400 m, one pharmacy is located in
the Brickwater Building, and three others located within 100 m of the subject property.
Five of the pharmacies in the Town Centre Area are attached to big box retailers including Shoppers Drug
Mart, Walmart, Save on Foods, No Frills, and London Drugs. The Zoning Bylaw does not prohibit
pharmacies within the Town Centre Area if they are within a commercial establishment with a Gross
Leasable Area greater than 700 m2 (7,535 ft2), such as a big box retailer. Given the proposed pharmacy is
paired with a medical clinic in a location needing such services, staff support the proposed Zoning Bylaw
amendment.
CONCLUSION:
It is recommended that first and second reading be given to Zone Amending Bylaw No. 7982-2024, and
that application 2023-373-RZ be forwarded to Public Hearing.

WHEREAS, it is deemed expedient to amend the Maple Ridge Zoning Bylaw No. 7600-2019, as
amended from time to time:
NOW THEREFORE, the Council of the City of Maple Ridge, enacts as follows:
1. This Bylaw may be cited as "Maple Ridge Zone Amending Bylaw No. 7982-2024".
1. That PART 4 -GENERAL REGULATIONS, Section 402.28.1.b. be amended as follows:
a. By adding the following additional text to Section 402.28.1.b immediately after the
clause:
An Accessory Pharmacy use in a Commercial establishment with a Gross Leasable
Area less than 700 square metres is permitted, specific to the following Lot and
address within the Town Centre Area:
Lot 4 District Lot 401 Group 1 New Westminster District Plan EPP65496, PID 030-
163-641. Unit 102, 104, 106 and 116 -22633 Selkirk Avenue.
2. The Maple Ridge Zoning Bylaw No. 7600-2019 is hereby amended accordingly.
