Maple Ridge Official Community Plan Amending Bylaw No. 72652016 Maple Ridge Zone Amending Bylaw No. 72662016 RECOMMENDATION: That Official Community Plan Amending Bylaw No. 72652016 be adopted; and further That Zone Amending Bylaw No. 72662016 be adopted. 9.2 2022326RZ, 12050 York Street, RS1 to RT1 To allow for the future construction of a duplex. RECOMMENDATION: 1. That Zone Amending Bylaw No. 79022023 be given second reading, and be forwarded to Public Hearing; 2. That the following terms and conditions be met prior to final reading: i. Road dedication on York Street as required; ii. Registration of a Restrictive Covenant for Duplex Design; iii. Registration of a Restrictive Covenant for Stormwater Management; iv. Removal of existing building; v. If the Director of Waste Management from the Ministry of Environment determines that a site investigation is required based on the submitted Site Disclosure Statement, a rezoning, development, or development variance permit cannot be approved until a release is obtained for the subject property; vi. In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject property. If so, a Stage 1 Site Investigation Report is required to ensure that the subject property is not a contaminated site. vii. EXECUTIVE SUMMARY Amendments are proposed to Metro 2050 that will better align its land use designations with the Metro Vancouver Regional District Board-adopted 2018 Electoral Area A Official Community Plan Bylaw that applies to the majority of the rural and remote portions of the Electoral Area (excluding UBC, UEL, Bowyer Island, Passage Island, and First Nation reserve lands). Staff have identified Metro 2050 regional land use designation changes to ninety-two parcels for the MVRD Board's consideration. These proposed amendments are consistent with Metro 2050's goals and strategies, and bring the Metro 2050 and OCP land use designations into closer alignment. They do not alter the intent of Metro 2050. These changes are based on a detailed review of the OCP designations relative to Metro 2050 regional land use designations and mapping improvements in the rural and remote reaches of the Electoral Area A. Given the nature of the changes, both Type 2 and Type 3 amendments to Metro 2050 are required. As a result, two separate amendment bylaws are provided to the Committee and Board for consideration. The first requires adoption with a weighted 2/3 majority of the Board and the second requires adoption by a weighted 50%+1 vote of the Board. PURPOSE To provide the Regional Planning Committee and the MVRD Board an opportunity to consider amendments to align regional land use designations with those in the 2018 Electoral Area A Official Community Plan. Page 197 of 225 BACKGROUND In 2018, following a two-year public engagement process, the MVRD Board adopted the first-ever Official Community Plan (OCP) for approximately 500 rural and remote properties in Electoral Area A (excludes UBC, UEL and First Nation Reserves). During the development of the OCP, staff recognized the need for alignment and consistency between Metro 2040 and the OCP. Since mapping corrections were not entertained during the Metro 2050 update, several Metro 2040 Electoral Area Land Use Designation inconsistencies were carried forward to Metro 2050. Hence, a batch of Metro 2050 amendments is proposed to correct these inconsistencies. LOCAL PLANNING IN RURAL AND REMOTE PORTIONS OF ELECTORAL AREA A Metro Vancouver provides the local planning function for the rural and remote communities in Electoral Area A (excluding UBC, UEL and First Nation Reserves). Approximately 500 properties located within these communities include permanent residences, seasonal homes and vacant forested lots. The communities include the northern reaches of Indian Arm; the west side of Pitt Lake; Howe Sound mainland (lots between the District of West Vancouver and the Village of Lions Bay; and north of the Village of Lions Bay); and Barnston Island. Legislative Context Under section 446 of the Local Government Act (LGA), municipalities are required to prepare a Regional Context Statement (RCS) that shows how their OCP is consistent with the regional growth strategy (where one exists). The municipality's RCS has to be accepted by the regional district board. This same requirement does not apply to OCPs for electoral areas because the regional district board is the decision making body for both the OCP and the regional growth strategy. There is, however, a bylaw consistency requirement that regional districts must adhere to under section 445 of the LGA: 445 (1) All bylaws adopted by a regional district board after the board has adopted a regional growth strategy, and all services undertaken by a regional district after the board has adopted a regional growth strategy, must be consistent with the regional growth strategy. To address this requirement, the Electoral Area A OCP contains a regional growth strategy alignment section describing how the OCP bylaw is consistent with the regional growth strategy. PROPOSED METRO 2050 LAND USE DESIGNATION AMENDMENTS To correct historical imprecise mapping data, Metro Vancouver undertook a major upgrade of its digital parcel mapping during the development of the Electoral Area A OCP. Staff worked closely with provincial staff at GeoBC, Metro Vancouver's Real Estate Services, and the public to update mapping and establish a consistent set of OCP land use designations. These corrections resulted in some inconsistencies between the regional growth strategy and Electoral Area A OCP land use designations and the current need to amend Metro 2050 mapping. In total, the land use designations of ninety-two parcels were identified as being inconsistent. The map below identifies the general location of these lands. These include small and large parcels along the Howe Sound Mainland (30 parcels); Northern reaches of Indian Arm and the Indian River Valley (23 parcels); and, the West side of Pitt Lake and the northern reaches of the Widgeon Area (20 parcels). The permitted land uses on these parcels (e.g. residential cabins) most closely align with the Metro 2050 regional Rural land use designation. Three parcels (6.1 ha) -proposed amendment from Agricultural to Conservation and Recreation. These parcels on Barnston Island were purchased by Metro Vancouver Regional Parks after Metro 2040 was adopted. Metro Vancouver Regional Parks owns and operates a few parks within the ALR that are currently designated as Conservation and Recreation e.g. Brae Island Regional Park and Aldergrove Regional Park. This amendment would increase consistency. Page 199 of 225 Type 3 Amendment (maps in Attachment 2) • 15 parcels (10.1 ha) -proposed amendment from Rural to Conservation and Recreation. These parcels (two in Howe sound, seven on Indian Arm and six on the west side of Pitt Lake) have a Natural Resource or Park OCP Designation (e.g. Crown lands, BC Park and BC Rail parcels) but have no residential leases and have a Metro 2050 Rural designation currently. • One parcel (1.5 ha) -proposed amendment to designate one parcel as Rural. This privately- held Boulder Island parcel currently has a Rural OCP Designation and has no Metro 2050 Designation. This parcel most closely aligns with Metro 2050 Rural land use designation. These proposed amendments are consistent with Metro 2050's goals and strategies and generally align pre-existing low density residential uses (frequently water access only) in Electoral Area A with Metro 2050. There are also a limited number of undeveloped private parcels which were identified as rural in the OCP process that align best with the Rural land use designation in Metro 2050. Parcels that are proposed to be changed from Rural to Conservation and Recreation or from no designation to Rural are considered a Type 3 amendment, under Metro 2050 section 6.3.4 d) and 6.3.4 m) respectively. Sixteen parcels are identified as a Type 3 amendment, which requires an amendment bylaw passed by an affirmative 50% + 1 weighted vote of the Metro Vancouver Regional District Board. NEXT STEPS If the amendments are initiated and the associated bylaw receives 1st, 2nd, and 3rd readings, they will then be referred to affected local governments, local First Nations and relevant agencies, as well as posted on the Metro Vancouver website for a minimum of 45 days to provide an opportunity for comment. Metro 2050 identifies additional public engagement opportunities that may be used at the discretion of the MVRD Board including: appearing as a delegation to the Regional Planning Committee or the MVRD Board when the amendment is being considered; conveyance of comments submitted from the respective local public hearing to the MVRD Board, and hosting a public information meeting (digitally or in person). All comments received will be summarized and included in a report advancing the bylaw to the MVRD Board for consideration of final adoption. ALTERNATIVES 1. That the MVRD Board: a) initiate the Metro 2050 Type 2 and Type 3 amendment processes to reflect the Electoral Area A Official Community Plan; b) give first, second, third readings to "Metro Vancouver Regional District Regional Growth Strategy Amendment Bylaw No. 1378, 2024"; c) give first, second, third readings to "Metro Vancouver Regional District Regional Growth Strategy Amendment Bylaw No. 1379, 2024"; and d) direct staff to notify affected local governments as per section 6.4.2 of Metro 2050. 2. That the MVRD Board decline the proposed amendments to Metro 2050 to reflect the Electoral Area A Official Community Plan and provide alternate direction to staff. FINANCIAL IMPLICATIONS There are no financial implications associated with this report. CONCLUSION A batch of amendments to Metro 2050 land use designations are proposed that reflect mapping corrections and land use designation changes associated with the 2018 Electoral Area A Official Community Plan. These amendments ensure consistency between the Electoral Area A Official Community Plan and Metro 2050. The proposed amendments are considered to be consistent with Metro 2050 and do not impact its five goals. Ninety-two parcels are proposed to be amended, with seventy-six parcels as a Type 2 amendment and 16 parcels as a Type 3 amendment to Metro 2050. Metro 2050 contains six regional and parcel based land use designations that support those objectives. By signing on to Metro 2050, if a member jurisdiction aspires to change the regional land use designation for a site then, as part of the process, they have agreed to have the Metro Vancouver Board consider any regional implications of the proposed amendment. Metro 2050 outlines the process for proposed amendments. Over the first year since Metro 2050 was adopted on February 24, 2023, Metro Vancouver staff identified some minor inconsistencies in terminology, formatting, numerical references, and mapping that are proposed to be corrected through a Type 3 amendment. The proposed amendment also includes mapping revisions that stem from MVRD Board-accepted regional context statements, regional land use designation amendments made under the municipal flexibility clause, updates to Metro 2050 reference maps based on new data (e.g., new sensitive ecosystem inventory map) and corrections to map text and designation boundaries. The proposed revisions are administrative in nature, and do not alter the intent of Metro 2050. This amendment is an administrative amendment intended to ensure that Metro 2050 contains the most current and correct maps and text. Mayor Dan Ruimy and Council, City of Maple Ridge Metro 2050 Type 3 Proposed Amendment to Reflect Accepted Regional Context Statements and Correct Minor Errors Page 2 of 2 66164757 At its February 23, 2024 regular meeting, the Board of Directors of the Metro Vancouver Regional District (MVRD) adopted the following resolution: That the MVRD Board: a) initiate the Metro 2050 amendment process for the Metro 2050 Type 3 Amendment to reflect accepted regional context statements and correct minor errors; b) give first, second, and third readings to “Metro Vancouver Regional District Regional Growth Strategy Amendment Bylaw No. 1380, 2024”; and c) direct staff to notify affected local governments as per section 6.4.2 of Metro 2050. As required by both the Local Government Act and Metro 2050, the regional growth strategy amendment process requires a minimum 45-day notification period to allow all affected local governments, First Nations, and members of the public to provide comment on the proposed amendment. Following the comment period, the MVRD Board will review all comments received and consider adoption of the amendment bylaw. The applicant has satisfied all of the terms and conditions set by Council; however, the environmental protection covenant is no longer necessary because the Watercourse Protection Development Permit being issued gives sufficient protection. Official Community Plan Amending Bylaw No. 7265-2076 is to amend the Albion Area Plan to redesignate the portion of the site designated as Institutional on the subject property, that is not intended to be developed as a school site to Low/Medium Density Residential. Zone Amending Bylaw No. 7266-2076 is to rezone from the RS-3 (Single Detached Rural Residential) Zone to the RS-1 b (Single Detached (Medium Density) zone. Council granted first reading for Zone Amending Bylaw No. 7266-2076 on September 20, 2016. Council granted first and second reading for Official Community Plan Amending Bylaw No. 7265-2076 and second reading for Zone Amending Bylaw No. 7266-2076 on September 28, 2021 (see Appendices B and C). This application was presented at Public Hearing on November 16, 2021, and Council granted third reading on November 23, 2021. The purpose of the application is to permit subdivision into ten lots of not less than 371 square metres, based on the application of the Density Bonus provision regulation of the proposed zone. (see Appendix D). RECOMMENDATIONS: 1. That Official Community Plan Amending Bylaw No. 7265-2016 be adopted; and 2. That Zone Amending Bylaw No. 7266-2016 be adopted. 2016-238-RZ Page 1 of 3 DISCUSSION: a) Background Context: Council considered this rezoning application at a Public Hearing held on November 16, 2021. On November 23, 2021, Council granted third reading to Official Community Plan Amending Bylaw No. 7265-2076 and Zone Amending Bylaw No. 7266-2076 with the stipulation that the following conditions be addressed: i) Amendment to Official Community Plan Schedule "A", Chapter 10.2 Albion Area Plan, Schedule 1: Albion Area Plan; Staff comment: The amending bylaw may be adopted with the zone amending bylaw. ii) Road dedication as required; Staff comment: The required subdivision plan has been submitted to be approved by the Approving Officer and registered by the applicant's legal counsel by Letter of Undertaking. iii) Park dedication as required, including construction of walkways, multi-purpose trails; and removal of all debris and garbage from park land; Staff comment: This is reflected in the above cited plan to be approved by the Approving Officer and registered at the Land Titles Office by the applicant's legal counsel through a Letter of Undertaking. iv) Registration of a Restrictive Covenant for the Geotechnical Report, which addresses the suitability of the subject property for the proposed development; Staff comment: This covenant is to be registered at the Land Titles Office by the applicant's legal counsel through a Letter of Undertaking. v) Registration of a Restrictive Covenant for the protection of the Environmentally Sensitive areas (wetlands) on the subject property; Staff comment: Securities being held by the City for the Watercourse Protection Development Permit have been determined to be adequate compensation and this covenant is no longer necessary to be registered at the Land Titles Office. vi) Registration of a Restrictive Covenant for Stormwater Management; Staff comment: This covenant is to be registered at the Land Titles Office by the applicant's legal counsel through a Letter of Undertaking. vii) Removal of existing building/structures; Staff comment: The demolition of the existing building/structures is under way. 2016-238-RZ Page 2 of 3 viii) In addition to the site profile, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject property. Council granted first reading to Zone Amending Bylaw No. 7902-2023 on February 28, 2023. This rezoning application is being considered for second rea ding and forward to Public Hearing as the applica tion was received prior to July 25, 2023 when Development Procedures Bylaw No. 5879-7999 was amended to require a complete rezoning application for consideration of first and second reading. To proceed further with this application additional information is required as outlined below. A complete application has now been received. Thi s application is in compliance with the Official Community Plan (OCP). Pursuant to Council Policy 6.37, this application is subject to the Community Amenity Con t ribution (CAC) Program at a rate of $7,400.00 per dwelling unit, for an estimated total amount of $7,400.00, or such rate applicable at third reading of this app lication. RECO MMENDATIONS: 1. That Zone Amending Bylaw No. 7902-2023 be given second read ing, and be forwarded to Public Hea ri ng; 2. That the following terms and conditions be met prior to final reading: i) Road dedication on York Street as required; ii) Reg istration of a Rest rictive Covena nt for Duplex Des ign; iii) Reg istration of a Rest rictive Covenant for Stormwater Management; 2022-326-RZ Page 1 of 5 iv) Removal of existing building; v) If the Director of Waste Management from the Ministry of Environment determines that a site investigation is required based on the submitted Site Disclosure Statement, a rezoning, development, or development variance permit cannot be approved until a release is obtained for the subject property; vi) In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject property. Project Description: Use: Duplex Zone: RS-1 (Single Detached Residential) Designation: Urban Residential Sing le-Family Residential Two-Unit Residential (Duplex) 790 m2 (8,503.48 ft2) York Street Urban Standard Yes The subject property at 12050 York Street is located on the east side of York Street and is approximately 837.8 m2 (9,018.0 ft2) in size (see Appendix A). The subject property is a rectangular, re latively flat lot. There is an existing sing le-family dwelling onsite that will require removal as part of the rezoning process. The existing vegetation onsite includes landsca pe screening and a few trees located along the peripheries of the property (see Append ix B). The appli cant proposes to rezone the subject property from RS-1 (Single Detached Residentia l) to RT-1 (Two-Uni t Urb an Residential) to permit the co nstru ction of a duplex. The subject pro perty is designated Urban Residential (see Appendix C) 3. Plann ing Analysis: i) Official Community Plan: The Offici al Community Plan designates the subject property as Urban Residential - Neighbourhood Residential, and development of the property is subj ect to the Neighbourhood Residential Infill Policies. These policies require that development be compatible with the surrounding neighbourhood, with particular attention given to site design, setbacks and lot configuration with the existing pattern of development in the area . Specifically, Policy 3.19(b) emphas izes that different unit types such as duplexes and triplexes, are sca led and designed to integrate characteristics that resemble a single-family dwelling with an emphasis on street- oriented buildings. The proposed rezoning of the subject property to the RT-1 zone, to support the development of a duplex, aligns with the intent of t hese OCP and Neighbourhood Residential Infill policies. ii) Zoning Bylaw: The applicant is proposing to rezone the subject property from the RS-1 zone to the RT-1 zone to permit the construction of a duplex (see Appendix D) which requires a minimum lot size of 750.0 m2 (8072.9 m2). After road dedication, the proposed lot area is 789.2 m2 (8,494.99 ft). The 2022-326-RZ Page 3 of 5 minimum lot width for the proposed RT-1 zone is 20 m (65.6 ft) and minimum lot depth is 27.0 m (88.6 ft). The property meets all the minimum requ irements. The RT-1 zo ne requires a minimum 40% of the lot area and a minimum 50% of the front yard to be maintained as a landscape area with a permeable surface. The applicant will be using permeable pavers to ach ieve the front yard requirements. The proposed layout meets the zonin g requirements for 40% permeable surface (see Appendix E). iii) Off-Street Parking and Loading Bylaw: According to the Maple Ridge Off-Street Parking and Loading Bylaw No. 4350-7990, the required off-street parking spaces are two parking spaces per dwelling unit and the applicant is providing two parkin g spaces per unit in the garages. One parking space per dwelling unit is required to be roughed-in and capable of providing Level 2 charging and the applicant is providing one roughed-in space per unit capable of providing Level 2 charging. The applicant is also providing each unit with a bicycle rack for storage in th e garage. iv) Proposed Variances: The applicant does not require any variances for the proposed development. v) Development Permits: A development permit is not required for the proposed development, however, the City will require a restrictive covenant to be registered to regulate form and character of the duplex and to ensure the proposal compliments adjacent single-family residential uses. 4. Environmental Implications: An arborist report has been provided in accordance with the Tree Protection and Management Bylaw No. 7733-2075. A tree permit will be required for the removal, protection and/or compensation of trees. All Engineering servicing and building design shall be coordinated with the approved tree retention/protection, landscaping and stormwater management plan. 5. Interdepartmental Implications: i) Engineering Department: The Engineering Department has indicated that the following will be required as a condition of Rezoning: • Road dedication as required to meet the design criteria of the Subdivision and Development Bylaw No. 4800-7993. 2022-326-RZ Page 4 of 5 • Utility servicing as required to me et the design criteria of the Subdivision and Development Bylaw No. 4800-7 993. • Cash in li eu of frontage upgrades due to the location of the development. ii) License. Perm its and Bylaws Department: The Building Department's Buildin g Code re lated com ments will be ad dressed at tim e of construction of the proposed duplex during the bu ilding permit process. 6. School District No. 42 Comments: Pursuant to Section 476 of the Loca l Government Act, consultation with School Dist ri ct No. 42 is required. A referra l was sent to Schoo l District No. 42 and they provided a response on Ju ly 27, 2023, which is attached to thi s report as Appendix G. CONCLUSION: It is recommended that second reading be given to Zone Amending Bylaw No. 7902 -202 3 to pe rmit the construction of a duplex, and that application 202 2-326-RZ be forwarded to Public Hearing. There were a host of onetime costs to advance Objectives and Key Results to deliver on Council's Strategic Plan. The 2024 property tax increase of 6.5% is lower than many lower mainland communities, but it is still higher than past years due to significant inflationary pressures. This Financial Plan Bylaw includes projects that were approved in prior years' budgets and are in the process of being delivered; projects of significant size and complexity often take multiple years to deliver. The community input was sought through two phases of public engagement. The initial phase was focused on priority setting to help inform the workplan and service enhancement priorities and the second phase was specific to feedback on the budget. The Report is designed to aid the public, and other interested parties, in better understanding what goes into the City's decision-making processes and the resulting financial resource allocations. Dive rsification of the tax base and generation of non-tax revenue are ongoing objectives, outlined in Section 6 of the Financial Susta inability Policy No. 5.52. Property tax revenue includes property taxes as well as grants in lieu of property taxes. Parcel Charges Parcel charges are comprised of a recycling charge, a sewer charge and on some properties, a local area service or improvement charge. Parcel charges are a useful tool to cha rge all or a subset of properties for a fixed or variable amount to support services. Unlike property ta xation the variable amount does not need to be related to property assessme nt value but can be something that more accurately reflects the cost of the service. Schedule "B" Revenue and Property Tax Policy Disclosure Fees & Charges Fees should be reviewed annually and updated if needed. Fees are used to offset some or all the costs of providing specific services. The utility fees are reviewed annually with a view towards using rate stabilization practices to smooth out large fluctuations in rates, as set out in the Business Planning Guidelines. Borrowing Proceeds Debt is used when it makes sense, and with caution as it commits future cash flows to debt payments, restricting the ability to use these funds to provide other services. The source of the debt payments needs to be considered as does the justification for advancing the project. More information on previously approved borrowing can be found in the most recent Financial Overview Report. Annual business planning practices are the mechanism for resource allocation decisions. Section 6 of the City's Financial Sustainability Policy discusses the necessity of diversifying the tax base. Development of employment-related properties is one method of diversification; therefore a key performance measurement in Strategic Economic Initiatives tracks the increased investment and development of non-residential properties. A policy in the Financial Sustainability Plan that calls for stable tax increases and the adoption of the annual increase early in the prior year in the Business Planning Guidelines provides citizens with a more stable and predictable set of cost increases. Property Tax Rates It is policy to adjust property tax rates annually to offset the change of market values on property taxes. Tax rates are reduced to negate the market increases. Property tax increases are then applied at the same relative increase for all classes, unless legislation restricts the rates, as with Class 2, Utility. The Business Class and Light Industry Class properties have the same municipal tax rate and are treated as a composite class when setting the tax rates. In reviewing tax rates to ensure competitiveness, absolute rates, tax multiples and overall tax burden are considered. The impact that assessed values have when comparing to other geographical areas must be considered in a comparison of tax rates. Permissive Tax Exemptions Council has set policies around the use of permissive tax exemptions. These are Council Policies No. 5.19 through No. 5.24. These policies discuss Churches, Community Halls, Heritage Sites, Homes for the Care of Children and the Relief of the Aged, the Poor, the Disabled and the Infirm, Municipal Recreational Services, Private Hospitals and Daycares, Private School and Youth Recreation Groups. Revitalization Tax Exemptions (no current programs) In the past, Revitalization Tax Exemptions have been leveraged as a tool to provide incentives for the attainment of strategic goals related to land development and the attraction of high-value jobs. The Town Centre Investment Incentive Program was established to attract private investment in the fulfillment of the Town Centre Area Plan. Similarly, the Employment Land investment Incentive Program was designed to encourage job creation by supporting investment in buildings and infrastructure on identified "employment lands". Schedule "C" Capital Expenditure Disclosure The sole purpose of this statement is to meet legislative requirements and highlight the value of the Development Cost Charges; no other conclusions should be drawn from the figures as the information could be misconstrued. This disclosure is required under the Local Government Acts. 560 {2); capital costs attributable to projects to be partially funded by Development Cost Charges (DCC) must be included in the financial plan. The DCC program includes projects as far out as 2043 so the capital expenditures must be extended to match. Certain types of projects are not planned past the five-year time horizon of the financial plan. Much less scrutiny is given to projects that are planned in years 2029 through 2043. Projects in these years typically exceed likely funding available. The initial phase focused on setting priorities for the upcoming budget and culminated in a draft financial plan. The second phase of engagement, which lasted from February 16 to March 22, sought the community's input on the draft budget and resulted in 174 participants providing feedback. Key concerns identified included affordability, support for emergency services, increased infrastructure and public safety investments, and calls for greater arts, culture, and commercial tax base support. Feedback was divided among support for the budget, opposition based on tax increases, and specific endorsements of service enhancements without supporting the resultant tax increases. Analysis of the feedback highlighted a general preference for investments in arts, culture, and infrastructure, with affordability being a significant concern among those opposed to the budget. This engagement process sets the stage for the Council's final decision on adopting the 2024-2028 Financial Plan and Tax Rate Bylaw at the April 9, 2024 meeting, reflecting community priorities and feedback. RECOMMENDATION: For information DISCUSSION: a) Background Context: 3757116 The 2024-2028 business planning process was initiated with Council in December 2023. Since that time, the public participated in an engagement campaign to set the priorities for the 2024 budget (Financial Plan), Council considered budget proposals, and staff were given direction on projects and service enhancements to include in the Financial Plan. A second engagement period was held from February 16 through March 22, asking the public for feedback on the draft budget. The public was provided with a budget highlights document, Attachment A, which summarizes key projects and new services included in the budget, the resulting property tax increase, and impact to the average home to inform their commentary. Aside from demographic questions, only one question was asked in the survey: Please share your comments and feedback on the City's 2024 draft budget. Page 1 of 3 Engagement Results The second round of community engagement saw a decrease in public participation from the first, yet participation remained strong relative to budget engagements in prior years. Over the course of the engagement period, 174 respondents submitted the survey with only one response coming in hardcopy and the rest by way of the City's Engage Maple Ridge platform. Six additional themes were identified in the analysis: • Affordability • Support for Fire and Police services • Increase Infrastructure • Increase Public Safety • Increase Arts & Culture funding • Increase Business/Commercial tax base Generally, participants who are not in-support of the budget cite affordability (31 comments), a desire for an increase in infrastructure (6 comments), transportation improvements specifically, or public safety supports (2 comments) or to shift to a stronger commercial tax base (2 comments) in their feedback. Those in support of the budget note that increases in arts and culture funding and strengthening municipal infrastructure (3 comments respectively) are preferred investments. Additionally, general support for Fire and RCMP services, strengthening the commercial tax base and challenges to affordability are also noted (1 comment respectively). Page 2 of 3 Respondents who support the service enhancements but not the overall tax increase identified that the investment in infrastructure projects, public safety and efforts to sh ift the commercial tax base as being important investments. One comment was received for each category. Overall, a large portion of feedback was general commentary. The category itself is heavily represented, 47 of 65 total comments, by responses seeking an increase to funding for arts and culture programs. Specifically, for funding related to Arts Centre Theatre (ACT) operations. During the last week of budget engagement, the ACT distributed a request for the public to voice their support for arts funding through the City budget engagement process. As a result of the call to action, a significant influx of commentary was received. b) Business Plan/Financial Implications: The second phase of engagement is the final step prior to, the Council's decision on adopting the 2024-2028 Financial Plan. Council will receive the Financial Plan for consideration at the Regular Council meeting of April 9, 2024. Also being considered at the meeting will be the 2024 Tax Rate Bylaw that will set this year's tax rate, which is a direct result of the funding approved in the Financial Plan. CONCLUSION: The community has participated in a second phase of public engagement pertaining to the 2024-2028 Business Plan, and the resulting information is being presented to Council. As per Provincial legislation, Property Tax Rate bylaws must be adopted before May 15 every year. A 6.5% municipal property tax increase is included in the 2024-2028 Financial Plan Bylaw and is consistent with the Council resolution provided at the end of Business Planning deliberations. The City also collects levies and taxes on behalf of external agencies such as the Provincial Government, BC Assessment and TransLink, and we still do not have the final rates for some of them; as such, information presented in the Appendix will change between now and final reading . RECOMMENDATION: That Maple Ridge 2024 Property Tax Rates Bylaw No. 7990-2024 be given first, second and third readings. DISCUSSION: a) Background Context: The are nine property classes in BC. They are: 1 Residential (includes both single family and strata residences) 2 Utilities 3 Supportive Housing 4 Major Industry 5 Light Industry 6 Business and Other 7 Managed Forest Land 8 Recreational Land 9 Farm Property tax rates are adjusted for two key factors each yea r: 1. The average market value change for each property class; and 2. The increased revenue requirements, as outlined in the Financial Plan . Property ta x rates are calculated against the Revised Roll , a complete list of all properties in Maple Ridge and their assessed values. Property tax rates are adjusted to remove the impact of market 3765201 Page 1 of 3 value changes. Property tax increases are then applied, at the same relative increase to all classes, unless otherwise directed by Council or restricted by legislation, as with Class 2 (Utilities). The average market value increase, based on market value at July 1 last year, for the Residential (Class 1) was 1.2%, though there is variation around this average. The actual increase or decrease in property taxes for each property will vary, depending on the relative change in assessed value for that property. The average market value increase for the Light Industry (Class 5) and Business and Other (Class 6) was approximately 5.1 %. As noted earlier, the tax rates for these classes are reduced to negate this market change. Although there are no Major Industry (Class 4) properties in Maple Ridge, a property tax rate is still included in the unlikely event that a supplementary reclassification occurs. The property tax notice that we issue includes levies from others (Provincial Government, BC Assessment, Translink, etc.) and we have no control over these levies. We still do not have the final rates for some of them; as such, information presented in the Appendix will change between now and final reading. b) Citizen/Customer Implications: For illustrative purposes, a sample of 8 property tax levies and assessments for the last few years are attached in the appendix. As noted earlier, the increase experienced by individual properties will vary, depending on the relative change in the assessed value of that property and these sample properties highlight this variability. CONCLUSION: This 2024 Property Tax Rates Bylaw sets the property tax rates which generates the majority of the City's revenue. A property tax rate bylaw must be adopted each year prior to May 15. An increase of 8.50% is planned for each year of the Financial Plan to cover both our own local sewer infrastructure, maintenance, and rate increases in the regional costs of wastewater treatment. Although the sewer levy increases by 8.50%, the parcel charge of $35 .00 remains the same, so the overall increase is 7.94%. RECOMMENDATION: That Maple Ridge Sewer Rate Amending Bylaw No. 7988-2024 be given first, second and third readings. DISCUSSION: a) Background Context: The annual sewer levy covers our local sewer infrastructure, its maintenance and the regional costs of wastewater treatment. b) Desired Outcome: Sewer rates that generate sufficient revenue to cover the cost of providing the service. c) Strategic Alignment: The region is improving wastewater treatment to reduce impact to the environment. d) Citizen/Customer Implications: 3765433 The 8.50% rate sewer rate increase in 2024 equates to an average increase of $42 .67 for a single family dwelling. The sewer parcel charge remains unchanged at $35.00, resulting in a total increase of 7.95%. Page 1 of 2 e) Business Plan/Financial Implications: The Sewer Utility pays for regional capital expenditures through an allocation model that essentially spreads rate increases over time to utility ratepayers. The 2024 sewer fees are approximately $580.00 per property. Approximately 65.00% of sewer fees are required for regional costs of wastewater treatment, which are increasing 10.00% a year. The remainder covers the costs of our local sewer infrastructure and maintenance requirements. Expenses include capital projects which results in fluctuations year to year, and cost impacts that new wastewater regulations have on capital investment requirements will be addressed at the regional level with member municipalities paying their respective portions. The Region's most recent five year rate projection is for an average annual increase of 10.00%, but this may increase due to recent developments with the wastewater treatment plant on the North Shore. CONCLUSION: The region is making significant investment in wastewater treatment resulting in increased costs being allocated to the municipalities served. The rate changes in this bylaw amendment are needed to cover both our portion of these regional costs and our own costs of our local sewer infrastructure and maintenance.
