He explained that he had excused himself from discussion of Item 1102 as he previously represented a client owning property in the area and felt there may be a perceived conflict of interest. 1003 Maple Ridge Cemetery Expansion Loan Authorization Bylaw No. 6679-2009 and Maple Ridge 240 Street Bridge Over Kanaka Creek Replacement Loan Authorization Bylaw No. 6680-2009 Staff report dated September 16, 2009 recommending that Maple Ridge Cemetery Expansion Loan Authorization Bylaw No. 6679-2009 and Maple Ridge 240 Street Bridge Over Kanaka Creek Loan Authorization Bylaw No. 6680-2009 be adopted. Registration of a geotechnical report as a Restrictive Covenant which addresses the suitability of the site for the proposed development; and iv. CARRIED 1202 Final Approval -Expropriation of Portion of 22364 127 Avenue for Re- alignment of Abernethy Way at 224 Street Staff report dated September 16, 2009 recommending the District proceed with the final step in the expropriation process for a portion of 22364 127 Avenue for re-alignment Way at 224 Street. R/09-366 Expropriation 22364 127 Ave Approval It was moved and seconded BE IT RESOLVED that the Council of the District of Maple Ridge pursuant to Section 18 of the Expropriation Act, R.S.B.C. 1996, c. 125, as the approving authority for the expropriation contemplated in the Expropriation Notices dated July 2, 2009 registered in the Lower Mainland Land Title Office under number 88789172 does approve that expropriation. BE IT FURTHER RESOLVED that the Corporate Officer is authorized and directed to: (a) sign and seal the Certificates of Approval in the form attached to this resolution as Schedule A; (b) notify or cause to be notified the expropriating authority and each owner (as defined in the Expropriation Act) of the District's approval of the expropriations; Council Minutes September 22, 2009 Page 10 of 13 (c) make the advance payment or payments as required under Section 20(1)(d) of the Expropriation Act and serve the Notices of Advance Payment in Form 8 along with copies of the appraisal report on which the advance payments are made; (d) file or cause to be filed in the Land Title Office Vesting Notices under Section 23 of the Expropriation Act; (e) sign and seal the Notices of Advance Payment and Vesting Notices. R/09-368 Powell Avenue Receive for Information It was moved and seconded That properties at 20383, 20515, 20625, 20695 and 20785 Powell Avenue be referred to the next round of Metro Vancouver's Regional Growth Strategy discussions. CARRIED Councillor King, Councillor Speirs -OPPOSED 1300 RELEASE OF ITEMS FROM CLOSED COUNCIL From the Closed Council Meeting of June 15, 2009 Expropriation of Portion of 22364 127 Avenue for Re-alignment of Abernethy Way at 224 Street Expropriation of Portion of 1264 7 224 Street for Re-alignment of Abernethy Way at 224 Street 1400 MAYOR'S REPORT Mayor Daykin provided an update of progress being made at Northumberland Court. He advised that the District of Maple Ridge has authorized its solicitors, Young, Anderson to commence injunction proceedings in the B.C. Supreme Court to enforce the Maple Ridge Business Licencing and Regulation Bylaw No. 6333-2005 against Jagdev Singh Athwal for carrying on the business of renting dwelling units in the District of Maple Ridge without a business licence Council Minutes September 22, 2009 Page 12 of 13 1500 Mayor Daykin attended the Blue Mountain Community Garden Harvest and the opening of a Ridge Meadows Association for Community Living facility for persons living with disabilities. He reminded residents that October 5 through October 9 is Translink's Share-A-Ride Week and that September 27 is BC River's Day. Mayor Daykin thanked all residents who participated in a campaign to stop library funding cuts. COUNCILLORS' REPORTS Councillor Morden Councillor Morden attended a meeting with School District No. 42 representatives and the Maple Ridge Rotary Club Harvest Wine Festival. Councillor Dueck Councillor Dueck attended the Ridge Meadows Association for Community Living open house and meetings of the Fraser Health Municipal Government Advisory Council, the Public Art Committee, the Arts Council and the Maple Ridge and Pitt Meadows Parks & Leisure Services Commission. She participated in a 'ride along' in the RCMP Air One helicopter. Councillor Dueck reminded residents of the Art Council Annual General Meeting on October 5. Councillor Speirs Councillor Speirs attended the Maple Ridge Rotary Club Harvest Wine Festival and the opening of the facility built by the Ridge Meadows Association for Community Living. He also attended a Lower Mainland Treaty Advisory Committee meeting, a Metro Vancouver presentation on incinerators and an Alouette River Management Society meeting. Councillor Hogarth Councillor Hogarth participated in a tour of the Ridge Meadows Association for Community Living's newest facility. He attended the Sunshine Dreams for Kids Charity Golf Tournament and a Municipal Advisory Committee for Accessibility Issues meeting. Councillor Hogarth was taken along as a passenger in the RCMP Air One helicopter. Councillor King Councillor King attended a Bicycle Advisory Committee meeting. She urged cyclist to ride safe and continue to use the north side route of the Pitt River Bridge until all stages of the bridge are open. Council Minutes September 22, 2009 Page 13 of 13 Councillor Ashlie Councillor Ashlie attended a number of events. She reported that the Spirit of BC Committee is continuing to work on celebrations for the 2010 Winter Olympics and that the Olympic Torch is slated to come through the community on February 8, 2010 around 7:00 a.m. Councillor Ashlie advised that she will be participating in the Raise a Reader Event at the Maple Meadows Way West Coast Station. 1600 OTHER MATTERS DEEMED EXPEDIENT-Nil 1700 NOTICES OF MOTION AND MATTERS FOR FUTURE MEETINGS -Nil 1800 QUESTIONS FROM THE PUBLIC Rex Rutherford Mr. Rutherford expressed concern regarding the approval of the expropriation process involving portions of 22364 127 Avenue and 22364 127 Street.
