Council Minutes December 15, 2009 Page 2 of 15 500 ADOPTION AND RECEIPT OF MINUTES 501 Minutes of the Regular Council Meeting of December 8, 2009 R/09-504 Minutes Regular Council December 8, 2009 501 It was moved and seconded That the minutes of the Regular Council Meeting of December 8, 2009 be adopted as circulated CARRIED 502 Minutes of the Development Agreements Committee Meetings of November 25 and 27, December 1, 3, and 7, 2009 R/09-505 Minutes Development Agmt It was moved and seconded Committee That the minutes of the Development Agreements Committee Meetings of November 25 and 27, December 1, 3, and 7, 2009 be received. CARRIED 600 PRESENTATIONS AT THE REQUEST OF COUNCIL -Nil 700 DELEGATIONS -Nil 800 UNFINISHED BUSINESS 801 Maple Ridge Agricultural Plan Staff report dated December 15, 2009 recommending that revisions to the Maple Ridge Agricultural Plan dated December 15, 2009 be received, that the Maple Ridge Agricultural Plan dated December 15, 2009 be endorsed and further that the Agricultural Advisory Committee be directed to established priorities for implementation of the plan. Council Minutes December 15, 2009 Page 3 of 15 R/09-506 Maple Ridge Agricultural Plan It was moved and seconded That 1) Revisions to the Maple Ridge Agricultural Plan dated December 15, 2009 be received; 2) the Maple Ridge Agricultural Plan dated December 15, 2009 be endorsed; and further 3) the Agricultural Advisory Committee be directed to establish priorities for implementation of the Maple Ridge Agricultural Plan dated December 15, 2009. Councillor Dueck requested that the motion be split into the three separate motions. Council agreed to proceed with each item as a separate motion. R/09-507 Maple Ridge Agricultural Plan Revisions R/09-508 Maple Ridge Agricultural Plan Endorsement It was moved and seconded That the revisions to the Maple Ridge Agricultural Plan dated December 15, 2009 be received. CARRIED It was moved and seconded That the Maple Ridge Agricultural Plan dated December 15, 2009 be endorsed. Upon discussion, it was decided that suggested amendments to the plan would be put on the floor as individual motions and that the main motion would be revisited upon completion of the discussion of and voting upon of each proposed amendment. Council Minutes December 15, 2009 Page 4 of 15 The proposed amendments to the plan were as follows: R/09-509 Maple Ridge Agricultural Plan Text Amendment R/09-510 Maple Ridge Agricultural Plan Text Amendment R/09-511 Maple Ridge Agricultural Plan Text Amendment It was moved and seconded That the text in the Maple Ridge Agricultural Plan dated December 15, 2009, Page 19, Section 5.6, Recommendation a) be amended by removing the words "Where a need is identified". CARRIED It was moved and seconded That the text in the Maple Ridge Agricultural Plan dated December 15, 2009, Page 19, Section 5.6, Recommendation c) which reads "Establish a drainage and flood control levy" be revised to read "Explore establishing a drainage and flood control levy". CARRIED Councillor King, Councillor Speirs -OPPOSED It was moved and seconded That the text in the Maple Ridge Agricultural Plan dated December 15, 2009, Page 19, Section 5.6, Recommendation d) which reads "Require upland land owners and developers to control storm water flows into the flood plain" be revised to read "Require upland land owners and applicants to control storm water flows into the flood plain". CARRIED Councillor King, Councillor Speirs -OPPOSED Council Minutes December 15, 2009 Page 5 of 15 R/09-512 Maple Ridge Agricultural Plan Text Amendment DEFEATED R/09-513 Maple Ridge Agricultural Plan Text Amendment DEFEATED R/09-514 Maple Ridge Agricultural Plan Text Amendment It was moved and seconded That the text in the Maple Ridge Agricultural Plan dated December 15, 2009, Page 19, Section 5.6, Recommendation g) which reads "Require compensation from unavoidable agricultural ... " be revised to read "Explore compensation from unavoidable agricultural ... ". DEFEATED Mayor Daykin, Councillor Ashlie, Councillor King, Councillor Speirs -OPPOSED It was moved and seconded That the text in the Maple Ridge Agricultural Plan dated December 15, 2009, Page 21, Section 5.9, Recommendation c) be deleted. DEFEATED Mayor Daykin, Councillor Ashlie, Councillor King, Councillor Speirs -OPPOSED It was moved and seconded That the text in the Maple Ridge Agricultural Plan dated December 15, 2009, Page 24, Section 5.13, Recommendation a) be replaced with the text "To protect the agricultural land base by concentrating growth to within the urban area boundary". CARRIED Councillor King, Councillor Speirs -OPPOSED Council Minutes December 15, 2009 Page 6 of 15 R/09-515 Maple Ridge Agricultural Plan Text Amendment R/09-516 Maple Ridge Agricultural Plan Text Amendment It was moved and seconded That the sentence in the Maple Ridge Agricultural Plan dated December 15, 2009, Page 25, Section 8.0 Glossary, Agricultural Land, be revised by removing the text "As defined in the Maple Ridge Official Community Plan" and beginning the sentence with the word "Land"; and further That the word 'uses' be added after the words "to permit agriculture". CARRIED It was moved and seconded That the necessary text changes in the Maple Ridge Agricultural Plan dated December 15, 2009 be made to correspond to the amendments approved by Council. CARRIED The main motion to endorse the Maple Ridge Agricultural Plan dated December 15, 2009 as put on the floor prior to discussion of amendments to the plan was discussed. "as amended" was added to the resolution. Maple Ridge Agricultural Plan Endorsement It was moved and seconded That the Maple Ridge Agricultural Plan dated December 15, 2009 be endorsed as amended. CARRIED 1002.2 Maple Ridge Zone Amending Bylaw No. 6685-2009 To rezone from RS-3 (One Family Rural Residential) to RM-1 (Townhouse Residential) to permit the construction of a Commercial/Mixed use building and 165 townhouses Second and third readings R/09-520 RZ/044/09 BL No. 6685-2009 It was moved and seconded Second and third That Bylaw No. 6685-2009 be given second and third readings. CARRIED 1002.3 RZ/044/09, 11213 240 Street Maple Ridge Zone Amending Bylaw No. 6696-2009 To rezone from RS-3 (One Family Rural Residential) to C-1 (Neighbourhood Commercial) to permit the construction of a Commercial/Mixed use building and 165 townhouses and to amend text in the C-1 zone. Second and third readings R/09-521 RZ/044/09 BL No. 6696-2009 It was moved and seconded Second and third That Bylaw No. 6696-2009 be given second and third readings. Final reading R/09-522 RZ/037/08 BL No. 6641-2008 It was moved and seconded Final reading That Bylaw No. 6641-2008 be adopted. Councillor Speirs -OPPOSED 1004 RZ/090/08, 22846 128 Avenue Maple Ridge Zone Amending Bylaw No. 6640-2008 CARRIED Staff report dated December 7, 2009 recommending final reading To rezone from RS-2 (One Family Suburban Residential) to RS-1 (One Family Urban Residential) to permit subdivision into 5 lots not less than 714 m2. Final reading R/09-523 RZ/090/08 BL No. 6640-2008 It was moved and seconded Final reading That Bylaw No. 6640-2008 be adopted. CARRIED Council Minutes December 15, 2009 Page 10 of 15 COMMITTEE REPORTS AND RECOMMENDATIONS 1100 COMMITTEE OF THE WHOLE Minutes -December 7, 2009 R/09-524 Minutes cow December 7, 2009 It was moved and seconded That the minutes of the Committee of the Whole Meeting of December 7, 2009 be adopted with the following amendment: Replace the text "That the staff report be forwarded to the Council Meeting of November 8, 2009" with the text "That the staff report be forwarded to the Council Meeting of December 8, 2009". CARRIED Public Works and Development Services 1101 DP/DVP/068/08, 22320 Lougheed Highway Staff report dated November 25, 2009 recommending that the Corporate Officer be authorized to sign and seal DVP/068/08 to retain an existing lane and vary minimum height requirements of the C-3 zone and further that the Corporate Officer be authorized to sign and seal DP/068/08 to permit construction of a two storey building with underground parking. R/09-525 DVP/068/08 DP/068/08 Sign and seal It was moved and seconded That the Corporate Officer be authorized to sign and seal DVP/068/08 respecting property located at 22320 Lougheed Highway; and further That the Corporate Officer be authorized to sign and seal DP/068/08. R/09-526 DVP/090/08 Sign and seal It was moved and seconded That the Corporate Officer be authorized to sign and seal DVP/090/08 respecting property located at 22846 128 Avenue. CARRIED 1103 Local Area Service Policy Amendment -Conversion of Private Driveways on Unpaved Roads Staff report dated December 8, 2009 recommending that Maple Ridge Local Area Service Policy No. 5.01 (Rev.1) be rescinded and that Maple Ridge Local Area Service Policy No. 5.01 (Rev.2) to add a new Qualifying Work and Cost Sharing Ratio for the conversion of private driveways within road allowances to an acceptable road standard be adopted. R/09-527 Local Area Service Policy Amendment It was moved and seconded That Maple Ridge Local Area Service Policy No. 5.01 (Rev. 1) be rescinded; and That Maple Ridge Local Area Service Policy No. 5.01 (Rev.2), attached as Appendix A to the staff report dated December 8, 2009 titled Local Area Service Policy Amendment -Conversion of Private Driveways on Unpaved Roads, be adopted. CARRIED Council Minutes December 15, 2009 Page 12 of 15 1131 Financial and Corporate Services (including Fire and Police) Desktop Replacements Staff report dated December 8, 2009 recommending that the Corporate Officer be authorized to sign a three year provision, service and support contract with Basic Business Systems for the replacement of the District workstation and laptop equipment. R/09-528 Award of Contract Desktop Replacement It was moved and seconded That the Corporate Officer be authorized to sign a three year provision, service and support contract with Basic Business Systems for the replacement of the District desktop and laptop equipment to a value that does not exceed $425,000.00, exclusive of GST. CARRIED 1132 Trade Retired Rescue 1 to the Justice Institute Fire and Safety Division (FSD) in exchange for access to the FSD Maple Ridge Campus Staff report dated December 8, 2009 recommending that the trade of a 1986 Mack Rescue Truck to the Justice Institute Fire and Safety Division in exchange for access to training resources be endorsed. R/09-529 Trade of Fire Truck to Justice Institute It was moved and seconded That the trade of a 1986 Mack Rescue Truck to the Fire and Safety Division of The Justice Institute of BC in exchange for access to their training resources as outlined in the staff report dated December 8, 2009 be endorsed. CARRIED Council Minutes December 15, 2009 Page 13 of 15 Community Development and Recreation Service 1151 RCMP Jail Cell Renovations -ITT-PL09-125 Staff report dated December 1, 2009 recommending that the RCMP Jail Cell Renovation Project be awarded to Bynett Construction and that a contingency be established for the project. R/09-530 Award of Contract RCMP Jail Cell Renovations It was moved and seconded That the RCMP Jail Cell Renovation Project be awarded to Bynett Construction in the amount of $417,000.00 inclusive of GST ($19,900.00), and further That a contingency of $41,790.00 be established for this project. CARRIED Correspondence -Ni I Other Committee Issues -Nil 1200 STAFF REPORTS 1201 Fraser Sewerage Area -Request for Expanding the Boundaries Staff report dated December 9, 2009 recommending that the Greater Vancouver Sewerage and Drainage District be requested to approve expansion of the Fraser Sewerage Area boundary in Maple Ridge to include properties identified on an attached map. Council Minutes December 15, 2009 Page 14 of 15 R/09-531 Request for Fraser Sewage Area It was moved and seconded Boundary Expansion That the Greater Vancouver Sewerage and Drainage District (GVS&DD) Board of Directors be requested to approve expansion of the Fraser Sewerage Area boundary in Maple Ridge to include the properties identified on the map attached to the staff report dated December 9, 2009. CARRIED 1300 RELEASE OF ITEMS FROM CLOSED COUNCIL 1400 MAYOR'S REPORT Mayor Daykin wished all residents a great holiday and Christmas season. He reminded everyone of Operation Red Nose 1500 COUNCILLORS ' REPORTS Councillor Hogarth wished all residents a Merry Christmas and all the best in New Year. Councillor King wished all residents a Merry Christmas and a Happy New Year. Councillor Dueck wished everyone a Merry Christmas and all the best in the New Year. Councillor Morden wished everyone a Merry Christmas and encouraged residents to stay safe over the holidays. Councillor Ashlie wished everyone happy holidays and a Merry Christmas. Councillor Speirs attended the ARMS Christmas Party and marched with workers on strike at Extra Foods. He wished all a Merry Christmas.
