Gill, Acting Chief Administrative Officer CARRIED The General Manager of Corporate and Financial Services provided an update on the changes to the Federal medical marihuana legislation. He advised on the court ruling on the legislation and the impact of the ruling on the District's plans to deal with grow operations. He outlined the process which would have been followed previous to the court ruling and advised that until the issue is dealt with through the court system, the municipal program will be put on hold. CARRIED Council Minutes March 25, 2014 Page 5 of 16 Public Works and Development Services 1101 2014-008-RZ, 12032 216 Street, RS-1 to P-2 Staff report dated March 17, 2014 recommending that Maple Ridge Zone Amending Bylaw No. 7063-2014 to rezone from RS-1 (One Family Urban Residential) to P-2 (Special Institutional) to bring existing assisted living use into compliance and allow construction of a two storey building with 20 assisted living units be given first reading and that the applicant provide further information as described on Schedules A, C and E of the Development Procedures Bylaw No. 5879-1999. Ken MacDonald -Local Fraser Health Manager, Mental Health Services Pitt Meadows-Maple Ridge Mr. MacDonald advised that 85 percent of the residents in the current assisted living facility are from Maple Ridge. He also advised on the funding for the program. R/2014-124 2014-008-RZ BL No. 7063-2013 First reading It was moved and seconded In respect of Section 879 of the Local Government Act, requirement for consultation during the development or amendment of an Official Community Plan, Council must consider whether consultation is required with specifically: i. The Board of the Regional District in which the area covered by the plan is located, in the case of a Municipal Official Community Plan; ii. The Board of any Regional District that is adjacent to the area covered by the plan; iii. The Council of any municipality that is adjacent to the area covered by the plan; iv. First Nations; v. School District Boards, greater boards and improvements district boards; and vi. The Provincial and Federal Governments and their agencies. Council Minutes March 25, 2014 Page 6 of 16 and in that regard it is recommended that no additional consultation be required in respect of this matter beyond the early posting of the proposed Official Community Plan amendments on the District's website, together with an invitation to the public to comment, and; That Bylaw No. 7063 -2014 be given first reading; and That the applicant provide further information as described on Schedules A, C, and E of the Development Procedures Bylaw No. 5879-1999. CARRIED 1102 2014-012-RZ, 24263 and 24295 112 Avenue, RS-2 to RS-1b Staff report dated March 17, 2014 recommending that Maple Ridge Zone Amending Bylaw No. 7065-2014 to rezone from RS-2 (One Family Suburban Residential) to RS-1b (One Family Urban [Medium Density] Residential) to permit twelve R-1 (Residential District) sized lots utilizing the Albion Area Density Bonus option be given first reading and that the applicant provide further information as described on Schedules A, B, F and G of the Development Procedures Bylaw No. 5879-1999, along with the information required for a Subdivision application. R/2014-125 2014-012-RZ BL No. 7065-2014 First reading It was moved and seconded In respect of Section 879 of the Local Government Act, requirement for consultation during the development or amendment of an Official Community Plan, Council must consider whether consultation is required with specifically: i. CARRIED 1103 2011-002-RZ, 25608 Bosonworth Avenue, A-2 to RS-2 Staff report dated March 17, 2014 recommending that Maple Ridge Zone Amending Bylaw No. 6795-2011 to rezone from A-2 (Upland Agricultural) to RS-2 (One Family Suburban Residential) to permit a subdivision of three lots be given second reading and be forwarded to Public Hearing. R/2014-126 2011-002-RZ BL No. 6795-2011 Second reading Forward to PH It was moved and seconded 1. That Bylaw No. 6795 -2011 be given second reading and be forwarded to Public Hearing; and 2. That the following term(s) and condition(s) be met prior to final reading. i. Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii. Road widening, truncation and cul-de-sac turn- around as required; iii. Registration of a geotechnical report as a Restrictive Covenant at the Land Title Office which addresses the suitability of the site for the proposed development; Council Minutes March 25, 2014 Page 8 of 16 iv. A disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks. If there is evidence, a site profile pursuant to the Waste Management Act must be provided in accordance with the regulations. v. Pursuant to the Contaminated Site Regulations of the Environmental Management Act, the property owner will provide a Site Profile for the subject land(s). CARRIED 1104 2012-102-RZ, 25638112 Avenue, RS-3 to RS-2 Staff report dated March 17, 2014 recommending that Maple Ridge Zone Amending Bylaw No. 6965-2013 to rezone from RS-3 (One Family Rural Residential) to RS-2 (One Family Suburban Residential) to permit subdivision into four RS-2 lots and one RS-3 lot remaining in the Agricultural Land Reserve be given second reading and be forwarded to Public Hearing. The Manager of Legislative Services advised of a revision to the recommendation in the staff report. R/2014-127 2012-102-RZ BL No. 6965-2013 Second reading Forward to PH It was moved and seconded 1. That Bylaw No. 6965-2013 be amended as identified in the staff report dated February 3, 2014, be given second reading, and be forwarded to Public Hearing; and 2. That the following terms and conditions be met prior to Final Reading: i. Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii. Road dedication as required; iii. Registration of a geotechnical report as a Restrictive Covenant at the Land Title Office which addresses the suitability of the site for the proposed development; Council Minutes March 25, 2014 Page 9 of 16 iv. Registration of a Tree Protection/Steep Slope Restrictive Covenant at the Land Title Office; v. Entering into a Restoration and Enhancement Agreement for the unconstructed portion of the 256 Street allowance abutting the site; vii. Removal of the existing building/s; viii. CARRIED 1106 2013-021-DVP, 20581 Maple Crescent Staff report dated March 17, 2014 recommending that the Corporate Officer be authorized to sign and seal 2013-021-DVP to vary building setbacks, road width for Battle Avenue and required off-street parking to permit construction of a two storey "Treatment Centre" building in the P-2 (Special Institutional) zone. CARRIED Councillor Bell -OPPOSED Council Minutes March 25, 2014 Page 11 of 16 1107 2013-096-RZ, Tandem Parking in the RM-1 Zone Staff report dated March 17, 2014 recommending that Maple Ridge Zone Amending Bylaw No. 7024-2013 as amended by given second reading and be forwarded to Public Hearing and that Maple Ridge Off-Street Parking and Loading Amending Bylaw No. 7025-2013 as amended by given second and third readings. The Manager of Legislative Services advised on minor changes to the recommendation in the staff report to better identify the proposed amendments. The Manager of Development and Environmental Services provided an overview and advised on the context of the tandem parking issue. He outlined the recommendations for amendments to the bylaws. CARRIED Council Minutes March 25, 2014 Page 13 of 16 1132 2014 Council Expenses Staff report dated March 17, 2014 providing Council expenses for 2014 updated to the end of February 2014. 1133 Shaw Wi-Fi Proposal Staff report dated March 17, 2014 recommending that an agreement with Shaw Communications to provide a Wi-Fi service be prepared and that the range of District properties for inclusion of the new service be supported. R/2014-135 Shaw Communications It was moved and seconded Wi-Fi Service Agreement That staff be directed to prepare an agreement with Shaw Communications to provide a Wi-Fi service utilizing District properties in accordance with the commitments noted in the Letter of Commitment in Appendix 1 of the staff report dated March 17, 2014, with the exception of the collection and use of personal information for public access; and That the range of District properties for inclusion of the new service be supported as noted in Appendix 2, Locations of Interest, of the staff report dated March 17, 2014. CARRIED Councillor Masse, Councillor Morden -OPPOSED Community Development and Recreation Service -Nil Correspondence -Ni I Other Committee Issues -Nil Council Minutes March 25, 2014 Page 14 of 16 1200 STAFF REPORTS 1201 Results of Alternative Approval Process for City Classification Staff report dated March 19, 2014 recommending the Manager of Legislative Service be authorized to write a letter to the Ministry of Community, Sport and Cultural Development requesting that the classification of Maple Ridge be changed from a District Municipality to a City. R/2014-136 Alternative Approval Process for City Classification It was moved and seconded WHEREAS the Corporate Officer has certified that approval of the electors to change the classification of Maple Ridge from a District Municipality to a City was obtained through the alternative approval process; NOW THEREFORE be it resolved as follows: That the Manager of Legislative Services be authorized to write a letter to the Ministry of Community, Sport and Cultural Development, with copies to MLA's Marc Dalton and Doug Bing, requesting that the classification of Maple Ridge be changed from a District Municipality to a City. CARRIED 1300 RELEASE OF ITEMS FROM CLOSED COUNCIL -Nil 1400 MAYOR'S REPORT Mayor Daykin attended the opening of "Seasons in the Park." He advised that the Greater Vancouver Sewerage and Drainage District is celebrating its 100 Year Anniversary. Council Minutes March 25, 2014 Page 15 of 16 1500 COUNCILLORS' REPORTS 1600 1700 Councillor Bell Councillor Bell attended "Friends of the Library" events and the Cultural Festival at the ACT. She advised that the Lower Mainland Local Government Association annual conference is upcoming in May. Councillor Hogarth Councillor Hogarth attended meetings of the North Fraser Post Secondary Task Force and the Maple Ridge-Pitt Meadows Parks and Leisure Services Commission. He also attended the annual general meeting of the Ridge Meadows Youth Diversion Program. He advised on an "Intersections Event" scheduled for April 9 put on by the Agricultural Advisory Committee. Councillor Morden Councillor Morden attended meetings of the Pitt Meadows Airport Society Board of Directors and the Maple Ridge-Pitt Meadows Parks and Leisure Service Commission. He also attended the annual general meeting of the Ridge Meadows Youth Diversion Program and a Youth Diversion forum. Councillor Masse Councillor Masse attended a North Fraser Post Secondary Task Force meeting and forum hosted by the Ridge Meadows Youth Diversion program. He advised that the Heritage Tea event is on April 5 and encouraged residents to attend. Councillor Ashlie Councillor Ashlie attended a forum hosted by the Ridge Meadows Youth Diversion Program and a meeting of Fraser Health. Mayor Daykin also attended the Ridge Meadows Youth Diversion Program Annual General Meeting as well as the Cultural Festival.
