The Mayor announced that all of Council tonight, were wearing the 125th Anniversary T-Shirts. 01 PRAYERS The Pastor conducted opening prayers. 02 MINUTES R199-424 Minutes August 10,1999 02.01 MOVED by Councillor Clements SECONDED by Councillor Stewart that the Minutes of the regular Council Meeting of August 10, 1999 be adopted as circulated. CARRIED Council Meeting Minutes August 24, 1999 Page 2 02.02 P199-425 MOVED by Councillor Gordon Public Hearing SECONDED by Councillor King Mm. Aug. 17/99 that the minutes of the Public Hearing of August 17, 1999 be adopted as circulated. CARRIED. 02.03 P199-426 MOVED by Councillor Levens Dev.Agreements SECONDED by Councillor Stewart Comm. Min. that the Development Agreements Committee Meetings of August 6 and 10, 1999 be received. CARRIED. 03 DELEGATIONS 03.01 Ridge Meadows Recycling Society Ms. Kelli Spiers and Ms. Kim Brown of the Ridge Meadows Recycling Society were in attendance to provide an update on the operation's programs, along with the second quarter report. Ms. Spiers in reporting on the apartment building recycling program, noted that at the present time they have 79% of the apartment buildings involved in the program, with the anticipated signing on of Sunrise and Sorrento apartments in the next few days. Ms. Spiers briefly went over how that service works. The color coded flyer was displayed showing a lot of pictures in order to make it easier to understand. The color coding is based on the bag and blue box system. The blue bag is also distributed to every apartment resident in order for them to collect all their recycables in the blue bag and then carry it to their recycling central area in their apartment building and sort it into the appropriate container. IF Council Meeting Minutes August 24, 1999 Page 3 The Collections Department have come up with a positive idea for those people who practice good recycling procedures and they have designed a fridge magnet stating "thanks for sorting your recycling so well". This magnet was the idea of the Collections Department in an attempt to let people know that they appreciate it when they practice good recycling habits. Ms. Spiers went on to speak about the Supportive Work Program for Adults with Developmental Disabilities which is paid for by the Provincial Government. There are agreements with a number of organizations, including the Simon Fraser Society, the Mainstream Association for Community Living and Ridge Meadows Association for Community Living that place people at the depot for work experiences for certain periods of time. The Recycling Society is providing a site that is accessible to the public and allows them to experience a work experience. These are things that are really valuable to some citizens that may not normally have this kind of access. Ms. Spiers went over a number of different work experience opportunities. The valuable work the Environmental Youth Team has been doing was discussed, such as the semi trailer that they designed and painted. They are also working on Blue Box flyers that everyone in the urban area will be receiving. The Youth Team was responsible for the planting of the 125 anniversary garden at the Depot and they have done a good job in making the place look attractive. Ms. Spiers noted that the Communities in Bloom Judges really liked what their team had done: The Youth Team has also been involved in community events, etc. In referring to the second quarter statement for the Recycling Society, Ms. Spiers stated they are on track and suggested they may come in with a bit of a profit. Ms. Spiers noted the Society is holding the line on expenses. In the revenue side, the newspaper and cardboard are enjoying a little bit of a spike in the prices which have resulted in almost 20% increase in revenue in this point in time. Ms. Spiers did state that they were not confident that that would hold for the whole year, but should be airight in that area. Bottle refunds are up 10%. An area that is not so great is steel and tin which is down $15,000. against their budget for the first half of the year. Ms. Spiers commented on the recent study provided by the University of Victoria. She noted that for garbage collection in Maple Ridge it would cost approximately $12.00 per month, $144.00 per year. The most any resident pays for recycling is $40.00 per year. Ms. Spiers also commented on an Angus Reid survey done by the G.V.R.D. which talks about the reasons why people choose to recycle instead of throwing the garbage away, they are - we care about the environment; we want a future for our children; we want to save landfill space; we don't want to waste things and we want to make a difference. Money,in the survey, was way done on the list with 2% of the respondents stating money was an issue. Council Meeting Minutes August 24, 1999 Page 4 Councillor King noted she was very pleased with the fridge magnet and wanted to compliment the Collections Department for their idea. Councillor King stated that the supportive work program really benefits the people in the municipality. Ms. Spiers responded that it something they are really proud of and noted that fifteen out of their fifty staff have developmental disabilities. The Society is recognized as one of the highest percentage employers of people with developmental disabilities. In response to a question from Councillor King, Ms. Spiers noted that at the curb side they will collect plastic bags and refundable containers, but not plastic bottles. Ms. Spiers noted the reason they are not picking up plastic bottles at the curbside is due to the lack of space on the vehicles. Ms. Spiers in response to a question with respect to accepting aerosol cans, noted that the Depot can accept them, but it is a difficult product and they do not encourage them. Councillor Stewart noted that it was encouraging to see that the G.V.R.D. has exceeded their recycling quota and felt the Ridge Meadows Recycling Society was a leader in that and he was encouraged to see that it is working. Councillor Levens stated that one of the first groups to join the Communities in Bloom was the Recycling Society and they have been strong supporters of Communities in Bloom. The Judges for the Communities in Bloom were so impressed with how the Recycling Depot works and what they are doing for the community. The judges stated that have not seen anything like it. Councillor Levens wanted to thank the Recyling Society for their support of the Communities in Bloom. 03.02 Mr. John Hammond & John Bastaja of the Maple Ridge Youth Centre Society Mr. Hammond of the Maple Ridge Youth Centre Society congratulated Council on the decision to proceed with the redevelopment of the downtown core. He went on to state that it is very encouraging to see a Municipal Council have the vision to shape our community in a very favourable way. Mr. Hammond stated they were especially pleased that the Youth Centre is included in the plans, as young people make up a large segment of our community and the steps that Council has taken will go a long way to influence them in a positive way. Mr. Hammond then presented a $20,000.00 cheque towards the capital cost of the Youth Centre. Mr. Hammond closed by stating there are many people in the community that are in support of this redevelopment. Councillor King and Mayor Durksen thanked the Youth Centre Society for their donation and the hard work that went into being able to present such a donation. Discussion In response to a question from Councillor King, the General Manager of Community Development, Parks and Recreation stated that they have not identified a landscape plan as yet, but it is certainly their intent to do so. He noted that the parking area is used only a couple of times a year for overflow parking and it is a grass area and it will be some time before the District will be able to develop the site into a parking area. With respect to the sign the General Manager stated it is certainly their intent to have landscaping around the base of the sign. Councillor Gordon echoed the comments that the parking lot remain grass as long as the lot is intended only for overflow parking. The motion was CARRIED. 05.03.02 Maple Ridge Official Community Plan Amending By-law No. 5831 - 1999 (RZ/39/99 - N.W. corner of Lougheed Highway and 105th Avenue to redesignate from Agricultural to Park and to include as a Non-Farm Use (Municipal Park). Discussion Councillor Gordon noted that this project is our affordable housing project and she is very glad to see it quickly moving through the system and is a project the District is in need of Councillor Gordon went on to ask how someone would get information on this project. A proponent of the project responded that once through the process tonight, the Greater Vancouver Housing Corporation will grant the project official status, and provide an information line. This information will be provided tomorrow to the Planning Department. In response to a question from Mayor Durksen, the gentleman stated there are two fully accessible units in the family portion of the project and all the senior's units are wheelchair adaptable. Councillor King congratulated the proponents on their presentation at the Public Hearing. Councillor King went on to state she feels it is great project and that it is in a great place, easy to get to all services without a car. Councillor King also liked the idea of a mixed project with seniors and families. Councillor King stated she hoped if this project was a success that there would be more projects considered. SECONDED by Councillor Levens Aug. 9 & 16-1999 that the Minutes of the Committee of the Whole Meetings of August 9 and 16, 1999 be adopted as circulated. 06.02 Public Works and Development Services 06.02.0 1 Terry Fox Run - September 19, 1999 - Request to Use Municipal Streets Reference was made to staff report dated August 3, 1999 in support of the following recommendation contained therein. Council Meeting Minutes August 24, 1999 Page 9 R199-435 MOVED by Councillor Stewart Teny Fox Run SECONDED by Councillor Gordon that the Terry Fox Run be authorized to use municipal streets, as outlined on the map attached to the report dated August 4, 1999, for their Annual Terry Fox Run on Sunday, September 19,1999 provided the conditions outlined in the said report are met. CARRIED 06.02.02 RZ129197 —23005 Dewdney Trunk Road - RS-1 to RM-1 - Request for One Year Extension - By-law No. 5705 - 1999. Reference was made to a staff report dated July 30, 1999 in support of the following recommendation contained therein to permit the subdivision into approximately 4 lots under the R- 1 zone and to permit the construction of approximately 5 townhouse units under the RM- 1 zone. R199-436 MOVED by Councillor Levens RZ/29/97 - One SECONDED by Councillor King Year Extension that pursuant to Maple Ridge Development Procedures By-law No. 5632 - 1997, a one year extension be granted to Rezoning Application RZ/29/97 to rezone property at 23005 Dewdney Trunk Road from RS-1 (One Family Urban Residential) to R-1 (Residential District) and R-3 (Special Amenity Residential District). CARRIED 06.02.03 Development ('ost Charge Forgiveness - 23795 and 23845— 118 Avenue Reference was made to the staff report dated August 5, 1999 in support of the following recommendation contained therein. R/99-437 MOVED by Councillor Clements DCC forgiveness SECONDED by Councillor King 23795/23845 — 118 Council Meeting Minutes August 24, 1999 Page 10 That with respect to Building Permit application BPC076199 for the property at 23795 and 23845 - 118 Avenue, be it resolved that in view of the necessity to construct road and water works on 118 Avenue, the highway and water components of the Development Cost Charges payable by the developer be reduced by $56,708.50. CARRIED 06.02.04 N.D. Lea Report - Recommendations Re 116 Avenue Reference was made to the staff report dated August 5, 1999. P199-438 MOVED by Councillor King N.D.Lea Report SECONDED by Councillor Stewart that the recommendations contained in the report titled "116th Avenue, Maple Ridge: 240th street to Creekside Street - Assessment of Need for a Road Link" be adopted and that the draft Cottonwood Guide Plan be amended accordingly. Discussion Councillor Gordon stated it was very critical for her to have this report completed to assess the transportation needs of the area. The General Manager of Public Works and Development provided an overhead of the area in question outlining the roads. He stated that the section of road that is in question was a road that has been identified in the Cottonwood Guide Plan as well the Transportation Plan for the municipality- which would basically connect 240 Street eastlwest across a low lying ravine area, up to 236 Street. Discussions have been held with respect to the liability on constructing the road with that type of topography. The General Manager stated that basically what the Consultant has found was the subject road was not required in the Cottonwood Area upon complete build-out of the community. It was found that 116 Avenue is not intended to be the main east-west collector - that has been determined at a previous time, to be 118th Avenue. Therefore it was recognized at the outset, that 116th Avenue would serve more as a local collector. It was noted the volume of traffic was relatively limited. The General Manager stated there will be a pedestrianlbicycle link. Council Meeting Minutes August 24, 1999 Page 11 Councillor Gordon stressed the environmental issues were very important in that area, noting that Horseshoe Creek is the only tributary to the Kanaka Creek where they have active cohoe spawning and she is pleased to see that the District is going to do something that will allow us to maintain the creek as a suitable salmon habitat. Councillor Gordon went on to state that she is also glad to see the pedestrian/bike crossing in order that they can walk or bike to the commercial area on 240th Street. Councillor King questioned what the connections would be for the pedestrian/bike paths and whether there would be an interconnecting freeway from the Cottonwood area into town. Councillor King in making reference to conm -ients in the report on Page 2, ask how will the District ensure that the suggestions to lessen the impact on the environment for the crossing will be followed. The General Manager responded that the pedestrian/bike pathway, basically follows the alignment of the original road. That is the only part that is in a environmental sensitive area. He went on to state that if this is an acceptable approach by Council, that is something we would have to design and something the staff would have to consider. The General Manager stated he felt it was important to understand that this does not necessarily mean there will not be a bridge built for vehicles into the site, because part of the property configuration in the area, splits on either side of the stream and it is necessary for the property owner to provide access to both sides of the property. One of those options would be to come across the stream, although it would be very expensive, but he will have to provide access into that property one way or the other as a requirement of the Municipal Act. The General Manager stated that what ever is done will be in conjunction with the recommendations of the report. The Chief Administrative Officer stated he felt it was important to note that the recommendation in this report is based on physical context and geography of this particular location and the District does not translate that from a staff perspective to all similar situations in the municipality. This is a specific instance and the resolution is based on the specifics of this case. In response to a question from Councillor Stewart, the General Manager stated that staffs recommendation would be to include the crossing in the first application. Council Meeting Minutes August 24, 1999 Page 12 Also in response to a question from Councillor Stewart, the General Manager advised that they will be having meetings with the representatives of the Horse Trails to go over the networking for Horse Trails. The motion CARRIED. 06.02.05 Building Department Statistics for July,1 999. Reference was made to the staff report dated August 5,1999 in support of the following recommendation contained therein. R199-439 MOVED by Councillor Clements Building Stats SECONDED by Councillor Levens July, 1999 that the Inspection Services Department's Building Statistics for the month of July, 1999 be received for information. [I 1 II 9J 06.02.06 Soil Conservation Act - Exemption - 13473 - 224 Street Reference was made to the staff report dated July 30, 1999 in support of the following recommendation contained therein. R199-440 MOVED by Councillor Clements Fill Placement SECONDED by Councillor King Exemption that the application for a fill permit under Permit Regulation Section 2(1)(d)(vii) of the Soil Conservation Act submitted by Ms. Murrell for the property at 13473 - 224th Street be granted an exemption provided the placement of fill is carried out in compliance with the relevant provisions of the Maple Ridge Soil Deposit Regulation By-law No. 4569 - 1991 and subject to provisions of the Soil Conservation Act. Council Meeting Minutes August 24, 1999 Page 13 Discussion Councillor Stewart noted that not only are we recommending the exemption, but that the District is also accepting partial responsibility for the approval of the placement of the fill. Councillor Gordon stated she would be voting in favour of the exemption as a result of the very thorough explanation given at the Committee of the Whole Meeting which answered her hydrology concerns. Councillor Clements noted that staff will be deriving a policy that will be able to apply consistently to a number of other properties. The motion was CARRIED. Councillor King left the Chamber during discussion on the next item because she is employed by School District 42 which is impacted by this decision. 06.02.07 SD/i 1/9 9 - (North East Corner of 236 Street & 133 Avenue. Reference was made to the Staff report dated August 6, 1999 in support of the following recommendation contained therein. MOVED by Councillor Stewart SD/i 1/99 - Phase In SECONDED by Councillor Gordon School Site Payment that the applicant for SD/I 1/99 be permitted to phase the school site payment for Lot 2, Section 28, township 12, Plan LMP 35466, New Westminster District. Discussion Councillor Gordon stated she would be voting in favour of this resolution as long as the School District is in favour of this proposal. The General Manager of Public Works and Development advised that as of.this date the District has not been able to receive the School District's official word on this, but he assured they would not proceed with the subdivision approval until the District receives the School District's approval. Council Meeting Minutes August 24, 1999 Page 14 Amendment re MOVED by Councillor Gordon SD/i 1/99 Phase in SECONDED by Councillor Levens School Site Payment that the following words be added "subject to receiving written confirmation from School District No. 42, accepting the phasing of the School Site payment. The amendment CARRIED. The motion as amended CARRIED. Coundilor KinR re-entered the meeting. 06.02.08 SD/i 2/99-5% Parkiand Dedication - 11535 & 11555 - 240 Street. Reference was made to the Staff Report dated August 5, 1999 in support of the following recommendation contained therein. R/99-442 MOVED by Councillor King SD/12/99 Parkiand SECONDED by Councillor Stewart Dedication that pursuant to Council's policy regarding 5% parkland dedication or payment of money in lieu, be it resolved that the owner of land the subject of SD/12/99 - (11535 & 11555 —240 Street) shall dedicate land for parkiand dedication as shown in the drawing attached to the report dated August 5, 1999. CARRIED 06.03 Financial and Corporate Services (includinr Fire and Police) 06.03.0 1 Elections 1999 - Disqualification of Potential Candidates. Reference was made to the staff report dated August 6, 1999 in support of the following recommendation contained therein. Council Meeting Minutes August 24, 1999 Page 15 MOVED by Councillor King Disqualification of SECONDED by Councillor Stewart Candidates rII1iI 06.04.01 that the memorandum of the Municipal Clerk dated August 6, 1999 be received, noting that it is reported therein that David Alexander and Randy Wagner, two candidates in the 1996 General Election, have failed to file the required Campaign Disclosure Statements and are therefore disqualified from running in the 1999 General Election. Discussion In response to a question from Councillor King, the Municipal Clerk advised that the only recourse for the disqualified candidates is to file with the Supreme Court of B.C. Mayor Durksen also noted that there will be an Election Workshop open to the public interested in obtaining more information on the Election process. The motion was CARRIED. Community Development and Recreation Service Maple Ridge's 125th Anniversary Celebrations Reference was made to a staff report dated August 10, 1999 in support of the following recommendation contained therein. R199-444 MOVED by Councillor Levens SECONDED by Councillor King that the Ridge Meadows Community Festival Society (the organizers) be authorized to close 224th Street between 119 Avenue and Dewdney Trunk Road on Sunday, September 12, 1999, between 6:00 a.m. to 10:00 p.m. for the 125 Anniversary celebrations, provided the conditions as outlined in the report of the Chief Administrative Officer are met, noting that portions of 119 Avenue and McIntosh Avenue west of 224 Street will be closed for temporary periods for marshalling purposes. Council Meeting Minutes August24, 1999 Page 16 CARRIED 06.05 Other Issues 06.05.0 1 Train Whistling Status. Reference was made to a report dated August 13, 1999 from the Chief Administrative Officer providing the current status of the train whistling complaints. P199-445 MOVED by Councillor King SECONDED by Councillor Stewart that the staff report dated August 13, 1999 with respect to train whistling be received. Discussion Municipal Clerk advised that the next step in this process is a response from the C.P.R. which should be available in one to two weeks. The motion was CARRIED. 07 MAYOR'S REPORTS Mayor Durksen commented on the two recent 100th Birthdays he attended and commended both ladies in raising families that have become good citizens of the community and Mayor Durksen stated he found it very encouraging. The Mayor noted he was pleased to see that Translink was at the Ferry Terminal doing a survey on how things could be improved. Mayor Durksen stated he had occasion to attend the Haven Guest Home before tonight's meeting and wanted to commend them for the work they are doing. With respect to the S.P.C.A., Mayor Durksen has appointed Councillors Gordon and Levens to work with the S.P.C.A. in locating a more suitable center. Council Meeting Minutes August 24, 1999 Page 17 Mayor Durksen also advised that he has appointed Councillors Kings, Stewart and Gordon to a Police Board. Mayor Durksen thanked Council for all the hard work they have done during the summer. - Mayor Durksen congratulated Jayman Builders on being a 1999 Georgie Silver Finalist for their Country Living project on 102nd Avenue. 08 COUNCILLORS' REPORTS - LIAISONS TO COMMITTEES Councillor Levens provided an update on the preparations for the celebration of Maple Ridge's 125th Anniversary. Councillor Levens noted that Council was wearing one style of 125th Anniversary T- Shirts and Sarah Robertson kindly modeled another style, both of which are available at $10.00 each from the Leisure Center or the Municipal Hall. Tickets are also available for the 125th Anniversary Dinner to be held at the Centennial Center on Friday, September 10th and tickets are $30.00 per person. A reminder of the time capsule was noted, stating that envelopes could be picked up at the office of the News. Schedule of events will be in the newspaper. Offices are starting to put 125 signs up in their windows. Councillor Levens concluded by stating everything is taking shape for an activity filled weekend. Councillor Stewart commented on the Mayor's appointment of a Police Committee, stating that he thought it was timely as there appears to be a number of things falling through the cracks and no one taking responsibility for them from a policing perspective. Councillor Stewart stated he felt it was really important to do preventative work with the affiliated groups that do have an impact in this area. Councillor Stewart noted that he had attended the Museum Workshop and felt the history of our municipality is very important and enjoyed theworkshop. Councillor Gordon noted she also attended the Museum Workshop on what they would like to see for the future and it was a very productive day. Council Meeting Minutes August 24, 1999 Page 18 Councillor Gordon also noted that she attend the last "Music on the Wharf' on Monday night and was happy to see industry and non-profit groups working together to bring such performances here. Councillor Gordon commented on this being Jim McBride, Municipal Clerk last Council Meeting and made reference to him being her counterpart on the Lower Mainland Treaty Advisory Committee for the past four years and what a superb job he had done. Councillor Gordon also thanked Mr. McBride on behalf of the Lower Mainland Treaty Advisory Committee for time he has spent on it. Councillor Clements noted that he has had the opportunity to attend the ECOMM Audit Committee hearing and was also fortunate to do a G.V.R.D. Parks Tour which included a tour of our own Kanaka Creek Park, not only from the land side, but also from the river side. In reference to ECOMM Councillor Clements noted that there were a number of items in the press, they have long since been resolved. The system continues to function well beyond their expectations. Councillor King commented on her recent vacation and went on to thank Jim McBride for being a wonderful colleague. Councillor King stated that "Kamloop's gain is our loss". Mayor Durksen expressed his appreciation to Mr. McBride as well. Mr. McBride thanked everyone for their comments and stated he has enjoyed working in Maple Ridge. In response to a question from Mayor Durksen on the Downtown Core, the Chief Administrative Officer responded by stating that the costs that will be incurred with this public/private partnership are lease costs, where the public will lease back the public buildings including the library, the arts center, the youth center, the expansion to the leisure center and also some office space adjacent to the existing municipal hail. The District's costs will be 2.4 million dollars per year which is all inclusive. In the event that the District wanted to proceed with those public buildings by borrowing the money, the cost of borrowing the money would be 2.4 million dollars per year. By going into a partnership with a private developer, two components are brought into the project other than the ones earlier mentioned, namely a Hotel and an office building which in fact generate property tax which then can be used to offset those public payments. The tax payments for a hotel and office building are approximately $500,000. per year. Therefore if you net that out against the lease, it comes out under 2 million dollars per year right away. In addition the two private sector components, the hotel and office building will purchase municipally owned land at fair market Council Meeting Minutes August 24, 1999 Page 19 value. They will be paying to the District 1.7 million dollars for the land that they will occupy for those two private components. In addition, the private components that Council has repeatedly pointed out, are important to the Core to secure people-oriented business community in the downtown. It has the opportunity to rejuvenate the downtown core which is a very important policy that this Council and previous Council's have had for many years. Mr. Robertson went on to state that Council has directed that there be no tax increases in order to support the project. As a result of that direction, the funding will come from a number of sources as follows: Sale of land for both the office building and the hotel, which generates approximately $1.7 million; secondly - building permits for the core project, both for the public and private components. The office building and the hotel generate more than half a million dollars per year in current dollars each and every year, therefore that is a significant amount. In addition, the District does have a very large land inventory, and the land inventory was built over a number of years with a view to having it support strategically specific capital works. So there will be some selective land sales to provide money for the core project. There are some parcels of land that are currently right for development, they are adjacent to services and they have always been designed to be sold. The recommendation will be made to Council that they be sold for best value and the money returned to the core to support facilities. Another source of revenue Mr. Robertson stated was the growth in the tax base. Every year the tax base in Maple Ridge grows by somewhere between $750,000. and a million dollars. Theyare suggesting that a portion of that be allocated towards the Core, even if its a 10% allocation on an annual basis, that will be $100,000. Particularly what that does, is it allows a growing community to support the types of facilities that will be built. In addition, Mr. Robertson stated there are some capital works reserve monies that are available. The District of Maple Ridge operates a budget system that does have a lifecycle cost for buildings and in fact because of these buildings being leased, we will not have to allocate those monies into the Capital Works Reserve and that is a significant amount of money annually. Our lease arrangement will require the developer to be responsible for major maintenance. Mr. Robertson concluded by stating there is a growth expected of users payments toward facilities such as the leisure center and the arts center. There will be some specific user payments that we can project for those buildings. The hotel will not build a pool and fitness center, they will utilize our facilities and we anticipate additional revenues there. Our sense is that we can achieve Council's objective and not have to increase the tax burden to support the downtown core. Council Meeting Minutes August 24, 1999 Page 20 In response to a question from Mayor Durksen, Mr. Robertson responded that what they are talking about in reference to land sales is less than 10% of the total inventory. Mr. Robertson pointed out that some of that property was acquired through tax sale, that have been sitting there not paying taxes to the District for quite some time. Councillor Levens noted that the present library is a leased building at 15,000 square feet. According to statistics, a municipality should have a library that is equal to half of a square foot per person which is equal to a library of 30,000 square feet. Councillor Levens suggested it might seem as a huge jump, but all we are doing is building a library that the municipality should have had years ago. Mr. Robertson responded to Councillor Leven's comment stating that the Library is projected to be 40,000 square feet. The District was asked to submit a federal government grant application called "Smart Communities" and we have been advised that our application has past the first round of that competition. There would be 5 Million dollars allocated to a municipality in B.C. to build something like a high tech library. If the District is successful, it would go a long way to equipping the library with computers, etc. Mr. Robertson stated that in addition to the sources of revenue that have been stated, there are also grants and other sources of revenue that we are not directly counting on. The General Manager of Community Development, Parks and Recreation noted that the park space will actually increase through this development. Mr. Murray explained that what this plan will do is increase the space from approximately 88,000 square feet to almost 135,000 square feet, which is almost a full acre increase. Coupled with the reconfiguration, that puts spaces that are currently separated by buildings together, will mean a much more effective space for events that we have come to enjoy in our community. Mr. Murray noted that a lot of that is possible due to the underground parking. Councillor Stewart in reminding the public why the District is doing this stated this is the result of studies and surveys that directed the Council to this downtown core development. Studies which were done such as the Angus Reid, the O.C.P. Review, the Downtown Action Committee and many user groups who have provided this type of direction to Council. Councillor Clements noted it has been many years since the downtown area enjoyed the agricultural fair grounds and he felt this was just a continuation of the update of the core area that started many years ago. Mayor Durksen stated he felt that was also the way they started the Fields for Kids and we now have excellent playing facilities for our kids along with the arena. Mayor Council Meeting Minutes August 24, 1999 Page 21 Durksen also made reference to E.C.R.A. which is opening October 23rd which will have four times the previous space. 09 VISITOR A CKNO WLEDGMENT Nil. 10 ADJOURNMENT @ 8:30 p.m. 11 QUESTIONS FROM THE PUBLIC 11.1 Mr. Harry Nicholson re Downtown Core Mr. Nicholson questioned the process the District is using for the Downtown Core, stating that there are very few people on the street that talk positive about the project, which means they haven't been sold. He noted also that the business community has not shown any spirited response for this project either. Mr. Nicholson suggested the public doesn't know what they are getting. He suggested the District would get a better turnout if a referendum was held on this. Mr. Nicholson stated he felt this project would crowd an already compacted area. Councillor Gordon responded to one comment, noting that previous referendums have been for borrowing money for the facilities, not for whether the public wanted the facilities. With this project the District is not borrowing money. Mr.Eric Phillips - Train Whistling Mr. Phillips stated he has lived in the Hammond area for the past eighteen years and has never had a problem with train whistling in that area. He stated he was opposed to having the train whistling eliminated. As President of the Hammond Community Association he has never had anyone approach him with the train whistling problem. He suggested Council should let the issue die on the rails. Council Meeting Minutes August 24, 1999 Page 22 Mr. Robertson noted that the key point in this matter is that any Council does not have the authority to deal with the train whistling issue. Council can not make them stop, the authority is simply not there. There is nothing Council can do about it. Mr. Robertson did state that the rules that deal with train whistling are in the process of change and part of the problem is that as they change, some of the communities have picked up on opportunities to have train whistling stopped in their communities. The problem that has been discussed with this practice is that it makes it even more confusing when you go from one community to the next and one may have a whistle rule and then no rule, etc. etc. .which is unsafe and difficult for people to follow. Mr. Robertson stated Council has been advised that there is not authority and the District has to wait and see what the rules will be. At the present time there is nothing the District can do. Mr. Phillips stated that C.P. Rail has great concerns about safety and liability on this subject. This report outlines options available, discusses the merits of each option and recommends that the development variance permit be authorized. RECOMMENDATION: That the Municipal Clerk be authorized to sign and seal Development Variance Permit DVP/24/99 and, That as a condition of Final Reading of Zone Amending Bylaw 5326-1995, a building scheme be approved and registered. BACKGROUND: On July 13, 1999 Council reviewed a development variance permit application (DVP/24/99) requesting a reduction in pavement width and right-of-way width for a development proposal located at 11358 236 Street. During discussion of this application, concerns were expressed that the subdivision geometry had changed from the geometry presented at Public Hearing in October 1995. As a result, Council deferred consideration of this application and requested a report that outlines options for either: Referring the original application back to Public Hearing Re-submitting the original application to a public information meeting Finding a solution for the road system Zone Amending Bylaw 5326-1995 to rezone the subject parcel to CD-1-93 was presented at Public Hearing on October 17, 1995. The subdivision geometry shown at Public Hearing is attached as Sketch 1. This bylaw was given third reading on October 24, 1995. Conditions to be met prior to Final Reading include the registration of a Rezoning Development Agreement and the deposit of security outlined in the agreement. The site is the subject of a subdivision application (SD/43196) and a letter of conditions and requirements or preliminary layout approval (PLA) has been issued. The geometry attached to the PLA is shown in the attached sketch 2 Approval of subdivision relies on, among other issues, adoption of bylaw 5326-1995 and issuance of a variance requested by DVP/24/99. DISCUSSION: As a result of Council's concern and in order to resolve this issue there are several options available, including: Rescind third reading and send the bylaw to a new public hearing Public info meeting and report to Council Proceed with the revised geometry The following is a discussion of these options. New Public Hearing Council could rescind third reading and require a new Public Hearing. Although the proposed zoning would be the same as previously requested (CD-1-93), the revised geometry would be presented, along with the proposed design guidelines for this development. Council would hear comments and concerns from the present neighbourhood regarding this proposal. Presentation at a new Public Hearing would delay this project by several months and would not offer a guarantee that the geometry presented at public hearing would be the approved layout unless steps were taken to limit development to the layout shown at Public Hearing. In general, if Council is concerned that alternative subdivision patterns could be considered after presentation at Public Hearing, this issue could be resolved through a Section 219 restrictive covenant limiting development to the pattern shown at the Public Hearing. If a concern regarding subdivision geometry is raised at Public Hearing, the request for this covenant should be made during consideration of second and third reading of the zone amending bylaw. Although second and third reading have been given to bylaw 5326-1995, this requirement could also be made a condition of final consideration of the present application. Public Information Meeting Council has adopted a policy regarding Public Information Meetings (see attached copy). These meetings are intended to advise the public of the details of the development proposal in advance of presentation at Public Hearing. The meetings offer a chance for the developer and the neighbourhood to discuss the proposal in an informal meeting. Observations from the PIM are prepared by staff and the developer and are forwarded to Council when first reading of the zoning bylaw is requested. In this circumstance, a Public Information Meeting is not recommended. The zoning bylaw was presented at Public Hearing in 1995 and no further input can be received by Council. -2- 3. Proceed with the Revised Geometry Staff, in support of the development variance permit, recommended that the revised geometry be accepted. The development yield is increased and the amount of constructed roadway is decreased. Further, lots adjacent to the existing subdivision to the north are 15 m wide, matching the minimum width requirements of the RS-lb lots to the north. The geometry allows for development to the south and in staff's opinion, provides an acceptable alternative to the geometry shown at Public Hearing. In support of the revised geometry, staff also recommend that a building scheme be approved prior to final consideration of the Zone Amending Bylaw. At the Public Hearing in 1995, a detailed building scheme was presented as an integral part of the development proposal. Although the subdivision geometry has changed, staff still feel that a higher level of design control is warranted, and that a building scheme should be registered as a part of the zoning process. CONCLUSION: Considering the above, staff recommend that the Municipal Clerk be authorized to sign and seal Development Variance Permit DVPI24/99. R. W. For any application involving an Official Community Plan amendment (other than a boundaiy adjustment for envirorunental or legal reasons), or for the rezoning of land to permit a significant amount of development in compliance with the Official Community Plan (any development proposing 50 or more dwelling units - or in the case of a staged development, where the site has the potential for 50 or more dwelling units) or where in the opinion of the Director of Planning, that a smaller development could have a significant impact on the amenities or character of the surrounding area, that the development application includes a package of materials to be presented and considered at a public information meeting. This information package would include: a conceptual plan of development, a statement regarding the benefits of the proposed development to the community, a statement regarding the relationship of the proposed development to the topography and vegetation of the site and surrounding lands, d a statement regarding the "fit" of the proposal into the character of the neighborhood. a statement regarding the environmental sensitivity of the site and steps proposed to deal with the preservation of appropriate lands or vegetation, a statement regarding the proposed on and off site servicing for the site. 2. The application and the materials would be reviewed in the normal manner by staff and a recommendation made to Council that the application and supporting materials be: forwarded to a Public Information Meeting, or forwarded to a Public Information Meeting when amendments to the proposal as specified in by Council are made, or not be further considered. If Council forwards the application to a Public Information Meetings, and approves the materials submitted, the applicant is then responsible to hold and host such a meeting (the location and time of the meeting to be approved by the Director of Planning), including notification of all households within the same area specified for a formal public hearing, the arrangement for and provision of facilities. the presentation of materials, and the recording of comments and questions. A staff member from the planning department would attend the meeting, and after receiving the comments and questions and a report from the applicant on changes proposed (if any) as a result of the comments and questions raised in the meeting, staff would prepare a report to Council with recommendations as to amendments to the application that Council should consider before further consideration. 4. Council considers the application, the public input, the recommendations of the applicant and staff, and determines whether the application should: proceed toa pUblic hearing with conditions to be met prior to that hearing, or not be given further consideration. 5. Council considers a By-law and holds the statutory Public Hearing as per the present procedure. 6. Council considers the application after the Public Hearing and either approves or denies the application (the applicant would meet the nornial conditions as per the present procedure prior to final consideration). There are no plans at this time to use this site for any of these uses. The site is presently used to accommodate overflow parking for special events at the Fairgrounds. This application will allow the placement of a 6 m x 3.6 m sign on the Lougheed Highway frontage of the site. The sign will provide information on community events that are taking place at the Fairgrounds and Planet Ice. It is recommended that the sign be approved under a Comprehensive Sign Plan to regulate all signage for the Fairgrounds site. V PLANNING ANALYSIS Official Community Plan Schedule 'B' The subject property is currently designated as Agriculture. It will be necessary to amend Schedule "B" and redesignate the site as "Park" to coincide with the CD-4-88 zone. Council's Policy states that where the Official Community Plan is to be amended a Public Information Meeting must be held. Staff are of the opinion that this is a minor amendment recognizing the existing use and recommend that the need to host a Public Information Meeting be waived. Schedule 'G" Schedule 'G" must be amended to designate the subject site as "Non Farm Use - Municipal Park". This acknowledges the Fairground designation and recognizes the non-farm use in the Agricultural Land Reserve (ALR). Agricultural Land Reserve The property is in Area 3 of the ALR. The Agricultural Land Commission (ALC) reviewed this area in 1993 and considered that agri-industrial uses for lots adjacent to the Lougheed Highway were appropriate. It recognized that given the urbanization in the neighbourhood, intensive agriculture operations would not be suitable but that other non-soil bound activities (such as low impact open space recreation) would be suitable. In 1998 after the Rural Plan Review, the area was reviewed again by the ALC and a decision was made to exclude approximately 60 ha east of the subject site from the AL.R. That review reconfu -med the Commissions earlier view that the balance of Area 3 remain available for agri-industrial uses within the ALR. Soils in Area 3 are generally Class 3-4 and are capable of supporting agricultural uses. The ALC concedes that while agri-industrial uses are appropriate, buildings and hard landscape coverage should be restricted to keep the soil in a condition suitable for possible food production. In January, 1999 Council authorized staff to proceed with the process which may lead to the installation of a readograph sign on this site. ALC approval is a part of this process and is therefore a condition of final read ing. VI OTHER CONCERNS The Zone Amending Bylaw will require approval from the Ministry of Transportation and Highways under Section 57 (2) of the Highway Act. VII CONCLUSION: The development application area would permit the construction of an information sign for events that take place on the Fairgrounds. Brown Ave., located one lot to the south, is the boundary between the commercial district and the high-density residential district. The three lots, which collectively form the development site, are on the south east corner of Fraser Street and 121 Avenue. The development consists of a four storey, 48 unit apartment on a consolidated site approximately 0.256 ha. (27560 sq. ft.) in area. -2- The project is sponsored by the Greater Vancouver Housing Corporation. The proposal provides a combination of seniors and family housing. Each has a differentiated entry and amenity area. The seniors' units are proposed to be one bedroom while the family residences will be 2 to 3 bedroom units. There will also be adaptable units that can be converted to full access handicap units at a future date. V PLANNING ANALYSIS (i) Official Community Plan The property is designated Apartment District (100 - 250 upnh) in Schedule "B" of the Official Community Plan. The proposal achieves a density of 177 upnh, which is consistent with the density objectives adjacent to the core. The four storey building proposed is also consistent with the building form for other apartment development in the area. Consistent with Council Policy regarding multi residential developments, this project will be developed in accordance with the objectives and guidelines detailed in Development Perimt Area XXXIII. Accordingly, prior to final zoning approval, amendments to Schedules "A" and "H" of the Official Community Plan is required to include the site into this Development Permit Area. Advisory Design Panel: This project is subject to review by the Advisory Design Panel prior to Public Hearing. This review will provide preliminary comments with a more detailed assessment prior to issuance of a Development Permit. Servicing Requirements: The Engineering Department has identified that all the services required to support the development proposal do not exist to the site. It will therefore be necessary for the owner to enter into a Rezoning Development Agreement and post the security to do the works prior to final reading. The existing lane to the east of the development will be extended north to access 121" Avenue. A remnant portion of the existing lane is proposed to be exchanged for the new lane extension. The road exchange and consolidation of the lots to create the development site must be complete prior to final zoning approval. External Agencies: The property is located within 800 metres of the Lougheed Highway. Therefore, in compliance with Section 57 of the Highway Act, approval by the Ministry of Transportation and Highways is required prior to final zoning approval. VI CONCLUSION: This development is in compliance with the Official Community Plan. The density proposed achieves the objectives of the plan employing a building form which enhances pedestrian use in the neighbourhood and complements the neighbouring commercial district. To the north is another 3 storey apartment building while to the east and south are existing single family residences and a shopping mall respectively. The building has two separate entrances. One for seniors' off Fraser, and another for families off 12 1st Street. On the main floor are 7, 3 bedroom family apartments and 2 seniors' units. Near these entries are the amenity spaces, handicap washrooins, an office, laundiy rooms and small kitchenettes for group use. The amenity rooms lead to common outdoor spaces beyond. On the second, third and fourth floors are the remaining units, The seniors' units are located In the south-west end of the building around their own elevator. Parking meets the zoning bylaw and Is located underground. Access is directly off the existing rear lane. The building expresses a strong two-storey base with individual entry gates from the street. That bylaw was given final reading on March 9, 1999 The following dates outline Council's consideration of the application and Bylaws: - The land use report (see attached) was considered on April 28, 1998; - First Reading was granted June 23, 1998 and Public Hearing was held July 21, 1998; - Second and Third reading was granted on July 28, 1998; - Final consideration was granted to OCP Amending Bylaw 5665-1998 on March 9, 1999 The following are the outstanding Council conditions to be addressed prior to consideration of final reading: Approval from the Ministry of Transportation and Highways; Comments from the School District; Registration of a comprehensive building scheme; -1- 4) Road dedication as required in order to facilitate a left hand turn bay on Dewdney Trunk Road. As a result of a development applications west of this site an engineer's report was provided which addressed concerns with traffic on Dewdney Trunk Road. That report determines the need for a left hand turn bay on Dewdney Trunk Road. It will therefore be necessary to achieve road dedication as a condition of final reading Discussion: As a result of current market conditions the applicant has requested that a one year extension be granted to the application. Construction of the road and water works is included in Maple Ridge Development Cost Charge Bylaw No. 5615 - 1997 and is therefore subject to Development Cost Charge forgiveness consideration at the Building Permit stage. It is appropriate to forgive a portion of the Development Cost Charges payable as compensation for the DCC works being constructed by the developer. The total amount eligible for forgiveness equals $56,708.50. RECOMMENDATION: That with respect to Building Permit application BPC 076/99 for the property at 23795 and 23845 118 Avenue, be it resolved that in view of the necessity to construct road and water works on 118 Avenue, the highway and water components of the Development Cost Charges payable by the developer be reduced by $56,708.50. BACKGROUND: a) History: A building permit application BPC 076/99 has been received that proposes construction of an elementary school at 23795 and 23845 118 Avenue for which Development Cost Charges will be payable. The consultant has submitted the report and staff recommend that Council adopt the recommendations of this report. RECOMMENDATION: That the recommendations contained in the report titled 1161h Avenue, Maple Ridge: 240th Street to Creekside Street - Assessment of Need for a Road Link" be adopted and that the draft Cottonwood Guideplan be amended accordingly. BACKGROUND: At the May 10, 1999 CouncillStaff meeting, the issue of the extension of 116 Avenue from 238A Street to 240 Street was discussed. As a result of this discussion, Council asked staff to hire a consultant to determine the necessity of constructing 116 Avenue. N.D. Lea & Associates was retained to evaluate two alternatives; full road construction or pedestrian/bicycle path construction. The report has been submitted and is presented to Council for consideration. DISCUSSION: The consultants identified two alternatives for comparative evaluation purposes. These are: Full construction of 116 Avenue, including sidewalks Construction of a cycle/foot path only These alternatives were evaluated in terms of four main criteria: the natural environment the general public interest existing local resident's concerns development issues According to the consultant " Within each of these categories, factors were weighted and each alternative ranked according to how poorly or well it performed in relation to the particular 0 0A.0f aspect concerned. Weightings and rankings were based on an informed evaluation, drawing on a site visit and a wide range of relevant documentation." As a result of this evaluation process Alternative 1 (full road construction) had a ranking of 4.83 and Alternative 2 (cycle/foot path only) had a ranking of 6.42. The consultant therefore concluded that Alternative 2 is the preferred option. As noted in the report, the natural environment was given a weighing factor of 40% reflecting community concerns regarding environmental issues as noted in the Official Community Plan. Road network efficiency and neighbourhood connectivity was weighted at 25%, development issues at 20% and local resident issues at 15%. Given these weighting factors, the conclusion is understandable. Staff have reviewed the report and based on the evaluation process used, concur with the conclusion. The consultant has also offered a number of suggestions to lessen the impact on the natural environment for this crossing. These include: stream crossings will best be achieved using bridges instead of culverts sewage and water pipes should be incorporated into the bridge structure to avoid the need for excavation across the stream channel road cuts should be minimized effort should be made to follow contours to prevent the need for extensive cut and fill. It is recommended that these suggestions be incorporated in the design of the trail through this area. CONCLUSION: N D Lea & Associates have recommended that 116 Avenue from Creekside to 240 Street not be built as a full road, but that a cycle/foot path be constructed in the ROW. Staff concur with this recommendation and recommend that the draft Cottonwood Guideplan be amended to reflect this conclusion. \ OR. W. INTRODUCTION AND BACKGROUND The Cottonwood area is a growing urban area east of the established town core of Maple Ridge. Kanaka Creek and its tributaries limit the proportion of the area that is suitable for urban development, and together with other planned parks will ensure that the area will retain a highly desirable and attractive environment. Initial planning of the road network in the area' considered various options, all showing 116th Avenue as a continuous route from Haney Bypass west of 2 24th Street through to 240th Street, but with its cross-section varying between 2 and 6 lanes, depending on other elements of the road network, e.g. a proposed new Fraser River bridge and linked north-south route. More detailed planning for the Cottonwood area was carried out in 19922. At this stage 116th Avenue was shown as a discontinuous route, with Cottonwood Creek limiting east-west movement, and Dewdney Trunk Road and Kanaka Way being the only continuous routes between 232nd and 240th Streets. l'his, together with the fact that 116th Avenue ends at 240th Street, which it tees into, reduced the importance of 116th Avenue, making it a collector road rather than an arterial. This revised road layout was retained in the Cottonwood Land Use Guide Plan (not an officially approved plan, but used as a working base by the District). Horseshoe Creek is identified as a watercourse designated for special treatment and a conservation area adjacent to the creek is designated in the OCP. The owner of properties adjacent to the 116 Avenue alignment has applied to develop these properties, and has prepared a cost estimate for the construction of this road segment. Citing high construction costs and environmental concerns, the owner requested that the District eliminate the requirement that he provide a road link through the Creek, proposing instead that access to his property be from 240th Street to the eastern portion, and 238A Street to the western portion. A trail could be provided through the valley for pedestrian and cycle access. The District was, however, concerned to ensure that an adequate road network was provided to serve the area, with good connectivity between local areas to maintain a sense of community and prevent certain areas from being relatively isolated. In order to resolve the impasse between the District and the Developer, the Corporation of the District of Maple Ridge approached N.D. Lea to review this matter. N.D. Lea, in association with Gartner Lee, environmental consultants, submitted a proposal which was acceptable to both parties, and formed the basis for this investigation and report. These alternatives were: • Alternative 1: "With 116th Avenue", i.e. a road link provided between 240th Street and Creekside Street with sidewalks, curbs and gutters, but without provision for parking so as to reduce required width of construction and associated costs and environmental impacts (see Figure 1) • Alternative 2: "Without 116th Avenue", but with a foot/cycle path provided (possibly on a different alignment to the proposed 116th Avenue), and with access to the eastern portion of the development site directly from 240th Street (see Figure 2). Four key areas of concern were identified: The natural environment • The general public interest throughout the potential areas of impact • Existing local residents and land-owners in the immediate area Development issues and the Developer's interests In order to quantif' the various impacts, a table was prepared, with weights attached firstly to the four areas of interest mentioned above, to reflect their relative importance in percentage terms in relation to each other, and then to the various sub- areas within each of the four main areas. A rating was attached to each category/issue to indicate how poorly or well each evaluation item is met with or without the proposed road link. Each aspect is discussed in Section 3 below to give substance to the selected weightings and rankings. 3. COMPARISON OF ALTERNATWES 3.1 Comparative Weighting of General Categories In deciding the relative importance of the four main categories identified above, the key area of community concern in relation to the need and desirability of providing the 116 Avenue connection was the natural environment. The Official Community Plan (OCP) refers to a survey which found that 99% of Maple Ridge residents believe that streams, rivers and groundwater should be protected, while 98% agree with the need to protect environmentally sensitive areas. The OCP refers to the findings of neighbourhood meetings held throughout Maple Ridge in 1995 that "Citizens strongly support measures to protect the environment and to preserve community attributes (eg views, green spaces, natural features) in order to maintain the quality of life in Maple Ridge." To link Creekside and 240 Streets, 116 Avenue would need to cross Horseshoe Creek, a known salmon spawning stream and part of a greenbelt that extends from 240th Street just south of 118 Avenue, to Kanaka Way. The natural environment was therefore accorded 40% of the overall weighting. General community concerns, including issues such as road network efficiency and neighbourhood connectivity, taking all modes of transport into account, are also clearly of great importance from the municipal perspective, and this aspect was allocated a weighting of 25%. Given that the number of existing local residents affected by the provision or non-provision of the link is relatively small, this aspect was accorded a weighting of 15%. Development issues (particularly road construction costs) and development were rated at 20%, which was considered justifiable in view of the high costs involved, which is significant to both the developer and the District. This gives the justification for the rankings of each aspect in Table I. Their respective weightings within the relevant main category are also discussed. The rankings for each main category in each alternative are then entered into the summary table at the bottom of Table 1, giving the overall rating for each alternative. An explanation of the evaluation framework is given in Appendix B. 3.2 Comparative Evaluation Within General Categories 3.2.1 The Natural Environment 3.2.1.1 Introductory Comments In determining meaningful evaluation components within the "natural environment" category, it was concluded that an assessment of the study area's natural functions and attributes should be made and relative impacts of each of the two alternative road configurations (see Section 2) should be determined. Natural functions include such obvious biophysical factors as flow conveyance, forested areas serving both a fish and wildlife habitat role as well as an erosion reduction role, and important fish habitat involving important fisheries life history functions. Natural attributes include such factors as occurrence of rare or threatened species and presence of heronries or raptor nests. For purposes of this comparative evaluation in the Cottonwood setting, the following four Natural Environment components were deemed most meaningful: • Fisheries habitat • Soils/Slope stability • Vegetation • Wildlife Reasons for these choices follow. 3.2.1.2 Fisheries The proposed road alternatives cross two stream courses with Alternative 1 involving wider (7 meter minimum assUmed) and more intrusive crossings than the other (assumed 3 meter width and design more sensitive to ravine contours). In 1993, Horseshoe Creek was the only Kanaka Creek tributary draining the Cottonwood neighbourhood which supported Coho spawning. Of five locations where suitable spawning gravel occurs, "...a section near 116th Avenue ... is the best area" (Kerr Wood Leidal, 1994). This locational fisheries sensitivity plus the relative size of riparian zone affected (which in turn influences fish habitat suitability) was deemed a meaningful factor for the comparative evaluation. It was deemed to carry a higher degree of environmental importance. File: 81438.019 - 6 - N.D. las Consultants Ltd. / P:8I8 1438O19\7OO\HWT.9195-(O7.28) Oartner Lee Ltd. 3.2.1.3 Slope Stability One of the most important components of the biophysical setting of the Cottonwood neighbourhood are the marine clays into which the stream course ravines are cut. These fine-grained clay soils are highly erodable and unstable especially where slopes are steep. During storms and high flow conditions, the stream courses are very dynamic and can change course within the flood plain, sometimes causing serious erosion at the toe of the ravine slopes. These factors can influence water quality, can cause slumping of the ravine walls and result in silt deposition in otherwise suitable fish spawning habitat. Owing to its potential influence on many other environmental factors and potential to cause property damage, this component has been accorded weighting importance. It is measured by the width of ravine lands affected. 3.2.1.4 Vegetation Forested lands provide cover and movement corridors for wildlife, along with nesting and feeding habitat. As well, in the Cottonwood ravines, forests help to reduce erosion of the fine-grained soils. This Natural Environment component is viewed as having lesser importance than the previous two but is nonetheless significant in the Cottonwood setting. Its wildlife habitat and erosion reduction function is measured by relative area of forested lands to be removed by each transportation routing alternative. Clearly the impact is greater in Alternative 1. 3.2.1.5 Wildlife One important wildlife attribute of the study area is the presence of a raptor nest in a cottonwood tree in the western end of the 116th Avenue alignment (Alternative 1) just before the intersection with 238A street (Norecol Environmental Consultants Ltd., 1993). The nest was inactive at the time of that study (mid-March). In the absence of more up to date information, we have assumed that the nest is active and will require rerouting to avoid it or nest removal after the last expected occupancy date (July end).Once again, this factor has been accorded lower weighting but is nonetheless a potential significance in evaluating the relevant merits of each alternative. 3.2.1.6 Weightings and Results within this Category In light of the factors noted above, fish habitat and soils/slope stability was accorded the greatest weighting (30% each) with vegetation and wildlife each allotted 20%. Results of the Comparative Evaluation are presented in Table 1. The clear preference from the natural environment perspective is Alternative 2 which resulted in a combined weighted total of 6.7 out of 10. The main reason for this difference is the displacement of fisheries and wildlife habitat by the road (Alternative 1) versus the bicycle path (Alternative 2) through the Horseshoe Creek stream valley / ravine system. As well, potential slope stability I soil erosion issues contributed to the difference. 3.2.2 General Public Services 3.2.2.1 Road Network Efficiency As indicated in the Introduction, this portion of 116th Avenue would not provide a route for longer distance trips except for cases where such trips had either an origin or a destination in the adjacent areas. Examples of such origins and destinations are homes between 240th Street and Horseshoe Creek which can access 116th Avenue without first getting onto 240th Street; homes west of the Creek between about 114 and I 17B Avenues; the proposed elementary/ French Immersion school at 118/238B intersection, or the community shopping centre on 240th Street at Kanaka Way. In Alternative 2 all of these would be adequately served by other collector roads, eg. 118th Avenue, Creekside StreetJ238B Street. As this road link would purely serve as a local collector, it would have limited importance for wider road network efficiency. Furthermore, trips which would use it would not have a particularly onerous detour were 116th Avenue not linked across Horseshoe Creek. Alternative 2 therefore rates only marginally lower than Alternative I under this aspect. (This aspect is discussed in more detail in the Appendix.) 3.2.2.2 Neighbourhood Policies Maple Ridge favours a road system with good connectivity, based on the general grid system in the area. This is considered to enhance community, promote pedestrian comfort and improve safety, as traffic is distributed through the network and there are fewer major, busy arterials. This connectivity is difficult to provide in the Cottonwood area owing to the topography, but obviously where this is possible, it is favoured in terms of this policy. It should also be borne in mind, however, that the non-provision of 116th Avenue does not result in unduly poor links between and within communities. Alternative 1 is therefore preferred over Alternative 2, but not to any great extent. 3.2.2.3 Transit System 116th Avenue would be very unlikely to be a transit route. In Alternative 2, a pedestrian route would be available for access to bus routes on either 240th Street or Creekside Street This might be slightly steeper or less direct than a sidewalk along a road, and not having traffic alongside may create the perception of it being less safe from a personal security viewpoint, esp. for women and children (although some users may appreciate the more natural environment). Recreational cyclists would probably prefer the traffic-free environment of Alternative 2, and it would be safer for both pedestrians and cyclists, but steeper gradients would be viewed by some as a disadvantage. Overall, though, Alternative 2 appears slightly more desirable. 3.2.2.5 Municipal Infrastructure The installation of municipal services such as watermains and sewers is easier during construction of a road, favouring Alternative 1. District officials have indicated that it would probably not be necessary to provide a watermain through the valley; a sewer pump station may be required, but this would probably be the case even in Alternative I. To avoid the valley entirely may require a longer routing for sewer mains in Alternative 2. Alternative I is therefore preferred under this aspect. 3.2.2.6 Recreational Values Preservation of the environment of Horseshoe Creek would be significantly enhanced by limiting the through-route to a sensitively-routed and constructed foot/cycle path. This strongly favours Alternative 2. - 3.2.2.7 Weightings and Results within this Catego,y In terms of public services, transportation aspects are of primary importance. These aspects therefore account for 75% of the weighting in this category. Whilst in general network efficiency would be the most important subcategory, it has been allocated a weighting of 20% here, since even if the link is provided, its use would be fairly local in scope. 30% has been allocated to neighbourhood policies (largely transportation-related), 10% to transit aspects, and 15% to pedestrian/cycle routes. Other aspects which have a less significant bearing are municipal infrastructure (services), accorded 10%, and recreational values, with 15%. The comparative evaluation within this category gives a marginal preference to Alternative I over Alternative 2: 7.05 vs 6.30. 3.2.3 Existing Local Residents 3.2.3.1 Local Accessibility As mentioned in 3.2.2.1, this section of 116th Avenue would serve principally as a local collector, so the scale of movements that would be affected by provision or non-provision of this link is important in ranking this aspect. Neither the number of motorists affected nor the extent to which they are inconvenienced would be particularly large if 116th Avenue is not built. Very few existing residents would benefit from the road, as the area that would be served by 116th Avenue consists largely of new development (either under construction or still in the planning stages). Apart from homes as trip ends, there is an elementary/French immersion school site at the 118th Avenue / 23 8B Street intersection; a proposed neighbourhood shopping centre at Creekside/1 16th, and a community shopping centre at 240th/Kanaka Way. The most common trips using 116th Avenue in Alternative 1 would be: • from homes east of Horseshoe Creek to the school at 11 8th/238B; • from same homes to neighbourhood shops at Creekside/116th; • from homes west of the Creek to community commercial at Kanakal240th. It should be borne in mind that pedestrian/cycle access across the Creek will still be available if 116th is not built for vehicular traffic. Also, the extra distance for auto trips would not be great. However, some of these would be rerouted via the much busier 240th Street, which would involve some delay at intersections, and a slight increase in accident risk. From a local accessibility viewpoint, therefore, Alternative 1 is certainly preferable, although the scale of the "problem" does not warrant a major difference in ranking between alternatives. More detail is given in the Appendix. 3.2.3.2 Local Traffic Pressures An important issue is the potential impact in Alternative 2 of additional traffic past existing homes. The only existing homes adversely affected to any significant extent would be about 15 homes on 118th Avenue between 238B and 240th Streets. Traffic along this road is likely to grow significantly whether or not 116th Avenue is built, since it gives access from 240th Street to a French Immersion / elementary school, which will attract children from a far wider radius than the average local elementary school, with a greater proportion being brought by car to school. With the school accommodating 475 students the number coming via 116th, and therefore diverted to 118th in Alternative 2 would likely be small at school peak traffic times. In the evening peak and after hours, only trips to the proposed neighbourhood shopping centre would add to traffic on 118th in Alternative 2, and the numbers would not be large. 3.2.3.3 Weightings and Results within this Category Since few existing residents experience any significant difference in accessibility between alternatives, this aspect is accorded 35% of the weighting, with local traffic pressures being 65%. Alternative I scores 7.0 in this category compared with 4.0 for Alternative 2. 3.2.4 Development Issues 3.2.4.1 Development Land Alternative I involves the loss of a considerable width of land to provide a road with sidewalks, and because of the significant fill required. In Alternative 2 this is reduced to a narrow strip for a pedestrian and cycle path, which can be routed to File: 81438.019 - 10- N.D. Whilst access still has to be provided, this can be achieved in Alternative 2 to from the existing road system with somewhat less land take. 3.2.4.2 Development Options In Alternative 1, 116th Avenue plays quite a dominant role in determining the shape of areas to be subdivided or developed with townhouses. In Alternative 2 the Developer has far more flexibility. 3.2.4.3 Servicing Costs Apart from road construction costs (see 3.2.4.4), the cost of servicing the subject site would be somewhat more in Alternative 2, making Alternative 1 the preferred option for this aspect. However, this is not a major issue, and anticipated cost differences are not large. 3.2.4.4 Road System Costs This is the most significant development issue. Initial estimates for the construction of this link were around $588,000, of which $200,000 would be supplied by the District as a Development Cost Charge (DCC). Whilst the cost of a pedestrian/cycle path has not been determined, and it would probably involve constructing a light wooden bridge structure, it would obviously be relatively low compared with the cost of constructing a road with a major culvert (though as a salmon spawning stream, an even more expensive bridge structure may be required to minimize disturbance of the stream bed). 3.2.4.5 Weightings and Results within this Category Cost is clearly the dominant factor in this category, being important to both the Developer and the District. Road System Costs have therefore been allocated 50% of the weighting for this category. 20% each has been allocated to development land and development options, with 10% allocated to servicing costs. The result of the comparative evaluation is a score of 5.20 for Alternative 1, and 8.50 for Alternative 2. The key results for the main categories are: Natural environment: Alt. 1—l.80,Alt.2-6.70 General public services: Alt. I - 7.05, Alt. 2— 6.30 Existing local residents: Alt. I - 7.00, Alt. 2 —4.00 Development issues: Alt. 1 —5.20, Alt. 2 - 8.50 5.2 The result of the overall evaluation was that Alternative I had a ranking of 4.83, and Alternative 2, 6.42. Alternative 2 is thus the preferred option in terms of the evaluation exercise reported here. SENSITiVITY OF RESULTS TO DIFFERENT WEIGHTINGS Introduction As may be seen from Table 1, the overall rating of each alternative is dependent on the weightings given to categories and subcategories, and on the ranking on a scale of I to 10 given to each alternative for each subcategory. The table was set up to cover the full range of relevant issues, to avoid "double-counting" and not to favour a particular conclusion. Individual subcategory rankings were allocated not knowing what the overall result would be in order to reduce bias. The justification for the weightings selected has been presented in the relevant sections of the report, and it is considered that the rankings used are a reasonable reflection of how well each alternative performs. As the weightings and rankings are qualitative, albeit based on an informed assessment, other reviewers might have allocated slightly different rankings and weightings. This section looks briefly at how sensitive the end result is to variations in the rankings and weightings. Weighting of Main Categories Two categories, natural environment and development issues, have Alternative 2 rated as significantly better than Alternative 1, whilst in the other two (general public services and existing local residents), Alternative 1 is better than Alternative 2. If, therefore, general public services and existing local residents are given greater weight - say, 30% and 25% respectively - this will obviously favour Alternative 1, bringing its overall weighted value up to 5.36, and Alternative 2's down to 6.27. Whilst this narrows the gap, natural environment and development issues would need to be given unrealistically low weightings for the two Alternatives to gain similar overall rankings. In view of the high cost of constructing a road, it might be justifiable to increase the weighting for development issues. This would obviously favour Alternative 2 over Alternative 1 even more than is reflected in the table. 5. 5.1 File :81438.019 - 13 - N.D. Lea Oonsulfan4e Ltd. / P:\8I\81438\019\700',HWT-9195-(07.28) Oartnor Lee Ltd. 5.3 Weightings within Categories Similar principles apply here, except that any changes to weightings within categories were found to have less impact than changes between categories. 5.4 Sensitivity of Rankings It was not considered desirable to carry out extensive tests of different rankings, since every effort was made to minimize bias. In certain cases it was difficult to decide whether to allocate, say, 4 and 6 for a particular subcategory, or 6 and 8. Such variations were tested, and also found to have minimal impact on the end result. R}COMMENDATIONS 6.1 It is recommended that Alternative 2 be adopted, i.e. no road, only a pedestrian/cycle path. 6.2 It is further recommended that the implications below be noted and the associated recommendations followed during development of the site and footpath. IMPLICATIONS Regardless which option is selected, a number of suggestions are presented to lessen impacts on the natural environment. First, stream crossings will best be achieved using bridges instead of culverts which in the case of Alternative 1 may increase costs significantly. This will facilitate fish passage and continued spawning in the 116th Avenue area as well as ensuring uninterrupted wildlife movement. Sewage and water pipes should be incorporated into the bridge structure to avoid the need for excavation across the stream channel. Second, road cuts should be minimized and in the case of the pathway, effort should be made to follow contours to prevent the need for extensive cut and fill. Finally, tree removal should be minimized in the ravines and the path system should be kept as narrow as practical to minimize exposure of the erodable soils. File 81438.019 - 14- N.D. A sample count in the evening peak at 118th Avenue / 240th Street in June 1999 gave peak hour flows as follows: NB on 240th : 206 vph SB on 240th : 89 vph EB on 240th : 24 vph Total : 319vph Total peak hour flow through the Creekside / 118 / 238B intersection is estimated at 130 vph. Count data supplied by the District gave pm peak hour flows of 117 NB and 158 SB on 240th just south of Dewdney Trunk Road. AM peak hour flows were very similar in magnitude. Two-way flow along Dewdney both east and west of 140th was around 1060 vph in the pm peak hour 1994. Two-way flow on Dewdney just east of 236th Street was 1380 in 1997. A2 FORECAST TRAFFIC FLOWS The Cottonwood Major Road Network Study forecast pm peak traffic volumes on build-out in 2002 to be as follows: 240th south of Dewdney : 590 NB, 975 SB, 1565 two-way 238B south of Dewdney : 110 NB, 160 SB, 270 two-way 240th north of Kanaka Way : 615 NB, 940 SB, 1565 two-way 236B north of Kanaka Way : 220NB, 200 SB, 420 two-way Clearly, flows on collectors such as 236B / Creekside / 238B are not expected to be particularly large. In the study area, the dominant attractor of trips in the morning peak will be the elementary school at 238B / 118th Avenue, which, with 475 students, will probably attract around 230 trips in and 200 out. It is likely that about one third of the inbound trips (75 vph) and maybe 20% of outbound trips (40) will use 240th Street and 188th Avenue. The reverse patterns will occur at the end of the school day, but in the pm peak, flows are more likely to be similar to the forecasts in the Cottonwood Major Road Network Study, i.e. between 250 and 400 vph two- way. A3 TRAFFIC DIVERTED FROM 116TH TO 118TH AVENUE IN ALTERNATIVE 2 This would be the "major" impact for existing residents in Alternative 2; traffic volumes on Creeksjde and other collectors in the area would not differ significantly. Considering the rectangular "area of influence" to be 240 - 236 Street between about 1 14A and 118 Avenue, it is estimated that, with 2/3 of the developable area having townhouses at 10/acre, and 1/3 single homes at 5/acre, 740 units could be built. Assume: - tripsfhh/day - 20 - 30% would use 116th Avenue - 50% of these trips would re-route to 118th Avenue This would amount to between 600 and 900 vpd two-way, or 60 - 135 trips in the peak hour. Traffic volume on 118th Avenue might therefore increase from between 100 and 200 vph in the pm peak, to between 160 and 335 vph. Traffic flow would be higher in the morning peak hour because of the school, but still not heavy, with diverted traffic in Alternative 2 being a similar proportion to the evening peak situation. This is still well within the range of volumes one would expect on a collector (250 - 300 vph in the peak, 1000 - 8000 vpd). File: 81438.019 A - 2 N.D. These were used in a calculation process which gave an end result expressed as a value between 0 and 10 for each alternative. The alternative with the higher value is the preferred alternative in terms of this evaluation framework. The four main categories evaluated were: • Natural environment • General public services • Existing local residents • Development Issues Each of these was accorded a weighting, such that the sum of the weightings equalled 1.0. Within each main category, sub-categories were identified, and also weighted to give a total of 1. For each sub-category, each of the two alternatives was given a ranking between 0 and 10, according to how "well" the alternative "performed" in that particular aspect. Thus in the main category "Natural Environment", under the sub-category "Fish Habitat" Alternative 1 had a ranking of 1 out of 10, and Alternative 2, 7 out of 10 (see Table 1, first line of numbers). These rankings were then multiplied by the relevant subcategory weightings (e.g. 0.3 for Fish Habitat) to give weighted values (0.30 for Alternative 1, 2.10 for Alternative 2 in our example). The sum of the weighted values indicates the performance of each alternative under the particular category. Thus in our example, under Natural Environment Alternative 1 scored 1.8 out of 10, and Alternative 2, 6.70. The weighted values for each category were than-- transferred to the Overall Summary table at the bottom of Table 1, and the process repeated in order to obtain a single overall figure for each alternative. RECOMMENDATION: That the application for a fill permit under Permit Regulation Section 2(1)(d)(vii) of the Soil Conservation Act submitted by Ms. Murrell for the property at 13473 224 Street be granted an exemption provided the placement of fill is carried out in compliance with the relevant provisions of the Maple Ridge Soil Deposit Regulation Bylaw No. 4569 - 1991 and subject to provisions of the Soil Conservation Act. BACKGROUND: An application was made to the Agricultural Land Commission by Ms. Dian Murrell of 13473 224th Street for an exemption from a permit for placing fihl.(Note: incorrect street address referenced in ALC letter dated May 18th, 1999.) The exemption was supported by the Agricultural Land Commission and forwarded to the District for comment. The application was made in order to alleviate livestock flood hazard during periods of high flow along the North Alouette through the construction of an elevated livestock paddock. Upon further review of project justification staff are supporting the exemption as it relates to the placement of fill for the construction of roads and facilities made necessary by the threat of flooding. Given the limited fill area proposed by this application and the immediate need to secure some protection measures on the property before the fall rains staff feel it is prudent that the District again consider supporting this application. This application and the concerns raised by residents in the low-lying areas adjacent to the North Alouette supports the District's position that a comprehensive hydrological study of the hydrological impacts of filling adjacent to the North Alouette River should be conducted. With the implementation of the study dependent on the receipt of external grant funding it would be inappropriate to withhold support for this exemption application pending study completion. Staff feels that the immediate need for flood protection at 13473 224th Street should take precedent at this time. A copy of the letter from the Agricultural Land Commission dated May 18' granting exemptions for the placement of fill on the property is attached for your information. The applicant has requested that he be allowed to phase this payment to match the percentage of land under application. Payments would be secured by a restrictive covenant registered against the land under Section 219 of the Land Title Act. Municipal staff have reviewed this matter with the municipal solicitor and support the request. The solicitor has advised that both a Council resolution and a School Board resolution are required for the deferral. This issue has been discussed with School Board staff. They support the request and will be recommending Board approval of an appropriate resolution. Oo7 Staff will be discussing this matter with School Board staff and will bring a recommendation to Council and the Board within the next few months to change the agreement to allow phased payment, thereby eliminating the need for a Council and Board resolution for each request. V CONCLUSION Both the School Board staff and the District staff support this request. RECOMMENDATION: That the Memorandum of the Municipal Clerk dated August 6, 1999 be received noting that it is reported therein that David Alexander and Randy Wagner, two candidates in the 1996 General Election, have failed to file the required Campaign Disclosure Statements and are therefore disqualified from running in the 1999 General Election. BACKGROUND: Bill 88 - 1999 was given Royal Assent on July 15, 1999 and amends many provisions of the Municipal Act. Details of some of those changes have been noted in material circulated by the UBCM and the Ministry of Municipal Affairs. Some of the changes impact the Election Provisions and will have bearing on the 1999 General Election. Section 92.2 (new) requires that I provide a report to the Municipal Council at an openg' meeting indicating which candidates and/or elector organizations involved in the last general election have failed to file the required Campaign Disclosure statement. While this new clause applies to the 1999 General Election and subsequent elections, following a discussion with the Municipal Solicitor and keeping in mind new authority given to the Chief Election Officer (Described later in this Memo), it is deemed prudent to provide this report at this time. Accordingly I advise that the following individuals failed to file the Campaign Disclosure statements for the 1996 General Election and thus are not qualified to run in the 1999 General Election; • David Alexander (Candidate for Mayor) • Randy Wagner (Candidate for Councillor) All of the candidates were provided with Nomination packages that included material indicating the requirement to file the statement within 120 days of the general election (Due March 17, 1997).
