The Minutes of the Municipal Council Meeting held on September 14, 1999 at 7:00 p.m. in the
Council Chamber of the Municipal Hall, 11995 Haney Place, Maple Ridge, British Columbia for
the purpose of transacting regular Municipal business.

03 DELEGATIONS
03.01 Blake Manning - World Karate Kobudo Championships
Blake gave a demonstration of the karate skills that led to his placing fourth overall in
the World Karate Kobudo Championships in Okinawa, Japan. He advised that he
participated in the Home Stay Program and presented Mayor Durksen with a gift
from the Mayor of Osoto Village where he stayed.
The Mayor congratulated Blake for his accomplishments and thanked him for
representing Maple Ridge in the Championships.
03.02 Ridge Meadows Crime Prevention Program
Corporal Pat Walsh, Officer in Charge of Community Policing, and Ms. Sharleen
Verhuist, Crime Prevention Co-ordinator, were in attendance to provide an update on
crime prevention initiatives in Maple Ridge and Pitt Meadows.
Corporal Walsh explained that the detachment is divided up into four zones and there
is a Community Policing Committee in each zone. Community policing is founded
on the premise that responsibility for policing is a community function. There are
many volunteers involved in community policing and the efforts of a small number of
police officers can accomplish tremendous results with the involvement of those
volunteers. It is the function of the volunteers to identify to the police issues of
common concern so that the police can develop action plans to deal with crime
disorder problems.
Ms. Verhuist noted that Maple Ridge's business community, Council and the local
media are all very supportive and that is the reason Maple Ridge's programs have
moved forward so well.
She advised that the Crime Prevention office is very proud of the Citizens on Patrol
Program. The volunteers give up their Friday and Saturday nights to patrol around
the community and report suspicious and criminal behavior. She noted some of the
successes of the program.

She provided an update on the success of the Speed Watch and Block Watch
programs, noting that there are 4000 Block Watch houses between Pitt Meadows and
Maple Ridge.
Mr. Verhuist explained that people can report drug houses in their neighbourhood and
that a special reporting package for this purpose is available at the police offices.
Corporal Walsh extended his appreciation to the corporate citizens, too numerous to
mention, for their considerable support of the crime prevention programs. He also
thanked the Mayor and Council for their support over the last three years.
The Mayor commended the Crime Prevention Unit on their considerable
accomplishments.
03.03 Mr. Lyle J. Homey re Water Rates - Rothsay and Garibaldi Heights
Mr. Homey referred to By-law No. 58 12-1999 setting out the new water rate structure
for the Rothsay-Garibaldi Heights area following the connection of those private
waters systems to the Municipal water system.
He expressed concern that the annual rate is $500 per year for their area and $143 per
year for the rest of the residents in the Municipality. He stated that if the by-law is
not rescinded, there will be many upset people in that area. He feels that by changing
the rates Council is setting a precedent.
The Mayor advised that the District plans to schedule a public meeting to explain, the
costs of the new system and how the water rate was determined. He noted that it is
costing the District $2.1 million for the work. The District is applying for a Provincial
grant to help offset some of the cost.
Mr. Homey referred to a public information meeting that was held last year and noted
that there were no Council members in attendance to answer the political questions.

Discussion
Councillor Gordon asked for clarification of the restrictive covenants that have
been placed on the site by the Ministry of Environment.
The Director of Current Planning advised that the restrictive covenant is to protect
Katzie Slough which lies to the west of the site. It covers the setbacks and
minimum elevation requirements.

06.02.02 Contract Recommendation - Dewdney Trunk Road & Dover Street Pedestrian
Traffic Signal.
Reference was made to the staff report dated August 24, 1999 in support of the
following recommendation contained therein:

Pedestrian Signal
Contract that Contract No. E-02-120-006 to install a lighted and marked pedestrian
walkway at Dover Street on Dewdney Trunk Road be awarded to
Transwestern Electrical Ltd.
Discussion
Councillor Stewart noted that there was some discussion of where this item, as
well as the proposed pedestrian light at 230 Street and Dewdney Trunk Road, fit
into the Capital Works Plan. He asked for further clarification.
The General Manager of Public Works and Development Services explained that
following approval of the motion, the intention is to install the Dover Street
pedestrian activated signal around the last week of October. There will be a
similar traffic device installed at 230 Street and Dewdney Trunk Road. It is part
of the major road network improvements jointly funded by the Greater Vancouver
Transportation Authority (GVTA) and the Municipality. Confirmation has been
received for the funding and the signal project will be proceeding in November.

06.02.03 Highway Use Permit - Frogstone Grill - 22932 Lougheed Highway
Reference was made to the staff report dated August 24, 1999 in support of the

Discussion
Councillor Gordon noted that this is an application to permit the use of a portion
of a Municipal road right-of-way for a sidewalk café. She is pleased to see this

type of application come forward. She noted that in Halifax when restaurant
owners want to add an outdoor component and the sidewalk is not wide enough,
they are permitted to build a wooden boardwalk. She suggested that concept
might work on some of the sidewalks here and questioned if they would be
accommodated in Maple Ridge.
The General Manager of Public Works and Development Services advised that
this is a common arrangement on streets without traffic and one that could be
encouraged provided it is safe and functional and does not impact on parking
spaces, etc. Staff would be prepared to work with businesses in the downtown to
deal systematically with those types of applications provided they meet safety
standards, etc.

06.03 Financial and Corporate Services (includinci Fire and Police)
06.03.01 Mutual Aid Agreement for Emergencies
Reference was made to the staff report dated June 14, 1999 recommending that
the District enter into a Mutual Aid Agreement with Pitt Meadows and Mission.

06.05 Other Issues
06.05.01 Lower Mainland Treaty Advisory Committee (LMTA C) - First Principles
Councillor Gordon advised that the Lower Mainland Treaty Advisory Committee
(LMTAC) has developed a series of guiding principles, called the LMTAC First
Principles, that will establish the basis on which specific local government
interests can be identified and expressed at the lower mainland area treaty tables.
Councillor Gordon noted that the First Principles are in draft form and will be
amended as comments are received from LMTAC members. There will be

responses from 22 Municipalities and three Regional Districts that will lead to the
final document.
She read the General Principles and the principles related to lands, resources and
governance. She advised that written copies of the draft principles in their
entirety are available to the public at the reception area of the Municipal Hall.
06.05.02 Appointment of Chief Election Officer and Deputy Chief Election Officer for
the 1999 Election
Reference was made to the staff report dated September 9, 1999 in support of the
following recommendation contained therein:

that pursuant to section 41 (1 and (2) of the Municipal Act, Jo-Anne
Hertzog be appointed Chief Election Officer for conducting the 1999
general local elections with power to appoint other election officials as
required for the administration and conduct of the 1999 general local
elections;
and that Tonya Polz be appointed Deputy Chief Election Officer for the
1999 general local elections.

07 MAYOR'S REPORTS
Canadian Home Builders'Association Silver Georgie A ward - Excellence by Local
Government in Co-operation/Leadership with Industry
The Mayor announced that the District of Maple Ridge has received a Silver Award
in-the above noted category for the Country Lane Project by Jayman Master Builders
(B. C.). The District is now eligible for the Gold Award which will be presented on
October 30, 1999 at the Gala Georgie evening at the Hyatt Regency Hotel.
Mr. Ray Bourbonnais of Jayman Master Builders added that the award is intended to
recognize those communities that have displayed an extraordinary degree of co-
operation with the development industry and reflects Maple Ridge's policy of
promoting residential development that is socially, economically and environmentally
healthy and that makes the best use of public facilities, services and land.

He thanked the members of the Planning and Engineering Departments who worked
closely with Jayman on the Country Lane Project.
08 COUNCILLORS' REPORTS - LIAISONS TO COMMITTEES
Councillor C. Gordon
Councillor Gordon referred to the "1% Solution" which is a national campaign
requesting that the federal government commit an additional 1% of its budget to the
provision of new social housing. She advised that the 1% solution was endorsed at
the recent Federation of Canadian Municipalities Conference and following her return
from the Conference, she asked the Social Planning Advisory Committee to come up
with a recommendation. She noted that a report and recommendation dated
September 14, 1999 from the Social Planning Advisory Committee has been
circulated to Council and she asked for Council's consideration of same.

Social Housing
that the District of Maple Ridge support the provision of social housing
by considering additional innovative mechanisms to encourage the
construction of such housing and that the District support the 1% Solution
Campaign and write the Minister of Labour and Responsible for
Homelessness to express such support.

Councillor Gordon thanked Councillor Levens and all the volunteers who worked so
hard over the weekend during the 125th Anniversary celebrations.
She advised that there will be an open house on September 20, 1999 at 7:00 p.m. in
the Council Chamber regarding the plans for the new Youth Centre that will be
constructed as part of the new downtown core project.

Councillor Levens advised that the results of the Communities in Bloom Competition
will available at the end of this week.
She advised that extra copies of the 125 Anniversary supplement that was included in
the local newspaper are available at the Municipal Hall, noting that the document
provides an excellent history of Maple Ridge.

She noted that the 125 Anniversary celebration was a super weekend. She displayed
a photograph of Serenity Taylor, the only baby born in Maple Ridge on the
September 12th anniversary date.
Councillor T. Baker
Councillor Baker advised that on September 12, 1999, as part of the District of Maple
Ridge's 125th Anniversary, our Mayor, on behalf of the members of Council and the
citizens of Maple Ridge, bestowed the "Freedom of the City" on the Royal
Westminster Regiment.
The Royal Westminster Regiment has a history dating back 136 years. Over those
years, many citizens of Maple Ridge served with the Regiment both as volunteers and
regular soldiers. The names of those who served in the 1st and 2nd World Wars and
paid with their lives are recorded on the Maple Ridge Cenotaph.
The Royal Westminster Regiment was also involved in helping our community with
the great flood of 1948.
The Regiment's participation in our 125th Anniversary celebration added to the
events of the day with the Regiment band playing on the bandstand for the enjoyment
of our citizens.
Councillor Baker thanked the Committee, Councillor Berry Levens, Kerry McLaren,
Legion President Tom Cameron, Terry Allyn, Jim McBride, Jeff Davis, Sheila
Nichols and Mayor Durksen for their participation.
Special recognition should be given to Mr. Jeff Davis who played a major role
researching the Regiment's involvement with the community and in bringing this to
Council's attention.
Councillor Baker advised that it is his pleasure to hand over the Regimental Plaque
which was presented to the District of Maple Ridge during the 125th Anniversary
celebrations.

Councillor King commended Councillor Levens and the 125th Anniversary
Committee for all the work they did to make the weekend such a success.
She advised that she attended Whonnock Days and was part of the Artist Studio
Tours which were also wonderful events.

Councillor Clements provided a brief update on E-Comm which he noted is short for
Emergency Communications for Southwestern B. C. E-Comm is a consolidation of
a number of emergency services for police, fire, ambulance, etc. and has brought
together a great deal of new technology. As with any new system there have been
glitches which have now been overcome. There have been 450,000 calls handled by
the new dispatch system in Vancouver with no loss of service as calls are also picked
up by the stand-by service. Maple Ridge and Pitt Meadows will be part of the
service in mid-summer of the year 2000.
He further noted that there is one other component that has not yet been exhibited
which is the record management service. This will allow police files to be shared and
crime will be solved more quickly by sharing of information across jurisdictional
borders.
He is pleased to report that E-Comm is performing beyond expectations in terms of
the original criteria that was developed.
Coundilor K. Stewart
Councillor Stewart advised that the 125th Anniversary Dinner was well attended and
ably hosted by Mr. Fred Armstrong. He further advised that the Westminster
Regiment ceremony was a wonderful event. He noted that there is a World War II
photograph of the Regiment and suggested obtaining a copy and displaying it as there
are Regiment members in it from Maple Ridge who can be recognized.

11 QUESTIONS FROM THE PUBLIC
11.1 Gilker Hill Road - Mr. Harry Nicholson
Mr. Harry Nicholson of 11461 - 236 Street stated that the new asphalt that has been
laid on Gilker Hill Road is uneven in some places. He questioned if it has been laid
by developers' contractors and if it is up to Municipal standards. He stated that on
the east side the asphalt is 3 to 5 feet higher than it has to be to meld in to make it
safe. The sidewalk is 3 feet higher than it should be. He also noted that there are 3
lamp standards on the street that do not work.

The Mayor asked the General Manager of Public Works and Development Services to
meet with Mr. Nicholson to discuss the concerns that he has raised.
11.2 Mr. Nicholas Peereboom - RZ123197 - Dedication and Construction of 116 Avenue
Mr. Peereboom referred to the above noted application and advised that he did not
intend to speak this evening but did not realize that the above noted application had
been placed on the Agenda.
The Mayor responded that it was withdrawn from the Agenda earlier in the meeting,
as requested by Mr. Peereboom.
Mr. Peereboom stated that in a pro-active move in 1994 he made a goodwill gesture
to donate land worth $300,000 to the road under discussion. He notes that the staff
report says that the District wants to acquire that land piecemeal in the future and
wants the present owner to continue to live at this site and post a bond to a mutually
agreeable future date. He made an offer in 1994 and does not agree with the report.
He stated that if the District wants to expropriate or buy property they should do it
now.
The Mayor noted that this matter was discussed at several Committee of the Whole
meetings and Mr. Peereboom was not in attendance. He asked that the report be
placed on the next Committee of the Whole Agenda and that Mr. Peereboom be in
attendance.
11.3 A speaker who did not identify himself advised that he was told there was to be a
meeting in the Council Chamber this evening regarding the Rothsay-Garibaldi water
rates. The Mayor advised that there was no meeting scheduled this evening, however,
there will be a public information shortly on that topic and the residents will be
advised of the date and time.
11.4 A resident of Maple Ridge thanked the 125th Anniversary Committee for awarding
her a certificate commemorating her 80th birthday on September 12, 1999, Maple
Ridge's 125th Anniversary.

The purpose of the Question Period is to provide the public with an opportunity to seek
clarification about an item on the agenda or other Municipal matter. Council will not
tolerate derogatory remarks directed at Council and/or staff during the Question Period.
If a member of the public has a concern related to a Municipal staff member, it should
be brought to the attention of the Mayor and/or Chief Administrative Officer in a private
meeting.
Each person will be permitted 2 minutes only to ask their question (a second
opportunity is permitted if no one else is sitting in the chairs in front of the podium).

SUMMARY:
Bylaws 5749-1998 & 5750-1998 have been considered by Council at Public Hearing and
subsequently granted 2 and 3 reading. The applicant has requested that final reading be granted.
The purpose of the rezoning is to permit a service commercial use.
RECOMMENDATION
That Maple Ridge Official Community Plan Amending Bylaw No. 5750-1998 and Maple
Ridge Zone Amending Bylaw No. 5749-1998 be reconsidered and adopted.

Council considered this rezoning application at a Public Hearing held on January 19, 1999. On
January 26, 1999 Council granted 2 and 3 reading to Maple Ridge Zone Amending Bylaw No.
5749-1998 and Maple Ridge Official Community Plan Amending Bylaw No. 5750-1998 with the
stipulation that the following conditions be addressed:
Preliminary approval from the Ministry of Environment, Water Management Branch;
Preliminary approval from the Ministry of Environment, Fish and Wildlife Branch;
Approval from the Ministry of Transportation and Highways;
Registration of a Rezoning Development Agreement including the deposit of security as
outlined in the Agreement including the deposit of security as outlined in the agreement;
Amendment to Schedule "B" of the Official Community Plan;
Amendment to Schedule "A" & "H" of the Official Community Plan;

7) A geotechnical report which addresses the suitability of the site for the proposed
development;
The following applies to the above:
The owners of the subject site have signed Restrictive Covenants with the Ministry of Environment,
Water Management Branch and Fish and Wildlife Branch. Approval from the Ministry of
Transportation and Highways has been granted.
The owners have entered into a Rezoning Development Agreement with the District of Maple
Ridge and submitted the security outlined in the agreement.
A geotechnical report submitted by SRK-Robinson Inc. dated August 25, 1998 concludes that there
are not any conditions that would preclude development on the property.
CONCLUSION:
As the applicant has met Council's conditions, it is recommended that final reading be given to the
bylaws.

SUBJECT: RZ123/97 - Dedication and Construction of 116 Avenue
SUM1\IARY:
116 Avenue between Cottonwood Drive and 236 Street is identified in the OCP as a major
highway network corridor. The extent of dedication and construction of this corridor is one of
several issues that must be resolved prior to presentation of a development proposal at Public
Hearing. Staff have reviewed a variety of options and recommend Option 2.
RECOMMENDATION:
That Option 2 as noted in the report from the Chief Administrative Officer dated July 27,
1999 be selected as the preferred option to identify the extent of dedication and
construction of 116 Avenue between Cottonwood Drive and 236 Street.
BACkGROUND:
On May 11, 1999 Council reviewed the attached land use report and forwarded the application to
Public Hearing. One of the conditions to be met prior to Public Hearing is resolution of the
construction and dedication of 116 Avenue between Cottonwood Drive and 236 Street through
Lot A, Ex Plan 16618 (the development site). Prior to final reading, some road dedication is
required.
DISCUSSION:
The route between Cottonwood Drive and 236 Street is designated on Schedule "C" of the OCP
as one of two major east-west corridors serving the Cottonwood area. The need for this route has
been identified in previous transportation studies completed in the late 1980's to earlier 1990's.
The extent of road dedication and construction for the development proposal has been an issue in
past applications involving this parcel. In an earlier land use report for a previous application
(RZ'50/93) this routc was identified as a designated collector route. The following is an excerpt
from this earlier report.
to The topography along this alignment is severe and the soil conditions difficult.
The costs for construction of the link will be relatively high and the benefits
accrue to a large area. It will therefore be constructed through Development
Cost Charges at a later dare when fisnds and demand warrant. It will be the
developers responsibility to dedicate and construct the portion east of
Cottonwood Drive to the future creek crossing as a part of this development
proposal.
A preliminary road profile has been prepared and confirms that although this route will be
difficult and costly to build, construction appears to be feasible. The profile also confirms that
the easterly portion of the development Site has limited (if any) development potential.
Recognizing this limitation, staff concluded in 1994 that the easterly portion should be acquired
through Development Cost Charges in the future as needed. This would allow the present owner
to continue to live at this site and postpone purchase to a mutually agreeable future date.
It was further concluded that staff would recommend that 116 Avenue from Cottonwood Drive to
236 Street be constructed by:
The municipality, from the east side of the townhouse site through the easterly portion of
development site to 236 Street
The developer, for that portion adjacent to the townhouse site.
Although construction of the easterly portion of this route was added to the Development Cost
Charge Bylaw, application RZ/50/93 was withdrawn and this issue was never resolved. It is
anticipated that the easterly portion of the development site will be acquired through
expenditures from the 5% parkiand acquisition fund (for the area designated Conservation) and
development cost charges (for the area required for road).
In considering the extent of road dedication for this application the following options are
available.
Option 1
Dedicate and construct only that portion of 116 Avenue adjacent to the townhouse site, and
achieve the balance of the dedication after acquisition of the balance of the site. As
recommended in the land use report, road construction is recommended for that portion of 116
Avenue adjacent to the townhouse site. This option achieves the recommended dedication and
construction but doesn't address the future extension of 116 Avenue to 236 Street.
Option 2 (recommended)
Includes option 1 and the dedication of road to the eastern boundary of Rem A (the former
landfill site) owned by the District. This option achieves dedication and construction of a portion
of 116 Avenue and clearly indicates the District's position regarding the future road alignment
for 116 Avenue.
Option 3
Includes options 1 & 2 and the dedication of road for all land not impacted by the house. This
option goes beyond option 2, is not necessary and is not recommended.

Includes options 1, 2, & 3 and a road reservation for the balance of the right-of-way. This option
goes beyond option 3, is also not necessary and is not recommended.
CONCLUSION:
Considering the above, it is recommended that Option 2 be considered to determine the extent of
dedication and construction of 116 Avenue between Cottonwood Drive and 236 Street.

SUMMARY:
Dewdney Trunk Road between the downtown core and Westgate Mall is a major arterial road.
Maple Ridge Senior Secondary and Mount Crescent Elementary are schools to the north of
Dewdney Trunk Road with catchment areas that ex tend south of Dewdney Trunk Road.
Children attending these schools frequently cross this high traffic arterial road. Contract No.
E02- 120-006 installs a pedestrian controlled signal at Dover Street replacing two painted
crosswalks at Acadia Street and at 220 Street.
RECOMMENDATION:
That Council award Contract No. E02-120-006 to Transwestern Electrical Ltd. and that
this contract become binding on the District upon the signature of the Mayor and the
Municipal Clerk.
BACKGROUND:
The District's vision is to provide a safe and livable community for present and future citizens.
As the municipality grows, safety measures and provisions need to keep pace. In recognition of
this the 1999 Captial Budget included Capital Project No. E02-120-006 to install a lighted and
marked pedestrian walkway at Dover Street on Dewdney Trunk Road. This type of application
meets the current traffic and pedestrian warrant analysis. The project contemplated a new lighted
crosswalk at Dover Street coexisting with the existing crosswalks at Acadia Street and 220
Street.
Through a series of meetings in 1999 with representatives from both schools, the Parent
Advisory Committees and neighborhood citizens consensus was reached that one crossing with
pedestrian activated signal provided the optimal safety option. In addition the traffic signal
analysis predicts that a pedestrian signal may be warranted within the next five years. A single
crossing point to funnel children safely across Dewdney Trunk Road makes sense and is
consistent with the safe routes to school objectives. The nearest controlled signals to Dover are
222 Street approximately 500m to the east and 216 Street approximately 600m to the west.

TENDER ANALYSIS
On August 20, 1999 the following two bids were received:
Transwestern Electrical Ltd. $51,826.52
Imperial Electric Ltd. $54,548.60
The low bid of Transwestern Electrical Ltd. was analyzed for compliance with the tender
documents and found to be in order. Transwestern Electrical have worked satisfactorily for the
District in the past.

SUBJECT: Highway Use Permit - Frogstone Grill
SUMMARY:
Maple Ridge Highway and Traffic By-Law No. 3136 regulates the use of municipal highways.
Highway Use Permits require Council approval where there is intent to sell goods or services.
The owner of Frogstone Grill has requested permission to use a portion of municipal highway for
a sidewalk café. Permit No. 24.99 authorizes this use.
RECOMMENDATION:
That Council authorize the Municipal Engineer to issue Highway Use Permit No. 24.99 to
the owner of the Frogstone Grill, Hakura Matoda Enterprises.
BACKGROUND:
The owner of Frogstone Grill at 22932 Lougheed Highway has requested permission to use a
portion of the municipal highway to construct a sidewalk café. Authorization for use of
municipal highway is through a Highway Use Permit The issuance of Highway Use Permits is
regulated through Bylaw No, 3136-1982, Maple Ridge Highway and Traffic Bylaw.
Section 25 of the bylaw requires Council permission prior to issuance of a permit under certain
circumstances. Section 25(a) states the following:
Except as authorized by a permit issued by the Council no person shall, upon any highway: sell or
display for the purposes of selling any article or thing.
Accordingly a patio use fits into the above category and Council's permission is required prior to
issuance of a permit.

DISCUSSION:
The District's Corporate Strategic Plan and the Official Community Plan both emphasize the
need to enhance and attract business to Maple Ridge.
The Strategic Plan supports economic development through initiatives that build a sustainable
community, attract new employment opportunities and attract investment. The Official
Community Plan promotes sustainable growth through encouraging self-sufficient, flourishing
businesses and enhanced employment opportunities. In addition the OCP promotes economic
diversity and resourcefulness in the community. The OCP also speaks to investigating incentives
to stimulate local business initiatives.
Discussion's among the Community/Business Relations, Building and Engineering Departments
concluded that sidewalk cafes can be a stimulant to greater activity in the restaurant business.
Permitting of sidewalk cafes supports the goals of the Strategic and Official Community Plans.
The proposed sidewalk café occupies a small area of the municipal right of way (31 m). Some
of the larger municipalities such as Vancouver charge a "rental rate" for use of public property.
Some such as West Vancouver charge a permit fee. Other municipalities such as Port Moody
and Coquitlam have no policy.
In the past five years only two restaurants (including the current applicant) have made inquiries
about sidewalk cafes. The current demand in Maple Ridge for sidewalk cafes occupying
municipal rights of way is very small. Any revenue sources achieved through a rental rate would
be marginal and likely act as a disincentive to restaurateurs. A one time processing fee of
$100.00 to offset administration costs makes sense for Maple Ridge. A refundable servicing
deposit of $1,000.00 to protect against damage to municipal property is also required. Additional
revenue will also be achieved through increased licensing fees.
Staff have developed a set of guidelines for sidewalk café applications to insure consistency of
standards. The Highway Use Pennit documents the liability insurance requirements and save
harmless the District against liens and/or claims.
As stated there have been a very limited number of inquiries for sidewalk cafes that use
municipal rights-of-way. However should the number of inquiries increase Council may wish to
consider bringing forward a Policy document to administer applications. At this time permitting
through a Highway Use Permit appears sufficient.

APPLICATION PROCESS for SIDEWALK CAFÉ
Review regulations and ensure that you are able to comply.
Make application with the Inspection Service Department.
The Inspection Service and or the Engineering Department will
provide a plan review and pre-Inspection. However, the District of
Maple Ridge is under no obligations to perform such inspections and
these inspections in no way relieve the applicant from the obligation to
comply with the regulations and the terms of the Sidewalk Café permiL
The plans will be distributed to various departments for acceptance. Upon plan
acceptance, a Highway Use permit will be issued to construct the enclosure and or to
use the District's sidewalk. An application fee and security deposit along with third
party liability insurance will be required at this step.
If an enclosure is being constructed, a fmal inspection for use and occupancy is
required.
S. Each anniversary date (one year from approval date) a renewal request for the
Highway Use permit is required. A pre-inspection for conformity with the original
agreement will be required prior to issuance of a new permit. It is the operator's
responsibility to ensure that the permit is renewed.

REGULATIONS for SIDEWALK CAFE
These regulations are fairly explicit and clarify community objectives for the commercial
areas of the District of Maple Ridge.
c/Sidewalk Cafe is permitted in the C3 and C2 zones. c445.
A minimum public sidewalk passage width of 2.1 meters (7 ft) is required along the frontage
of the café.
A sidewalk café must be an extension with the abutting business and cannot be subleased.
The café must be directly abutting and touching the frontage or fiankage of the building to
which it is associated. This is so that patrons and servers do not disrupt pedestrian traffic on
the sidewalk.
IAn enclosure is required to contain the café where more than 2 seats are provided per table.
Themaximumheight of the enclosure shall be 121 cm(4ft)butnotlessthan9l cm(3 ft).
This is the height from the top of railing to the finish grade of the adjacent sidewalk. (see
sample drawing 'A' and suggestion on type of enclosure)
The café enclosure must be a construction style, which allows for removal within 24 hours, if
so required.
/'Open type cafe (without enclosure) may be permitted at the discretion of the Municipal
Engineer. This is generally restricted to a table with two seats. Seating arrangements must not
back onto the sidewalk.
/Seasonal flowering plants should be incorporate with the sidewalk café with enclosures.
Proposed locations for planter box, hanging baskets must be shown on the plan.
I The café must be wheelchair accessible.
I Permanent fixtures to District's sidewalk are not permitted.
/ Exterior signage must comply with the District of Maple Ridge Sign bylaw no 4653-1992.
I The enclosure and covering must be approved, inspected and accepted by the Inspection
Services Department prior to occupancy.

at all times to all parts of any works constructed under this' Permit for the purpose of
inspecting the same;
That the Municipal Engineer at his diScretion may increase or decrease the area of the
Sidewalk Cafe in such a manner as he deems appropriate at any time;
That the Municipal Engineer may at any time impose upon the Permittee whatever rules and
regulations it deems appropriate concerning the sidewalk café, and in particular, but not so as
to restrict the generality of the foregoing, the Municipal Engineer may make rules and
regulations with respect to the hours of operation, safety, appearance, decorations, colors,
signs, trademarks, furnishing, appliances, clothing and dress, cleanliness, sanitation, garbage
and refuse disposal, entertainment, exhibits, weather protection, lighting, planters and plants,
the covering over the sidewalk, the broadcasting and/or amplification on any noises including
music and speech from the facility or the adjacent building occupied by the Permittee, the
attachment of anything in a temporary or permanent fashion to the adjacent street, property,
building and public utilities, and any other matter, items or thing which touch or concerns the
facility and the Perniittee covenants to faithfully observe and abide by all such rules and
regulations;
That the Permittee shall hold and save harmless the Corporation from and against all claims,
damages and lien claims of every kind, arising out of or in any way connected with any
works, operations, or other things for which this permit is issued;
That the Permittee shall obtain and maintain during the term of this Permit a comprehensive
general liability insurance policy providing coverage of not less than $2,000,000.00, naming
the Corporation as an additional named insured and providing that the said policy shall not be
cancelled, lapsed or materially altered without 30 days notice in writing to the Corporation. A
copy of such policy shall be delivered to the Corporation prior to the issue of this Permit;
That while reasonable care will be taken on the part of the Corporation of the District of
Maple Ridge ('the Corporation") to avoid damage to any private works constructed under this
Permit while carrying out the construction or maintenance of any public work in any
highway, the Corporation accepts no responsibility of any kind for such damage if the same
should result from such public work;
That the Municipal Engineer at his discretion may terminate this permit at any time, upon
giving the Permittee three (3) days notice of its intention to terminate the permit; such notice
shall be by way of letter and shall be deemed to have been properly given if delivered to the
Permittee or any employee of the Permittee at the premises. No compensation of any sort
what so ever shall be payable to the Pennittee on account of such termination. Upon receipt
of the notice to terminate the Permittee shall forthwith vacate and shall remove therefrom all
equipment and improvements installed on the premises, and must return the Municipal
sidewalk in good repair and condition and free from hazard, all to the satisfaction of the
District of Maple Ridge;
That the Municipal Engineer shall have the right at any time and from time to time, upon
giving the Permittee notice to order the closure of the sidewalk café due to special events, and
in such case the closure shall be so long as the Municipal Engineer directs. For the duration
of such closure, the Pennittee shall remove from the sidewalk whatever furnishing, items and
things the Municipal Engineer orders removed and in the event that the Permittee fails to
remove the said items, then the District of Maple Ridge may provide for the removal and
storage of the same forthwith without notice to the Permittee and the Permittec will be
charge for the cost of such removal and storage;
That the Permittee shall remove any and all improvements, items and things as part of the
sidewalk café upon termination of this permit, to the satisfaction of the District of Maple
Ridge. If the Permittee fails to yield up and surrender the sidewalk in a condition satisfactory
to the District of Maple Ridge, then the Municipal Engineer may carry out such work at the
expense of the Permittee;
That the Permittee is not exempt from any obligations created by any laws, bylaws and lawful
orders which touch and concern the sidewalk café and the activities authorized hereby;
12. That the Permittee shall provide reasonable and safe pedestrian access at all;
I, the applicant for this permit, agree to all terms and conditions hereinbefore expressed, and am
bound thereby and by all provisions of Maple Ridge Highway and Traffic By-Law No. 3136-
1982 (as amended), as the same pertain to this permit, and deposit herewith the required security

SUBJECT: Mutual Aid Agreement for Emergencies
EXECUTIVE SUMMARY:
The current Mutual Aid Agreement for emergencies between the Maple Ridge Fire Department and the
District of Mission and the District of Pitt Meadows are over 20 years old. These agreements require a
review and update of the terms and conditions for the provision of mutual aid.
RECOMMENDATION:
That the District of Maple Ridge enter into a new Mutual Aid Agreement with the District of Pitt
Meadows and the District of Mission the highlights of which are contained in the June 14, 1999
report from the Manager of Operations & Staff Development.
BACKGROUND:
Mutual Aid Agreements are intended to provide a formal framework for the provision of Fire
Department resources to neighboring communities in the event that the fire department resources in these
communities are overwhelmed. It also provides for the utilization of neighboring communities' Fire
Department resources in the event that the Maple Ridge Fire Department requires additional emergency
resources.
The highlights of the agreements are as follows:
The Fire Department resources are released at the discretion of the Fire Chief. Nothing in the terms
of the agreement requires the department to provide resources and resources would only be released
providing that sufficient resources were maintained to protect the community.
There is no charge for the reciprocal provision of manpower and equipment in the event of an
emergency, however any consumables used in the operation, or any damage to trucks and equipment
will be paid for by the requesting community. The community in which the emergency occurred will
cover any litigation resulting from the actions or in-actions of the Fire Department.
The overall command of an incident will remain the responsibility of the senior fire officer of the
community in which the emergency occurred, however, the direction of the individual fire fighters
and equipment will remain under the control of each fire department.
The Fire Chief will attempt to fully utilize the communities' emergency resources before requesting
assistance except where special equipment is not available from the bordering parties. When the
emergency is brought under control any mutual aid resources shall be released first before any local
resources are released.
In the instance of the Mutual Aid agreement in Mission, both departments have similar trucks and
equipment and are able to provide equal resources in the event of an emergency.
In the instance of Mutual Aid with Pitt Meadows, Pitt Meadows does not have the ability to provide
an Aerial Tower Truck. A review conducted by the Pitt Meadows Fire Department concluded that it
was more fiscally prudent to rely on the provision of mutual aid for an Aerial Tower Truck than to
purchase an Aerial Tower Truck for Pitt Meadows Fire Department. As a result of Pitt Meadows
not being able to provide an Aerial Tower device through mutual aid, it is recommended that a
request for the use of the Maple Ridge Fire Department's Aerial Tower Truck by Pitt Meadows be
considered a fee for service above and beyond a regular Mutual Aid Agreement. Use of the Maple
Ridge Aerial Tower Truck shall be charged in accordance with Schedule "A" of the Greater
Vancouver Regional District's Mutual Aid Agreement for Emergencies.

(hereinafter called Maple Ridge) OF THE FIRST PART
and THE DISTRICT OF MISSION
(hereinafter called Mission) OF THE SECOND PART
WHEREAS, the Parties desire to enter into an agreement whereby emergency resources can be
deployed to assist any Party during an emergency.
NOW THEREFORE THIS AGREEMENT WITNESSES THAT, in consideration of the mutual
covenants and agreements herein contained and subject to the terms and conditions hereinafter
set out, the Parties agree as follows:
1. In this Agreement, unless the content otherwise requires,
"emergency", means any present or imminent calamity or sudden or violent disturbance
that in the opinion of the Fire Chief cannot be brought under control by use of the
available local emergency resources and that require prompt coordination of action or
special regulation of persons or property to protect health, safety or welfare of people, or
to limit property damage;
"emergency resources", means all persons, equipment and material held by, in the service
of, or directly available to the fire service of a Party;
"Fire Chief' means, for each Party, the senior municipal employee responsible for the fire
service of the Party or his delegate.
"mutual aid" means emergency resources provided by a Party outside the boundaries of
the Party that requested the emergency resources;
2. The procedure to be followed in requesting and rendering aid under this agreement shall be
governed by the following principles;
A Fire Chief will attempt to fully utilize the community emergency resources before
requesting assistance.
The Fire Chief who receives a request for emergency resources from another Party may
respond with such resources available to assist in controlling the emergency incident; but
nothing in this Agreement shall be construed to require a Fire Chief to dispatch
emergency resources that he does not consider are available.
The Senior Officer in charge within the area of the emergency shall remain in the charge
and direct all mutual, aid resources in cooperation with the responding mutual aid senior
officer. The said resources may be recalled if the need arises by its own Fire Chief.
When the emergency is brought under control any mutual aid shall be released first
before any local resources are released.
No charge shall be levied for services rendered by any of the parties to this Agreement or
personnel of the other party hereto.
0 Cost of repairs or replacement of damaged equipment due to the mutual aid incident and
expendable material used at that site will be the responsibility of the department
requesting mutual aid.
Any Party may terminate its rights and responsibilities under the Agreement by giving to the
City Clerk of the other Parties, thirty days notice in writing of its intention to do so.,
Subject to paragraph 5, neither party shall initiate legal action or third party proceedings
against the other party, based on the provision of or failure to provide emergency resources.
If an action or other claim is brought against a party to this Agreement, the municipality in
which the incident or event giving rise to the action occurred shall (a) defend the action on
behalf of itself and the other party, and (b), subject to paragraph 6, indemnify and save the
other party harmless from and against all losses, expenses, damages or liabilities that the
other party suffers or incurs as a result of that action or claim.
All disputes arising out of or in connection with this agreement, or in respect of any legal
relationship associated therewith or derived therefrom, shall be referred to and finally
resolved by arbitration administered by the British Columbia International Commercial
Arbitration Centre pursuant to its Rules.
The place of arbitration shall be Vancouver, British Columbia, Canada.
In an arbitration under s.5, the arbitrator has the jurisdiction to determine whether a party has
suffered or incurred any loss, expense, damages or liability as a result of the gross negligence
or willful misconduct of the other party, and if the arbitrator so determines, the arbitrator may
allocate responsibility between the parties for that loss, expense, damages or [iability in
whatever maimer the arbitrator considers appropriate, and for that purpose may grant relief
against the indemnity in paragraph 4.
For the purpose of Section 4 and 5, "Party" includes any employee, contractor or volunteer of the
Party.

t) Use of the Maple Ridge Aerial Tower Truck shall be charged in accordance with
Schedule "A" of the Greater Vancouver Regional District Mutual Aid Agreement for
Emergencies.
1) Cost of repairs or replacement of damaged equipment due to the mutual aid incident and
expendable material used at that site will be the responsibility of the department
requesting mutual aid.
3. When Maple Ridge provides the use of its Aerial Tower
the Party providing emergency resources may, within sixty days after so doing, render to
the Party that requested emergency resources a correct account of the Aerial Tower usage
and the cost of the service in accordance with the table of costs set out in Schedule "A"
hereto;
the Party that requested emergency resources shall pay the account within thirty days
after receiving it.
4. Subject to paragraph 5, neither party shall initiate legal action or third party proceedings

RE: Development of LMTAC "First Principles"
The Lower Mainland Treaty Advisory Committee (LMTAC) held three workshops in 1999 to
develop a series of guiding principles that help to inform local government interests in treaty
negotiations. The "First Principles" provide the context for the specific interests explored in
other LMTAC interest documents, such the July 1998 Considerations interest paper.
Please find attached approved draft 5 of LMTAC's "First Principles" received by the LMTAC
membership on June 23, 1999. The attached First Principles deal with issues such as lands,
resources and governance that are the subject of treaty negotiations and are also of central
importance to local governments. Working with your representatives to the Committee, LMTAC
respectfully asks that your Council review the attached First Principles and provide our office
with written comments no later than September 30, 1999. We would also be pleased to assist
your Council in preparing for the discussion and being present as needed to answer questions.
In the Fall, LMTAC will revise the Prinicples to reflect the comments received so that local
government concerns with regards to treaties can be effectively presented to the provincial treaty
negotiators. Your detailed attention to this matter is most appreciated.

LMTAC FIRST PRINCIPLES
Background
The Lower Mainland Treaty Advisory Committee (LMTAC) held three workshops in 1999 to
develop a series of guiding principles that will establish the basis on which specific local
government interests can be identified and expressed at Lower Mainland area treaty tables. The
First Principles will provide the context for LMTAC input to the provincial treaty negotiation
team on topics such as lands, resources and governance. The LMTAC will utilize these First
Principles as a starting point to more detailed exploration of the topics in future LMTAC
documents and interest papers.
LMTAC's First Principles were developed by consensus with the assistance of an independent
facilitator. Opinions and issues raised at the workshops that could not be resolved by consensus
or which did not directly relate to the First Principles discussion were set aside in a "parking lot"
for future review by LMTAC members.
The First Principles are in draft form and will be amended as comments are received from
LMTAC members.
General Principles
Consistent application of the LMTAC First Principles shall be maintained across Lower
Mainland treaty agreements, particularly with regard to but not limited to taxation,
application of laws, land use planning, transportation, environmental regulations and
relationships with Local Governments.
2. Treaty agreements in other regions of the Province not be used as a precedent or template
for urban treaty settlements and that provisions in Lower Mainland area treaties reflect the
complex realities of the urban environment specific to each treaty.

Local Government be recognized in the treaty process as a independent, responsible and
accountable order of government, not as a secondary level or third party interest.
Treaties should uphold the principle that all Canadians should be afforded equal rights and
opportunities, while acknowledging the recognition afforded to the Aboriginal peoples in
the Constitution.
Treaty settlements must encourage inclusive and accessible communities, to help build
respect for Aboriginal and Non-Aboriginal peoples' values, heritage, cultuie and traditions.
The issues, process and expected outcomes of tripartite treaty negotiations must be open
and provide for public input throughout negotiations by First Nations, Provincial and
Federal negotiating parties. The cost of the public process to be funded by the tripartite
negotiating parties.
Agreements in Principle (Stage 4) shall not be completed until all overlaps of those
Aboriginal Peoples that have provided statements of intent to the British Columbia Treaty
Commission have been resolved and shall include the details of the overlap resolution
agreement.
Dissenting Views:
• does not adequately address latecomers to the treaty process, overlaps and
certainty. There should be no "latecomers" to the process.
• is unrealistic.
• the overlap issue needs to be resolved, not the overlaps themselves.
• use of the word "addressed" in place of "resolved".
• latecomers and certainty should be addressed in separate principles.
The Lower Mainland Treaty Advisory Committee is the voice for Lower Mainland area
Local Governments on all issues relating to the treaty process.
Lands
Urban treaty settlements, because of scarcity of unencumbered lands in the treaty areas,
should be composed primarily of cash and other fiscal considerations, rather than land.

Existing privately owned fee-simple lands, Crown Corporation lands and Local
Government owned lands and assets acquired through a Local Government process must
not be subject to treaty negotiations. This includes but is not limited to: local government
facilities, dedicated municipal parks, protected areas, greenbelts, school board lands, local
government commercial operations (i.e. forest lands, park restaurants), and Crown lands
subject to a Local Government license or tenure.
Explanatory Note:
• principle was developed to gain assurance that local government land in all its forms,
whether it is owned or dedicated for a specific purpose, will not be subject to treaty
negotiations. Various municipal tenure types and land uses are mentioned as
examples.
In the pre or post treaty negotiation process and during negotiations, where First Nations
acquire Crown lands or wish to purchase fee-simple lands within Local Government
boundaries, those lands shall remain in fee-simple and remain subject to Local Government
jurisdiction and taxation, unless otherwise agreed to by the Local Government through a
community consultation process which may include a referendum.
Explanatory Note:
• principle speaks to local government's jurisdiction over fee simple lands and the
continuation of local government regulatory and taxation authority over lands that may
be transferred as part of a treaty settlement.
• lands received by a First Nation as part of a treaty settlement (or added after the treaty
is signed) should have no new or special status (i.e. they should be owned in fee-
simple).
Dissenting views:
• a clause needs to be added which addresses the issue of lands contiguous to
existing reserve lands.
• pnnciplë could be interpreted as to restrict the land boundaries of treaty settlements
to only the existing reserve land base.
• it is not realistic.
Treaty settlement lands should be held as 'fee-simple' land and not have any unique status
as outlined in any other agreement.

jurisdiction. Treaty settlement lands within municipalities and regional districts are to
be treated like all other lands.
• LMTAC members seeks further clarity on the legal definition of 'fee-simple', how
treaty settlement lands will be registerable under the provincial Land Titles Act, and
how the form of 'fee-simple' created by the Nisga'a Final Agreement is different from
'fee-simple' lands held by private property owners (i.e. whether the Crown retains
underlying title).
Treaties must ensure that access (via land, water, air or sub-surface rights-of-way) is
maintained to local government-owned lands, privately held lands, leased lands, other
rights-of-way, airspaces, and/or private and public infrastructure for the purposes of, but
not limited to, infrastructure development and maintenance.
Explanatory Note:
• principle speaks to the need for continued access to local government lands and assets
on, between or adjacent to treaty settlement lands as well as to privately held lands
between or adjacent to treaty settlement lands.
Dissenting views:
principle needs to address issue of overlapping treaty settlement boundaries.
Resources: Natural and Physical
Sustainabiity of local economies is a priority in the post treaty environment. Lower
Mainland area renewable, natural resources, including but not limited to forests, water and
fish, must continue to be managed on a sustainable basis in order not to undermine the
economic base of Local Governments and their communities.
Explanatory Note:
• Sustninthility can be generally defmed as the ability "to make development meet the
needs of the present without compromising the ability of future generations to meet
their own needs." (from Our Common Future, The World Commission on
Environment and Development)
International wildlife agreements and legislation of the provincial and federal government
that applies to non-Aboriginals with respect to conservation of wildlife, migratory birds
and fish, be incorporated into all treaties. Present, future and potential refuge areas,
including but not limited to areas such as the Boundary Bay Wildlife Management Area
and Maple Wood Flats should be identified and protected during the treaty process.

Lands in the Agricultural Land Reserve (ALR) must remain in the ALR and under the
jurisdiction of the Agricultural Land Commission.
Existing park tenures, agricultural, forests and range leases and licenses and other leases
and licenses on Crown lands, and the economic viability of these agreements, and any
provisions for their renewal, should be respected.
Local Government and private interests in water including but not limited to historic rights
of water use, watersheds, water licenses, rights of access to shorelines, status of water lots,
access and easements for servicing, and enforcement of purity control standards and water
use regulations, must be preserved. This also includes ground water and aquifers.
Within the Lower Mainland region, including but not limited to, subsurface and submerged
rights shall not be transferred to a First Nation government without consultation and
concurrence of Local Government.
Forest land which may come under Aboriginal control must remain and continue to be
managed within the existing timber supply areas and Forest Districts to ensure no loss of
Annual Allowable Cut (AAC) on the land base.
Governance and Jurisdiction
Treaties must recognize and respect the authority and jurisdiction of the federal, provincial
and local governments.
Treaty settlements must remain within the framework of the Canadian Constitution and the
Canadian Charter of Rights and Freedoms. Canadian Criminal Law must continue to
apply.
Treaties must uphold the principle of "no taxation without representation" for all persons
residing on treaty settlement lands.

the principle speaks to the need for treaties to have effective mechanisms to ensure
that all persons who are living on treaty settlement lands and who are paying taxes or
levies to the First Nation have access and a voice in First Nation governance systems.
Aboriginal self-government provisions should provide for First Nation participation in, or
partnerships with, Local Governments or First Nation regional governments for more
effective and efficient delivery of services and programs.
Explanatory Note:
• principle speaks to the need for First Nations to achieve a coordinated approach to self
government to achieve efficiency, whether it be through partnerships with other First
Nations, local or regional governments.
• the principle also maintains that First Nations should be involved in regional
governance initiatives, such as air and water quality management, sewage treatment,
transportation and other issues of regional significance.
Standards and regulations that apply to treaty settlement lands must meet or exceed
established standards set by federal, provincial and Local Governments for issues
including, but not limited to, safety standards, licensing, environmental protection, fire
protection, building codes, noise controls, public health and labour standards.
Treaties must include an effective dispute resolution mechanism that is accessible to Local
Governments, particularly relating to inter-jurisdictional issues, such as, but not limited to,
planning, land use, natural resources, growth management, stewardship and transportation.
In the matters of Local Government jurisdiction, as defined by provincial legislation, Local
Government must have equality of opportunity to assume powers available to First Nations
that shall exist in the post-treaty environment.
Dissenting views:
• Alternative wording: "In a post treaty environment, if First Nations are to enjoy
greater rights and powers, there should be an opportunity for Local Governments to
take up those powers."
Aboriginal self-government must uphold the principle of democracy and accountability.

are democratic or not.
• the original proposed principle should stand: "Aboriginal self-government should
uphold the principle of democracy and accountability, and remain open and
accessible to all constituents whether they reside on or off treaty settlement lands
or are from the traditional territory of another First Nation."
• principle needs further development.
Treaty benefits including the provision of programs and services under self-governance
arrangements must be accessible to all treaty beneficiaries (as defined through the
eligibility and enrollment provisions of each treaty) whether those treaty beneficiaries
reside on or off treaty settlement lands such that the cost of providing programs and
services to treaty beneficiaries do not become the responsibility of a local government.
Explanatory Note:
• principle speaks to the fact that Lower Mainland area local governments have
increasing off-reserve resident populations and to the need for urban treaties to address
this issue. The costs of providing programs and services to First Nations living off
future treaty settlement lands should not become the responsibility of local
government.
Dissenting Views:
principle should clearly address the issue of Aboriginal peoples living on treaty
settlement lands who are from the traditional territory of another First Nation.
Treaties must identify programs and services which because of their regional significance
(such as, but not limited to, air quality and sewage treatment) First Nations must provide to
their constituents either directly or indirectly through a contract with Local Governments or
other agencies for the provision of those programs and services.
Explanatory Note:
• principle speaks to the various interconnections between urban communities that
Lower Mainland area treaties will need to address, and recognizes the responsibility
that all jurisdictions have in creating and sustaining systems that benefit all residents
of the Lower Mainland.
Fiscal
31. Treaties must recognize the fiscal capacity of all levels of government and not impose any
extra financial cost to Lower Mainland residents and taxpayers, other than their

contribution to treaty settlements as per the cost sharing Memorandum of Understanding
between the province and the government of Canada.
Explanatory Note:
• principle speaks to the commitment from BC that the revenues coming to local
governments will not be affected (i.e. that treaties will be 'revenue neutral' to local
governments) and that no undue cost burden will be borne by Lower Mainland area
residents in the form of increased taxation, levies, etc.
Treaties should recognize and respect transparent mechanisms through which service
agreements can be established for financial contributions by all users of Local Government
programs, services, and infrastructure.
There must be no negative impacts on Local Government tax revenues resulting from
treaty settlements, particularly on the ability of Local Government to derive tax revenue
from sources such as property taxes and grants-in-lieu from Crown lands. Any revenue
loss to Local Governments arising from treaty settlements must be fully compensated.
The provincial Municipal Act and Vancouver Charter must be reformed to enable Local
Governments to develop flexible taxation and cost recovery mechanisms when dealing
with Aboriginal governments.
Explanatory Note:
• principle speaks to need to reform provincial legislation to enable Local Governments
to act more independently when dealing with future Aboriginal governments. Existing
legislation often limits the development of new and innovative arrangements.
Treaties must respect and recognize existing provincial fiscal commitments to Local
Governments.

election officials as required for the administration and conduct of the 1999 general local elections;
and that Tonya Polz be appointed Deputy Chief Election Officer for the 1999 general local
elections.

Dear Neighbor,
Welcome to the new world of "Us And Them."
Our city council has introduced a Schedule "A" water rate, covering our area.
With respect to the water rate, Schedule "A", the "Them'3 people, "Them" being
the rest of the people in Maple Ridge water supply area, will pay a water rate fee of
$143.00 per year. On the other hand, the "Us" people of the Rothsay/Garibaldi water
supply area will pay a water rate of $500.00 per year.
Some questions regarding this rate structure come to mind, such as:
Is this rate schedule fair? For how many years will this rate be in effect? How will
this added cost of water in the "Us" area effect the future sale of said property? As the
home owners in the "Us" area are just home owners, and not developers, does the water
rate charge for the "Us" area people not seem to be arbitraiy, onerous, discriminatory, and
maybe even unconstitutional?
Why are the "Us" pçople paying so much more for water? Was someone remiss in
their duty while the private water systems were first installed in the "Us" area?
Did not the home owners in the "Us" area buy their properties in good faith,
believing that the developers in concert with the municipal and provincial governments,
had carried out their due diligence on behalf of people in the "Us" area?
In any event, we are not looking for culpability today, nor do we say there is any,
we just want fairness.
We look at the water utility system as being contiguOus, and as such, of benefit to
the whole community, both current and future. Should their not then be a fairer way
apportioning costs to correct and up-grade the water system in the "Us" area?
If you, the good people of the "Us" area, believe, as I do, that there must be a
fairer way of addressing this water rate business, get involved. Contact the Mayor, Carl
Durksen, and Coundiors Tom Baker, Jim Clements, Candace Gordon, Linda King, Betty
Levens, Ken Stewart, and let them know how you feel.
Remember also that there will be an election this fall, use your vote well, but most
of all ask the people who seek to represent all of Maple Ridge to make a pledge of fairness
to each and every citizen of our community and then hold their feet to the fire, so to
speak, if they do not measure up.

BACKGROUND:
The Social Planning Advisory Committee of Council wanted to recognize the efforts of
Municipal Council in supporting the provision of affordable housing. Recent initiatives such
as the housing study, the introduction of densification measures in the Official Community
Plan, the creation of small lot zoning, the secondary suite policies, and the recent grant in
support of the GVRD housing project on Fraser Street are all testaments to Council's support.
However, to truly address the needs of the homeless and particularly those of limited income,
a coordinated approach is needed. The Province of British Columbia is one of the only two
Provincial Governments still involved in the support of social housing and should be
recognized for such effort. As well, the Federal Government has a role to play, particularly in
the provision of funds to support initiatives.
The number of Canadians that are homeless or one pay-cheque away from being homeless
prompted the Toronto Disaster Relief Committee to spearhead the "1% Solution". The 1%
Solution is a national campaign requesting that the Federal Government commit an additional
1% of its budget to the provision of new social housing. In support of the 1% Solution the
City of Toronto declared homelessness to be a national disaster and has been lobbying other
municipalities to support this initiative. At the Federation of Canadian Municipalities (FCM)
conference, the FCM endorsed this 1% Solution.
The Social Planning. Advisory Committee is concerned with the lack of Federal dollars being
committed to the provision of social housing, and in particular the shortage of such housing in
the Lower Mainland. Therefore, the Committee is recommending that the District of Maple
Ridge support the 1% Solution and that a resolution supporting the initiative be forwarded to
the Honourable Claudette Bradshaw, Minister of Labour and Responsible for Homelessness.

ON SEPTEMBER 12, 1999, AS PART OF THE DISTRICT OF MAPLE RIDGE 125TH i\NNTVERSARY
OUR MAYOR, ON BEHALF OF THE MEMBERS OF COUNCIL AND THE CITIZENS OF MAPLE
RIDGE, BESTOWED THE "FREEDOM OF THE CITY ON THE ROYAL WESTMINSTER
REGIMENT."
THE ROYAL WESTMINSTER REGIMENT HAS A HISTORY DATING BACK 136 YEARS.
OVER THOSE YEARS, MANY CITIZENS OF MAPLE RIDGE SERVED WITH THE REGIMENT
BOTH AS VOLUNTEERS AND REGULAR SOLDIERS. THE NAMES OF THOSE WHO SERVED IN
THE 1ST AND 2" WORLD WARS AND PAID WITH THEIR LIVES ARE RECORDED ON THE
MAPLE RIDGE CENOTAPH.
THE ROYAL WESTMINSTER REGIMENT WAS ALSO INVOLVED IN HELPING OUR COMMUNITY
WITH THE GREAT FLOOD OF 1948.
THE REGIMENT'S PARTICIPATION IN OUR 125TH ANNTVERSARY CELEBRATION ADDED TO
THE EVENTS OF THE DAY WITH THE REGIMENT BAND PLAYING ON THE BAND STAND FOR
THE ENJOYMENT OF OUR CITIZENS.
I WOULD, AT THIS TIME, LIKE TO THANK THE COMMITTEE, COUNCILLOR BETTY LEVENS,
KERRY MCLAREN, LEGION PRESIDENT TOM CAMERON, TERRY ALLYN, JIM MCBRIDE, MR.
JEFF DAVIS, SHEILA NICHOLS AND YOU, YOUR WORSHIP, FOR YOUR PARTICIPATION.
SPECIAL RECOGNITION SHOULD BE GIVEN TO MR. JEFF DAVIS WHO PLAYED A MAJOR
ROLE RESEARCHING THE REGIMENT'S INVOLVEMENT WITH THE COMMUNITY AND IN
BRINGING THIS TO COUNCIL'S ATTENTION.
YOUR WORSHIP, IT IS NOW MY PLEASURE TO HAND OVER THE REGIMENTAL PLAQUE
WHICH WAS PRESENTED TO THE DISTRICT OF MAPLE RIDGE ON SUNDAY EVENING.
