Special Council Meeting Minutes December 15, 1999 Page2 Discussion On question from Councillor Speirs, the Municipal Clerk advised that no change has been made to the requirement that a delegation wishing to appear before Council has to give ten days notice. Councillor Gordon commented that the advance notice gives staff an opportunity to provide any necessary reports, etc. prior to the meeting. Councillor Speirs stated it is his understanding that Council has the ability to shorten the notification time if they wish. The Municipal Clerk clarified that Council can receive delegations at any point in time upon adoption of a resolution to that effect. Councillor Isaac noted that the by-law does not reflect Council's request to have a televised question period. The Chief Administrative Officer advised that staff is currently compiling a spreadsheet on what procedures the other Municipalities follow with respect to question period and that information will be brought forward shortly for Council's consideration. On question from Councillor Harris, the Municipal Clerk defined a point of order, noting that it usually relates to a departure from the procedural by-law during a meeting. He advised that staff does not recommend enclosing the transmission ditch but there is a small ditch that will be enclosed at the complete expense of the property owner. Note: This Agenda is also posted on the Municipal Web Site at www.mapleridge.org 01 BY-LAWS 01.01 Maple Ridge Procedure By-law No. 5871-1999 final reading Note: By-law to be circulated separately. 01.02 Maple Ridge 2000 Provisional Budget By-law, No. 5 874-1999 final, reading - Note: By-law to be circulated separately. 02 ADJOURNMENT s. karasz Page 1 a CORPORATION OF THE DISTRICT OF MAPLE RIDGE BYLAW NO. 5871 - 1999 A Bylaw to Govern the Meetings of the Council and Committees of Council of the Corporation of the District of Maple Ridge WHEREAS, the Council for the Corporation of the District of Maple Ridge deems it necessary and desirable to regulate the meetings of the Council and Committees of Council and the conduct thereof; AND WHEREAS, section 235 of the Municipal Act, R.S.B.C. 1996, c.323, as amended (the "Act") requires the Council by bylaw to establish the procedures that are to be followed by the Council for the conduct of business including the manner by which resolutions may be passed and bylaws adopted; NOW THEREFORE, Council of the Corporation of the District of Maple Ridge in open meeting assembled, ENACTS AS FOLLOWS: This Bylaw may be cited for all purposes as "Maple Ridge Council Procedure Bylaw No. 5871, 1999." "Maple Ridge Procedure By-law No. 3100 - 1982" and all amendments thereto are hereby repealed in their entirety. PART 1— INTERPRETATION Definitions 1. In this bylaw "Act"means-the-Junicz,aiAct; - "Chair" means the Mayor, Acting Mayor, or presiding officer appointed under the Act or this bylaw, who is chairing a meeting; "Clerk" means the municipal employee appointed as the officer responsible for corporate administration in accordance with sections 196 and 199 of the Act; "Committee" means a standing or select committee of Council constituted as provided in theAct; )/O 1 Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 2 "Committee of the Whole" means the committee established as such under this bylaw, of which committee the Mayor and all Councillors are members; "Council" means the governing and executive body of the municipality constituted as provided under the Act; "inaugural meeting" means the meeting at which the members elected at the most recent general election are sworn in; "meeting" means an inaugural, regular or special meeting, as the context requires; "member" means the Mayor or a Councillor; "member's address" means the address set out in section 57; "motion" means a formal proposal made by a member at a meeting of the Council or a committee that the Council or committee approve or order a specified course of action; "municipality" means The Corporation of the District of Maple Ridge; "Municipal Hall" means the municipality's principal business address at 11995 Haney Place, Maple Ridge, British Columbia; "posting locations" means the bulletin board in the main floor and second floor lobby of the Municipal Hall; "question" means the subject matter of a motion; "quorum" means in the case of Council, a majority of the number of members of which the Council consists under the Act, and in the case of a committee or other body, a majority of the voting members appointed; "regular meeting" means a meeting of the Council, other than a special or inaugural meeting, held under Part 2; "special meeting" means a meeting of the Council other than a regular or inaugural meeting, held under Part 3. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 3 Incorporation of Act's Definitions 2. A definition in the Act which is incorporated into this bylaw has the meaning given to it in the Act. Interpretation of Bylaw 3. Reference in this bylaw to a numbered "section" or "Part" is a reference to the correspondingly numbered section or Part of this bylaw, the plural is to be considered to be a reference also to the singular, unless the context otherwise requires, a resolution or vote of the Council is a reference to a resolution or vote passed by the affirmative vote of a majority of the members present and entitled to vote on the matter, except as otherwise provided by the Act or this or any other bylaw of the District, a requirement for a 2/3 vote is a requirement for the affirmative vote of at least 2/3 of the number of members of which Council consists under the Act. PART 2— REGULAR MEETINGS Time and Location of Re2ular Meetings 4. Subject to a schedule of meetings adopted by resolution of Council at a regular meeting, and subject to sections 5, 7 and 8, a regular meeting is to be held in the Municipal Hall, on the second and fourth Tuesday of each month, unless the Tuesday is a holiday, in which case the regular meeting is to be held on the next day that is not a holiday. (a) Despite section 4, no regular meeting is to be held if the meeting. has been cancelled by a resolution of Council passed under section 7 at a previous meeting. 10 Notice of Re2ular Meeting. 5. The Clerk must give public notice of a regular meeting by posting notice at the posting. locations at least twenty-four (24) hours before the date of the regular meeting. If there is no quorum of members at the location for a regular meeting within 30 minutes of the time stated in the public notice for the meeting, or a quorum is lost during a meeting, (a) the Clerk must record in the minute book the members present, (b) the members present must direct that the regular meeting be held or continued at the Municipal Hall at 7:00 p.m. on the next day that is not a holiday, or on the date of the next scheduled regular meeting, (c) all business on the agenda for that regular meeting not dealt with at that regular meeting is incorporated in the agenda for the regular meeting held on the earlier of the dates referred to in subparagraph (b) (i) or (ii). Cancelled9 Rescheduled or Called Re2ular Meetings 7. (a) The Council may by resolution cancel or reschedule any regular meeting, or change the time or location for the holding of a meeting. (b) The resolution to cancel or reschedule a regular meeting postpones the business on the agenda for the meeting to the next or the rescheduled regular meeting. Notice of Cancelled or Rescheduled Meeting 8. Except in the case of a meeting for which there is no quorum or a quorum is lost, the Clerk must give public notice of the cancelled, rescheduled or called meeting or of the change of time or location by posting notice to the public at the posting locations before the date and time on which the regular meeting was to have been held. Meetings Open to The Public 9; Subject to section 10 of this bylaw all meetings shall be open to the public. (a) In accordance with sections 242.2 and 242.3 of the Act, a Council meeting or Special Council meeting or part thereof may be closed to the public if the subject matter being considered relates to one or more of the following: personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the District; personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the District on condition of anonymity; labour relations or employee negotiations; the security of property of the District; the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure might reasonably be expected to harm the interests of the District; law enforcement, if the Council considers that disclosure might reasonably be expected to harm the conduct of an investigation under or enforcement of an Act, regulation or bylaw: litigation or potential litigation affecting the municipality; the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose; information that is prohibited from disclosure under section 21 of the Freedom of Information and Protection of Privacy Act; a matter that, under another I enactment, is such that the public must. be excluded from the meeting; and a matter prescribed by regulation under section 242.8 of the Act. (b) Before a meeting or part of a meeting is closed to the public the Council must state by resolution the fact that the meeting is to be closed and the basis under section 10(a) on which the meeting is to be closed. Section 10 applies to: a body that under the Act may exercise the powers of the District or Council; the board of variance; the local court of revision; advisory committees or other advisory bodies established under this bylaw or the Act including standing and select committees of Council. PART 3— SPECIAL MEETINGS Calline and Notice of a Snecial Meetin 12. (a) A special meeting may be called in compliance with applicable enactments or by a resolution of Council fixing the time, date, and place. (b) The Clerk must prepare the public notice and an agenda for each special meeting which must state the nature of each item of business to be dealt with at the special meeting and the notice and agenda must be delivered to each member's address and be posted in the posting locations at least 24 hours before the time of the meeting. PART 4— PROCEDURES FOR COUNCIL MEETINGS Mayor to Open Meetin2s 13. Once a quorum is present, the Mayor, or in the absence of the Mayor, the Acting Mayor, must call the meeting to order and be the Chair for the meeting after the posted time for the meeting. Mayor, Arrives After Commencement 14. If the Mayor arrives after commencement of a meeting, he or she will preside on arrival. Unless the Council otherwise resolves, the general order of business at every regular meeting shall be in the following order: Call to Order, Opening Prayers, Presentations at the Request of Council Adoption of Minutes, Delegations Correspondence, By-laws, Committee reports and recommendations, Mayor's Reports Councillors' Reports, Other matters deemed expedient, (1) Notices of Motion, Adjournment, Questions from the Public. MeetingAgenda Preparation, 16. The Clerk must prepare an agenda for each regular meeting, which must be in the order set out in section 15, State the general nature of each item of business to be dealt with at the meeting, Be delivered to each member's address at least twenty-four (24) hours before the time when a regular meeting is to be held, and Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 8 (d) Be posted at the posting locations at least twenty-four (24) hours before the time set for a regular meeting. Petitions 17. Petitions to Council will be considered in the same manner as correspondence to Council and therefore in accordance with the process outlined in section 19 of this bylaw. the person who wishes to submit a petition to the Council delivers to the Clerk (i) the complete petition, and th) the name and address of each person who has signed the petition. the petition must be in a format whereby the nature of the issue/item is clearly evident so that signatories to the petition are clearly aware of the issue to which they have affixed their signature. Dele2ations 18. A delegation may appear before the Council, if, at least ten (10) days prior to the regular meeting at which the delegation wishes to appear, (a) the delegation provides to the Clerk: a written brief clearly outlining the intended presentation and subject matter to be presented by the delegation, and the name and address of the spokesperson for the delegation. (b) The Clerk shall advise the presenter or the spokesperson of the date of the meeting at which the delegation may appear. (c) The maximum time for presentation by a delegation before the Council is ten minutes. (d) The maximum number of delegations for each Council meeting shall be three and they shall be selected in order of their request date. (e) Where an individual or group wishes to appear at consecutive meetings, their delegation shall only be approved if no more than two delegations are scheduled for that meeting. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 11 (iii) to ask a question pertinent to the matter under debate, speak for no more than five minutes at a time, except that Council may resolve to permit a member to speak longer, not speak to a matter already disposed of by the Council, except on a motion for reconsideration in accordance with section 44, not speak when called to order by the Chair until the point of order has been resolved. Improper Conduct 26. (a) No member or person attending the meeting may interrupt a member who is speaking, except that a Councillor may raise a point of order. No member or person attending the meeting may cause a disturbance, disrupt or in any manner delay the conduct of business at a meeting. No member or person permitted or invited to speak on any matter coming before the Council or a Committee may use any rude or offensive language or, by tone or manner of speaking, express any point of view or opinion or make any allegation which, directly or indirectly, reflects upon the public conduct or private character of any person. Removal of Those Behaving Improperly 27. If a person resists or disobeys an order of the Mayor or other person presiding to leave a meeting of Council, that person may be removed, if necessary, by a peace officer at the direction of the Mayor or other person presiding. Enquiries or Submission By Those Attending Meetin2 or Hearing 28. (a) Subject to sections 18 and 22, no person attending a meeting may address the Council on any item of business on the agenda, unless the Council by unanimous resolution of those present and voting agrees to allow that person to address it. (b) Any person attending a, meeting of a standing or select committee, a public hearing, or any person asking a public question under section 15(n) may address the Council or committee with leave of the Chair. (b) If the ruling of the Chair is challenged, the Chair must put the challenge to a vote. Points of Privile2e 29. (a) A member may raise a question of privilege at any time, whereupon the Chair must interrupt a matter of consideration on the agenda, interrupt a member who had been speaking, until the point of privilege is ruled on, ask the member raising the point of privilege to state the substance of and the basis for the point of privilege, and state the provision of this bylaw or other rule of order applicable to the point of privilege, which the Chair must do at once without debate. If the ruling of the Chair is challenged, the Chair must put the challenge to a vote. Any unfinished business on the agenda will be forwarded to the next Council Meeting should the motion to adjourn or the motion to fix the time to which to adjourn be adopted as a point of privilege. (d) The length of time or time to reconvene must be specified should the motion to recess be raised as a point of privilege. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 9 (f) The Council may waive strict compliance with paragraphs (c), (d) and (e) by resolution. Correspondence 19. (a) All correspondence addressed to the Mayor and Council, or to the Council, shall be acknowledged in writing by the Clerk to the writer thereof and a copy of the correspondence shall be forwarded to Council either directly or through the Council agenda. (b) The Clerk shall be granted the authority to refer correspondence to Municipal Council, the appropriate department and/or the appropriate committee of Council, and the writer shall be so advised of this referral and the response to the correspondence. Delivery of Minutes 20. The Clerk must prepare, and deliver to each member's address, the minutes of the last regular meeting at least twenty-four (24) hours prior to the next regular meeting, and each special and/or closed meeting not more than fourteen days after the meeting. Adoption of Minutes 21. (a) The minutes of every meeting must be adopted by the resolution of the Council. (b) The minutes may be adopted by resolution of the Council without their being read to the meeting. Any error or omission in the minutes may be identified by a member verbally and rectified by a resolution or unanimous consent, failing which the adoption of the minutes shall be postponed to the next meeting. The minutes of a meeting from which the public is excluded must be adopted at a subsequent meeting from which the public is excluded. Public Questions at Council Meetin2s 22. After the Council meeting is adjourned, a maximum of fifteen (15) minutes will be allotted for the public and media to ask the Council questions related to any item on the Council Agenda. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 10 PART 5—RULES OF DEBATE Recognition of Speakers 23. (a) No member may speak in a meeting until the member has raised his or her hand and/or signaled through some similar means and the Chair has recognized the member. If two or more members indicate simultaneously that they wish to speak, the Chair may designate the order in which each is to speak. The Mayor may speak at a meeting at any time without leave, but may not interrupt a member except to restore order. If a Councillor has indicated a desire to speak at the same time the Mayor begins to speak, the Mayor may speak first. Manner of Address by Speakers 24. (a) A person must address the Mayor as "Mister, or Madam, Mayor" or "Your Worship" as the case may be. (b) A person must address a Councillor by that Councillor's surname preceded by "Councillor." Rules Respecting Councillors When Speakin2 25. Except as otherwise unanimously resolved by the Council members present and voting, a member may speak only to an item of business on the agenda called for consideration by the Chair, not speak to an item on the agenda until a motion dealing with the substance of the item has been moved and seconded, subject to section 29, speak only once to a matter, except that a member may speak more than once to a matter (i) with the leave of the Chair, (ii) to explain a material part of his or her speech which may have been misunderstood, or Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 13 PART 7— MOTIONS Notice of Motion 31. (a) A member may give Notice of Motion which he/she intends to present to Council by giving a copy of such motion to the Clerk during a meeting of the Council. (b) The Notice of Motion will be considered as an agenda item on the next regularly scheduled meeting of the Council. (c) The introduction of a Notice of Motion is governed by the following procedure: the motion must be in writing signed by the mover and seconder, the motion must be read aloud by the Clerk if it is not on the agenda, only the member making the motion may make introductory remarks, after being read aloud the motion shall be open for consideration and shall be deemed to be in possession of Council and may be withdrawn only by resolution of Council. (d) The Council may not proceed with any Notice of Motion on the agenda in the absence of the member at whose request the item was placed on the agenda unless: written consent of the absent member is presented to the Chair of the meeting, or Council resolves to proceed with the Notice of Motion despite the absence of that member. Resolutions and Bylaws • 32. (a) Pesolution; the radirg of ,bylaws md the adoption of blaw must be dealt with on a motion put by a member and seconded by another member. (b) The Chair may not put forward or second a motion. Inadmissible Motion 33. (a) If the Chair considers that a motion is ôontrary to a bylaw or the Act, the Chair must inform the Council at once and may refuse to permit debate on the motion and to put the question to a vote. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 14 (b) The Chair must give reasons for any such refusal at once. Recording of Motions 34. The Clerk must record in the minutes the text of every motion that is duly moved and seconded. Reading of Motions 35. After a motion has been seconded by another member and recorded by the Clerk, if so requested by a member, the Clerk must read the motion aloud to the meeting before the motion is debated or put to the vote by the Mayor. Withdrawal of Motion 36. A motion may not be withdrawn after it has been voted on by the Council, or it has been read to the meeting unless the Council otherwise resolves. Amendment of Motions 37. (a) A member may move to amend a motion being considered by the Council, but that member may not move any further amendments to that motion. (b) A motion to amend must be seconded. A member may move to amend an amendment already moved and seconded. No motion to amend a motion may be made if the amendment negates the motion which would be amended. If any member states that a proposed amendment to a motion would negate that motion, the Chair must at once rule whether that would be the case. That ruling may be appealed to the Council as if the ruling were on a point of order. 13 Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 15 Effect of Motion to Amend 38. (a) If a motion to amend a motion is carried, the motion which has been amended is to be voted on as amended, or defeated, the motion in respect of which the amendment was moved is to be voted on without amendment. (b) A motion to amend must either be withdrawn or voted on before the motion which would be amended may be voted on. Question to be Put After Debate 39. The Chair must put every question to a vote immediately after debate on that question is closed. Poll 40. Any Councillor may require a poii on a question. Recordin2 of Votes 41. The Clerk must record in the minutes of a meeting the name of any member who voted in the negative on any question. Effect of Not Voting When Not Abstention 42. (a). A-member present- at- a-meet-i.n-g at -the - t-ime.o.f a- vote who-abstains from-voting is deemed to have voted in the affirmative. - (b) No member may leave a meeting once a vote on a matter has been called. Declaration If Not Entitled To Vote 43. (a) A member attending a meeting must not participate in the discussion of or vote on a matter that he or she has a direct or indirect pecuniary interest unless, Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 16 the pecuniary interest of the member is a pecuniary interest in common with electors of the District generally; the matter relates to remuneration or expenses payable to one or more members in relation to their duties as council members; the pecuniary interest is so remote or insignificant that it cannot reasonably be regarded as likely to influence the member in relation to the matter. (b) If a member has a direct or indirect pecuniary interest or considers himself or herself for any other reason not entitled to vote on or discuss a matter, the member must declare this and state the general nature of why the member considers this to be the case. (c) After making the declaration the member: must not take part in the discussion of the matter and is not entitled to vote on any question in respect of the matter; must immediately leave the meeting or that part of the meeting during which the matter is under consideration; and must not attempt in any way, whether before, during or after the meeting, to influence the voting on any question in respect of the matter. (d) When the declaration is made the person recording the minutes must record the member's declaration, the reasons given for it and the times of the member's departure from the meeting room and, if applicable, of the member's return. (e) The person presiding at the meeting must ensure that the member is not present at the meeting at the time of any vote on the matter. (f) Section 43 of this bylaw applies to Council members in relation to council meetings, standing and select committee meetings and any bodies subject to section 242.7 of the Act. Reconsideration 44. (a) A member who voted with the majority either for or against a motion may, at any time within one month of the vote, introduce a motion to reconsider the resolution, motion or proceeding, including the defeat of a motion, if the resolution, motion or proceeding has not been acted upon irreversibly by an officer, employee or agent of the municipality. Is Maple Ridge Council Procedure Bylaw No. 5871 - 1999 4 Page 17 The Mayor may, at any time within one month of the vote, bring back for reconsideration a resolution, motion or proceeding, whether adopted or defeated, if the resolution, motion or proceeding has not been acted upon irreversibly by an officer, employee or agent of the municipality. If a motion to reconsider is defeated, the subject matter of the resolution or proceeding may not be open for consideration by the Council within 6 months except by way of a new and substantially different motion. PART 8— ADOPTION OF BYLAWS Bylaw Introduction 45. Unless the Council otherwise resolves, the Council may not consider a proposed bylaw unless the Clerk has given a copy of it to each member, or it is on the agenda for the meeting. Introducing Bylaws 46. Every proposed bylaw is to be introduced at a meeting by specifying its title and subject matter. The Clerk shall be prepared to give the necessary background information as may be required by the Council. Readin2sg Amendments and Adoption of Bylaws 47. (a) Subject to this bylaw and any other legislation, the Council may give any or all three readings of a bylaw at one meeting. (b) Every bylaw passed by the CouncIl, with the exception of a community plan bylaw or zoning bylaw, shall be reconsidered not less than one day after the bylaw has received third reading and before adoption. A community plan bylaw or zoning bylaw may be adopted at the same meeting at which said bylaw receives third reading. A bylaw, except a zoning bylaw, may be amended at any time up until the Clerk has affixed thereto the corporate seal of the District, provided, however, that no bylaw after third reading has been given may be altered or amended except on motion of Council. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 18 (e) Municipal bylaws come into force on the later of the date it is adopted by Council, or a date set by the bylaw. (f) If adopted by the Council, a bylaw shall be signed by the Mayor or Acting Mayor, as the case may be, and by the Clerk and the Clerk shall affix thereto the corporate seal of the District. Reconsideration of Part or All of Bylaw (a) Subject to other enactments, the Council may rescind the most recent reading of a proposed bylaw, other than first reading, and then give the proposed bylaw that - reading with or without amendment. (b) A resolution is required to rescind a reading of a proposed bylaw, and to amend the proposed law. Description of Steps in Every Bylaw On the last page of every bylaw that is enacted by the Council, the Clerk must set out the applicable dates on which: readings and the adoption of the bylaw occurred; a 2/3 or a unanimous vote of the Council occurred, as the case may be; a public hearing occurred; and the assent of the electors was received. PART 9 — STANDING. AND SELECT COMMITTEES Creation of Select and Stan' ding Committees 50.- (a) The Mayor may establish standing committees for matters he or she considers would be better regulated and managed by a committee and he or she may appoint the members of the standing committee. (b) The Council may, 'by resolution, establish a select committee to consider or enquire into any matter and to report its findings and opinion to the Council. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 19 (c) The Mayor or Council, as the case may be, shall appoint a Chair to every standing and select committee. Procedures Governing Standing, Select and Other Committees 51. (a) The rules of procedure in this section govern every committee. (b) Subject to the other rules contained in this section, the rules of procedure and order which govern regular Council meetings govern every committee meeting. The number of times a member may speak on any matter is not limited. At any time a member of the public may be invited by the Chair to speak or appear as a delegation to the committee. The presentation of the delegation may not exceed ten minutes duration unless so resolved by the Committee. - (c) A committee may hold a special committee meeting when its chair so directs, the Mayor so directs, or directed to meet by resolution of the Council. (d) The Clerk must appoint a secretary for each committee. (e) The secretary must give at least 24 hours notice of a meeting to the members of the committee when the meeting is called and he or she keep minutes of the proceedings of the committee. (f) After the Council Committee or Mayor, as the case may be, has set the schedule of meetings for standing and select committees, the Clerk shall prepare and post, at posting locations, a notice respecting the time, place and date of the committee meetings. Quorum 52. A quorum of a committee or other advisory body is a majority of the Committee or advisory body's members. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 20 Attendance at Standing and Select Committee Meetings (a) Any member, the Chief Administrative Officer and any other official of the municipality invited by the committee may attend a meeting of a committee and participate in any debate if the committee so desires. Only members or persons appointed to committees in accordance with section 50 may move or second motions or vote at committee meetings. (b) The first meeting of a select committee after its creation must be held on the date and at the time and location specified by the Mayor or the Council as the case may be. Every meeting of a select committee after its first meeting is to be held at the date, time and location specified by resolution of the select committee and after consultation with the Clerk. Meetings of Standin2 Committee The first meeting of a standing committee after its creation must be held on the date and at the time and location specified by the Mayor. All regular meetings of a standing committee after its first meeting is to be held at the date, time and location specified by resolution of the standing committee and approved by Council. Reporting to Council by Committees (a) Minutes and recommendations arising from committee meetings shall be forwarded to Council for their information. A committee must report to the Council when directed by resolution of the Council. The proceedings of a standing and select committees are subject to approval of Council, except executive or administrative proceedings that may be delegated by the Council from time to time. A select committee is dissolved on delivering its report to the Council unless the report is delivered as an interim report for the information of the Council, or the Council resolves to request the committee to consider or enquire into a further matter and to report its findings to the Council. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 21 Mayor a Member of All Committees The Mayor is appointed as a voting member to all committees. PART 10— GENERAL Councillors' Address for Notices The address to which all notices and other communications are to be sent to members by the Clerk for the purposes of this bylaw and otherwise is the specified mail box trays at the Corporation of the District of Maple Ridge Municipal Hall. Unprovided For Cases The rules governing debates and procedure found in Robert's Rules of Order, except as are inconsistent with provisions of this bylaw or the Act, shall govern the council. Severance If any portion of this bylaw is held to be invalid by a Court of competent jurisdiction, such invalidity does not affect the validity of the remaining portions of this bylaw. Irregularity The failure of Council to observe the provisions of this bylaw does not affect the validity of resolutions passed or bylaws enacted by Council. Waiver Where all members are present at a meeting, the absence of a call for such a meeting or failure to give notice to all or any member will not rndertlie, meeting invalid if the unanimous consent of those members present is gained prior to transacting any business. WHEREAS pursuant to the provisions of the Municipal Act and amendments thereto, Council may, by by-law authorize the installation of works as a Local Improvement and authorize the borrowing of funds necessary; AND WHEREAS, legal petitions have been received by two-thirds (2/3) majority of the property owners of six (6) parcels in an area of the Municipality requesting construction and installation of 125 metres of 300 mm diameter storm sewer complete with appurtenances, and the said petitions have been signed by the minimum required two-thirds (2/3) majority of the owners of the six (6) parcels to be specially charged; AND WHEREAS, the above mentioned petitions have been certified by the Clerk as being sufficient in all respects; AND WHEREAS, Council has received a report from the Director of Project Engineering stating that: The Lifetime of Works it ten (10) years; The estimated cost of the works is $13,185.00; The proportion of the total costs which will be specially charged against the parcels benefiting from or abutting on the works is 100%. RECOMMENDATION: That Maple Ridge Council Procedure Bylaw No. 5871-1999 be read a first and second time, and that the Rules of Order be waived and Maple Ridge Council Procedure Bylaw No. 5871-1999 be read a third time; and That the Maple Ridge - Council Schedule 2000 be approved. BACKGROUND: The Municipal Act was recently amended by Bill 88 with many implications for local government. An immediate issue for Municipal Council is adoption of an amended procedure bylaw prior to December 28, 1999. A copy of the relevant sections of the Municipal Act are attached for reference. Maple Ridge Procedure Bylaw .No. 3100-1982 and amending bylaws previously met provincial requirements and the needs of this community and organization. Adoption of Bill 88 requires that procedure bylaws be amended to provide for: setting the time and place for Council Meetings and establishing the procedure for notice of Council and Committee Meetings; establishing procedures for standing, select and other Advisory Committees; establishing procedures for when and how a Council or Committee Meeting may be closed to the public; and including conflict of interest provisions that are extended to Council Members in relation to committees and other advisory bodies. 4 p A number of discretionary provisions have also been included for Council consideration and exceed the limits of Maple Ridge Procedure Bylaw No. 3 100-1982: additional portions of Robert's Rules of Order have been explicitly included; maximum number of delegations is three per Council Meeting with a ten minute time allotment and written notice of ten days; correspondence is referred by the Municipal Clerk to Council, Council Committees or staff for appropriate actionlresponse; the Municipal Clerk assumes responsibility for Maple Ridge Council Committees and Advisory Bodies. The intent of the amended procedure bylaw is to meet all legislated requirements, establish a procedural framework for Council decisions and Committee recommendations, allow appropriate public access to meetings and permit some discretion by Council and staff to address unforeseen issues. The District of Maple Ridge - Council Schedule 2000 is also required by Municipal Act. A definition in the Act which is incorporated into this bylaw has the meaning given to it in the Act. Interpretation of Bylaw 3. Reference in this bylaw to a numbered "section" or "Part" is a reference to the correspondingly numbered section or Part of this bylaw, the plural is to be considered to be a reference also to the singular, unless the context otherwise requires, a resolution or vote of the Council is a reference to a resolution or vote passed by the affirmative vote of a majority of the members present and entitled to vote on the matter, except as otherwise provided by the Act or this or any other bylaw of the District, a requirement for a 2/3 vote is a requirement for the affirmative vote of at least 2/3 of the number of members of which Council consists under the Act. PART 2— REGULAR MEETINGS Time and Location of Regular Meetings 4. Subject to a schedule of meetings adopted by resolution of Council at a regular meeting, and subject to sections 5, 7 and 8, a regular meeting is to be held in the Municipal Hall, on the second and fourth Tuesday of each month, unless the Tuesday is a holiday, in which case the regular meeting is to be held on the next day that is not a holiday. (a) The Council may by resolution cancel or reschedule any regular meeting, change the time or location for the holding of a meeting, or (b) The resolution to cancel or reschedule a regular meeting postpones the business on the agenda for the meeting to the next or the rescheduled regular meeting. Notice of Cancelled or Rescheduled Meeting 8. Except in the case of a meeting for which there is no quorum or a quorum is lost, the Clerk must give public notice of the cancelled, rescheduled or called meeting or of the change of time or location by posting notice to the public at the posting locations before the date and time on which the regular meeting was to have been held. Meetings Open to The Public 9. Subject to section 10 of this bylaw all meetings shall be open to the public. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 5 Exclusion of Public From Meetings 10. (a) In accordance with sections 242.2 and 242.3 of the Act, a Council meeting or Special Council meeting or part thereof may be closed to the public if the subject matter being considered relates to one or more of the following: personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the District; personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the District on condition of anonymity; labour relations or employee negotiations; the security of property of the District; the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure might reasonably be expected to harm the interests of the District; law enforcement, if the Council considers that disclosure might reasonably be expected to harm the conduct of an investigation under or enforcement of an Act, regulation or bylaw: litigation or potential litigation affecting the municipality; the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose; information that is prohibited from disclosure under section 21 of the Freedom ofInformation and Protection of Privacy Act; a matter that, underanother enactment, is such ihat the public nrust be excluded from the meeting; and : a matter prescribed by regulation under section 242.8 of the Act. (b) Before a meeting or part of a meeting is closed to the public the Council must state by resolution the fact that the meeting is to be closed and the basis under section 10(a) on which the meeting is to be closed. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 6 Application to Other Committees and MuniciDal Bodies 11. Section 10 applies to: a body that under the Act may exercise the powers of the District or Council; the board of variance; the local court of revision; advisory committees or other advisory bodies established under this bylaw or the Act including standing and select committees of Council. PART 3— SPECIAL MEETINGS Calling and Notice of a Special Meeting 12. (a) A special meeting may be called in compliance with applicable enactments or by a resolution of Council fixing the time, date, and place. (b) The Clerk must prepare the public notice and an agenda for each special meeting which must state the nature of each item of business to be dealt with at the special meeting and the notice and agenda must be delivered to each member's address and be posted in the posting locations at least 24 hours before the time of the meeting. PART 4— PROCEDURES FOR COUNCIL MEETINGS Mayor to Open Meetings 13. Once a quorum is present, the Mayor, or in the absence of the Mayor, the Acting Mayor, must call the meeting to order and be the Chair for the meeting after the posted time for the meeting. MavorArrives After Commencement 14. If the Mayor arrives after commencement of a meeting, he or she will preside on arrival. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 7 Business at Regular Meetings 15. Unless the Council otherwise resolves, the general order of business at every regular meeting shall be in the following order: Call to Order, Opening Prayers, Presentations at the Request of Council Adoption of Minutes, Delegations Correspondence, By-laws, Committee reports and recommendations, Mayor's Reports Councillors' Reports, Other matters deemed expedient, (1) Notices of Motion, Adjournment, Questions from the Public. Meeting AendaPreparation 16. The Clerk must prepare an agenda for each regular meeting, which must be in the order set out in section 15, State the general nature of each item of business to be dealt with at the meeting, Be delivered to each member's address at least twenty-four (24) hours before the time when a regular meeting is to be held, and Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 8 (d) Be posted at the posting locations at least twenty-four (24) hours before the time set for a regular meeting. Petitions 17. Petitions to Council will be considered in the same manner as correspondence to Council and therefore in accordance with the process outlined in section 19 of this bylaw. the person who wishes to submit a petition to the Council delivers to the Clerk (i) the complete petition, and Lu) the name and address of each person who has signed the petition. the petition must be in a format whereby the nature of the issue/item is clearly evident so that signatories to the petition are clearly aware of the issue to which they have affixed their signature. Delegations 18. A delegation may appear before the Council, if, at least ten (10) days prior to the regular meeting at which the delegation wishes to appear, (a) the delegation provides to the Clerk: a written brief clearly outlining the intended presentation and subject matter to be presented by the delegation, and the name and address of the spokesperson for the delegation. (b) The Clerk shall advise the presenter or the spokesperson of the date of the meeting at which the delegation may appear. (c) The maximum time for presentation by a delegation before the Council is ten minutes. (d) The maximum number of delegations for each Council meeting shall be three and they shall be selected in order of their request date. (e). Where an individual or group wishes to appear at consecutive meetings, their delegation shall only be approved if, no more than two delegations are scheduled for that meeting. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 9 (f) The Council may waive strict compliance with paragraphs (c), (d) and (e) by resolution. Correspondence 19. (a) All correspondence addressed to the Mayor and Council, or to the Council, shall be acknowledged in writing by the Clerk to the writer thereof and a copy of the correspondence shall be forwarded to Council either directly or through the Council agenda. (b) The Clerk shall be granted the authority to refer correspondence to Municipal Council, the appropriate department andlor the appropriate committee of Council, and the writer shall be so advised of this referral and the response to the correspondence. Delivery of Minutes 20. The Clerk must prepare, and deliver to each member's address, the minutes of the last regular meeting at least twenty-four (24) hours prior to the next regular meeting, and each special and/or closed meeting not more than fourteen days after the meeting. Adoption of Minutes 21. (a) The minutes of every meeting must be adopted by the resolution of the Council. (b) The minutes may be adopted by resolution of the Council without their being read to the meeting. Any error or omission in the minutes may be identified by a member verbally and rectifiedby a resolutiori or unanimous consent, failing which the adoption of the minutes shall be postponed to the next meeting. The minutes of a meeting from which the public is excluded must be adopted at a subsequent meeting from which the public is excluded. Public Ouestións at Council Meetings 22. After the Council meeting is adjourned, a maximum of fifteen (15) minutes will be allotted for the public and media to ask the Council questions related to any item on the Council Agenda. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 10 PART 5— RULES OF DEBATE Recognition of Speakers 23. (a) No member may speak in a meeting until the member has raised his or her hand andlor signaled through some similar means and the Chair has recognized the member. If two or more members indicate simultaneously that they wish to speak, the Chair may designate the order in which each is to speak. The Mayor may speak at a meeting at any time without leave, but may not interrupt a member except to restore order. If a Councillor has indicated a desire to speak at the same time the Mayor begins to speak, the. Mayor may speak first. Manner of Address by Speakers 24. (a) A person must address the Mayor as "Mister, or Madam, Mayor" or "Your Worship" as the case may be. (b) A person must address a Councillor by that Councillor's surname preceded by "Councillor." Rules Respecting Councillors When Speaking 25. Except as otherwise unanimously resolved by the Council members present and voting, a member may speak only to an item of business on the agenda called for consideration by the Chair, not speak to an item on the agenda until a motion dealing with the substance of the item has been moved and seconded, subject to section 29, speak only once to a matter, except that a member may speak more than once to a matter (i) with the leave of the Chair, (ii) to explain a material part of this or her speech which may have been misunderstood, or Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 11 (iii) to ask a question pertinent to the matter under debate, speak for no more than five minutes at a time, except that Council may resolve to permit a member to speak longer, not.speak to a matter already disposed of by the Council, except on a motion for reconsideration in accordance with section 44, (0 not speak when. called to order by the Chair until the point of order has been resolved. Improper Conduct 26. (a) No member or person attending the meeting may interrupt a member who is speaking, except that a Councillor may raise a point of order. No member or person attending the meeting may cause a disturbance, disrupt or in any manner delay the conduct of business at a meeting. No member or person permitted or invited to speak on any matter commg before the Council or a Committee may use any rude or offensive language or, by tone or manner of speaking, express any point of view or opinion or make any allegation which, directly or indirectly, reflects upon the public conduct or private character of any person. Removal of Those Behaving Improperly 27. If a person resists or disobeys an order of the Mayor or other person presiding to leave a meeting of Council, that person may be removed, if necessary, by a peace officer at the direction of the Mayor or other person presiding. Enquiries or Submission By Those Attending Meeting or Hearing 28. (a) Subject to sêôtiôns 18 and 23, person attending a meeting may address the Council on any item of business on the agenda, unless the Council by unanimous resolution of those present and voting agrees to allow that person to address it. (b) Any person attending a meeting of a standing or select committee, a public hearing or a public meeting, or any person asking a public question under section 14(n) may address the Council or committee with leave of the Chair. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 12 PART 6— POINTS OF PRIVILEGE AND ORDER Points of Order 29. (a) A member may raise a point of order at any time, whereupon the Chair must interrupt a matter of consideration on the agenda, interrupt a member who had been speaking, until the point of order is ruled on, ask the member raising the point or order to state the substance of and the basis for the point of order, and state the provision of this bylaw or other rule of order applicable to the point of order, which the Chair must do at once without debate. (b) If the ruling of the Chair is challenged, the Chair must put the challenge to a vote. PART 7— MOTIONS Notice of Motion 30. (a) A member may give Notice of Motion which he/she intends to present to Council by giving a copy of such motion to the Clerk during a meeting of the Council. (b) The Notice of Motion will be considered as an agenda item on the next regularly scheduled meeting of the Council. (c) The introduction of a Notiàe of Motion is governed by the following procedure: the motion must be in writing signed by the mover and seconder, the motion must be read aloud by the Clerk if it is not on the agenda, only the member making the motion may make introductory remarks, after being read aloud the motion shall be open for consideration and shall be deemed to be in possession of Council and may be withdrawn only by resolution of Council. (d) The Council may not proceed with any Notice of Motion on the agenda in the absence of the member at whose request the item was placed on the agenda unless: Maple Ridge Council Procedure Bylaw No. 5871 - 1999 13 Page 13 written consent of the absent member is presented to the Chair of the meeting, or Council resolves to proceed with the Notice of Motion despite the absence of that member. Resolutions and Bylaws (a) Resolutions, the reading of bylaws and the adoption of bylaws must be dealt with on a motion put by a member and seconded by another member. (b) The Chair may not put forward or second a motion. Inadmissible Motion (a) If the Chair considers that a motion is contrary to a bylaw or the Act, the Chair must inform the Council at once and may refuse to permit debate on the motion and to put the question to a vote. (b) The Chair must give reasons for any such refusal at once. Recording of Motions The Clerk must record in the minutes the text of every motion that is duly moved and seconded. - Reading of Motions After a motion has been seconded by another member and recorded by the Clerk, if so requested by a member, the Clerk must read the motion aloud to the meeting before the motion is debated or put to the vote by the Mayor. Withdrawal of Motion A motion may not be withdrawn after it has been voted on by the Council, or it has been read to the meeting unless the Council otherwise resolves. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 14 Amendment of Motions 36. (a) A member may move to amend a motion being considered by the Council, but that member may not move any further amendments to that motion. A motion to amend must be seconded. A member may move to amend an amendment already moved and seconded. No motion to amend a motion may be made if the amendment negates the motion which would be amended. If any member states that a proposed amendment to a motion would negate that motion, the Chair must at once rule whether that would be the case. That ruling may be appealed to the Council as if the ruling were on a point of order. Effect of Motion to Amend 37. (a) If a motion to amend a motion is carried, the motion which has been amended is to be voted on as amended, or defeated, the motion in respect of which the amendment was moved is to be voted on without amendment. (b) A motion to amend must either be withdrawn or voted on before the motion which would be amended may be voted on. Ouestion to be Put After Debate 38. The Chair must put every question to a vote immediately after debate on that question is closed. Poll 39. Any Councillor may require a poli on a question. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 15 Recording of Votes /"'40. The Clerk must record in the minutes of a meeting the name of any member who voted in the negative on any question. Effect of Not Voting When Not Abstention (a) A member present at a meeting at the time of a vote who abstains from voting is deemed to have voted in the affirmative. (b) No member may leave a meeting once a vote on a matter has been called. Declaration If Not Entitled To Vote (a) A member attending a meeting must not participate in the discussion of or vote on a matter that he or she has a direct or indirect pecuniary interest unless, the pecuniary interest of the member is a pecuniary interest in conunon with electors of the District generally; the matter relates to remuneration or expenses payable to one or more members in relation to their duties as council members; the pecuniary interest is so remote or insignificant that it cannot reasonably be regarded as likely to influence the member in relatiOn to the matter. If a member has a direct or indirect pecuniary interest or considers himself or herself for any other reason not entitled to vote on or discuss a matter, the member must declare this and state the general nature of why the member considers this to be the case. After making the declaration the member: must not take part in the discussion of the matter and is not entitled to vote on any question in respect of the matter; must immediately leave the meeting or that part of the meeting during which the matter is under consideration; and (iii) must not attempt in any way, whether before, during or after the meeting, to influence the voting on any question in respect of the matter.. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 16 When the declaration is made the person recording the minutes must record the member's declaration, the reasons given for it and the times of the member's departure from the meeting room and, if applicable, of the member's return. The person presiding at the meeting must ensure that the member is not present at the meeting at the time of any vote on the matter. Section 42 of this bylaw applies to Council members in relation to council meetings, standing and select committee meetings and any bodies subject to section 242.7 of the Act. Reconsideration 43. (a) A member who voted with the majority either for or against a motion may, at any time within one month of the vote, introduce a motion to reconsider the resolution, motion or proceeding, including the defeat of a motion, if the resolution, motion or proceeding has not been acted upon irreversibly by an officer, employee or agent of the municipality. The Mayor may, at any time within one month of the vote, bring back for reconsideration a resolution, motion or proceeding, whether adopted or defeated, if the resolution, motion or proceeding has not been acted upon irreversibly by an officer, employee or agent of the municipality. If a motion to reconsider is defeated, the subject matter of the resolution or proceeding may not be open for consideration by the Council within 6 months except by way of a new and substantially different motion. PART 8— ADOPTION OF BYLAWS Bylaw Introduction 44. Unless the Council otherwise resolves, the Council may not consider a proposed bylaw unless the Clerk has given a copy of it to each member, or it is on the agenda for the meeting. Maple Ridge Council Procedure Eylaw No. 5871 - 1999 Page 17 Introducing Bylaws 45. Evety proposed bylaw is to be introduced at a meeting by specifying its title and subject matter. The Clerk shall be prepared to give the necessary background information as may be required by the Council. Readings, Amendments and Adoption of Bylaws 46. (a) Subject to this bylaw and any other legislation, the Council may give any or all three readings of a bylaw at one meeting. (b) Every bylaw passed by the Council, with the exception of a conmiunity plan bylaw or zoning bylaw, shall be reconsidered not less than one day after the bylaw has received third reading and before adoption. (c) A community plan bylaw or zoning bylaw may be adopted at the same meeting at which said bylaw receives third reading. (d) A bylaw, except a zoning bylaw, may be amended at any time up until the Clerk has affixed thereto the corporate seal of the District, provided, however, that no bylaw after third reading has been given may be altered or amended except on -- motion of Council. (e) Municipal bylaws come into force on the later of the date it is adopted by Council, or a date set by the bylaw. (f) If adopted by the Council, a bylaw shall be signed by the Mayor or Acting Mayor, as the case may be, and by the Clerk and the Clerk shall affix thereto the corporate seal of the District. Reconsideration of Part or All of Bylaw 47. (a) Subject to other enactments, the Council may rescind the most recent reading of a proposed bylaw, other than first reading, and then give the proposed bylaw that reading with or without amendment. (b) A resolution is required to rescind a reading of a proposed bylaw, and to amend the proposed law. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 18 Description of Steos in Every Bylaw 48. On the last page of every bylaw that is enacted by the Council, the Clerk must set out the dates on which: readings and the adoption of the bylaw occurred; a 2/3 or a unanimous vote of the Council occurred, as the case may be; a public hearing occurred; and the assent of the electors was received. PART 9— STANDING AND SELECT COMMITTEES Creation of Select and Standing Committees 49. (a) The Mayor may establish standing committees for matters he or she considers would be better regulated and managed by a committee and he or she may appoint the members of the standing committee. The Council may, by resolution, establish a select committee to consider or enquire into any matter and to report its findings and opinion to the Council. The Mayor or Council, as the case may be, shall appoint a Chair to every standing and select committee. Procedures Governing Standing. Select and Other Committees 50. (a) The rules of procedure in this section govern every committee. (b) Subject to the other rules contained in this section, the rules of procedure and order which govern regular Council meetings govern every committee meeting. The number of times a member may speak on any matter is not limited. At any time a member of the public may be invited by the Chair to speak or appear as a delegation to the committee. (iii) The presentation of the delegation may not exceed ten minutes duration unless so resolved by the Committee. Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 19 (c) A committee may hold a special committee meeting when its chair so directs, the Mayor so directs, or directed to meet by resolution of the Council. The Clerk must appoint a secretary for each committee. The secretary must give at least 24 hours notice of a meeting to the members of the committee when the meeting is called and he or she keep minutes of the proceedings of the committee. After the Council Committee or Mayor, as the case may be, has set the schedule of meetings for standing and select committees, the Clerk shall prepare and post, at posting locations, a notice respecting the time, place and date of the committee meetings. Ouorum A quorum of a committee or other advisory body is a majority of the Committee or advisory body's members. Attendance at Standing and Select Committee Meetings (a) Any member, the Chief Administrative Officer and any other official of the municipality invited by the committee may attend a meeting of a committee and participate in any debate if the committee so desires. Only members or persons appointed to committees in accordance with section 49 may move or second motions or vote at committee meetings. (b) The first meeting of a select committee after its creation must be held on the date and at the time and location specified by the Mayor or the Council as the case may be. Every meeting of a select committee after its first meeting is to be held at the date, time and location specified by resolution of the select committee and after consultation with the Clerk. Meetin2s of StandingCommittee 53. The first meeting of a standing committee after its creation must be held on the date and at the time and location specified by the Mayor. All regular meetings of a standing Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 20 committee after its first meeting is to be held at the date, time and location specified by resolution of the standing committee and approved by Council. Reporting to Council by Committees 54. (a) Minutes and recommendations arising from committee meetings shall be forwarded to Council for their information. A committee must report to the Council when directed by resolution of the Council. The proceedings of a standing and select committees are subject to approval of Council, except executive or administrative proceedings that may be delegated by the Council from time to time. A select committee is dissolved on delivering its report to the Council unless the report is delivered as an interim report for the information of the Council, or the Council resolves to request the committee to consider or enquire into a further matter and to report its findings to the Council. Mayor a Member of All Committees 55. The Mayor is appointed as a voting member to all committees. PART 10— GENERAL Councillors' Address for Notices 56. The address to which all notices and other communications are to be sent to members by the Clerk for the purposes of this bylaw and otherwise is the specified mail box trays at the Corporation of the District of Maple Ridge Municipal Hall. Unprovided For Cases 57. The rules governing debates and procedure found in Robert's Rules of Order, except as are inconsistent with provisions of this bylaw or the Act, shall govern the council. A Maple Ridge Council Procedure Bylaw No. 5871 - 1999 Page 21 Severance If any portion of this bylaw is held to be invalid by a Court of competent jurisdiction, such invalidity does not affect the validity ofthe remaining portions of this bylaw. Irregularity The failure of Council to observe the provisions of this bylaw does not affect the validity of resolutions passed or bylaws enacted by Council. Waiver Where all members are present at a meeting, the absence of a call for such a meeting or failure to' give notice to all or any member will not render the meeting invalid if the unanimous consent of those members present is gained prior to transacting any business. (3) As soon as convenient, the council must consider the mayor's reasons and either reaffirm or reject the bylaw. resolution or proceeding. (4) If a bylaw, resolution or proceeding is rejected, it is deemed to be repealed and is of no effect, and must not be reintroduced to the council for 6 months except with the unanimous consent of the council. (5) The conditions that applied to the adoption of the original bylaw, resolution or proceeding apply to its rejection. i998-34-36. Acting mayor and deputy mayor 220. (1) A council may appoint one of its members to be deputy mayor and one of its members to be acting mayor. If the office of mayor becomes vacant, the council must appoint a member to be acting mayor, and the acting mayor is to continue in office until another mayor is elected or appointed. Dining the absence, illness or other disability of the mayor, the acting mayor has all the powers of and is subject to the same rules as the mayor. Intermunicipal questions 221. Except where otherwise provided, all questions arising between municipalities must be decided by the mayors of the municipalities or, if they cannot aee, by the Supreme Cowi, whose decision is final. 134.3& Division 3— Council Meetings First council meeting after general local dection Sept. 222. (1) Following a general local election, the first council meeting must be on the first Monday after December 1 in the year of the election. (2) If a quorum of council members elected at the general local election has not taken office by the time referred to in subsection (1), the first council meeting must be called by the municipal officer assigned responsibility under section 198 [corporate adininisrarion] and held as soon as reasonably possible after a quorum has taken office. 1999-57.. Regular and special council meetings 2&99 mi (1) After its first meeting under section 222, a council must meet regularly in accordance with its bylaw under section 235 [procedure bylaw], and ask decides and- as provided in this d For the purposes of this Act, a special council meeting is a council meeting other than a statutory, regular or adjourned meeting. - If permitted under subsection (4), a council meeting may be conducted by means of electronic or other communications facilities. The Lieutenant Governor in Council may make regulations permitting meetings under subsection (3) and prescribing conditions, limits and requirements respecting such meetings. 19$977. (1) A notice of the day, hour and place of a special council meeting must be given at least 24 hozs before the time of meeting, by posting a copy of the notice at the regular council meeting place, and ( leaving one copy for each council member at the place to which the member has directed notices to be sent. Each copy of a notice under subsection (1) must be signed by the mayor or the municipal officer assigned responsibility under section 198 [corporate adminüiranon]. Notice of a special council meeting may be waived by unanimous vote of all council members. 13-3& Council members may request special meeting 224. (1) Two or more council members may, in writing, request the mayor to call a special council meeting. (2) Two or more council members may call a special council meeting if within 24 hours after receiving a request under subsection (1), the mayor refuses or neglects to arrange for the special council meeting to be held within 7 days after receiving the request, or the mayor is absent (3) If a special council meeting is called under subsection (2), the council members calling the meeting must sign the notice under section 223. 199634-36. 225. and 226. Repealed. [1999.37.58] Mayor to preside at council meetings 227. (1) The mayor, if present, must preside at council meetings. (2) If the mayor, deputy mayor and the acting mayor are absent from a council meeting, the members present must choose a member to preside, and the presiding member has, for that plupose, all the powers of and is subject to the same rules as the mayor. (3) Any council member may preside in committee of the whole. Poinis of order 228. The mayor or the member presiding at a council meeting must preserve order and decide points of order that may arise, subject to an appeal to the other council members present. 9634-3 I Appeal from d.00 of mayor 229. (1) On an appeal by a council member from a decision of the mayor, the question as to whether the chair is to be sustained must be immediately put by the mayor and decided without debate. The mayor must be governed by the vote of the majority of the other council members present If the votes are equal, the question pa&ses in the affirmative. The names of the council members voting for or ag ainst the question miut be recorded in alinixtes If the mayor refuses to put the question under subsection (1), the council must immediately appoint a member to preside temporarily, that presiding member must proceed in accordance with subsection (I), and a resolution or motion carried under this subsection is as binding as if carried under subsection (I). (1) This section applies to council members in relation to council meetings, and meetings of committees referred to in section 235 (1) (b) [standing, select and other council committees]. (2) A council member present at the meeting at the time of the vote who abstains from voting is deemed to have voted in the aajve. (3) If the votes of the council members present at the meeting at the time of the vote are equal for and against a question, the question is negatived and the presiding member must declare this result. 199844-36; 199847-59. Council member declaration if not entitled to vote Sept. 231.(1) This section applies to council members in relation to council meetings, meetings of committees refetred to in section 235 (1) (b) [standing, select and other council comrnitrees], and meetings of bodies that are subject to section 242.7 [application to other municipal bodies]. Sept. 25/9 (2) If a council member attending a meeting considers that he or she is not entitled to participate in the discussion of a matter, or vote on a question in respect of a matter because the member has a direct or indirect pecuniary interest in the matter or for any other reason, the member must declare this and state the general nature of why the member considers this to be the case. (3) After making the declaration, the member must not take part in the discussion of the matter and is not entitled to vote on any question in respect of the nianr, must immediately leave the meeting or that part of the meeting during which the matter is under consideration, and must not attempt in any way, whether before, during or after the meeting, to influence the voting on any question in respect of the matter. (4) Whàn the declaration is made, (a) the person recording the minutes of the meeting must record the member's declaration, the reasons given for it and the times of the member's departure from the meeting room and, if applicable, of the member's return, and (b) the person presiding at the meeting must ensure that the member is not present at the meeting at the time of any vote on the matter. Sept. (5) Whether or not a declaration is made under subsection (2). if a council member has a direct or indirect pecuniary interest in a matt, the member must not participate in the discussion of the matter, voteon the attempt in any way, whether before, during or after the meeting, to influence the voting on any question in respect of the mart• (6) Subsection (5) does not apply (a) if the pecuniary interest of the council member is a pecuniary interest in common with electors of the municipality generally, - (b)if the matter relates to remuneration or expenses payable to one or more council members in relation to their duties as council members, or (c) if the pecuniary interest is so remote or insignificant that it cannot reasonably be regarded as likely to influence the member in relation to the matt. Sept. 28199 97 Quickscribe Services Lit 1996 MuAL Acr RS Ca&p. 323 A person who Contiavenes subsection (5) is disqualified from continuing to hold office as a council member unless the contravention was done inadvertently or because of an error in judgment made in good faith. If otherwise qualified, a person disqualified under subsection (7) is qualified to be nominated and elected in the by-election to fill the vacancy created by this disqualification and, if elected, is qualified to hold the Mir oce. Sept. (9) The council may apply to the Supreme Court for an order under subsection (10) if, as a result of subsection (2), the number of council members who may discuss and vote on a matv'r falls below the quorum for the council, or the number of council members required to adopt the applicable bylaw or resolution. t. 28/99 (9.1) An application under subsection (9) may be made without notice to any other person. (10) On an application under subsection (9), the court may order that all or specified council members may discuss and vote on the matter, despite the other provisions of this section, and make the authority under paragraph (a) subject to any conditions and directions the court considers appropriate. -I 1998-34-36;.199937. Division 4— Council Proceedings Exercise of powers by bylaw or resolution 232. (1) If an enactment provides that a council is required or empowered to exercise a power by bylaw, that power may only be exercised by bylaw. Except as reswicted by subsection (1), the powers of a council may be exercised by resolution or bylaw. An act or proceeding of a council is not valid unless it is authorized or adopted by bylaw or resolution at a council meeting. 19984436. General rule that matters be decided by majority of members present 233. Unless otherwise provided, all acts to be done by the council, and all other questions, including adjournment, that may come before the council must be done and decided by a majority of the council members present at a meeting. 19984436. Requirement for 2/3 majority 234. A requirement in this Act for an affirmative vote of at least 2/3 of all members of a council means an affirmative vote of at least 2/3 of the number of members of which the council consists under this Act. 199844-3&. Procedure bylaw *!~~>. 235.(1) The council must, by bylaw, do the following: (a) establish the procedures that are to be followed for the conduct of its business, including the manner by which resolutions may be passed and bylaws adopted; (b) establish the procedures that are to be followed in conducting meetings of select and st2nding committees of council, and any other committee composed solely of council members acting in that capacity; (c) establish the time and place of regular meetings of council; (d) require advance public notice respecting the time, place and date of council and committee meetings and establish the procedures for giving that notice. ACT RS CRAP 323 (2) A bylaw under this section must not be altered except by a bylaw passed at a regular council meeting in accordance with a notice in writing given and openly announced at an earlier regular mecung. 1999-3741. Minutes of council meetings Sepc. 236. (1) Minutes of council meetings must be legibly recorded, certified as correct by the designated municipal officer, signed by the mayor or other member presiding at the meeting or at the next meeting at which they are adopted, and open for public inspection at the municipal hail during its regular office hours. (2) Subsection (1) (d) does not apply to minutes of that part of a council meeting from which persons were excluded under section 242.2 (closed meetings!. 1999-3741. 7 *~~> Minutes of council committee meetings 237. Establishment of standing committees 239. (1) The mayor may establish standing committees for mal?rs the mayor considers would be better regulated and managed by committee, and for that purpose may provide for appointment as members of a standing committee persons who are not council members. (2) At least 112 the members of a standing committee must be council members. 99844-3t Witnesses at council or committee meetings 240. (1) A counciL a standing committee or a select committee has power, under the signature of the mayor, to summon witnesses for examinrton on oath for mas about the administration of the municipality, and has=thesame asis ye ted in a court of law in civilcases A member of council or of a standing or select conmunce or the municipal officer assigned responsibility under section 198 [corporate administration] may administer the oath to a witness. A witness may be e,aiTIind, cross .rlivniTled and re-examined according to the rules and practice of the Supreme Cowl in civil cases. iagea& •1 Petitions to council 241. (1) A petition to a council must include the full name and residential address of each petitioner. (2) Except as provided for local improvements, the sufficiency and validity of a petition to a council is to be determined by the municipal officer assigned responsibility under section 198 [corporate adnzinistrazionJ, who must record this determination by certificate. Sept. 28/99 99 Quicksaibe Services Lid. 1996 MtnuAL ACT ES Caa.p. 323 A certificate under subsection (2) is final and conclusive. After a petition has been certified as sufficient and valid, or after the time set for Submission of the petition, a person may not withdraw their name from the petition or add a name to the petition. 1 1998-34-36. Counter petition process 242. (1) Unless otherwise provided, this section applies to counter petitions required or authorized under this Act in relation to proposed municipal bylaws, actions or other matters. The council must establish a deA!ine by which counter petitions in relation to a specific matter must be submitted to the council. Notice of the counter petition opporumity in relation to a matter must be published in at least 2 issues of a newspaper, with the second publication at least 30 days before the deadline established under subsection (2), and from the daze of first publication in a newspaper, must be posted on the notice board or usual place for publishing notices at the municipal hail. SpL (4) A notice under subsection (3) must include the following: a general description of the proposed matter; a statement that counter petitions against the proposed matter will be provided by the council, if requested; a statement that the council may proceed with the matter unless the counter petition is signed by at least 5% of the electors of the area to which the counter petition applies; the area to which the counter petition applies, if that area is not the whole of the municipality; the deadline for submitting signed counter petition forms to the council; an estimate of the number of electors who must petition against the matter in order for the counter petition to be sufficient; other information required under subsection (9). Sept. (5) For the ptwposes of permitting the electors to petition againct the proposed rnat1, the council must prepare counter petitions ready for distribution at the time it first publishes the notice under subsection (3), and distribute a counter petition to each person who requests one. 22199 (5.1) A person who receives a counter petition referred to in subsection (5) may make accurate copies of the counter petition for the pwposes of this section. (5.2) Each counter petition or accurate copy of a counter petition may be signed by one or more electors. (6) A counter petition is sufficient if. on the basis of the signed counter petition forms submitted to the council before the deadline established under subsection (2), the counter petition is signed by at least 5% of the electors of the area to which the counter petition applies. Sept. (7) Any question as to the sufficiency or accuracy of a counter petition or copy of a counter petition received itmier this section must be determined by the municipal officer assigned responsibility under section 198 jcorporaze adrthzisrrationJ. c. 22199 (7.1) If a counter petition is certified as sufficient, the council must not proceed with the proposed bylaw, action or other matter unless it receives the assent of the electors. (8) If a counter petition is not sufficient, the council may proceed with the proposed bylaw, action or other ntnr. 22199 (9) The Lieutenant Governor in Council may make regulations as follows: prescribing information that must be included in a notice under subsection (3); prescribing the form and content of counter petitions referred to in subsection (5), which may be different for different classes of matters to which counter petitions relate. 1998-34-36: 1999-37€2. Meetings that may or must be dosed 242.2 (1) A part of a council meeting may be closed to the public if the subject matter being considered relaxes to one or more of the following: personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality; personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the municipality on condition of anonymity; labour relations or employee negotiations; the security of property of the municipality; the acquisition., disposition or expropriation of land or improvemem if the council considers that disclosure might reasonably be expected to harm the interests of the municipality; (f) law enforcement, if the council considers that disclosure might reasonably be expected to harm the conduct of an investigation under or enforcement of an Act, regulation or bylaw; g) consider don of whether para (e) or (f) applies inrelatioa to a___ litigation or potential litigation affecting the municipality; the receiving of advice that is subject to solicitor-client privilege. including communications necessary for that purpose; information that is prohibited from disclosure under section 21 of the Freedom of' Information and Protection of Privacy Acr, a matter that, under another enactment, is such that the public may be excluded from the meeting (1) a matter prescribed by regulation under section 242.8. (2) A part of a council meeting must be closed to the public if the subject matter relaxes to one or more of the following: a request under the Freedom of Information and Protection of Privacy Act if the council is designated as head of the local public body for the purposes of that Act in relation to the a matter that, under another enacent, is such that 'the public must be excluded from the meeting. (3) If the only subject matter being considered at a council meeting is one or more matters referred to in subsection (1) or (2). the applicable subsection applies to the entire meeting. Regulations respecting open meetings 242.8 The Lieutenant Governor in Council may make regulations to do one or more of the foUowing prescribing a manr for the purposes of section 242.2 (1) (1) [meetings that may be closed]; prescribing a body or class of body for the purposes of section 242.7 (e) [application to other bodies]; in relation to section 242.7, excluding a specified body from the application of this Division or section 237 (minutes of council committeesJ, or both; modifying the effect of this Division or section 237 [minutes of council committees], or both, in relation to a body that is subject to this Division under section 242.7. Division 5— Additional Powers Persons may be honoured with freedom of the municipality 243. (1) To honour a distinguished person, by unanimous vote of its members, a council may confer freedom of the municipality on that person. (2) Until the council revokes the honour, a person given freedom of the nnmiipality is deemed to be an elector of the municipality and is eligible to be registered as such and to vote in an election for mayor or councillor, and despite any other enacment, if the person is a Canadian citizen, is deemed to be qualified to be nominaxed, be elected and hold the office of mayor of the municipality. (3) To honour a distinguished unit of the armed forces of Canada the United Kingdom or another nation of the Commonwealth, by unanimous vote of its members, a council may confer freedom of the municipality on that unit. (4) The commanding officer of a unit honoured with freedom of the municipality has by virtue of office the same qualifications and privileges of a person honoured with freedom of the municipality. 1998-34-36.
