Note: Councillor Dozie joined the meeting at 9:39 am and participated in the meeting electronically. 1. CALL TO ORDER -9:02 am 1.1. Territory Acknowledgement The Mayor provided the territory acknowledgement. 1.2 Approval of the Agenda R/2023-S(C)-031 Moved, seconded, and CARRIED THAT the agenda of the July 4, 2023, Special Council meeting be adopted. 2. GENERAL MATTERS 2.1 Resolution to Exclude the Public Document: 3314140 Special Council Meeting Minutes July 7, 2023 Page 2 of 5 R/2023-S(C)-032 Moved, seconded, and CARRIED THAT, pursuant to section 90 of the Community Charter, this meeting be closed to the public as the subject matters being considered relate to the following: • 90(1)(a) -personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality; • 90(1)(e) -the acquisition, disposition or expropriation of land or improvements , if the council considers that disclosure might reasonably be expected to harm the interests of the municipality; • 90(1)(i)-the receipt of advice that is subject to solicitor-client privilege, including communication necessary for that purpose; • 90(1)(k) -negotiations and related discussions respecting the proposed provision of a municipal service that are in their preliminary stages and that, in the view of the council, could reasonably be expected to harm the interests of the municipality if they were held in public. 3. RECONVENE FROM IN CAMERA Note: The meeting reconvened from in camera at 2:42 pm with all members of Council present and Councillor Dozie participating electronically. 6. UNFINISHED BUS/NESS 6.1 2020-237-RZ. 11070 Lockwood Street. 24984. 25024 and 25038 112 Avenue. RS-3 to RS-2. RS-1b and RM-1 Staff report dated June 20, 2023, recommending that Official Community Plan Amending Bylaw No. 7942-2023 be given first and second reading and forwarded to Public Hearing and that Zone Amending Bylaw No. 7844-2022, to rezone from RS-3 (One Family Rural Residential) to RS-2 (Single Detached Suburban Residential), RS-1b Document: 3363787 Special Council Meeting Minutes July 7, 2023 Page 3 of 5 (Singe Detached (Medium Density) Residential), and RM-1 (Low Density Townhouse Residential), to permit the construction of approximately 37 single-family lots and a 102-unit townhouse development, be given second reading as amended, and be forwarded to Public Hearing. R/2023-S(C)-033 Moved, seconded, and CARRIED 1. That, in accordance with Section 4 75 of the Local Government Act, opportunity for early and on-going consultation has been provided by way of posting Official Community Plan Amending Bylaw No. 7942-2023 on the municipal website and requiring that the applicant host a Development Information Meeting (DIM), and Council considers it unnecessary to provide any further consultation opportunities, except by way of holding a Public Hearing on the bylaw; 2. That Official Community Plan Amending Bylaw No. 7942-2023 be considered in conjunction with the Capital Expenditure Plan and Waste Management Plan; 3. That it be confirmed that Official Community Plan Amending Bylaw No. 7942-2023 is consistent with the Capital Expenditure Plan and Waste Management Plan; 4. That Official Community Plan Amending Bylaw No. 7942-2023 be given first and second reding and be forwarded to Public Hearing; 5. That Zone Amending Bylaw No. 7844-2022 be given second reading as amended, and forwarded to Public Hearing; and further 6. That the following terms and conditions be met prior to final reading: i) Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii) Amendment to Official Community Plan Schedule "A", Chapter 10.2 Albion Area Plan, Schedule 2: Albion Area Plan and Figure 1: Northeast Albion and Schedule "C"; iii) Road dedication on Lockwood Street and 110 Avenue as required; iv) Dedication of the conservation areas to the City and removal of all invasives, debris and garbage from park land, as required; v) Consolidation of the subject properties; vi) Registration of a Restrictive Covenant for the Geotechnical Report, which addresses the suitability of the subject properties for the proposed development; vii) Registration of a Restrictive Covenant for the protection of the Environmentally Sensitive areas (wetlands) on the subject properties; viii) Registration of a Statutory Right-of-Way plan and agreement for City i nfrastru ctu re; ix) Registration of a Restrictive Covenant for Tree Protection; x) Registration of a Restrictive Covenant for Stormwater Management; xi) Registration of a no-build Restrictive Covenant to protect future subdivision design for proposed lots 37 and 38; xii) Removal of existing buildings; xiii) In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject properties. If so, a Stage 1 Site Investigation Report is required to ensure that the subject property is not a contaminated site; xiv) That a voluntary contribution, in the amount of $851,200.00 ($7,100.00 x 38 lots, and $5,700 x 102 units), or such rate applicable at third reading of this Document: 3363787 Special Council Meeting Minutes July 7, 2023 Page 4 of 5 application, be provided in keeping with the Council Policy 6.31 with regard to Community Amenity Contributions; xv) Payment of the Density Bonus for Albion Area provision for the RM-1 (Low Density Townhouse Residential) zone, in the amount of $316,200 ($3,100 per unit x 102 units); and xvi) Payment of the Density Bonus for Albion Area provision for RS-1b (Single Detached (Medium Density) Residential), in the amount of $114,700 ($3,100 per lot x 37 lots). That Council refer item 10.3 to Administration to return to the July 18, 2023 Closed Council Meeting, with a report regarding the acquisition of park areas, walkways, trails, neighbourhood park amenities and features shown on the park concept plan. Mayor Ruimy requested a reconsideration of the previous Resolution No. R/2023-S(C)- 033 to delete the last clause in its entirety. R/2023-S(C)-034 Moved, seconded, and CARRIED That Council reconsider and vote again on Resolution No. R/2023-S(C)-033. R/2023-S(C)-035 Moved, seconded and CARRIED 1.
