Zone Amending Bylaw No. 7586-2019 To rezone from RS-3 (Single Detached Rural Residential) to RS-2 (Single Detached Suburban Residential). R/2023-CM-198 Moved, seconded, and CARRIED THAT Zone Amending Bylaw No. 7586-2019 be adopted. 10. COMMITTEE REPORTS AND RECOMMENDATIONS 10.1 2023-216-RZ, Maple Ridge Minor Development Variance Permit Delegation Bylaw No. 7952-2023 Staff report dated September 5, 2023, recommending that Maple Ridge Minor Development Variance Permit Delegation Bylaw No. 7952-2023, delegating the issuance of minor DVPs authority to the Director of Planning, be given first and second reading. Council discussed options and staff answered questions of Council. R/2023-CW-199 Moved and seconded THAT Maple Ridge Minor Development Variance Permit Delegation Bylaw No. 7952- 2023 be given first and second reading. Moved, seconded and DEFEATED THAT Maple Ridge Minor Development Variance Permit Delegation Bylaw No. 7952- 2023 be amended to include the RS-1 zone. with Mayor Ruimy and Councillors Carreras, Dozie and Dueck opposed Moved, seconded and DEFEATED THAT Item 10.1 be referred back to staff for further review and revisions to the draft Bylaw to provide for a more assertive approach and increase the Zoning Bylaw setbacks up to 25% for height and parking to be delegated to staff. Allowing Larger Detached Garden Suites on Residential Lots Staff report dated September 5, 2023, recommending that the Zone Amending Bylaw No. 7866-2022, to permit the total gross floor area of the Detached Garden Suites to be a maximum of 140m2 or 15% of the lot area, whichever is less, be given first and second reading and be forwarded to Public Hearing. Non-Adhering Residential Use in the Agricultural Land Reserve That staff report dated September 5, 2023, recommending that Application 2023- 185-AL, to allow the construction of a new residence while maintaining two existing residences for the period of construction, respecting property located at 22761132 Avenue be forwarded to the Agricultural Land Commission for their review and consideration. R/2023-CW-201 Moved, seconded, and CARRIED THAT Application 2023-185-AL, respecting property located at 22761132 Avenue be forwarded to the Agricultural Land Commission for their review and consideration. 10.4 2023-183-RZ. 12129 Edge Street. RS-1 to RM-2 Staff report dated September 5, 2023, recommending that Zone Amending Bylaw No. 7957-2023, to rezone from RS-1 (Single Detached Residential) to RM-2 (Medium Density Apartment Residential) to permit the future construction of a six-storey rental apartment building, be given first reading and that the applicant submit a complete application, including further information as set out in the report. Councillor Yousef left the meeting at 7:42 pm. Councillor Carreras left the meeting at 7:43 pm. R/2023-CW-202 Moved, seconded, and CARRIED 1. In respect of Section 4 75 of the Local Government Act, requirement for consultation during the development or amendment of an Official Community Plan, Council must consider whether consultation is required with specifically: Document:3493693 Regular Council Meeting Minutes September 5, 2023 Page 5 of 8 i. The Board of the Regional District in which the area covered by the plan is located, in the case of a Municipal Official Community Plan; ii. The Board of any Regional District that is adjacent to the area covered by the plan; iii. The Council of any municipality that is adjacent to the area covered by the plan; iv. First Nations; v. Boards of Education, Greater Boards and Improvements District Boards; and vi. The Provincial and Federal Governments and their agencies. and in that regard it is recommended that no additional consultation be required in respect of this matter beyond the early posting of the proposed Official Community Plan amendments on the City's website, together with an invitation to the public to comment; 2. That Zone Amending Bylaw No. 7957-2023 be given first reading; and further 3. That the applicant submit a complete application, including detailed information and technical reports, for the rezoning, Official Community Plan amendment, and development permit applications. with Councillor Schiller opposed with Councillors Carreras and Yousef absent 10.5. 2023-208-RZ. 12035 Glenhurst Street. RS-1 to R-4 Staff report dated September 5, 2023, recommending that Zone Amending Bylaw No. 7958-2023, to rezone from RS-1 (Single Detached Residential) to R-4 (Single Detached (Infill) Urban Residential), to permit a future subdivision of two lots, be given first reading and that the applicant submit a complete application and provide further information as set out in the report. Councillor Yousef returned to the meeting at 7:44 pm. R/2023-CW-203 Moved, seconded, and CARRIED THAT Zone Amending Bylaw No. 7958-2023 be given first reading; and further THAT the application submit a complete application, including detailed information and technical reports, for the rezoning and subdivision applications. with Councillor Carreras absent 10.6 2023-255-RZ. 13285 Balsam Street. RS-3 to CD-4-23 Staff report dated September 5, 2023, recommending that Zone Amending Bylaw No. 7962-2023, to rezone from RS-3 (Single Detached Rural Residential) to a proposed CD-4-23 (Medium/High Density Townhouse Residential with Live/Work Units), to permit the construction of a townhouse development with 42 market strata dwelling units, be given first reading and that the applicant submit a complete application, including further information as set out in the report. RS-3 to RM-1 and R-2 Staff report dated September 5, 2023, recommending that Zone Amending Bylaw No. 7852-2022, to rezone from RS-3 (Single Detached Rural Residential) to RM-1 (Low Density Townhouse Residential) and R-2 (Single Detached (Medium Density) Urban Residential), to permit a future subdivision of one RM-1 lot and three R-2 lots and the future construction of a townhouse development with 52 market strata dwelling units, be given second reading and be forwarded to Public Hearing. R/2023-CW-205 Moved, seconded, and CARRIED 1. That Zone Amending Bylaw No. 7852-2022 be given second reading, and be forwarded to Public Hearing; 2. That the following terms and conditions be met prior to final reading: i. Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii. Road dedication for the lane as required; iii. Consolidation of the subject properties; iv. Registration of a Restrictive Covenant for the Geotechnical Report, which addresses the suitability of the subject properties for the proposed development; v. Registration of a Restrictive Covenant for the protection of Visitor Parking; vi. Registration of a Restrictive Covenant for Stormwater Management; vii. Removal of existing buildings; viii. In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject properties. If so, a Stage 1 Site Investigation Report is required to ensure that the subject property is not a contaminated site. ix. That a voluntary contribution, in the amount of $412,400.00 ($7,400.00 per townhouse dwelling unit and $9,200.00 per single family lot), or such rate applicable at third reading of this application, be provided in keeping with the Council Policy 6.31 with regard to Community Amenity Contributions. x. RS-1a to R-4 Staff report dated September 5, 2023, recommending that Zone Amending Bylaw No. 7881-2022, to rezone from RS-1a (Single Detached (Amenity) Residential) to R-4 (Single Detached (Infill) Urban Residential), to permit a future subdivision of three lots, from the existing two lots, be given second reading and be forwarded to the Public Hearing. Councillor Carreras returned to the meeting at 7:48 pm. R/2023-CW-206 Moved, seconded, and CARRIED 1. That Zone Amending Bylaw No. 7881-2022 be given second reading, and be forwarded to Public Hearing; and further; 2. That the following terms and conditions be met prior to final reading: i. R/2023-CW-207 Moved, seconded, and CARRIED THAT the Corporate Officer be authorized to sign and seal 2023-174-VP respecting property located at 20451 Hampton Street. 10.10 2023-220-VP. 20438 Hampton Street. Development Variance Permit Staff report dated September 5, 2023, recommending that the Corporate Officer be authorized to sign and seal 2023-220-VP, to increase the maximum building height for the principal building, respecting property located at 20438 Hampton Street.
