Allowing Larger Detached Garden Suites on Residential Lots The subject application is to permit the total gross floor area of Detached Garden Suites to be a maximum of 140 m2 or 15% of the lot area, whichever is less. Maple Ridge Zone Amending Bylaw No. 7852-2022 R/2023-CM-248 Moved, seconded, and CARRIED THAT Maple Ridge Zone Amending Bylaw No. 7852-2022 be given third reading. 9.3 2022-293-RZ, 21511 and 21521 Exeter Avenue. RS-1a to R-4 To permit the rezoning to allow a future subdivision of three lots. Maple Ridge Zone Amending Bylaw No. 7881-2022 R/2023-CM-249 Moved, seconded, and CARRIED THAT Maple Ridge Zone Amending Bylaw No. 7881-2022 be given third reading. with Councillor Yousef opposed 9.4 2021-471-RZ, 22582. 22588. 22596, 22606 and 22610 121 Avenue, RS-1 to RM-3 To permit the rezoning to allow the future construction of a 5-storey apartment building with 87 market strata dwelling units. Maple Ridge Zone Amending Bylaw No. 7810-2021 R/2023-CM-250 Moved, seconded, and CARRIED THAT Maple Ridge Zone Amending Bylaw No. 7810-2021 be given third reading. 9.5 2023-016-RZ, 20000 Stewart Crescent, M-3 to CD-2-23 To facilitate the re-development of the subject site for the expansion of the E-One Moli Energy facility. Maple Ridge Zone Amending Bylaw No. 7908-2023 Document:3569148 Regular Council Meeting Minutes October 24, 2023 Page 4 of 8 R/2023-CM-251 Moved, seconded, and CARRIED THAT Maple Ridge Zone Amending Bylaw No. 7908-2023 be given third reading. 9.6 2024-2027 Permissive Tax Exemptions Exempt certain types of properties from municipal property taxation for up to ten years. Maple Ridge Tax Exemption Bylaw No. 7961-2023 R/2023-CM-252 Moved, seconded, and CARRIED THAT Maple Ridge Tax Exemption Bylaw No. 7961-2023 be given adoption. 9. 7 2018-489-RZ. 20278 and 20292 Patterson Avenue, RS-1 to RM-2 To permit the future construction of an 88 unit, four-storey apartment building. Maple Ridge Zone Amending Bylaw No. 7523-2018 R/2023-CM-253 Moved, seconded, and CARRIED THAT Zone Amending Bylaw No. 7523-2018 be adopted. 10. COMMITTEE REPORTS AND RECOMMENDATIONS 10.1 2023-346-RZ, City of Maple Ridge Off Street Parking and Loading Bylaw No. 7970-2023 To require owners and occupiers of any land, building or structure to provide off street parking, bicycle, and loading spaces. Council discussed options and staff answered questions of Council. R/2023-CM-254 Moved, seconded, and CARRIED That City of Maple Ridge Off Street Parking and Loading Bylaw No. 7970-2023 be given first reading; and That Staff bring forward the necessary bylaw and policy amendments to align with the City of Maple Ridge Off Street Parking and Loading Bylaw No. 7970-2023. 10.2 2020-129-RZ, 13287 232 Street. RS-3 to RS-1 To permit a future subdivision of two lots. R/2023-CM-255 Moved, seconded, and CARRIED 1. That, in accordance with Section 4 75 of the Local Government Act, opportunity for early and on-going consultation has been provided by way of posting Official Document:3569148 Regular Council Meeting Minutes October 24, 2023 Page 5 of 8 Community Plan Amending Bylaw No. 7653-2020 on the municipal website, and Council considers it unnecessary to provide any further consultation opportunities, except by way of holding a Public Hearing on the bylaw; 2. That Official Community Plan Amending Bylaw No. 7653-2020 be considered in conjunction with the Capital Expenditure Plan and Waste Management Plan; 3. That it be confirmed that Official Community Plan Amending Bylaw No. 7653-2020 is consistent with the Capital Expenditure Plan and Waste Management Plan; 4. That Official Community Plan Amending Bylaw No. 7653-2020 be given first and second reading and be forwarded to Public Hearing; 5. That Zone Amending Bylaw No. 7654-2020 be given second reading, and be forwarded to Public Hearing; i) Registration of a Restrictive Covenant for the Geotechnical Report and floodplain report, which addresses the suitability of the subject property for the proposed development; ii) Removal of existing buildings on proposed Lot 1; iii) Registration with Fraser Health for septic disposal and water quality; and registration of a Restrictive Covenant for the protection of the septic field areas; iv) If the Director of Waste Management from the Ministry of Environment determines that a site investigation is required based on the submitted Site Disclosure Statement, a rezoning, development, or development variance permit cannot be approved until a release is obtained for the subject property; v) In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject property. If so, a Stage 1 Site Investigation Report is required to ensure that the subject property is not a contaminated site. vi) That a voluntary contribution, in the amount of $9,200, or such rate applicable at third reading of this application, be provided in keeping with the Council Policy 6.31 with regard to Community Amenity Contributions. 10.3 2021-402-RZ. 20535 123 Avenue. RS-1 to R-1 To permit a future subdivision of two lots. R/2023-CM-256 Moved, seconded, and CARRIED 1. That Zone Amending Bylaw No. 780-2021 be given second reading, and be forwarded to Public Hearing; 2. That the following terms and conditions be met prior to final reading: i) Registration of a rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii) Road dedication of 123 Avenue as required; iii) Removal of existing building; iv) In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject Document:3569148 Regular Council Meeting Minutes October 24, 2023 Page 6 of 8 property. If so, a Stage 1 Site Investigation Report is required to ensure that the subject property is not a contaminated site. v) That a voluntary contribution, in the amount of $9,200, or such rate applicable at third reading of this application, be provided in keeping with the Council Policy 6.31 with regard to Community Amenity Contributions. 10.4 2021-579-RZ, 23682 Dewdney Trunk Road, M-1 to RM-1 To permit a future subdivision of approximately two single-family lots fronting Dewdney Trunk Road and construction of approximately 16 townhouse units on a third lot to the south R/2023-CM-257 Moved, seconded, and CARRIED 1. That Zone Amending Bylaw No. 7826-2022 be given second reading, and be forwarded to Public Hearing; and further 2. That the following terms and conditions be met prior to final reading: i) Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii) Road dedication on 119 Avenue and for the new lane as required; iii) Registration of a Restrictive Covenant for the Geotechnical Report, which addresses the suitability of the subject property for the proposed development; iv) Registration of a Restrictive Covenant for the protection of Visitor Parking; v) Registration of a Restrictive Covenant for the Stormwater Management; vi) If the Director of Waste Management from the Ministry of Environment determines that a site investigation is required based on the submitted Site Disclosure Statement, a rezoning, development, or development variance permit cannot be approved until a release is obtained for the subject property; vii) In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject property. R/2023-CM-258 Moved, seconded, and CARRIED 1. That, in accordance with Section 475 of the Local Government Act, opportunityfor early and on-going consultation has been provided by way of posting Official Community Plan Amending Bylaw No. 7873-2022 on the municipal website and requiring that the applicant host a Development Information Meeting (DIM), and Council considers it unnecessary to provide any further consultation opportunities, except by way of holding a Public Hearing on the bylaw; Document:3569148 Regular Council Meeting Minutes October 24, 2023 Page 7 of 8 2. That Official Community Plan Amending Bylaw No. 7873-2022 be considered in conjunction with the Capital Expenditure Plan and Waste Management Plan; 3. That Official Community Plan Amending Bylaw No. 7873-2022 be given first and second reading and be forwarded to Public Hearing; 5. That Zone Amending Bylaw No. 787 4-2022 be given second reading, and be forwarded to Public Hearing; 6. That the following terms and conditions be met prior to final reading: i} Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii} Approval from the Ministry of Transportation and Infrastructure; iii} Amendment to Official Community Plan Schedule "A", Chapter 10.4 Town Centre Area Plan, Schedule 1-Town Centre Area Land-Use Designation Map; iv} Road dedication on Royal Crescent as required; v} Consolidation of the subject properties; vi} Registration of a Restrictive Covenant for the Geotechnical Report, which addresses the suitability of the subject site for the proposed development; vii} Registration of a Restrictive Covenant for protecting the Visitor Parking; viii}Registration of a Restrictive Covenant for Stormwater Management; ix} Registration of a Housing Agreement in accordance with Section 483 of the Local Government Act and a Restrictive Covenant stating that the proposed 98- unit apartment building will be restricted to residential rental units; x} In addition to the Ministry of Environment Site Disclosure Statement, a disclosure statement must be submitted by a Professional Engineer advising whether there is any evidence of underground fuel storage tanks on the subject properties. That the Corporate Officer be authorized to sign and seal 2018-489-DP respecting property located at 20278 and 20292 Patterson Avenue. 10.7 Consolidated Fees & Charges Amending Bylaw -Recreation Services Fees Annual review and adjustment of recreation service fees. R/2023-CM-260 Moved, seconded, and CARRIED THAT the Maple Ridge Consolidated Fees & Charges Amending Bylaw No. 2023-7966 be given first, second, and third readings. R/2023-CM-261 Moved, seconded, and CARRIED 1. That lntermunicipal Business Licence Scheme Bylaw No. 6957-2012 be repealed in its entirety; 2. That lntermunicipal Business Licence Agreement Bylaw No. 7971-2023 be given first, second and third reading; and 3.
