Date: Council Workshop January 5. 2004 Page 3 of 3 Rules for Holding a Closed Meeting A part of a council meeting may be closed to the public if the subject matter being considered relates to one or more of the following: personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality; personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the municipality on condition of anonymity; labour relations or employee negotiations; the security of property of the municipality; the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure might reasonably be expected to harm the interests of the municipality; law enforcement, if the council considers that disclosure might reasonably be expected to harm the conduct of an investigation under or enforcement of an Act, regulation or bylaw; consideration of whether paragraph (e) or (f) applies in relation to a matter; litigation or potential litigation affecting the municipality; the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose; information that is prohibited from disclosure under section 21 of the Freedom of Information and Protection of Privacy Act; a matter that, under another enactment, is such that the public may be excluded from the meeting; (1) a matter prescribed by regulation under section 242.8. (m) information relating to local government participation in provincial negotiations with First Nations, where an agreement provides that the information is to be kept confidential. Resolution to Oppose Bill 85: BC Hydro Public Power Legacy and Heritage Contract Act December 2003 WHEREAS the Government of British Columbia passed the BC Hydra Public Power Legacy and Heritage Contract Act ("Bill 85") in the Legislature on November 19, 2003; AND WHEREAS the BC government has not consulted with British Columbians about the implications of Bill 85; AND WHEREAS Section 2(2) (a), (b), and (c) of Bill 85 allow the BC government to dispose of generation, storage, transmission, and distribution assets of BC Hydro for vague and arbitrary reasons such as: the assets are no longer "used" or seen as "useful" [in the public sector] the assets are no longer "fit for their intended purpose" [in the public sector] the assets are to be "replaced" [by the private sector]; AND WHEREAS Section 3 of Bill 85 allows the Lieutenant Governor in Council, also known as Cabinet, to override decisions about electricity rates made by the BC Utilities Commission—an arm's length regulatory body for BC Hydro; THEREFORE BE IT RESOLVED THAT (Municipal Council / District) calls upon the BC government to: Immediately repeal Bill 85; Hold broad and meaningful consultations with British Columbians about the future of BC Hydro and our province's electricity system; Reverse all legislative, regulatory, and contractual measures to date which give (or potentially give) control of BC Hydro and its assets to the private sector.
