Bill Dingwall provided an update on R.C.M.P. activities and distributed a written report to Council. 1.2 Amabile Ranta, #208-12188-224 Street, Transit System Ms. Ranta distributed a petition for increased, direct service between Maple Ridge and Coquitlam in order to decrease travel time and reduce the number of vehicles on the road. She indicated that she has accumulated over 300 signatures and requested Council's support of this action. 2. PUBLIC WORKS AND DEVELOPMENT SERVICES Note: The following items have been numbered to correspond with the Council Agenda: Committee of the Whole Minutes February 5, 2001 Page 2 of 11 902 'RZ/29/97 -23005 Dewdney Trunk Road, Application Closed 902.1 Maple Ridge Zone Amending By-law No. 5664-1998 Staff report dated January 9, 2001 recommending that the three readings granted the subject by-law be rescinded as a new application has been submitted. RECOMMENDATION That second and third reading granted Maple Ridge Zone Amending By-law No. 5664-1998 on July 28, 1998 be rescinded and that first reading granted on June 23, 1998 be rescinded. 902.2 Maple Ridge Zone Amending By-law No. 5705-1998 Staff report dated January 9, 2001 recommending that the three readings granted the subject by-law be rescinded as a new application has been submitted. RECOMMENDATION That second and third reading granted Maple Ridge Zone Amending By-law No. 5705-1998 on July 28, 1998 be rescinded and that first reading granted on June 23, 1998 be rescinded. 903 DP/54/00-Save-On-Foods, Valley Fair Mall Staff report dated December 3, 2000 recommending that the Municipal Clerk be authorized to sign and seal DP/54/00 to effect changes to the exterior design and treatment of the food store. The architect of the development was in attendance to answer questions on this application. He responded to questions on why some of the changes were made before Council's approval by saying that the developer felt the changes were not significant. He indicated that the concerns raised with respect to vehicle and pedestrian access would be addressed. He confirmed that the developer would be proceeding with all aspects of the landscaping plans. ) . ) J Committee of the Whole Minutes February 5, 2001 Page 3 of 11 RECOMMENDATION That the Municipal Clerk be authorized to sign and seal DP/54/00 respecting property located at 22709 Lougheed Highway. Councillor Gordon OPPOSED. ACTION REQUIRED 904 Staff is to provide Council with a copy of the original Development Permit prior to the February 13, 2001 Council Meeting. Councillor King left the meeting at 1 :50 p.m. and Mayor Hogarth assumed the Chair for the balance of the meeting. ALR/52/00-24079 and 24111 Dewdney Trunk Road, Meadowridge School Staff report dated January 4, 2001 recommending that the subject application to subdivide lands for use as a parking lot and playing field/running oval be authorized to proceed to the Land Reserve Commission. RECOMMENDATION That application ALR/52/00 (for the property located at 24079 and 24111 Dewdney Trunk Road) for subdivision and use within the ALR as described in the staff report dated January 4, 2001 be authorized to proceed to the Land Reserve Commission. 905 ALR/54/99 -12680-248th Street, Application to Subdivide Staff report recommending that the subject application for subdivision within the ALR not be authorized to proceed to the Land Reserve Commission. The applicant, S. Susin, spoke of his reasons for wishing to subdivide the property and provided information on the surrounding properties. The Director of Planning explained that the staff recommendation was based on the fact that the application did not meet the criteria of the three tests contained in the Planning Policies of the District of Maple Ridge governing the Agricultural Land Reserve. Committee of the Whole Minutes February 5, 2001 Page 4 of 11 RECOMMENDATION That application ALR/54/99 (for the property located at 12680-248th Street) for subdivision within the ALR as described in the staff report dated January 25, 2001 not be authorized to proceed to the Land Reserve Commission. Councillor Isaac, Councillor Harris and Councillor Morse OPPOSED. The recommendation was defeated. 906 RZ/47/00-21729 & 21731124th Avenue Staff report dated January 22, 2001 recommending that the subject application to rezone from RS-1 to RS-1 b to facilitate a three-lot subdivision be forwarded to Public Hearing. RECOMMENDATION That application RZ/47/00 (for properties located at 21729 and 21731 -124th Avenue) to rezone properties described in the staff report dated January 22, 2001 from RS-1 to RS-lb be forwarded to Public Hearing noting that the conditions to be met prior to Public Hearing and prior to final consideration of the Zone Amending By-law are detailed in that report. 907 RZ/2/95 -22323 Callaghan A venue, Maple Ridge Zone Amending By-law No. 5255-1995 • Staff report dated January 19, 2001 recommending that second and third reading of the subject by-law be rescinded as no application for extension has been received. RECOMMENDATION That second and third reading granted Maple Ridge Zone Amending By-law No. 5255-1995 granted April 25, 1995 be rescinded; and further That first reading granted Maple Ridge Zone Amending By-law No. 5255- 1995 granted March 28, 1995 be rescinded. ) Committee of the Whole Minutes February 5, 2001 Page 5 of 11 908 RZ/03/01 -Text Amendments to Maple Ridge Zone Amending By-law No. 5946-2001 Staff report dated January 22, 2001 recommending that the subject by-law be given first reading and the requirement for a Public Hearing be waived. RECOMMENDATION That Maple Ridge Zone Amending By-law No. 5946-2001 be read a first time and that the requirement for this By-law to proceed to Public Hearing be waived under Section 890(4) of the Local Government Act. 909 RZ/58/00-North East Corner 236 Street/133 Avenue, Rock Ridge Estates Staff report dated January 22, 2001 recommending that the subject application to rezone from RS-3 to CD-1-93 for 20 units and RM-1 for 56 units be forwarded to Public Hearing. The Planner confirmed that this application is consistent with the recommendations of the Silver Valley Study and noted that the application contains only minor modifications to the original application. RECOMMENDATION That application RZ/58/00 (for property located on the North East Corner of 236 Street and 133 Avenue) to rezone property described in the staff report dated January 22, 2001 from RS-3 (One Family Rural Residential) to CD-1- 93 (Amenity Residential District) and RM-1 (Townhouse Residential) be forwarded to Public Hearing noting that the conditions to be met prior to Public Hearing and prior to final consideration of the Zone Amending By- law are detailed in that staff report and that the accompanying Official Community Plan Amending By-law be forwarded to the same Public Hearing. 910 RZ/13/99, 10515, 10595 -240 Street and 23950 Zeron Avenue, One-Year Extension Staff report dated January 22, 2001 recommending that the subject application for 21 single-family lots be granted a one-year extension and further conditions included. Committee of the Whole Minutes February 5, 2001 Page 6 of 11 RECOMMENDATION That a one year extension be granted for rezoning application RZ/13/99; and That the following conditions be added to those already required in the staff report dated October 19, 1999 for RZ/13/99: 1. A Preliminary Lot Grading Plan be provided by a professional engineer consistent with the recommendations contained in the Terra Engineering geotechnical report dated November 4, 1999; 2. Preliminary Building Concepts be consistent with the lot grading proposal and the recommendations of Terra Engineering; 3. An updated geotechnical assessment based on the preliminary plan of development be provided; and 4. A Restrictive Covenant must be registered at the Land Title Office based on the geotechnical engineer's design criteria and grading requirements for both buildings and services. 911 Fish Protection Act: Streamside Protection Regulation Staff report dated January 23, 2001 submitted for information on the contents and possible implications of the newly adopted Streamside Protection Regulation. RECOMMENDATION That the staff report entitled "Fish Protection Act: Streamside Protection Regulation" dated January 23, 2001 be received for information. ACTION REQUIRED A staff presentation is to be made at the Council Meeting of February 13, 2001 on this report. 912 Single Family Residential Use Restrictive Covenant Staff report dated January 24, 2001 recommending that the practice of placing a restrictive covenant on the title to new lots be discontinued, a blanket discharge of existing covenants takes place and advertising be placed announcing the changes. Council requested that the recommendation be split into two separate recommendations. ) Committee of the Whole Minutes February 5, 2001 Page 7 of 11 RECOMMENDATION That the Approving Officer discontinue the practice of placing the single family residential use restrictive covenant on the title to new lots created. RECOMMENDATION That staff be directed to advertise that the District of Maple Ridge will no longer be enforcing secondary suite restrictions in Section 219 covenants and in the same notice, invite any owners wishing to clear their title of such a covenant to prepare and present the Municipal Clerk, for execution, a discharge document for their property. Councillor Morse OPPOSED. ACTION REQUIRED 3. 931 Staff is to look into whether it is possible to change wording of "the District will no longer be enforcing" when advertising a change to the By-law. Staff is to provide a report on other options, i.e. controlling the number of suites permitted in a new development, restricting the number of covenants removed in a development FINANCIAL AND CORPORATE SERVICES (including Fire and Police) International Exchange -RCMP School Liaison Officer Staff report dated January 11, 2001 recommending that a 6-week exchange program with an International School Liaison Officer from Bristol, England be supported. RECOMMENDATION That the District of Maple Ridge support the initiative of an International Exchange of a School Liaison Officer from the Ridge Meadows Detachment of the Royal Canadian Mounted Police with an International School Liaison Officer from Bristol, England for a term of six weeks in each respective Country. Committee of the Whole Minutes February 5, 2001 Page 8 of 11 932 Notice of Taxi Rate/Fare Increase Staff report dated January 23, 2001 requesting comments from Council with respect to the application by local taxi companies for a Supplemental Tariff Increase. RECOMMENDATION That the staff report entitled "Notice of Taxi Rate/fare increase" dated January 23, 2001 be received for information; and That Council's comments be forwarded to the three taxi companies operating in Maple Ridge. ACTION REQUIRED Council is to be provided with information on the date and amount of the last increase by taxi companies. Council is to be provided with a copy of a letter received last year regarding a change to the Local Government Act with respect to regulation of ownership of taxi companies. 933 Thomas Haney Days Proclamation March 15, 16, 17 & 18, 2001 Staff report dated January 29, 2001 recommending that an exception be made to the Proclamation Policy and that March 15, 16, 17 & 18, 2001 be proclaimed "Thomas Haney Days". RECOMMENDATION That an exception, based on community historical reasons, be made to the current Proclamation Policy dated June 13, 1995 and that March 15, 16, 17 and 18, 2001 be proclaimed "Thomas Haney Days" in the District of Maple Ridge. 934 Criteria for Mid-Year Funding Requests from Community Organizations Staff report dated January 24, 2001 recommending that the policies on grants in aid and partnership agreements be reaffirmed. ) Committee of the Whole Minutes February 5, 2001 Page 9 of 11 RECOMMENDATION That the current Grants in Aid Policy and Partnership Agreements-Leases and Fee for Service Proposals Policy be reaffirmed. ACTION REQUIRED 4. 951 Information is to be provided at the February 13, 2001 Council Meeting on what the funds requested by the Thomas Haney Days Committee will be used for. Councillor Speirs left the meeting at this point. COMMUNITY DEVELOPMENT AND RECREATION SERVICES Ridge Meadows Senior Society Request for Support of an "A" Liquor License Application Staff report dated January 15, 2001 recommending that the application of the Society be supported. RECOMMENDATION That Council support the application of the Ridge Meadows Seniors Society to the Liquor Licensing Branch for an "A" Liquor License for the Ridge Meadows Senior Society Activity Centre. Councillor Speirs returned to the meeting. 5. CORRESPONDENCE 981 District of Salmon Arm, RCMP Contract Policing Costs Letter from Colin N. Mayes, Mayor, requesting the endorsement of a resolution respecting the RCMP budget process and forwarding of the resolution to UBCM and the Federation of Canadian Municipalities. Committee of the Whole Minutes February 5, 2001 Page 10 of 11 RECOMMENDATION That the letter dated January 10, 2001 from Colin N. Mayes, Mayor, District of Salmon Arm be received for information and that Council endorse the resolution of the District of Salmon Arm and forward it to UBCM and the Federation of Canadian Municipalities. ACTION REQUIRED Staff is to prepare a resolution for the February 13, 2001 Council Meeting endorsing the resolution. The letter is to be forwarded to the Policing Study and Liaison Committee for discussion on an ongoing basis. 982 District of Hudson's Hope, Deregulation of Electricity Letter from L.M. Harwood, Mayor, requesting that letters be sent to provincial candidates requesting a commitment against privatization or deregulation of B.C. Hydro. RECOMMENDATION That the letter dated January 8, 2001 from L.M. Harwood, Mayor, District of Hudson's Hope, be received for information and that staff be directed to prepare a letter to be sent to the local candidates requesting their commitment against privatization or deregulation of B.C. Hydro. ACTION REQUIRED Staff is to prepare a resolution for the February 13, 2001 Council Meeting 983 Protocol for GVRD Capital Projects Letter from Johnny Carline, Chief Administrative Officer, GVRD, dated January 17, 2001 requesting confirmation of endorsement of the Protocol and other comments. "' ) Committee of the Whole Minutes February 5, 2001 Page 11 of 11 The Chief Administrative Officer commented that, although the overall set of Protocols is very good, it is his opinion that the payments of municipal charges on regional structures retroactively to 1995 would be onerous. RECOMMENDATION No recommendation was made on this item. ACTION REQUIRED Staff is to prepare a resolution for the February 13, 2001 Council meeting endorsing the Protocol with the exception of the retroactive payments on regional structures. 6.
