DELEGATIONS/STAFF PRESENTATIONS 1.1 TransLink, Fraser River Crossing Marvin Shaeffer provided an update on the Fraser River Crossing Study. He reviewed the schedule of the study noting that although the due date for completion is December 2001, it is their hope to present the report by July. 2. PUBLIC WORKS AND DEVELOPMENT SERVICES Note: The following items have been numbered to correspond with the Council Agenda: 902 RZ/58/00, North East Corner of 236 Street and 133 Avenue -By-law No. 5953-2001, 5954-2001 and 5955-2001, Rezoning to CD-1-93 and RM-1 Committee of the Whole Minutes March 19, 2001 Page 2 of 12 Staff report dated March 7, 2001 recommending that Maple Ridge Zone Amending By-law No. 5953-2001, Maple Ridge Zone Amending By-law No. 5954-2001 and Maple Ridge Official Community Plan Amending By-law No. 5955-2001 be given first reading. The proposed rezoning will permit construction of approximately 20 units and 56 townhouse units. The Acting Director of Planning responded to comments made at the Public Information Hearing by pointing out that the road standards are the existing standards and the grading is to facilitate road cuts. The development is using an existing storm water management system. Notification was sent to neighbouring property owners and signage was posted as required. The owner's representative, Gary Lycan, reviewed the application explaining that it is a two-part application. The townhouse development portion of the application will be delayed in proceeding, as it requires expansion of the water supply system. RECOMMENDATION That Maple Ridge Zone Amending By-law No. 5953-2001, Maple Ridge Zone Amending By-law No. 5954-2001 and Maple Ridge Official Community Plan Amending By-law No. 5955-2001 be read a first time. 903 RZ/13/01, 12423-203 Street, Rezoning from RS-1 to RS-lb Staff report recommending that the subject application to permit future subdivision into 2 lots and the accompanying Official Community Plan Amending By-law be forwarded to Public Hearing. The owner of the property, Simon Rodgers, explained that the purpose of the rezoning is to create 2 lots. He noted that although the square footage does not meet the requirements, the length and width of the lots are in excess of the requirements. RECOMMENDATION That application RZ/13/01 (for property located at 12423-203 Street) to rezone property described in the staff report dated March 6, 2001 from RS-1 (One Family Urban Residential) to RS-lb (One Family Urban (medium density Residential) be forwarded to Public Hearing noting that the conditions to be met prior to Public Hearing and prior to final consideration ) Committee of the Whole Minutes March 19, 2001 Page 3 of 12 of the Zone Amending By-law are detailed in that report and that the accompanying Official Community Plan Amending By-law be forwarded to the same Public Hearing. ACTION REQUIRED Staff is to review procedures with a view to including advertising in the local newspaper as part of the public notification procedure. 904 ALR/01/00, 12639, 12685, 12759-232nd St., 12640-228th St., 22870-12ih Place Staff report dated February 19, 2001 recommending that the subject application for exclusion from the ALR not be authorized to proceed to the Land Reserve Commission. The representative of the owners, Mr. Duguid, asked that the following items be corrected in the staff report: • Page 2 refers to the properties being east of232nd and they are west of 232nd. • Reference is made to 2 creeks being on the property and there is just one creek named Balbanian and Coho Creek. He referred to previous reports that indicated properties with similar soil conditions could be supported for exclusion. Mr. Lance Rafferty, one of the owners, explained his reasons for requesting exclusion and responded to the comments of a petition submitted by neighbouring residents. He indicated that there is no blue heron nest on the property and that the enhancements to the creek would not be lost in the development. RECOMMENDATION That application ALR/01/00 (for property located at 12639, 12685, 12759- 232nd, 12640-228th Street and 22870-12ih Place) for exclusion from the Agricultural Land Reserve as described in the staff report dated February 19, 2001, not be authorized to proceed to the Land Reserve Commission. RECOMMENDATION That application ALR/56/00 (for property located at 22785-129th Avenue) for subdivision within the Agricultural Land Reserve as described in the staff report dated March 6, 2001 be authorized to proceed to the Land Reserve Commission. ACTION REQUIRED Committee of the Whole Minutes March 19, 2001 Page 5 of 12 The Engineering Department is to advise if the road allowances will still be required. A copy of the policy concerning flood plains is to be circulated to Council. 906 DP/16/01, 24085 -130 Avenue, Development Permit Area XXX for Watercourse Protection Staff report dated March 12, 2001 recommending that a development permit be issued to construct a deck on an existing single family residential dwelling located within 50 metres of Millionaire Creek. RECOMMENDATION That the Municipal Clerk be authorized to sign and seal DP/16/01 respecting property located at 24085-130 Avenue, subject to the conditions outlined in the staff memo dated March 12, 2001. 907 Soil Conservation Act -Exemption 24072 Dewdney Trunk ) Staff report dated March 8, 2001 recommending that the subject application for exemption be granted. The Acting Director of Planning explained that the Land Reserve Commission has supported this exemption and is seeking Council's support of the application. She noted that if there is any contravention of our by-laws, action could be taken by the District. She advised that there are no requirements for the owners of the surrounding properties to be notified of the application. RECOMMENDATION That the application for a fill permit under Permit Regulation Section 2(1)(d)(i) of the Soil Conservation Act submitted by Mr. Charlie Richards for the property at 24072 Dewdney Trunk Road be granted an exemption subject to the relevant provisions of the Maple Ridge Soil Deposit Regulation By-law No. 5763-1999 and the Soil Conservation Act. Mayor Hogarth OPPOSED. 908 Excess Capacity/Extended Services Agreement LC 66/99; SD 18/96, 236 Street and 133 Avenue Committee of the Whole Minutes March 19, 2001 Page 6 of 12 Staff report dated March 13, 2001 recommending that Latecomer Charges be imposed on the benefiting lands. The Director of Development Engineering clarified the location of the benefiting lands and indicated that if there was a change to the Official Community Plan the properties would be dealt with based on the terms of this agreement. RECOMMENDATION That with respect to the subdivision of lands involved in SD18/96 at 236 Street and 133 Avenue, be it resolved: 1. That the cost to provide the excess or extended services are, in whole or in part, excessive to the municipality and that the cost to provide these services shall be paid by the owners of the land being subdivided; and 2. That Latecomer Charges be imposed for such excess or extended services on the parcels and in the amounts as set out in the staff report dated March 13, 2001; and further 3. That the Mayor and Municipal Clerk be authorized to sign and seal a "Latecomer Agreement" with the subdivider of the said lands. 909 Tommy's Bar and Grill -Extension of Operating Hours Staff report dated March 12, 2001 recommending that the application of the Haney Hotel for an extension of operating hours not be supported. This item was withdrawn from the agenda. 910 Mountain Festival Society Use of Municipal Streets Staff report dated March 2, 2001 recommending the authorization of the use of Municipal Streets for the Annual Mountain Festival Parade. RECOMMENDATION That Mountain Festival Society (the organizer) be authorized to use Municipal Streets for the Annual Mountain Festival Parade provided the conditions outlined in Schedule "A" of the staff report dated March 2, 2001 are met. ) Committee of the Whole Minutes March 19, 2001 Page 7 of 12 911 Transfer of Kanaka Creek Road and adjacent Parkland to GVRD Staff report dated March 5, 2001 recommending the transfer of the closed portion ofKanaka Creek Road and the adjacent lands dedicated as park to the GVRD. RECOMMENDATION That the District of Maple Ridge transfer the closed portion of Kan aka Creek Road and lands dedicated as park adjacent to Kanaka Creek Road, as described in the staff report dated March 5, 2001, to the Greater Vancouver Regional District, subject to registration of appropriate agreements to permit access to municipal services. 912 Planning Department-Modified Work Program and Business Plan Staff report dated March 8, 2001 recommending the endorsement of the Modified Work Program. The Acting Director of Planning explained that the proposed changes would permit the completion of a number of projects that would provide a framework for the OCP review process. RECOMMENDATION That the Modified Work Program as contained in the Planning Department Business Plan 2001-2002 attached to the staff report entitled "Planning Department Modified Work Program and Business Plan" dated March 8, 2001 be endorsed. 913 Changes to Fee By-law Staff report dated March 7, 2001 recommending that By-law No. 5542-1997 be repealed and By-law No. 5949-2001 be adopted to establish application fees. The Planner described the proposed changes noting that the review stemmed from the Business Planning process. He noted that the proposal has not been reviewed by the Economic Advisory Commission or the Urban Development Institute. RECOMMENDATION That Maple Ridge Development Application Fee By-law No. 5949-2001 be read a first and second time and that the rules of order be waived and Maple Committee of the Whole Minutes March 19, 2001 Page 8 of 12 Ridge Development Application Fee By-law No. 5949-2001 be read a third time; and further That the By-law be referred to the Economic Advisory Commission and the Urban Development Institute ACTION REQUIRED Staff is to review the policy of charging for Special Event licenses. 914 Whispering Falls Water Incident Note: This item was dealt with following item 903. Reference was made to a staff report entitled "Whispering Falls Water Incident" dated March 12, 2001 that was circulated separately from the agenda. The General Manager Public Works and Development Services reviewed the events that followed the reporting on Monday, March 5 of an incident at the Whispering Falls/256th Street water system. The Director of Corporate Support provided details of the internal review noting that while there were no employee actions worthy of review, there were rules and policies that failed in this incident. As a result, there will be enhancements to the inspection documentation procedures, new protocols and processes for providing avenues for expressing concerns will be developed and levels of communication will be improved. The Waterworks Superintendant described the water-sampling program that is followed by the District. RECOMMENDATION That the staff report entitled "Whispering Falls Water Incident" dated March 12, 2001 be received for information; and That letter of thanks be written to those agencies for their assistance and offers of assistance during the incident response; and further That the enhancement of security be authorized at various water facilities at an approximate cost of $50,000 utilizing water reserve funding. ) Committee of the Whole Minutes March 19, 2001 Page 9 of 12 915 Liquid Waste Management Plan Staff report dated March 12, 2001 recommending the adoption of the GVRD Liquid Waste Management Plan. RECOMMENDATION 3. 931 That the waste management plan entitled "Greater Vancouver Regional District Liquid Waste Management Plan February 2001" attached to the staff report dated March 12, 2001 be adopted; and further That the Greater Vancouver Regional District be authorized to submit the Liquid Waste Management Plan to the British Columbia Minister of Environment, Lands and Parks for approval pursuant to Section 18(1) of the British Columbia Waste Management Act. FINANCIAL AND CORPORATE SERVICES (including Fire and Police) Gasoline and Diesel Fuel Supply, BC Petroleum Products Buying Group Staff report dated March 2, 2001 recommending that the District accept the Chevron Canada partnership proposal for a four-year period. The Manager of Procurement clarified that the agreement will result in a fixed discount of prices not a fixed price. RECOMMENDATION That the District of Maple Ridge, as a member of the BC Petroleum Products Buying Group, accept the Chevron Canada partnership proposal for a four (4) year period for the supply of gasoline and diesel fuels. 932 Purchasing Policy Staff report dated March 14, 2001 recommending the adoption of the Purchasing Policy. RECOMMENDATION That the Purchasing Policy attached to the staff report dated March 14, 2001 be adopted. COMMUNITY DEVELOPMENT AND RECREATION SERVICES -Nil 5. CORRESPONDENCE 981 BC Lumber Trade Council, Support of Free Trade in Lumber Letter dated February 28, 2001 from Robert Plecas, President, requesting a letter of support for the BC Lumber Industry be sent to the Prime Minister. RECOMMENDATION That the letter dated February 28, 2001 from Robert Plecas, President, BC Lumber Trade Council be received for information; and That a letter of support for the B.C. lumber industry be sent to The Right Honourable Jean Chretien, Prime Minister. 982 City of Toronto, Board of Health, Air Quality and Low Sulphur Fuel Purchasing Practice Letter dated February 26, 2001 from Yvonne Davies, Secretary, submitting the report of the Medical Officer of Health on the success of the City's low sulphur fuel purchasing practice as a means to reduce air emissions. RECOMMENDATION That the letter dated February 26, 2001 from Yvonne Davies, Secretary, City of Toronto, Board of Health, be received for information. 983 GVRD, Economic Development Opportunity Fax dated March 5, 2001 from Bob Paddon, Manager, Communications & Education, providing information on an economic development opportunity with the publication "Coastalogic: A Guide to Vancouver & Southwestern British Columbia's Business Advantages. ) Committee of the Whole Minutes March 19, 2001 Page 11 of 12 RECOMMENDATION That the facsimile dated March 5, 2001 from Bob Paddon, Manager, Communications & Education, Greater Vancouver Regional District be received for information; and further That the facsimile be forwarded for comment to the Director of Permits & By-laws, the Economic Advisory Commission, the Pitt Meadows & Maple Ridge Tourism Society and the Chamber of Commerce. 984 BC Ports Competitiveness Committee, BC Wharf Operators Association Letter dated March 5, 2001 from B.D. Eshleman, President, submitting information on the Ports Competitiveness Consultative Process. RECOMMENDATION That the letter dated March 5, 2001 from B.C. Eshleman, President, BC Ports Competitiveness Committee be received for information; and That the letter be referred to the Greater Vancouver Regional District with a request that a unified resolution regarding municipal taxes be prepared; and further That the unified resolution be forwarded to the Federation of Canadian Municipalities and the Union of British Columbia Municipalities. 985 District of Sparwood, Exclusion of Municipalities from Negligence Act Letter dated March 7, 2001 from Cal McDougall, Mayor, requesting support in lobbying the Province to amend Section 4(2)(a) of the Negligence Act to exclude municipalities. RECOMMENDATION That the letter dated March 7, 2001 from Cal McDougall, Mayor, District of Sparwood be received for information; and further Committee of the Whole Minutes March 19, 2001 Page 12 of 12 That the letter be referred to staff for comment on the actions that may be undertaken to support the resolution being presented to the Union of British Columbia Municipalities requesting an amendments to Section 4(2)(a) of the Negligence Act to exclude municipalities. ACTION REQUIRED Staff is to prepare a report containing suggestions of ways to support the resolution of the District of Sparwood. 986 The Council Advocacy, Anti-Noise Pollution Letter dated March 1, 2001 from George F. Evans, Chairman & Chief Executive Officer, submitting information for amendments to anti-noise by-laws. RECOMMENDATION That the letter dated March 1, 2001 from George F.
