DELEGATIONS/STAFF PRESENTATIONS 1.1 R.C.M.P. Update 1.2 Insp. Bill Dingwall reported on the activities of the RCMP for the second quarter of 2001. He reviewed recent staff changes, provided an update of recent crime statistics, and volunteer activities and noted items of particular interest. A copy of the report was circulated to Council. Real Estate Board of Greater Vancouver, Maple Ridge Division, Adrian Keenan, Vice President, Ron Mitchell, Willard Dunn Mr. Keenan provided an overview of the activities of the Real Estate Board of Greater Vancouver and encouraged Council to involve the real estate community on its Committees. He introduced Ron Mitchell as the government liaison for the Maple Ridge Division of the REBGV. Willard Dunn, who served on the Silver Valley study as the Realtors' representative, expressed his personal opinions of the format of the Study and the Civitas report. He cautioned Council that if fully Committee of the Whole Minutes June 4, 2001 Page 2 of7 implemented the study would have a dramatic effect on the price of housing in Maple Ridge. 2. PUBLIC WORKS AND DEVELOPMENT SERVICES Note: The following items have been numbered to correspond with the Council Agenda: 902 ALR/60/99, 12212, 12230-248th Street and 12225, 12245-250th Street Staff report dated April 17, 2001 recommending that the subject application not be authorized to proceed to the Land Reserve Commission. The Acting Director of Planning displayed a map of the properties on the overhead noting that the staff recommendation is based on Council's policy with respect to the exclusion of lands in the ALR. The applicant, David Thordarson, speaking on behalf of all the owners, informed Council that when he purchased his property he was not aware that it was in the ALR despite having done extensive research. No notation was made on the property title. The title was subsequently changed by the ALC. He asked that Council consider extending the boundary as there is urban development on three sides of the property, urban amenities exist in the area, the land is not conducive to agricultural use and the property is zoned RS-1. As limited information was available on the density transfer system, the owners preferred to apply for exclusion. RECOMMENDATION That application ALR/60/99 (for property located at 12212, 12230-248th Street and 12225, 12245-250th Street) for exclusion from the Agricultural Land Reserve as described in the staff report dated April 17, 2001, be deferred to the July 16, 2001 Committee of the Whole meeting. Councillor Harris, Councillor Speirs, Mayor Hogarth OPPOSED ACTION REQUIRED Staff is to prepare a report that includes information on the density transfer option for the applicant. Staff is to determine what agricultural uses are permissible under RS-1 zoning in the ALR. Committee of the Whole Minutes June 4, 2001 Page 3 of7 903 Discussion of Council policy with respect to applications for removal from the ALR is to be placed on a future Council agenda. Ridge Meadows Association for Community Living, Legendary Run Staff report dated May 11, 2001 recommending that Ridge Meadows Association for Community Living be authorized to use municipal streets for their Legendary Run on Sunday, July 15, 2001. RECOMMENDATION That Ridge Meadows Association for Community Living be authorized to use municipal streets for their Legendary Run on Sunday, July 15, 2001 provided the conditions outlined in · Schedule "A" attached to the staff report dated May 11, 2001 are met. 904 RZ/26/93, 116 Ave. West of 240 Street, File Closure ) Staff report dated May 24, 2001 recommending that all readings granted to Maple Ridge Zone Amending By-law No. 4961-1993 be rescinded and the file closed. J RECOMMENDATION That second and third reading granted September 27, 1993 and first reading granted on August 23, 1993 to Maple Ridge Zone Amending Bylaw No. 4961- 1993 be rescinded. 905 RZ/28/98, 10390 Slatford Place & 10389-240 St., Final One Year Extension Staff report dated May 24, 2001 recommending that this application for 14 residential lots and 7 townhouse units be granted a one-year extension. RECOMMENDATION That pursuant to Maple Ridge Development Procedures Bylaw No. 5879- 1999, a one year extension be granted for rezoning application RZ/28/98 to rezone property at 10390 Slatford Place and 10389-240 Street. Committee of the Whole Minutes June 4, 2001 Page 4 of7 906 DP/38/01, 11267-280th Street Staff report dated May 24, 2001 recommending that the subject application to reconstruct and expand a single-family dwelling located within 50 metres of Whonnock Creek be approved. RECOMMENDATION That the Municipal Clerk be authorized to sign and seal DP/38/01 respecting property located at 11267 280th Street. 907 Sewer Extension, 250 Street North of 122 Avenue Staff report dated May 25, 2001 recommending that the request for extension of the sewage collection system within the ALR be denied. Willard Dunn, representing the owner, advised Council that the Health Department require that the septic field be placed at the back of the property. This will require extensive clearing of the property as the owners wish to build their home at the front of the property. Mr. Dunn asked for an explanation of why properties in the ALR on 244th north of Dewdney were connected. The General Manager Public Works and Development Services explained that the ALC will only consider including ALR properties in the sewage collection system if there is an overriding health concern and this was the case with those properties. Mr. Dunn also asked if the owner has the right to apply for a LIP. The General Manager Public Works and Development Services responded that the financial mechanism is not under discussion for this application and while the applicant could put forward a request it would likely be denied. RECOMMENDATION That Policy 9.02 entitled "Sewer Area "A" -Extension Into The Agricultural Land Reserve" be affirmed; and further That staff be directed to inform the proponent that the request for extension of the sewage collection system on 250 Street north of 122 Avenue to serve lands within the Agricultural Land Reserve is denied. ) Committee of the Whole Minutes June 4, 2001 Page 5 of7 ACTION REQUIRED A review of the policy with respect to sewer extensions within the ALR and a discussion of the development of an agricultural plan are to be included on a Council agenda. 908 Maple Ridge Business and Industry Park -Lot Grading Staff report dated May 28, 2001 recommending that the District enter into an agreement with Maple Ridge Business and Industry Park. RECOMMENDATION That the staff report entitled "Maple Ridge Business and Industry Park -Lot Grading" dated May 28, 2001 be received for information; and further That the Mayor and Municipal Clerk be authorized to sign and seal an agreement with Maple Ridge Business and Industry Park, respecting the grading of municipal property located on 256th Street, legally described as Lots 1, 2, 3, 4, and 10, District Lot 5326, Group 1 (MRBIP) and Lot 1, District Lot 5326, Group 1 (District land). Councillor Gordon excused herself from the meeting for item 909 as she sits on the Board of Directors of the Cynthera Transition House Society. 909 Cynthera Transition House Society, "Walk for Change", Use of Municipal Streets Staff report dated May 28, 2001 submitting information on the June 10, 2001 "Walk for Change". RECOMMENDATION That the staff report entitled . ~'Walk for Change" dated May 28, 2001 be received for information. Councillor Gordon returned to the meeting. FINANCIAL AND CORPORATE SERVICES (including Fire and Police) 931 Train Whistle Cessation Application Update Staff report dated May 31, 2001 providing information on negotiations with CP Rail and Transport Canada for a train whistle ban at 8 crossings in Maple Ridge. The Property & Risk Manager reviewed the report noting that CP Rail has agreed in principal to the whistle ban application for Maple Meadows Way, Lome Ave., 224th St. and River Road. Negotiations are continuing for the other crossings. CP Rail has agreed to re-inspect the crossings to ensure they will meet the new standards expected to be imposed by Transport Canada. He pointed out that CP Rail has reserved the right use the whistles if there is a safety hazard and to reconsider the bans if conditions at the crossings change. RECOMMENDATION That the staff report entitled "Train Whistle Cessation Application Update" dated May 31, 2001 be received for information; and That staff be directed to proceed with the applications for the crossings at Maple Meadows Way, Lorne Avenue, 224th Street and River Road; and further That staff continue negotiations with Canadian Pacific Railway for the crossings at 203rd Street, Ditton Street, 240th Street and the private crossing at Anderson Pacific Forest Products. COMMUNITY FORUM Willard Dunn Mr. Dunn asked for clarification in writing of what agricultural use, if any, is permitted under RS-1 zoning in the ALR. The Chief Administrative Officer indicated that this would be done. ACTION REQUIRED Staff is to investigate agricultural uses under RS-1 zoning and send a reply to Mr.Dunn.
