Wood, Municipal Engineer Acting Mayor Isaac announced the addition of the following item to the agenda: 953 Department of Canadian Heritage Cultural Spaces Canada Program Grant Application l. DELEGATIONS/STAFF PRESENTATIONS -Nil 2. PUBLIC WORKS AND DEVELOPMENT SERVICES Note: The following items have been numbered to correspond with the Council Agenda: 902 SD 8/00, Larch Ave. & 235 St., Development Cost Charge Reduction Staff report dated June 20, 2001 recommending that the highway component of the DCC be reduced by $20,400. Committee of the Whole Minutes July 9, 2001 Page 2 of 12 RECOMMENDATION That with respect to Subdivision SD 8/00 be it resolved that in view of the necessity for constructing road works at Larch Avenue and 235 Street, the highway component of the Development Cost Charges payable by the subdivider be reduced by $20,400.00 reflecting the Bylaw costs applicable to the works. 903 Excess Capacity/Extended Services Agreement, LC 80/01; SD 54/96, 240 St. & McClure Dr. Staff report dated June 15, 2001 recommending that Latecomer Charges be imposed on the benefiting lands. RECOMMENDATION That with respect to the subdivision of lands involved in SD 54/96, at 240 Street and McClure Drive, ~e it resolved: 1. That the cost to provide the excess or extended services are, in whole or in part, excessive to the municipality and that the cost to provide these services shall be paid by the owners of the land being subdivided, and 2. That Latecomer Charges be imposed for such excess or extended services on the parcels and in the amounts as set out in the staff report dated June 15, 2001, and further 3. That the Mayor and Municipal Clerk be authorized to sign and seal a "Latecomer Agreement" with the subdivider of the said lands. 904 RZ/31/94, 22333-122 Avenue, File Closure Staff report dated June 18, 2001 recommending that all readings granted to Maple Ridge Zone Amending By-law No. 5342-1995 be rescinded and the file closed. RECOMMENDATION That second and third reading granted November 28, 1995 and first reading granted October 24, 1995 to Maple Ridge Zone Amending By-law No. 5342- 1995 be rescinded. ) Committee of the Whole Minutes July 9, 2001 Page 3 of 12 905 RZ/20/93, 22136-22150 Dewdney Trunk Road, File Closure Staff report dated June 18, 2001 recommending that all readings granted to Maple Ridge Zone Amending Bylaw 4886-1993 be rescinded and the file closed. The applicant, Dave Telep, expressed his opinion that the by-law respecting the closure of files should be reviewed as it causes hardship and expense to the development community. He suggested that if a file has been inactive for a period of two years, the applicant be granted a 2 year extension by paying an extension fee and providing new drawings. He advised that although this application is 8 years old, an expression of interest was made 6 months ago for a government subsidized project but funding was not available. RECOMMENDATION That second and third reading granted June 21, 1993 and first reading granted May 17, 1993 to Maple Ridge Zone Amending By-law No. 4886-1993 be rescinded. Councillor Isaac OPPOSED RECOMMENDATION That staff be directed to re:view the policy regarding file closure. 906 RZ/18/95, 10110-240 Street, File Closure Staff report dated May 3, 2001 recommending that all readings granted to Maple Ridge Zone Amending Bylaw 58984-2000 be rescinded and the file closed. RECOMMENDATION That second and third reading granted April 25, 2000 and first reading granted March 28, 2000 to Maple Ridge Zone Amending By-law No. 5894- 2000 be rescinded. Committee of the Whole Minutes July 9, 2001 Page 4 of 12 907 DVP/50/01, 11414 Creekside Street Staff report dated June 25, 2001 recommending that qualifying property owners be notified that the subject application will be considered at the July 24, 2001 Council meeting. Alisha Hayes, Davenport Design Group, a consultant for the applicant, asked Council to review the hillside restriction policy as it impacts the wishes of residents for a walk-out basement. Ms. Hayes offered to facilitate a workshop on this subject if Council so desired. The Acting General Manager Public Works and Development Services advised that a survey was sent to over 200 people in the community on this policy and 30 responses were received. A report is expected to come forward in the near future. RECOMMENDATION That the Municipal Clerk be authorized to notify qualifying property owners that approval of DVP/50/01 respecting property located at 11414 Creekside Street will be considered by Council at the July 24, 2001 meeting. 908 RZ/62/00, 20544 Powell Ave., RS-3 to R-1, Public Hearing Staff report dated June 26, 2001 recommending that the subject application be forwarded to Public Hearing. The Chief Administrative Officer displayed a map of the project and indicated that a low-density application is expected to be submitted following the rezoning. The park dedication satisfies the needs of the Ministry of the Environment for protection of McKinney Creek. RECOMMENDATION That application RZ/62/00 (for property located at 20544 Powell Avenue) to rezone property described in the staff report dated June 26, 2001 from RS-3 (One Family Rural Residential) to R-1 (Residential District) be forwarded to Public Hearing noting that the conditions to be met prior to Public Hearing and prior to final -consideration of the Zone Amending By-law are detailed in that staff report. ) Committee of the Whole Minutes July 9, 2001 Page 5 of 12 909 RZ/15/00, 11655 Burnett St., C-3 and RS-1 to CS-1, Public Hearing Staff report dated June 26, 2001 recommending that the subject application be forwarded to Public Hearing. The Chief Administrative Officer described the uses of the surrounding properties. He advised that the Design Panel would look at this application and make recommendations on it appearance given its gateway location and suggest access routes that will reduce the impact on the residential area. RECOMMENDATION That application RZ/15/00 (for property located at 11655 Burnett Street) to rezone property described in the staff report dated June 26, 2001 from C-3 and RS-1 to CS-1 be forwarded to Public Hearing noting that the conditions to be met prior to Public Hearing and prior to final consideration of the Zone Amending By-law are detailed in that staff report. ACTION REQUIRED The Design Panel is to be instructed to make recommendations on the appearance of this project and on access routes. 910 RZ/19/01, 27790-27844 Dewdney Trunk Rd., A-2 to A-1 and P-1, Public Hearing Staff report dated June 12, 2001 recommending that the subject application be forwarded to Public Hearing and given first reading. RECOMMENDATION That application RZ/19/01 (for property located at 27790 & 27824 Dewdney Trunk Road and two properties adjacent on its south/east boundary) to rezone property described in the staff report dated June 12, 2001 from A-2 (Upland Agricultural) to A-1 (Small Holding Agricultural) and P-1 (Park) be forwarded to Public Hearing; and further That Maple Ridge Zone Amending By-law No. 5974-2001 be read a first time. Committee of the Whole Minutes July 9, 2001 Page 6 of 12 911 Neighborhood Pub Capacity Increase Application Process Staff report dated July 3, 2001 recommending that the proposed application process for capacity increases to neighborhood pubs be approved. The Acting General Manager Public Works and Development Services reviewed the proposed process noting that there is no requirement from the Liquor Control Board for public input. The Liquor Control Board requires that the District of Maple Ridge provide a recommendation for each application but the final decision will be made by this agency. RECOMMENDATION That the staff report entitled "Neighborhood Pub Capacity Increase Application Process" dated July 3, 2001 be received for information; and further That Council concurs with the application process for capacity increases to neighborhood pubs outlined in the staff report dated July 3, 2001. 912 20623 Battle Avenue, Maple Ridge, Clean-up of Property Staff report dated July 4, 2001 recommending that the subject property be cleaned up and the owner invoiced for all costs. RECOMMENDATION That with respect to the property located at 20623 Battle Avenue and earlier unsuccessful attempt to affect clean up, be it resolved that the Business Licensing, Permits and Bylaws Department be authorized to engage a contractor or the District of Maple Ridge Public Works Department for the purpose of cutting and cleaning the lot of debris including weeds, vines, branches, long grass and domestic garbage. Additionally, the exposed concrete foundation remaining from the house fire several years ago must be filled; and further That the cost of the clean-up efforts shall be invoiced to the registered owner of the subject property and in the event that the registered owner fails to pay the costs on or before December 31, 2001, said costs are to be added to and form part of the taxes payable on the property. ) Committee of the Whole Minutes July 9, 2001 Page 7 of 12 3. FINANCIAL AND CORPORATE SERVICES (including Fire and Police) 931 Community Group Web Page Hosting & Links Staff report dated June 25, 2001 recommending the adoption of the "Community Group Web Page Posting & Links Policy". The Chief Administrative Officer explained that a series of requests have been made to link to our web site. These requests have been refused until guidelines are in place. The policy is similar to policies being followed by other local governments. RECOMMENDATION That the staff report entitled "Community Group Web Page Hosting & Links" dated June 25, 2001 be received for information; and further That the "Community Group Web Page Hosting & Links Policy" attached to the staff report dated June 25, 2001 be adopted. 932 Special Occasion License, Port Hammond Days Celebrations Staff report dated June 26, 2001 recommending approval of the application from the Port Hammond Community Association for a Special Occasion License for August 11-12, 2001 and use of Hammond Community Centre. RECOMMENDATION That the application from the Port Hammond Community Association by way of a letter dated April 23, 2001, and a telephone conversation with the Municipal Clerk on July 3, 2001, for a Special Occasion License to hold a Beer Garden at the Hammond Community Centre as part of the annual Port Hammond Days Celebrations be approved as follows: Saturday Sunday August 11, 2001 August 12, 2001 12 Noon to 6:00 p.m. 12 Noon to 6:00 p.m. And further, that the use of the Hammond Community Centre (Municipal property) for this Special Occasion License be authorized. Committee of the Whole Minutes July 9, 2001 Page 8 of 12 933 Bank Signing Officers Staff report dated June 29, 2001 recommending that the Senior Finance Manager be approved as a signing officer and that the term "Manager of Accounting" be replaced with "Municipal Accountant". RECOMMENDATION That the Senior Finance Manager be approved as a signing officer of the District of Maple Ridge and added to the list of signing officers for bank transfers, cheques, bank drafts and financial investment transactions; and further That the term "Manager of Accounting" be deleted from that list and the term "Municipal Accountant" be added in its place. 934 GVTA Governance Model Staff report dated June 27, 2001 recommending that the principle that GVTA Board Members be elected during the 2002 municipal elections be endorsed. Council debated the principle of GVTA Board members being elected members. Councillor Morse joined the meeting during this discussion. RECOMMENDATION That the principle that GVT A Board Members be elected by municipal voters during the 2002 municipal elections be endorsed. Mayor Hogarth, Councillor Harris, Councillor Isaac, Councillor King, Councillor Morse, Councillor Speirs OPPOSED ACTION REQUIRED Information on GVRD administration costs is to be provided to Council. Committee of the Whole Minutes July 9, 2001 Page 9 of 12 935 Special Occasion License, Caribbean Street Festival Staff report dated July 3, 2001 recommending approval of the application from the Caribbean Street Festival for a Special Occasion License for Sunday, July 15, 2001. RECOMMENDATION That the application received July 3, 2001, from one of the 224th Street merchants organizing the Caribbean Street Festival, for a Special Occasion License to hold a Beer Garden, be approved as follows: Sunday July 15, 2001 2:00 p.m. to 9:30 p.m. And further, that the use of Municipal property for this Special Occasion License be authorized. 936 Customer Comment Cards Staff report dated July 4, 2001 providing statistics on the Customer Comment ) Card program. RECOMMENDATION That the staff report and graph entitled "Customer Comment Cards" dated July 4, 2001 be received for information. 4. COMMUNITY DEVELOPMENT AND RECREATION SERVICES 951 Review of Parks & Leisure Services Agreement Note: This item was deferred from the June 26, 2001 Council Meeting. Staff report dated June 27, 2001 providing recommended wording for the resolutions. 951.1 That the report from Brian Johnston be received. Committee of the Whole Minutes July 9, 2001 Page 10 of 12 RECOMMENDATION That the report of Brian Johnston on the subject of the Joint Parks & Leisure Services Agreement attached to the staff report dated May 30, 2001 be received for information. 951.2 That the model be endorsed with the exception of the annual audit. The General Manager Community Development, Parks and Recreational Services, on question, advised that the request for the review came from both the Maple Ridge and Pitt Meadows Councils. The Chief Administrative Officer commented that it is customary to review cost sharing agreements and to have such a review conducted by an outside party. RECOMMENDATION That the model described in Mr. Johnston's report on the Joint Parks & Leisure Services Agreement be endorsed with the exception that an outside audit of the Parks & Leisure Services budget be carried out in 2002 and only be repeated on the request of either party to the agreement and at the expense of the party requesting the audit. Councillor Morse OPPOSED 951 .3 That the Terms of Reference for a study of the financial terms be endorsed. RECOMMENDATION That the Terms of Reference for a study of the financial terms of the Joint Parks & Leisure Services Agreement be endorsed. Councillor Morse OPPOSED RECOMMENDATION That the subject and necessity of an appropriate cycle for outside auditing of the Parks & Leisure Services budget be referred to the Parks & Leisure Services Commission for a recommendation following receipt of the first audit report. Committee of the Whole Minutes July 9, 2001 Page 11 of 12 952 Memorial Peace Park Additions Staff report dated June 27, 2001 recommending the installation of additional lighting at Memorial Gardens : RECOMMENDATION That a change order be authorized for the installation of additional light fixtures, for the installation of a 300 amp electrical service and for the provision of additional electrical outlets for specialty lighting for the Memorial Peace Park at a cost of up to $110,000 noting that the funding will be provided for the park project from development cost charges. 953 Department of Canadian Heritage Cultural Spaces Canada Program Grant Application The General Manager Community Development, Parks and Recreational Services explained that the District had been encouraged to submit an application no later than this week necessitating the addition of this item to the agenda. ) RECOMMENDATION That the General Manager of Community Development, Parks and Recreational Services be authorized to submit a grant application to the Cultural Spaces Canada Program of the Department of Canadian Heritage for funding and support of providing the required technical equipment for the Arts Centre and Theatre. 5.
