Over the past few years, Units 1, 2, 3 and 4, 11731 Fraser Street, Maple Ridge, BC, legally described as: • Strata Lot 1 District Lot 398 Group 1 New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata Lot as shown on form 1, • Strata Lot 2 District Lot 398 Group 1 New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on form 1, • Strata Lot 3 District Lot 398 Group 1 New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on form 1, and • Strata Lot 4 District Lot 398 Group 1 New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on form 1; have been vacant due to a fire in April of 2005. The British Columbia Fire Code requires owners of vacant buildings to ensure the building remains secure at all times to prevent safety concerns due to unauthorized entry. Both Fire and Bylaw Enforcement staff have confirmed that the building has been insecure a total of eleven times since October of 2006. Appendix A lists the dates that District officials have contacted the property owner to report the building insecure along with a number of photographs of the insecure building. The RCMP has also reported attendance at the vacant building ten times since June 2006 for various disturbances occurring in and about the vacant building. There is concern that this failure on the part of the owner to secure the building in a manner that prevents unauthorized entry, may result in personal injury to individuals due to the unsafe condition of the building and/or property damage to surrounding buildings due to a fire. 1101 RECOMMENDATION(S): WHEREAS Division 12 of Part 3 of the Community Charter authorizes Council to require the owner or owners of a structure or erection to remove or demolish or otherwise deal with the building or other structure where Council considers that the building or other structure is in or creates an unsafe condition. AND WHEREAS Jagdev Singh Athwal is the registered owner (the 'Owner') of a building known as Units 1, 2, 3 and 4, 11731 Fraser Street, Maple Ridge, BC, and legally described as: • Strata Lot I District Lot 398 Group 1 New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on form 1, • Strata Lot 2 District Lot 398 Group I New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on form 1, • Strata Lot 3 District Lot 398 Group I New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on form 1, and, • Strata Lot 4 District Lot 398 Group I New Westminster District Strata Plan NW8 together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on form 1; (the 'Property'), and the Owner has failed to maintain the building on the Property in a safe and secure manner. AND WHEREAS the building on the Property includes common property that is owned, in part, by Jagdev Singh Athwal, Sofia Athwal, Mary Ann Rose Jones, Michael John Kwasnica, Sean Douglas Myers and Regina Luise Oemltzsch, the registered owners of the other strata lots on District Lot 398 Group I New Westminster District Strata Plan NW8 (the Common Property Owners', NOW THEREFORE, the Council of the District of Maple Ridge, in open meeting assembled, resolves as follows: Council hereby declares that the building on the Property also known as Units 1, 2, 3 and 4, 11731 Fraser Street, Maple Ridge, BC, is in and creates an unsafe condition, within the meaning of Section 73(2)(a) of the Community Charter, as a result of being insecure on numerous occasions over the past two years. Council requires the Owner and the Common Property Owners to demolish and remove, no later than thirty (30) days after a copy of this resolution is delivered to them, the building on the Property also known as Units 1, 2, 3 and 4, 11731 Fraser Street, Maple Ridge, BC. Council requires the Owner and the Common Property Owners to fence the area the building on the Property was formerly located no later than thirty (30) days after a copy of this resolution is delivered to them. The fence must be stable and at least 1.5 metres tall. Council requires the Owner and the Common Property Owners to fill in and level any hole created by the removal of the building on the Property no later than thirty (30) days after a copy of this resolution is delivered to them. In the event the Owner and the Common Property Owners have not done the work required of them by Sections 2, 3 and 4 of this resolution within thirty (30) days after a copy of this resolution is delivered to them, the District may by its own forces or those of, a contractor engaged by the District, enter on the Property and any common property associated with the Property and do the work required by Sections 2, 3 and 4 of this resolution. In the event that the District takes action under Section 5 of this resolution, the District may recover the expense from the Owner and the Common Property Owners, together with costs and interest, in the same manner as municipal taxes in accordance with Sections 17, 258 and 259 of the Community Charter. In the alternative, if the District does not take any action pursuant to section 5 or 6 of this resolution, the District's solicitors are hereby authorized to apply to the BC Supreme Court, pursuant to Section 274 of the Community Charter, to enforce this resolution by way of a court order. The previous resolution adopted by Council regarding the Property is hereby repealed. DISCUSSION: Background Context: In April of 2005, a fire rendered the four townhouse units located at 11731 Fraser Street uninhabitable. Fire restoration permits were issued for each of the units between April and August of 2005 by the District of Maple Ridge. None of the repairs were completed and the permits expired in April and July of 2007. The British Columbia Fire Code requires owners of all vacant buildings to ensure the building remains secure at all times to prevent safety concerns as a result of unauthorized entry. Since October of 2006, both the Fire and Bylaw Enforcement Departments have responded to 11731 Fraser Street on 11 separate occasions as a result of the building being insecure. Orders to secure the building were issued to the Owner for each occurrence by District officials. On a number of occasions, it appeared that the building had been occupied as articles of clothing and other items were noted by District officials. During the unauthorized entry to the building, many of the plumbing and electrical fixtures including wiring and piping were removed rendering the units unsafe. Fire Department officials continue to respond to concerns that the building is insecure. Unfortunately, this requires resources and takes Fire officials away from completing other duties. The municipality is not currently in a position to recover these costs from the property owner and therefore the costs are borne by all taxpayers. Unfortunately, the Property includes common property and the owners of that common property also need to be involved in this process. Desired Outcome(s): It has been over two years since a fire occurred at the Property and although fire restoration permits were issued for repairs to the building, no works have occurred. In fact, many of the undamaged fixtures, piping and wiring in the building have been removed by individuals who have gained unauthorized entry to the building. This type of activity will certainly add to the costs of repair and is a direct result of the failure to secure the building. The Owner has suggested that repairs have not been completed due to a disagreement with the insurance company over his claim for damages. During the past two years, District officials have met with the Owner a number of times to impress upon him that he must ensure that while the insurance claim remains outstanding, and no repair work is commenced, the building must remain safe and secure. It was suggested to the owner that he hire an individual to monitor the building and deal with any unauthorized entry immediately. Unfortunately, no efforts that we are aware of have been made by the Owner to address the problem of regular unauthorized entry. The British Columbia Fire Code requires all property owners to secure vacant buildings from unauthorized entry. The Owner of this particular building has made no attempts to work with the District to resolve the ongoing problem of unauthorized entry. Rather, the Owner seems to rely on District officials to alert him to a problem with the building. This practice cannot continue and we are requesting that Council consider a demolition order to address this dangerous situation. C) Citizen/Customer Implications: Insecure buildings create unsafe conditions for residents residing in the immediate neighborhood. Fire officials are concerned that unauthorized entry into the building may result in personal injury or accidental fire which may impact surrounding buildings. Insecure buildings also attract homeless individuals and although the building may provide shelter from the outside elements, the building does not comply with any building code or health requirements for occupation. Financial Implications: Dealing with insecure buildings requires on site inspections by either Fire or Bylaw Officers with costs attributed to the general taxpayers. It is uncertain what impact the demolition of the building will have on the Owner's insurance claim. Alternatives: District officials can continue to respond to reports that the building is insecure and issue orders to the Owner to secure the building. Council may consider any alternatives for effectively dealing with the Property which may be forthcoming from the Owner as a result of Council's consideration of a demolition order. CONCLUSIONS: The building located at 11731 Fraser Street has been vacant due to a fire since April of 2005. Over the past year, District officials have attended the Property numerous times to deal with the building being insecure. The Owner has been encouraged to take measures to effectively deal with the situation but to date has done little to address the situation. This application is in compliance with the Official Community Plan. RECOMMENDATIONS: That Bylaw No. 6510-2007 be given first reading and be forwarded to Public Hearing; and That the following terms and conditions be met prior to final reading. Approval from the Ministry of Transportation; Registration of a Rezoning Servicing Agreement including the deposit of security as outlined in the Agreement; Registration of Section 219 Covenant for a Geotechnical Report that addresses the suitability of the site for the proposed development; Road dedication as required; Consolidation of the development site. (One Family Urban Residential) Designation: Commercial Existing Use of Property: Hotel, Liquor Primary Establishment & Licensee Retail Store Proposed Use of Property: Liquor Primary Establishment, Licensee Retail Store & Commercial Retail Units Site Area: 0.446 HA Access: Lougheed Highway & 207 Street Servicing: Full Urban Companion Applications: DP/061/07 & VP/061/07 b) Project Description: An application has been submitted to rezone the properties located at 20690 Lougheed Highway and 11839 207 Street from RS-i (One Family Urban Residential) and CS-i (Service Commercial) to C-2 (Community Commercial) to permit the demolition of the current building and construction of a new commercial complex containing a liquor store, pub and commercial space. The future consolidated lot will front onto Lougheed Highway and 207 Street. Currently the RS-1 (One Family Urban Residential) zoned lot is being used for parking for the liquor store and is designated Commercial in the Official Community Plan. It is proposed that the development occur in two phases. Phase 1 will consist of the construction of the pub and liquor store, Phase 2 will consist of the construction of the Commercial Retail Units. The existing building will be temporarily retained and remain operational until the construction of the new pub and LRS are completed. The commercial retail units will be built once the existing building is demolished. -2- C) Planning Analysis: Official Community Plan: The properties are designated General Commercial in the Official Community Plan and the proposal complies with this land use designation. Zoning Bylaw: A preliminary review of the plans in relation to the Zoning Bylaw requirements has revealed that the proposal will require 3 variances. The applicant is proposing to consolidate the two properties which together meet the minimum lot width, lot depth and lot area requirements of the C-2 (Community Commercial) zone. A Development Variance Permit application has been received to vary the following: The building height of 7.5 m has been exceeded with pitched roofs. The height of the roof from the slab elevation is now 9.15 m, an excess of 1.65 m over the bylaw. A second storey greater than 50% in area of the first storey. The second storey pub and deck combined are 50.9% of the lower floor, therefore the total second storey area is slightly over the maximum with the patio/deck. The 3.0 metres front lot line setback to allow a canopy to provide additional rain protection to the street to the east property with zero setback. These variances will be reviewed in a future report to Council because they add significantly to the building's overall design and architectural presence at this significant corner. Development Permits: The proposed design of this development will have to be consistent with the Commercial Development Permit Guidelines for form and character as per Section 8.5 of the Official Community Plan. An application for the Development Permit has been received and will be the subject of a future Council Report. Advisory Design Panel: The proposed project was reviewed by the Advisory Design Panel on September 11, 2007 and was given general support by the group but recommended that revisions to the proposal be submitted to Planning staff to address the following: • Location of sidewalk along 207 Street (confirmation with Engineering Dept). • Relocation of garbage and recycling enclosure and screening. • Strengthening of the architecture of the corner at Lougheed Highway and 207 Street. Following this meeting, project plans were revised as follows: -3- Added a roof and extended the height of the garbage & recycling enclosure in order to reduce noise and odours. Added more outrigger beams and a trellis 12 feet along 207 11, and 24 feet along Lougheed Highway in order to provide a significant interest without a traditional tower solution. Development Information Meeting: A Development Information Meeting was held September 6, 2007between 5:00-8:OOPM in the conference room of the Best Western Hotel, 21735 Lougheed Highway, Maple Ridge. Notice of the meeting was mailed out to all residents and owners within 50 metres of the subject properties on August 21, 2007. Copies of the Notice of Development Information Meeting were published in the August 22nd, 2007 and August 291h, 2007 editions of "The News" newspaper. The meeting was facilitated by the property owner and project architect. Roughly 19 people attended the meeting over the 3 hours and most were neighbours of the subject property. Comment sheets were provided at the meeting and 3 have been received. Attendees were generally impressed with the quality of the design and materials. However, they did express concerns regarding the proposed development relating to: Noise from the unenclosed pub patio and its location at the rear of the building facing adjacent townhouse units. Loud music emanating from the building. Noise from vehicle traffic into/out of the parking lot and drunk and disorderly patrons in the parking lot. Safety of the adjacent townhouse units. Noise and odors from the garbage & recycling enclosure proposed to be located beside the adjacent townhouse units. In response, the project plans were revised as follows: • Glazing has been added to the south wall of the patio, a 6'-0" high glass partition has been added on the west wall and a retractable roof has been added in order to minimize noise from the pub. • The fence along the south property line has been changed from 6'-0" to 8'-0" to increase security and will be made out of tongue and groove cedar which will aid in noise abatement. • Modified the plantings along the south property line to include barberry which will act as a planting barrier to discourage crime. d) Interdepartmental Implications: Engineering Department: The Engineering Department reviewed the servicing for the development and provided their comments as follows: -4- • Road dedication required on Lougheed Highway will be determined by the Ministry of Transportation. Road dedication of 3 m along west side of 207 Street and a 6 m by 6 m corner truncation at the intersection of Lougheed Highway and 207 Street is required. • The Lougheed Highway road frontage must be reconstructed with concrete sidewalk, curb and gutter. On the 207 Street side the existing sidewalk, concrete curb and gutter will remain in place other than where changes are proposed to the driveway accesses. These areas will need to be reconstructed to match the existing sidewalk and curb. • The applicant's consultant will need to review the adequacy of the existing sewer main and connection and show how the site will connect to the storm sewer. • The existing water service is inadequate for the proposed use so a new connection will need to be installed at the applicant's cost. • Street lighting improvements will be required on both frontages. • A street tree planting plan must be included with the off-site servicing design. The size, type and location of the boulevard trees must agree with the information shown regarding trees on the landscaping drawings that will be submitted as part of the development approval process. • Underground wiring required. • A demolition permit will be required from the Building Department to remove existing building on site. The existing water service will need to be permanently disconnected and the sewer service will be temporarily disconnected. Fire DeDartment: A site plan and floor plans showing locations of fire related infrastructure is required. This is to include the locations of fire department connection, fire hydrant, fire alarm panel, sprinkler room, standpipe connections and includes lane measurements and overhead obstructions. A greater mix of services would benefit the neighbourhood located to the south of the site, as this site is within walking distance for many residents. C) Planning Analysis: Official Community Plan: The 1996 Official Community Plan (OCP) restricted this site and the surrounding commercial sites to utilizing only commercial zones that are suited to highway commercial services. During the review for the 2006 OCP, it was recognized that commercial development in this area had not kept pace with current market trends. The 2006 OCP designates the subject site for commercial use which includes permitting the C-2 (Neighbourhood Commercial) zone as a land use option and many sites along Lougheed Highway have since been rezoned to C-2 (Community Commercial) to permit more neighbourhood commercial uses. -2- Zoning Bylaw: The proposed C-2 (Community Commercial) zone is intended to provide convenience shopping and personal services to residents of surrounding neighbourhoods. As mentioned above, the applicant intends to retain the existing buildings and no external changes to the buildings or site is proposed. The rezoning of this property to C-2 (Community Commercial) will cause the use of one of the current tenants (Enterprise Rent-A-Car) to become non-conforming. The applicant has advised the tenant of the implications of this change. Off-Street Parking and Loading Bylaw: The existing buildings are a total of 1016.73 m 2 in size and the parking requirement for a uses in the C-2 (Neighbourhood Commercial) zone is 34 stalls and the site currently provides 55 parking stalls. Planning Analysis: Official Community Plan: The proposed development is consistent with the Official Community Plan which designates this site as Commercial. Zoning Bylaw: A preliminary review of the plans in relation to the Zoning Bylaw requirements has revealed that the proposal complies with the bylaw. Citizen/Customer Implications: A Restrictive Covenant on title restricts the'use of the building to those "intended for the use and enjoyment of the Grantees and their members" and states that the building "shall not be leased to or used by any third parties without the express consent of each of the Grantees". There may be objections from neighbouring residents to the proposed zone amendment as the original intent of the building was for it to be used as an amenity building to the surrounding condominiums in Fraserview Village. Fraserview Village is a residential development for residents 55 years and older. Therefore, a child day care facility may be considered at odds with this intent. However, in discussion with the applicant, this commercial use/banquet hall building was built to rent out as a means of helping to pay for the recreation building located on the same site. The addition of a child -2- day care use is consistent with this objective. In addition, the strata council which represents 500 households is in support of this building being used for a child care centre use. Interdepartmental Implications: Building Department: The Building Department has advised that 10% of the building footprint may be used for an accessory use without upgrading requirements being imposed as per the 2006 BC Building Code. Therefore, approximately 45m 2 may be used for a child care centre use in the existing building. The applicant is required to provide a summary of how the building will be compliant with the 2006 BC Building Code for uses occupying floor space greater than 45m 2. Fire Department: The Fire Department does not have any issues with this accessory use. Intergovernmental Issues: As the property lies within 800m of Lougheed Highway, this application has been referred to the Ministry of Transportation for comments. The Applicant's submission conforms with the notice of application requirements of the Agricultural Land Commission. Analysis shows that the applicant's intended use for the properties is contrary to the current Official Community Plan policies adopted by Council in 2006. The properties are also in the Metro Vancouver Green Zone. The Agricultural Advisory Committee established by Council earlier this year is undertaking an Agricultural Plan for the District. Council may decide that exclusion applications prior to the completion of that Plan are premature. At their February 14, 2005 Workshop, Council resolved that the process for referring applications to the Agricultural Land Commission include the following options: The application not be authorized to go forward to the Agricultural Land Commission. The application be authorized to go forward to the Agricultural Land Commission with a summary of Council's comments. RECOMMENDATION: That the application not be authorized to go forward to the Agricultural Land Commission. DISCUSSION: a) Background Context: Applicant: Aragon Development Corp Owner: Victoria L Gerndt, Douglas Bell and Cheryl Bell Legal Description: Lot 2 and Lot 3, Section 22, Township 12, Plan 3118 1105 OCP: Agricultural Zoning: RS-3 (One Family Rural Residential) Surrounding Uses North: Use: Zone: Designation: South: Use: Zone: Designation: East: Use: Zone: Designation: West: Use: Zone: Designation: Private School P-i. (Park and School) Agriculture (Draft OCP), 100% within the Agricultural Land Reserve. 4 properties, rural residential and farm use RS-3 (One Family Rural Residential) Agricultural, 100 % within the Agricultural Land Reserve, 2 properties with farm status as defined by BC Assessment Authority. 2 ALC approved developments within the Agricultural Land Reserve: utility use (hydro substation) and non farm use (school use). RS-3 (One Family Rural Residential) Agricultural, 100% within the Agricultural Land Reserve. 8 properties, 7 used as residential, one for service commercial purposes 7 properties zoned RS-3 (One Family Rural Residential), one property zoned CS-i (Service Commercial) properties designated suburban residential and 1 property designated Rural Commercial Existing Use: Rural residential.and farm. Proposed Use: 80,000 square foot Commercial Centre. Site Area: 6.4 hectares (15.8 acres) Access: Dewdney Trunk Road Servicing: Both subject properties are outside of the Urban Area Boundary but have sewer and water services. Previous Applications: Applications AL/017/06 and AL/040/05 concerned both subject properties for a similar proposed use and exclusion from the Agricultural Land Reserve. Council denied both applications from proceeding to the Agricultural Land Commission. A non-farm use application (AL/052/00) for school purposes was made for both subject properties. This application was approved by the Agricultural Land Commission, and the northern portions of the subject properties were subdivided and subsequently rezoned for this purpose. b) Project Description: The applicants are requesting the exclusion of the subject properties from the Agricultural Land Reserve in order to develop them as a 7,432 square meter (80,000 square foot) Community Commercial center. A watercourse traverses both subject properties. Policies The subject properties are not within the Urban Area Boundary, and the Agricultural designation of the subject properties did not change with the Official Community Plan, which was adopted on November 14, 2006. This bylaw contains growth management policies which must be considered in light of the merits of this application, including: Policy 2 - 4 Outside the Urban Area boundary, commercial growth will be directed to rural commercial and historic commercial centres. Relevance of Policy 2 - 4. Rural Commercial centres are intended to meet the needs of a rural population and are typically less than 93m2 (1,000ft2) in area. Historic Commercial Centres are intended to be the commercial hearts of the historic communities they serve. The scale of this proposed use greatly exceeds the typical size of either rural or historic center. The proposed location is not appropriate for a historic centre. On this basis, this proposed use should be considered an urban use outside of the Urban Area Boundary, and is therefore inconsistent with the policy direction of the Official Community Plan. Policy 2 - 6 Maple Ridge supports and maintains the Urban Area Boundary recognizing the role that is has on limiting urban expansion, preserving community character, reducing land speculation within the Agricultural Land Reserve and protecting the agricultural land base, and in providing for the efficient delivery of services. Adjustments to the Urban Area Boundary: will only be supported if the District has an adopted Agricultural Plan; will only be considered in cooperation with the Agricultural Land Commission and the Greater Vancouver Region District (now Metro Vancouver); and will only be conducted during a Comprehensive Official Community Plan review, or Council directed Comprehensive Urban Area Boundary review, and applications considered outside of the either review are considered premature. Relevance of Policy 2 - 6. On the basis of this policy, this development proposal cannot be supported. The Official Community Plan introduced new supportive policies for agriculture that have particular relevance to this application, including: -3- Policy 6-10 Maple Ridge will strive to maintain its agricultural land base in Maple Ridge through the following mechanisms:.. respecting the integrity of the urban area boundary by establishing a distinct separation between rural and urban designated areas:... Relevance of Policy 6-10. The subject site is adjacent to other agricultural land and any non- farm uses could have a significant impact on the agricultural potential of these properties. Active farming does take place nearby. Properties located at 24162, 24269, and 2433lDewdney Trunk Road have farm exempt status according to BC Assessment Authority Statistics. Policy 6-12 Maple Ridge will protect the productivity of its agricultural land by:... preserving larger farm units and areas by using appropriate buffers such as roads, topographic features, watercourses, ditching, fencing, or gradually reduced residential densities on properties adjacent to agricultural land;... Relevance of Policy 6 -12. The current lot configuration of the adjacent properties along 2401h Street is an appropriate interface between the agricultural areas to the east of 2401h Street and land uses to the west, which are within the urban area boundary. These properties range in size from 0.2 hectares (0.5 acres) to 0.6 hectares (1.38 acres). These lot sizes are consistent with the policy direction in the Official Community Plan, which identifies gradually reduced residential densities next to agricultural land as an interface buffer. The effectiveness of this interface would be undermined by the exclusion of the subject properties from the Agricultural Land Reserve. Other Considerations • The subject properties are not within the Fraser Sewerage Area Boundary. Requirements prior to permitting an urban style of development include an application to the Greater Vancouver Sewerage and Drainage District Board to permit sewer extension, and an application to the Metro Vancouver Regional District to amend the Regional Context Statement as it applies to the Green Zone and to the urban area boundary. There is no guarantee that such applications would be approved. • The proposed development of these properties is inconsistent with the long term goals of the community and the Region. This application is in an area which lies outside the urban area boundary and is designated as Green Zone in the Livable Region Strategic Plan. Maple Ridge must consider the four fundamental strategies of the Livable Region Strategic Plan (LRSP) when considering future development: I) Protection of the Green Zone; Building of complete communities: Achievement of a compact metropolitan region; and Increased transportation choice. • This application proposes a significant urban use for properties that lie outside of the urban area boundary, and is therefore not supportable under the Regional Context Statement. Any -4- proposed use for these properties that would require an exclusion from the Agricultural Land Reserve would also require an amendment to the Livable Region Strategic Plan and the Green Zone through an application to the Metro Vancouver Regional District Board. To date, no such proposed amendments have been successful. • It is anticipated that the exclusion of these lands would prompt further ALR exclusion applications and requests for amendments to the Green Zone. Council has directed that an Agricultural Plan be completed. The Agricultural Advisory Committee established by Council this year has undertaken to complete the Agricultural Plan. Council may decide that exclusion applications in advance of the Agricultural Plan are premature. Commercial Land Use Study The Commercial Lands Study was produced by J.P. Rollo and Associates as background information to guide the review of the Official Community Plan. The policy recommendations derived from the J.P. Rollo and Associates Commercial Land Use Study were presented to Council on November 1, 2004. The report findings indicated that a community commercial centre was needed to serve residents of East Haney / Cottonwood and East Maple Ridge. The initial optimum size for this centre was considered to be 6,967 square meters (75,000 square feet), and with population growth, could expand to between 11,612 and 13,935 square meters (125,000 and 150,000 square feet) over the next several years. It was noted that commercial development had commenced at the northeast corner of 240th Street and Dewdney Trunk Road. (Cooper's Foods store). To further develop this area to serve this market, all corners of this intersection could be considered for commercial development of either an urban or a rural nature. The subject properties are not directly at this intersection and therefore are inconsistent with the recommended prime location for commercial development. In addition, their combined area is 6.4 hectares, or 15.8 acres, which is equivalent to over 64,000 square meters (688,900 square feet). The stated intent of this application is to build 7,432 square meters (80,000 square feet) of commercial floor space, significantly lower than maximum lot coverage on a site of this size. At 40 % maximum lot coverage, the combined subject properties could accommodate over 25,457 square meters (275,000 square feet) of commercial floor space, which greatly exceeds projected demand as outlined in the Commercial Land Use Study. Development of this size could undermine opportunities for existing and future commercial uses both in this area and potentially in the downtown which Council has identified as a priority for increased residential density and commercial redevelopment. Table 1 provides the commercial floor space potential for each of the subject properties identified on Appendix II at the intersection of Dewdney Trunk Road and 240th Street that are either zoned or designated for commercial uses under the Official Community Plan. -5- Prop. The appropriate rural commercial zone is CS-4, which is restricted to a commercial floor space of 279 square meters (3,000 square feet). The combined commercial floor space potential of these properties at this intersection meet the identified current needs and are generally sufficient to meet projected demand as estimated in the Commercial Land Use Study. In addition, a Neighbourhood Commercial centre is designated at .112t Avenue and 240th Street. Retail development at this location would also serve residents in the neighbourhoods of Albion and.Cottonwood. d) Alternatives: Council has the option of forwarding this application to the Agricultural Land Commission for their consideration. It should be noted that if this exclusion application is successful, the approval of the Metro Vancouver Regional District would be required to exempt this property from the Green Zone of the Livable Region Strategic Plan. CONCLUSION: Council has been provided with a range of options for processing this application. There is an opportunity to acquire more books with one of the two options. That option reflects a 3% increase in the Library Materials budget. Approving that option will result in an increase to the Maple Ridge Library Levy of 2.13%. Council is requested to provide direction to Councillor Daykin (the District's FVRL Board representative) so that he can bring Council's input to the November 28th, 2007 Board Meeting. RECOMMENDATION(S): That version two of the 2008 Fraser Valley Regional Library budget be endorsed noting that this option provides for a 3% increase in the Library Materials budget and will represent a 2.13% increase in the Maple Ridge library Levy. DISCUSSION: Background Context: Each year Council is provided an opportunity to offer input to the Regional library Budget through Council's representative on the FVRL Board of Directors. Desired Outcome(s): For several years it has been identified that the book stock in the system is falling behind. Some budget adjustments have been made previously to address the shortfall. The 2008 version two budget will help in addressing the problem. C) Strategic Alignment (as appropriate): The Maple Ridge Library contributes significantly to literacy in this community and is an important aspect of our local quality of life. In recent surveys over 50% of area residents are users of the library. Citizen/Customer Implications: The Library budget will increase to a small degree next year comparable to inflation. In light of the District's population growth over the past year an even smaller increase will result in the payment made by residents on their tax bill. Business Plan/Financial Implications: See above. 1151 CONCLUSIONS: The Library provides a service which is consistently identified as being valuable by area residents. (Jim) Rule MWM / / Chief Administrative Officer VRL PASER VALLEY REGIONAL LIBRARY PROPOSED 2008 FVRL BUDGET PURPOSE Two scenarios of the Proposed 2008 Fraser Valley Regional Library Budget are presented for consideration by the FVRL Board representatives and your local government councils/boards. The purpose of this report is to provide the Fraser Valley Regional Library Board with information and recommendations concerning the operating, capital and grant budgets proposed for 2008. THE DIFFERENCE The difference between the two proposed budget scenarios is the amount of the Library Materials budget. Our suppliers have told us that, with the stronger Canadian dollar, a 0% budget increase should give us status quo buying power for 2008. The option for a 3% increase in Library Materials budget would enhance the floating collection for your residents' use and enjoyment. PROPOSED 2008 FVRL BUDGET FVRL WASEP VALLEY PEGIONAL LIBPARV PROPOSED 2008 FVRL BUDGET (continued) THE PROCESS The Proposed 2008 Fraser Valley Regional Library Budget has been compiled with the assistance of FVRL's senior management and exempt library managers. FVRL Director of Finance Mary O'Callaghan and Budget Officer Manoj Rajan have worked with library managers, and library managers have discussed community library needs with their contacts at the local government level. FVRL senior management met with the Board Chair and Board Vice Chair to review the draft budget scenarios. The Proposed 2008 FVRL Budget is a culmination of these efforts. The District of Hope's Council has approved the addition of eight staffing hours for Hope's Library. The City of White Rock is still considering the option of adding some additional Sunday openings in 2008. If this is approved, the costs will be billed in addition to the budget allocation. Job Evaluation Program: Contingency re implementation of new Job Evaluation program budgeted again in 2008. Library Program and Promotion Budgets: Some small increases, both local and shared, to implement new programs and enhance existing ones. Building Maintenance: Anticipated insurance cost increases, building maintenance costs. Supplies: Some small increases, both local and shared, to cover inflation and the need for office, computer, and health and safety supplies. Information Technology Department Capital Budget: The Integrated Library Software (ILS) upgrade for 2008 will be funded primarily through the Public Library Services Branch's Technology Grant ($87,000). The remaining cost ($22,779) is part of the Operating Budget proposal. The IT Capital Budget also includes the Equipment Budget ($29,752 - down from $50,000 in 2007) and the Computer Capital Lease payment Budget ($72,777 - up from $6,323 in 2007). The PLSB Technology Grant was used to pay Capital Leases in 2007. Also included in the budget proposals are small increases in replacement hours at the Administrative Centre in order to accommodate the proposed increase in the Municipal Surplus Allocation. I. CONFIDENTIAL To Maple Ridge Mayor and Council, Maple Ridge RCMP Traflic Section, Langley Mayor and Council, Langley RCMP Traffic Section, Mission Mayor and Council, Mission RMP Traffic Section, ICBC: LET'S SHARE THE ROAD - SAFELY!! Within the past month two riders and their horses in Maple Ridge have been struck by passing motor vehicles. This brings the total of serious and reported horse and vehicle accidents to four in only two years. With the growing number of people moving into rural and semi-rural areas, horse and vehicle accidents are going to increase unless something is done to educate both drivers and equestrians on how to share the road safely. We the Undersigned; request that the RCMP, ICBC and our Municipal Mayor and Council take action to ensure that drivers are made aware of the importance of driving with caution and consideration when passing horses and their handlers on the road. We feel such action could take the form of an educational campaign similar to the Motorcycle Awareness prOgram. We acknowledge that as equestrians on the road, that we must be aware of the laws of the road an .w they pertain to us, but we also request that our Municipalities, ICBC, and the RCMP also recognize that people who deliberately attempt to frighten our horses while we ride on the roads are guilty of endangering not only our lives, but also of those who may be in the near-by vicinity. An Order that the Respondents provide such written authorizations as. are requested by the Administrator to obtain property, accounts, funds, information, documents and/or records held by third parties on behalf of the Strata Corporation; • (p) • An Order that the Respondents provide the Petitioners with an opportunity to inspect and take copies of all documents relating to the Strata Corporation required to be maintained pursuant to section 35 of the Strata Property Act within 14 days, including any documents currently in the hands of any Strata Council member, any owner, or any third party answerable to a Respondent; (q) An Order that the Respondent Strata Corporation prepare a. proposed amended budget as recommended by the Administrator, including allocations to the contingency reserve fund in the amount required by the Strata Property Act and the Regulation thereto, and provide copies to all owners within 60 days; An Order that the Respondent Strata Corporation give notice of, and hold a properly convened Special General Meeting within 90 days at which the proposed amended budget may be discussed, and approved by the owners; An Order that there be a Special Levy in the amount of $40,000.00 to provide interim funds for administrative expenses, insurance, expert advice, emergency repairs; and such other immediate costs which in the Administrator's sole discretion cannot wait for the accumulation of a suitable operating fund from the collection and deposit of strata fees, and that the special levy be payable by owners according to their unit entitlement within 14 days, without need for approval of the owners; In the alternative, an Order that the Respondent Strata Corporation put forward a 3/4 vote resolution for the consideration of the owners, at a Special General Meeting called within 90 days, to raise a special levy to pay for administrative expenses, insurance, expert advice, emergency repairs; and such other immediate costs which in the Administrator's sole discretion cannot wait for the accumulation of a suitable operating fund from the collection and deposit of strata fees; An Order that the Respondent Strata Corporation hold a properly convened Annual General Meeting each year, within 60 days of the fiscal year end; A Declaration that no special levies were validly assessed on November 4, 2006 or March 19, 2006, and the Respondent Strata Corporation must forthwith credit each owner with any amount assessed against each respective owner's account pursuant to any special levy purported to be raised on either occasion. An Order that the R espondent Strata Corporation forthwith take the necessary steps to cancel the Liens filed in the Land Title Office as Document BA009626 on June 2, 2006 against strata lot 15, owned by Sean Meyers and asDocument BA009962 on June 2, 2006 against strata lot 12, owned by Regina Oemitzsch, and provide the Petitioners with proof of cancellation within 14 days. An Order that the Respondent Strata Corporation govern itself in accordance with duly passed, registered and enforceable bylaws, and take reasonable steps to enforce those bylaws in the discretion of the Administrator. A Declaration that any bylaws passed on June 22, 2003, August, 10, 2003 and/or subsequent dates, but which, were not properly registered in accordance with section 128 of the Strata Property Act, are void and unenforceable. 6 (z) A Declaration that the motion restricting the number of council members which was allegedly passed on June 22, 2003 is contrary to. the registered bylaws and is void and unenforceable. (aa) A Declaration that the Strata Corporation has no authority to borrow arising out of the November 4, 2006 Strata Council meeting, and an Order that any loan arranged with an arms length third party pursuant to a decision made at that meeting must be fully repaid by the Respondent Strata Corporation within 60 days. (bb) An Order that the Respondent Strata Corporation on direction of the Administrator remedy the installation of smoke detectors in strata lot 20 without visible wiring or cosmetic damage, and repair the cosmetic damage ôaused to that strata lot by the April 27, 2007 installation, all at the Strata Corporation's expense. (cc) An Order that the Administrator determine what expenditurs have been made personally by owners with respect to necessary repairs, andlor compliance with municipal work orders, which should properly be common expenses of the Strata Corporation, and that the Respondent Strata Corporation reimburse the owners for all such expenditures (dd) An Order that the Administrator determine what municipal Orders remain outstanding, and make reasonable efforts to comply with such reasonable Orders as soon as practicable, and dispute any such Order which the Strata Corporation can address more practically. (ee) An Order that the Administrator secure the 11731 building to the satisfaction of the District of Maple Ridge. (ff) An Order that the Administrator have authority to negotiate with the District on behalf of the Strata Corporation to avoid or effect the repeal of any further demolition Order. (gg) An Order that the Administrator request a further fire inspection from the municipal fire authority within 30 days, and comply with all reasonable Orders Of the municipal fire authority within the time provided. (hh) An Order that the Administrator prepare a priority list of projects necessary to bring the Strata Corporation's holdings into a good state of repair and maintenance, including time and cost estimates within 60 days of the date of this Order, obtaining such assistance from Engineers, inspectors and other professionals as is necessary in the Administrator's sole discretion. (ii) An Order that the Administrator, in consultation with the insurer and such experts as the Administrator requires, prepare a report setting out options and obtain estimates for the repair andlorremediation of the 11731 Building. 7 (jj) A Declaration that an emergency exists as contemplated under section 98(3) of the Strata Property Act and Bylaw 2 1(2) from the Schedule of Standard Bylaws, and that there are reasonable grounds to believe that an immediate expenditure is necessary to ensure safety or prevent significant loss or damage, whether physical or otherwise. (kk) An Order that the Administrator may use any balance of the Contingency Reserve Fund to arrange immediate emergency repairs to stop the water penetration into the strata complex pursuant to section 98(3) of the Strata Property Act. (11) An Order that the Administrator may take such steps to improve the security of the Strata Complex as he determines are necessary in his sole discretion, including but not limited to hiring security guards and/or contracting with a security company, erecting barricades, securing doors, removing squatters, and/or taking steps to evict problematic tenants pursuant to section 138 of the Strata Property Act. (mm) An Order that the Administrator may arrange to remove and dispose of any object which. is located on common property, including limited common property, including personal possessions which are being stored in contravention of the bylaws, rubbish and/or any object which appears to have been discarded or improperly stored on common property, including limited common property, after providing the owners and occupants with 14 days written notice by postal mail containing a reasonable description of the objects to be removed and disposed of. (nn) An Order that the Administrator review the fmancial records and determine the state of arrears of each owner based on properly documented and properly determined strata fees as well as properly documented and properly assessed special levies, adjusted for properly documented overpayments, within 3 months, and provide notice to each owner in arrears pursuant to sections 112 and 116 of the Strata Property Act, with respect to arrears determined to be owing; (oo) An Order that the Administrator obtain and review the financial documents of the Respondent Strata Corporation and prepare a report to Court within one year, indicating whether it is appropriate in the Administrator's judgment to have a financial audit performed for past or present fiscal years performed by a designated Accountant at the expense of the Strata Corporation; (pp) An Order that the Administrator may in his sole discretion proceed by filing a Lien and seeking a Court Ordered Sale of any strata lot which does not resolve the stated arrears set out in the notice referred to in the paragraph above within the time period set out in the notice. 8 (qq) An Order that Jagdev Singh Athwal, Raj Athwal, and Sonia Athwal forthwith comply with section 32 of the Strata Property Act and by providing written notice to the owners within 60 days disclosing any interest in contracts and transactions of the Strata Corporation during their tenure as Strata Council members. (rr) An Order that within 60 days Jagdev Singh Athwal, Raj Athwal, and Sonia Athwal account for and return any Strata Corporation funds spent on personal expenditures. (ss) A Declaration that Jagdev Singh Athwal is not excused from payment of strata fees or special levies for any strata lot which he owns during a period where such a strata lot is uninhabitable or uninhabited. (tt) An Order that the Administrator forthwith retain and instruct a lawyer on behalf of the Strata Corporation to provide advice with respect to any legal remedies the Strata Corporation may have against the Respondents Jagdev Singh Athwal, Raj Athwal and/or Sonia Athwal. (uu) An Order that the Administrator be authorized to instruct the lawyer retained on behalf of the Strata Corporation to proceed by filing a Writ or otherwise initiating legal action against the other Respondents to protect the interests of the Strata Corporation; (vv) An Order that the Administrator be ordered to instruct the lawyer retained on behalf of the Strata Corporation to take any necessary action to protect and preserve the Strata Corporations interests as regards the insurance claim for fire damage to the 11731 building. (ww) An Order that within 60 days, the Strata Corporation retain a licensed strata management company selected by the Administrator on behalf of the Strata Corporation tà manage the Strata Corporation's affairs under the direction of the Administrator. (xx) An Order that the Respondent Strata Corporation register the current mailing address of the Strata Corporation in the Land Title Office; (yy) An Order that an Administrator acting on behalf of the Strata Corporation may extend any time limit under any of the Orders set out herein for 45 days by giving written notice to all of the owners, and for more than 45 days with leave of this Court; (zz) An Order that, if any 3/4 vote resolution(s) or majority vote resolution(s) of the owners are required to give effect to any of the Orders set out herein, and if such resolution(s) do not pass at a general meeting of the owners, that the Administrator or the Petitioners have leave to apply to this Court for an Order approving the resolution(s); (aaa) A Declaration that the Petitioners have been treated in a significantly imfair maimer by the Respondents; (bbb) An Order that special costs be awarded to the Petitioners; 9 (ccc) In the alternative, an Order that costs be awarded to the Petitioners at Scale B; (ddd) Such other and further relief as this honourable Court shall deem meet. Thc Petitioners seek relief pursuant to: Sections 3, 72, 164, 165, 174 and the whole of the Strata Property Act; Rule 10(1)(a), 44, 52 and 57 of the Rules of Court; At the hearing of this Petition will be read the Affidavit of Michael Kwasnica, sworn the 12th day of October, 2007 1 and filed herewith, and such other material as may be filed on behalf of the Petitioners. FACTS The facts upon which this Petition is based are as follows: The Respondent, the Owners, Strata Plan NW 8 (the "Strata Corporation") is a strata corporation pursuant to the provisions of the Strata Property Act, composed of 20 apartment style residential strata lots, located in Maple Ridge, B.C. The Strata Plan was registered on July 21, 1969. The Petitioner, Michael Kwasriica is a businessman and is the registered owner of strata lots 9 and 11 which are currently tenanted. The Petitioner, Regina Oemitzsch is the registered owner of strata lot 12. The Petitioner, Sean Myersis the registered owner of strata lot 15, in which he resides. The Petitioner, Mary Jones is a homemaker and is the registered. owner of strata lot 20, in which she resides. The Respondent Mr. Jagdev Singh Athwal is a businessman and is the registered owner of 14 of the strata lots comprising the Strata Corporation. Ivir. Athwal is the current president of the Strata Council. The Respondent Sonia Athwal, is a pharmacist,. is Mr. Athwal's daughter and is the registered owner of strata lot 19. Sonia Athwal is a current member of the Strata Council. The Respodent Raj Athwal is Jagdev Singh Athwal's wife. Raj Athwal does not own a strata lot. Raj Athwal is a current member of the Strata Council. The Strata Corporation is not presently being run in substantial compliance with the mandatory provisions of the Strata Property Act, or in accordance with the registered bylaws. The Strata Corporation is portrayed very negatively by the press and by the Council and staff of the District of Maple Ridge. The Strata Corporation's Common Property shows obvious sis of fire damage, serious neglect,. haphazard repair, and is littered with garbage, construction debris and other discarded objects, presenting an eyesore and a fire hazard. . On April 24, 2005 there was a serious fire in the 11731 building. The 11731 building was severely damaged by that fire, and remains unoccupied and unrepaired. An insurance 10 shortfall is expected and the Strata Council has not provided the Petitioners with adequate information with respect to the status of the insurance claim, any settlement offers, or any plans for repair or remediation of the 11731 building. Other less serious fires have occurred on common property, including garbage fires, and a suitcase the. Another small fire was caused determined by the Fire Department to have been caused by squatters inhabiting the crawispace below unit 5 in the 11727 building. Squatters continue to periodically inhabit the crawlspace below buildings within the complex, as well as Building 11731. Mi. Athwal and/or the Strata Council have made or permitted alterations to Common Property without proper approval of the Strata Corporation, including erection of dilapidated structures, alterations to the building envelope, and removal of roofing material which was covered under warranty at the time of removal. The Strata Council has directed that smoke detectors be installed in strata lot 20 in an unsightly and dangerous manner. The Strata Council is enforcing bylaws which were never registered and therefore never came into force. At a June 22, 2003 special general meeting Mr. Athwal proposed and passed a majority vote resolution restricting membership on the Strata Council to 3 members. This was done without amending the bylaws. Everyone other than the representatives of the Athwal family voted against this motion. Also at the June 22, 2003 Special General Meeting, Mr. Athwal and his wife Raj Athwal took over majority control of the Strata Council. The one other Strata Council member at that time, Stanley Kanehara, was not related to Mr. Athwal. Mr. Athwal's daughter Sonia Athwal replaced Mr. Kanehara as a Strata Council member approximately one year later. Multiple Orders of the Municipality have been issued from 2004 and onwards with respect to the appearance, condition, security and fire hazards associated with the subject Strata Corporation without suitably prompt or comprehensive action taken by the Strata Corporation. On August 8, 2006 the Ministry of Public Safety and Solicitor General made a further Order with respect to remediation of the Strata Corporation's holdings. On September 11, 2007 the District of Maple Ridge voted to demolish the 11731 building • because the Strata Council has consistently failed to secure the building pending repair and remediation. Two insurers have cancelled insurance policies in the name of the Strata Corporation for poor maintenance and failure to disclose a fire respectively. The insurance arranged by the Strata Council on behalf of the Strata Corporation which expired in March, 2007 was depreciated value insurance rather than full replacement value insurance as required by the Strata Property Act, contrary to the direction of the owners. It is not known to the Petitioners if the Strata Corporation is currently insured: On November 4, 2006 the Strata Council purported to authorize a special levy and a loan to be taken out by the Strata Corporation. Neither the special levy nor the loan were properly approved by 3/4 vote of the owners. 11 27. The Strata Corporation has filed liens and is seeking to collect arrears against two owners•• with respect to a special levy which was not approved in accordance with the Strata • Property Act. .28. •. The Strata Corporation has failed to comply with document requests made in accordance with sections 36 and 59 of the Strata Property Act. . . .1.. The Strata Corporation has not kept.the current mailing address on file in the land title office as requiredby section 62 of the Strata Property Act. The current address on file is the address of the original developer. Mr. Athwal has used Strata Corporation funds for payment of expenses which are not properly common expenses of the Strata Corporation. Rotting and damaged stairs, railings and fences, as well as other dangerous conditions present fire risks, security risks and liability issues for the Strata Corporation and owners. . . Junk, debris and discarded fixtures and possessions litter the common property; . . . Mold, rat and other pest infestations are a problem within the strata complex No Annual General Meeting was held in 2005 or yet in. 2007. .. . Some of Mr. Athwal's strata lots have been reported by the press tor be inhabited by drug dealers and users. Mr. Athwal has not taken any reasonable steps to evict tenants who cause a disturbance, either as the landlord or as a Strata Council member. Yet, of this group: - 34,000 have college diplomas - 30,000 have trade certificates - 28,000 have university degress > The BC economy is the strongest it has been in decades and with this growth is the demand for skilled workers. Persons with disabilities have the motivation, education and ability to assist BC employers in meeting this demand. > A 10% increase in employment for persons with disabilities means an additional 13,000 persons with disabilities would be employed by 2010 within British Columbia. This would increase the current number of employed persons with disabilities from 132,000 to 145,000.
