CORPORATION OF THE DISTRICT OF MAPLE RIDGE BY-LAW NO. 718-1964 A by-law to establish rates and charges for the use of the common sewer WHEREAS, pursuant to the provisions contained in the “Municipal Act”, being Chapter 255, R.S.B.C., 1960 and amendments thereto, Council may by by-law, and with the approval of the Lieutenant-Governor in Council, impose a charge against the owner or occupier of real property for the use of a sewerage system, and may vary the charge. Bylaw No. 718-1964 Page 2 AND WHEREAS, it is deemed necessary by the Council of the Corporation of the District of Maple Ridge to impose user rates and charges upon real property within the sewered area in order to meet the financial obligations of capital debt, interest thereon, and maintenance. NOW THEREFORE, the Council of the Corporation of the District of Maple Ridge in open meeting assembled, ENACTS AS FOLLOWS: 1. This By-law may be known and cited as “Maple Ridge Sewer Rate By-law No. 718-1964. 2. In this By-law, unless the context otherwise requires: “Corporation” shall mean the Corporation of the District of Maple Ridge. “Council” shall mean the Council of the Corporation of the District of Maple Ridge. 5563-1997 “Dwelling Unit” means one or more rooms used for the residential accommodation of only one family when such room or rooms contain or provide for the installation of only one set of cooking facilities. 5563-1997 “Family” means the persons sharing a household, consisting of: (a) two or more persons related by blood, marriage, adoption, or foster parenthood; or (b) three or fewer unrelated persons. “User” shall include any person, corporation, partnership or party and the heirs, successors and assigns of them or any of them to whom the context can apply whose premises are connected to the common sewer of the Corporation of the District of Maple Ridge. 6893-2012 6782-2010 6716-2010 6636-2008 6537-2007 6457-2006 3. The annual minimum flat rate charge for sewer service shall apply to all users of the common sewer system owned and operated by the Corporation of the District of Maple Ridge as set out on Schedule “A”. All rates herein provided for, shall be collected annually by the Collector at the same time and in a like manner as land taxes and shall be subject to the same penalties if not paid by the tax due dates. All meter rates herein provided for, shall be billed four times per year and shall be subject to a 10% penalty if not paid within 30 days of the date of mailing for each billing period.” Bylaw No. 718-1964 Page 3 5530-1997 3.1 Notwithstanding Sections 12, 13 and 14 of Maple Ridge Sanitary Sewer Regulation By-law No. 691-1964 as amended, the Greater Vancouver Sewerage and Drainage District is hereby authorized to collect a fee, on behalf of the Corporation, in conjunction with a Waste Discharge Permit issued under the Greater Vancouver Sewerage and Drainage District Sewer Use By-law No. 164, calculated at $0.10 per cubic metre of the total volume of contaminated groundwater discharge to the sanitary sewer allowed by the Waste Discharge Permit to be remitted to the Corporation by the Greater Vancouver Sewerage and Drainage District. The fee hereinbefore noted is in addition to any other fees that the Greater Vancouver Sewerage and Drainage District is authorized to collect pursuant to the Greater Vancouver Sewerage and Drainage District Sewer Use By-law No. 164. 4. All rates and charges provided herein shall be due and payable by all users within the current year and shall be payable to the Collector of the Corporation of the District of Maple Ridge, in the Municipal Hall, or to such other person or persons as the Council may from time to time designate. 5. Pursuant to the provisions contained in Section 564 (2) of the Municipal Act, being Chapter 255, R.S.B.C., 1960 and amendments thereto, and amounts imposed under Section 3 of the By-law, remaining unpaid after the 31st day of December in each year shall be deemed to be taxes in arrears in respect of the land upon which are situate, the premises of the user and shall be placed on the tax roll for collection in the year following.
