CARRIED 600 PRESENTATIONS AT THE REQUEST OF COUNCIL RESENTATIONS 601 Ser er ergean ean eant SD Shannon t Shannon, Seaforth Highlanders of Canada (Canadian Forces) -Return of the Maple Ridge flag flown in Afghanistan Sergeant Shannon returned the Maple Ridge Municipal flag to Mayor and Council with thanks. He explained that the flag had been given to him as part of a flag initiative which allowed soldiers serving in Afghanistan to fly the flag from their home town. He gave a powerpoint presentation of the Maple Ridge flag being flown at Camp Nathan Smith where he was stationed. Council Minutes November 25, 2008 Page 3 of 15 700 DELEGATIONS – Nil 800 UNFINISHED BUSINESS – Nil 900 CORRESPONDENCE – Nil 1000 BY BY-LAWS Note: Items 1001 to 1005 are from the Public Hearing of November 18, 2008 Bylaws for Second and Third Reading 1001 RZ/079/08, Byrnes Road – Robertson Cemetery 1001.1 Maple Ridge Official Community Plan Amending Bylaw No. 6606 6606-2008 To amend Schedule “B” of the Official Community Plan (as shown on Map No. 765) from Rural Residential to Institutional. Second and third readings The Director of Planning advised that discussions have been held with a surveyor pertaining to the issue of obtaining a legal survey. She advised that the surveyor confirmed that there is no legislative requirement to pursue a legal survey on the part of the District in order to proceed with rezoning on this site. She also advised that the need for a legal survey will be triggered by purchase of the property R/08-443 RZ/079/08 BL No. 6606-2008 It was moved and seconded That Bylaw No. 6606 6606-2008 be given second and third readings. CARRIED Council Minutes November 25, 2008 Page 4 of 15 R/08-444 RZ/079/08 It was moved and seconded That staff proceed with research to ascertain the requirements of a survey for the Byrnes Road – Robertson Cemetery property and report on the time frame, the cost of a survey and on a method of acquisition of the property and report back to Council. CARRIED 1001.2 Maple Ridge Zone Amending Bylaw No. 6607 6607-2008 To rezone from RS-3 (One Family Rural Residential) to P-6 (Civic Institutional) to reflect this use as a historic cemetery. CARRIED 1001.3 Maple Ridge Heritage Designation Bylaw No. 662 6622-2008 To be designated as a historical site under Section 967 of the Local Government Act in order to provide long term protection of an historical burial site. Second and third readings R/08-447 RZ/056/08 BL No. 6614-2008 It was moved and seconded Second and third That Bylaw No. 6614 6614-2008 be given second and third readings. CARRIED 1002.2 Maple Ridge Zone Amending Bylaw No. 6615 6615-2008 To rezone from RS-2 (One Family Suburban Residential) and RS-3 (One Family Rural Residential) to RM-1 (Townhouse Residential) and RS-1b (One Family Urban (Medium Density) Residential) to permit 40 townhouse units and 4 single family residential lots. Second and third readings. The Director of Planning advised that a flood covenant will be placed on the title of the 4 single family residential lots to make purchasers aware that the properties are in the flood plain. She also advised that the single family residential lots will have building restrictions due to the location in flood plain. CARRIED Council Minutes November 25, 2008 Page 6 of 15 Note: Councillor Hogarth excused himself from the discussion of Item 1003 as there may be a perceived conflict. 1003 RZ/017/08, 12038 Edge Street, 22554 & 22566 Brown Avenue Maple Ridge Zone Amending Bylaw No. 6626 6626-2008 To rezone from RS-1 (One Family Urban Residential) to CD-1-00 (Comprehensive Development) to permit the construction of a residential dormitory intended for future conversion into an assisted seniors living facility and to allow for the addition of definitions for “Dormitory Unit” and “Student Housing” into the Bylaw and to amend the CD-1-00 (Comprehensive Development) zone to include “Student Housing” as a permitted principal use and “Dwelling Unit” as a permitted accessory use. Second and third readings R/08-449 RZ/017/08 BL No. 6626-2008 It was moved and seconded That the terms and conditions to be met prior to final reading of Bylaw No. 6626 6626-2008 be amended by removal of Part 2) iv. a . The curre current use will be restricted to students enrolled with nt School District No. 42 and Part 2) iv) e. CARRIED 1005 RZ/014/08, 13655 256 Street Maple R Ridge Zone Amending Bylaw No. 6613 idge 6613-2008 To rezone from A-2 (Upland Agriculture) and P-5 (Corrections and Rehabilitation) to M-2 (General Industrial) & M-4 (Extraction Industrial) to permit the manufacture and retail sale of concrete products and gravel processing. Second and third readings The Director of Planning advised that the District Noise Bylaw will be used to address any complaints regarding noise caused by work being done on the proposed site. The General Manager, Public Works and Development Services advised that an environmental impact study was done on the property and that an environmental monitor will report back to the municipality on a regular basis. CARRIED 1006 CP/046/07, Detached Garden Suites Staff report dated November 18, 2008 recommending that Maple Ridge Sewer Rate Amending Bylaw No. 6594-2008, Maple Ridge Water Rate Amending Bylaw No. 6595-2008 and Maple Ridge Recycling Charges Amending Bylaw No. 6598-2008 be repealed due to administrative errors and that Maple Ridge Sewer Rate Amending Bylaw No. 6630-2008, Maple Ridge Water Rate Amending Bylaw No. 6631-2008 and Maple Ridge Recycling Charges Amending Bylaw No. 6632-2008 be given first, second and third readings. He explained that the Friends in Need Food Bank is the only legitimate charity of this type in Maple Ridge and does not solicit donations door-to-door. Mayor Robson addressed a display by Coast Mountain Bus Services and the future of a direct express bus to Braid Station for the community. He also thanked the local newspapers for doing a credible job during his tenure and acknowledged District of Maple Ridge staff for their hard work. 1500 COUNCILLORS’ REPORTS Councillor Hogarth Councillor Hogarth attended a Municipal Advisory Committee on Accessibility Issues meeting. He expressed his thanks to both Councillor Stewart and Mayor Robson for their three years working on behalf of the community. Councillor King Councillor King attended an Arts Council and a Bicycle Advisory Committee meeting. She thanked all those who had chosen to run for public office and expressed her appreciation to Mayor Robson and Councillor Stewart. Councillor Dueck Councillor Dueck attended a Youth Diversion Meeting. She asked that the status of the Mayor and the Maple Ridge designate on that committee be reviewed at a future Workshop. She thanked the electorate for taking the time to vote and thanked staff for the work done. She thanked Mayor Robson and Councillor Stewart for their work in the last three years and wished them both well in their future endeavours. Council Minutes November 25, 2008 Page 14 of 15 Councillor Speirs Councillor Speirs attended a Lower Mainland Local Government Association meeting and will be attending a Municipal Insurance Association of BC and Lower Mainland Treaty Advisory Committee meeting. He also thanked Mayor Robson and Councillor Stewart for their work in the last three years. He reminded all that the Hospice Society will be hosting “Time to Remember” on December 3. Councillor Stewart Councillor Stewart commented on relationships developed over his time on Maple Ridge. He touched on some of the committees he has served on during his tenure as Councillor and expressed that the position was a great learning experience which contributed to increasing his knowledge of the community. He also commented on the helpfulness of staff. He encouraged residents to donate to the Salvation Army for the Christmas season. Councillor Daykin Councillor Daykin spoke to the accomplishments by Council over the last three years. He expressed his appreciation for his fellow Council members as well as Maple Ridge staff. He wished Mayor Robson and Councillor Stewart all the best in future endeavours and welcomed Councillor-Elect Ashlie and Councillor-Elect Morden. He reminded all of the Santa Claus Parade on December 6. 1600 OTHER MATTERS DEEMED EXPEDIENT -Nil 1700 NOTICES OF MOTION AND MATTERS FOR FUTURE MEETINGS -Nil 1800 QUESTIONS FROM THE PUBLIC Mr. McWhinney Mr. McWhinney asked if Council was aware that there were still members of the Robertson Family in the Maple Ridge area. He also asked whether Council was aware of provisions under the Cemeteries Act which would allow a municipality to take custodial ownership of a property.
