Gill, General Manager of Corporate and Financial Services The General Manager of Corporate and Financial Services gave a PowerPoint presentation providing a review of property taxation methodology and explaining tax rate multiples. 700 DELEGATIONS – Nil 800 UNFINISHED BUSINESS 801 Award of Contract, ITT ITT-PL11 PL11-42, 224 Street Loading and Unloading Area, on District Owned Land Adjacent to Spirit Square Staff report dated July 26, 2011 recommending that Contract No. ITT-PL11-42 for construction of a 224 Street Loading and Unloading Area be awarded to Canadian Lawn Care Services Ltd. and that the Corporate Officer be authorized to execute the contract. CARRIED 802 Building, Electrical, Gas and Fire Safety Inspection Reports for 11701, 11709, 11715 and 11723 Fraser Street Staff report dated July 26, 2011 recommending Council consideration of options for remedial action or commencement of injunction proceedings in BC Supreme Court to enforce bylaws against Northumberland Fraser Street Holdings Inc. for property at 11701, 11709, 11715 and 11723 Fraser Street. Council Minutes July 26, 2011 Page 4 of 28 The Director of Licences, Permits and Bylaws gave a PowerPoint presentation providing photographs taken on July 12, 2011 indicating the state of the buildings and the property. She reviewed the staff report and advised that staff recommended proceeding with Option A – Remedial Action Powers – Enforcement Alternative No. 1. R/2011-363 Remedial Action Order It was moved and seconded Northumberland WHEREAS Division 12 of Part 3 of the Community Charter (the “Charter”) authorizes Council to impose a remedial action requirement on the owner or owners of a building including a requirement to remove or demolish the building where: 1) Council considers that the building is in or creates an unsafe condition; 2) Council considers that th the building contravenes e the Provincial building regulations or a District bylaw under s. 8(3)(l) (buildings and other structures); and/or 3) Council declares the building is a nuisance; AND WHEREAS Northumberland Fraser Street Holdings Inc., Inc. No. 87410 74109 (the “Owner”) is the registered owner of 16 9 strata lots known as Units #5, #6, #7 and #8, 11723 Fraser Street, Maple Ridge, BC; Unit #9, #10, #11,and #12, 11709 Fraser Street, Maple Ridge, BC; Units #13, #14, #15 and#16, 11701 Fraser Street, Maple Ridge; Units #17,#18, #19 and #20, 11715 Fraser Street, Maple Ridge, BC and legally described as: -Strata Lot Lots 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, , 19 and 20 of District Lot 398 Group 1 New Westminster District Strata Plan NW8 together with an inte interest in the rest common property in proportion to the unit entitlement of the strata lot as shown of form 1, (the “Strata Lots”); AND WHEREAS the buildings containing the Strata Lots includes common property (the Strata Lots and the common property collectiv collectively being, the “Buildings”) that is owned by ely Northumberland Fraser Street Holdings Inc., Inc. No. 874109 as the registered owner of all 20 strata lots shown on form 1 filed with Strata Plan NW NW-8 (“The Owners, Strata Plan NW NW-8”); NOW THEREFORE, the Counci Council of the District of Maple Ridge, in l open meeting assembled, resolves as follows: Council Minutes July 26, 2011 Page 5 of 28 1. THAT Council hereby considers that the Buildings located at 11701, 11709, 11715 and 11723 Fraser Street, Maple Ridge, BC; are in a hazardous condition, within the meani meaning of Section 73(2)(b) of the Charter, as a result of ng the Buildings contravening the District of Maple Ridge Building Bylaw No. 6180 0-2003, the BC Building Code, the District of Maple Ridge Fire Prevention Bylaw No. 4111 4111-1988 and/or the BC Fire Code. 2. THAT Council hereby considers that the Buildings are in HAT and creates an unsafe condition, within the meaning of Section 73(2)(a) of the Charter, as a result of the Buildings being insecure on numerous occasions over the past year, the Buildings continuing to deteriorate and/or the Buildings contravening the District of Maple Ridge Building Bylaw No. 6180 0-2003, the BC Building Code, the District of Maple Ridge Fire Prevention Bylaw No. 4111 4111-1988, and/or the BC Fire Code. 3. THAT Council hereby declares that the Buildings are a nuisance, within the meaning of Section 74 (2) of the Charter, as Council considers the Buildings to be so dilapidated and unclean as to be offensive and pose a risk to the community. 4. THAT Council hereby requires pursuant to its rem remedial edial action powers under Part 3, Division 12 of the Charter that the Owners, and The Owners, Strata Plan NW NW-8: a. demolish and remove the Buildings no later than thirty (30) days after notice of this remedial action requirement under s. 77 of the Charter has been sent by the District to the Owner and The Owners, Strata Plan NW NW-8; b. erect a strongly constructed fence at least 1.5 meters tall around the area where the Buildings were formerly located immediately after the Buildings are demolished a and removed and maintain the fence nd until the requirement in s. 4(c) of this resolution has been complied with; and c. fill in and level any hole created by the removal of the Buildings no later than thirty (30) days after notice of this remedial actio action requirement under s. n 77 of the Charter has been sent by the District to the Owner and The Owners, Strata Plan NW NW-8; Council Minutes July 26, 2011 Page 6 of 28 (collectively, the “Remedial Action Requirement”). 5. THAT the District advise the Owner and The Owners, Strata Plan NW NW-8 that they ma may request that Council reconsider y the Remedial Action Requirement by providing the District written notice within 14 days of the date on which notice under s. 77 of the Charter was sent and that if any or all of the actions required by the Remedial Action Requirement is not completed by the date specified for compliance, the District may take action in accordance with section 17 of the Charter and undertake any or all of the actions required by the Remedial Action Requirement without further notice to and a at the expense of the Owner and The t Owners, Strata Plan NW NW-8. Councillor Ashlie Councillor Ashlie attended the 224 Street Celebration and participated in a Slow Cycle Tour promoting farming. She wished a wonderful summer to all. Councillor Speirs Councillor Speirs recognized staff volunteers helping citizens during tax time. He attended a Parks and Leisure Services hosted tour of emerging parks in the District which included a tour of the South Bonson recreation facility. He also attended the 224 Street celebration and participated in the Comedy of Errors play. Council Minutes July 26, 2011 Page 26 of 28 Councillor Morden Councillor Morden attended the ribbon cutting ceremony for 224 Street, a fundraiser for the Fire Department Burn Fund and a Parks and Leisure Services tour of the South Bonson recreation facility. He reminded residents of the Rotary Duck Race to the held on July 31 and encouraged all to mail HST ballots. Councillor King Councillor King wished staff and citizens a good summer break. 1600 OTHER MATTERS DEEMED EXPEDIENT – Nil 1700 NOTICES OF MOTION AND MATTERS FOR FUTURE MEETINGS – Nil 1800 QUESTIONS FROM THE PUBLIC Sandy Macdougall Mr. Macdougall referred to Item 1003 and asked whether a bylaw that has received third reading and amended, creating a substantive change to the bylaw, would have to be defeated and sent back to Public Hearing. The Chief Administrative Officer indicated that this would be the case. Mr. Macdougall asked if an entirely new bylaw will have to be brought forward. The Chief Administrative Officer confirmed that it would. Dian Mur Murrell ell Ms. Murrell expressed concern over the filling and berming activities being carried out on 224 Street and 132 Avenue. She asked whether Council and District staff will consider working with the Agricultural Land Commission to put a stop order on all activities being carried out on these properties. The Chief Administrative Officer provided an update on discussions held between staff of the Agricultural Land Commission and District Planning and Environmental staff. He outlined work to be done to follow up on these discussions and explained terms the Agricultural Land Commission has ruled on. He indicated that both Agricultural Land Commission and District staff will be visiting the sites again in the next few days to ensure compliance. Council Minutes July 26, 2011 Page 27 of 28 Ms. Murrell asked whether Agricultural Land Commission compliance staff will be doing inspections. The Chief Administrative Officer confirmed that they will. Rosemary Webster Ms. Webster asked what assurances can the District of Maple Ridge provide that what is being done on the property at 224 Street and 132 Avenue will not negatively impact neighbouring properties. She outlined statements made in the recent hydrology study of the area. The Chief Administrative Officer explained aspects of the hydrology report and advised on Agricultural Land Commission legislation. He also advised on the District’s ability to enforce a development permit with respect to water course protection. Nona Coles Ms. Cole asked what the District intends to do about the 8 ft by 8 ft slabs of concrete being buried under the soil in the properties at 224 Street and 132 Avenue. She asked how the District will protect the property for future farm use when it is sold. The Chief Administrative Officer advised that it has been indicated that the concrete slabs are a part of the berm and road structure. Marg Priebe riebe Ms. Priebe asked when the dredging around the 224 Street bridge will commence. The Municipal Engineer advised that dredging on the bridge at 224 Street is slated to begin in early September. Jim Findlay Mr. Findlay indicated that his property was adjacent to Mr. Cho’s property. He expressed concern with traffic in the neighbourhood, law enforcement issues and flooding. He asked whether the process being dealt with currently by his neighbourhood is driven by people like the citizens that are upset or whether there is leadership that residents can look to from District staff and Council on problems being faced. The Chief Administrative Officer advised that District staff is committed to working through the problems the neighbourhood is experiencing and that staff is working with the Agricultural Land Commission to resolve issues. Mayor Daykin advised that the General Manager Public Works and Development Services met with residents from the area and staff will be working on mitigating traffic issues.
