CARRIED 402 Minutes of the Development Agreements Committee Meeting of April 27(2) and 28(2), 2016 and May 4, 2016 be received. CARRIED 500 PRESENTATIONS AT THE REQUEST OF COUNCIL – Nil 600 DELEGATIONS 601 City's Sewer Trunk Line Located Outside of Legal Right of Way • Diane Vissers Ms. Vissers shared her neighbourhood’s experience resulting from the impact of the City’s sewer trunk line located outside of a legal right-of-way. She stated that many questions remain unaddressed and expressed concern that a decision to allow the pipe to remain in its current location was made in a Closed Council meeting and therefore negated participation by the residents impacted. Ms. Vissers outlined other concerns of the residents which included questioning how the impact of a catastrophic event on the pipe or a break in the pipe will be dealt with, advising that the City cannot service the pipe due to its close vicinity to homes. She asked about the option to relocate the pipe along Golden Ears Way and expressed concern that this option was not considered. Ms. Vissers expressed disappointment regarding the handling of the issue and requested that Council revisit the decision and that the residents impacted by the trunk line be involved in the conversation. Council Meeting Minutes May 10, 2016 Page 3 of 13 700 UNFINISHED BUSINESS 701 Motion by Councillor Robson R/2016-262 It was moved and seconded That staff be directed to prepare an Official Community Plan Amending Bylaw to designate the lands identified in Strategy #4: 232 Street /128 128th th Avenue in the Commercial & Industrial Strategy: 2012 2012-2042 (August 2014) “Industrial” for “Mi Mixed Employment” use, allowing for a small amount of xed land along the western edge of the area to be designated “Urban Residential”, to complete the 126B Avenue, 127 Place and 127 127th th Avenue road network and provide a transition between existing residential and future employment land uses. CARRIED 800 CORRESPONDENCE – Nil 900 BYLAWS Bylaws for Final Reading 901 RZ/115/10, 23213 Lougheed Highway Staff report dated May 10, 2016 recommending final reading 901.1 Maple Ridge Official Community Plan Amending Bylaw No. 6940 6940-2012 To designate from Agricultural to Commercial and Conservation Final reading R/2016-263 It was moved and seconded That Bylaw No. 6940 6940-2012 be adopted. CARRIED 901.2 Maple Ridge Zone Amending Bylaw No. 6834 6834-2011 To rezone from M-2 (General Industrial) to CS-1 (Service Commercial) to align the zone with the existing commercial business Final reading R/2016-264 It was moved and seconded That Bylaw No. 6834 6834-2011 be adopted. CARRIED Mayor Read, Councillor Shymkiw -OPPOSED Council Meeting Minutes May 10, 2016 Page 8 of 13 1104 2014 2014-054 054-SD, 23590 Dogwood Avenue, Local Area Service Bylaw Staff report dated May 2, 2016 recommending that a Local Area Service Bylaw be authorized for enhanced landscape maintenance costs and that Dogwood Ridge Local Area Service Bylaw No. 7246-2016 be given first, second and third readings. R/2016-275 It was moved and seconded 1. That a Local Area Service Bylaw, as formally petitioned by the developer of the lands referred to as ‘Dogwood’, and per the Community Charter, Part 7, Division 5, 211 (1)(a), be authorized for the enhanced landscape maintenan maintenance costs to be levied on the ce benefitting properties to be created by subdivision of the land; and further 2. That Bylaw No. 7246 7246-2016 be given first, second and third readings. CARRIED Note: Councillor Robson excused himself from discussion of Items 1105 and 1106 at 8:17 p.m. as he lives in the vicinity of the proposed developments. 1105 2011 2011-002 002-RZ, 25608 Bosonworth Avenue, Final One Year Extension Staff report dated May 2, 2016 recommending that a final one year extension be granted for rezoning application 2011-002-RZ to rezone from A-2 (Upland Agricultural) to RS-2 (One Family Suburban Residential) to allow for future subdivision into 3 lots. R/2016-276 It was moved and seconded That pursuant to Maple Ridge Development Procedures Bylaw No. 5879 5879-1999, a final one year extension be granted for rezoning application 2011 2011-002 002-RZ (property located at 25608 Bosonworth Avenue and that the following conditions be addressed prior to conside consideration of Final Reading: ration i. Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii. Road widening, truncation and cul cul-de de-sac turn turn-around as required; iii. A Community Amenity Contribution in the amount of $15,300 to be paid prior to final reading. R/2016-278 It was moved and seconded That pursuant to Maple Ridge Development Procedures Bylaw No. 5879 5879-1999, a final one year extension be granted for rezoning application 2012 2012-102 102-RZ (property located at 25638 112 Avenue) and that the following conditions be addressed prior to consideration of Final Reading: i. Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt of the deposit of a security, as outlined in the Agreement; ii. Road dedication as required; iii. Council Meeting Minutes May 10, 2016 Page 11 of 13 R/2016-280 It was moved and seconded That Contract ITT ITT-EN16 EN16-23, 128 Avenue/Abernethy Way Road and Drainage Improvements (216 Street to 224 Street), be awarded to B & B Contracting (2012) Ltd. in the amoun amount of $6,524,600.00 excluding taxes; t and That a construction contingency of $975,000.00 be approved to address potential variations in field conditions; and That the ISL Engineering and Land Services Ltd. contract for Engineering Design Services for 128 Avenue (Abernethy Way) from 210 Street to 224 Street, be amended to increase the budget by $250,000.00 for environmental monitoring and construction compliance services; and That the Financial Plan be amended to increase the project budget by $989,600.00 as detailed in the Council Report dated May 2, 2016 titled Award of Contract ITT ITT-EN16 EN16-23: 128 Avenue/Abernethy Way Road and Drainage Improvements (216 Street to 224 Street); a and further nd That the Corporate Officer be authorized to execute the contracts.
