decided at Council meetings which affect many people’s lives. Therefore, we ask that
you act with the appropriate decorum that a Council Meeting deserves. Commentary

QUESTION PERIOD
The purpose of the Question Period is to provide the public with an opportunity to
ask questions of Council on items that are of concern to them, with the exception of
Public Hearing by-laws which have not yet reached conclusion.
Council will not tolerate any derogatory remarks directed at Council or staff
members.
Each person will be permitted 2 minutes to ask their question (a second
opportunity is permitted if no one else is sitting in the chairs in front of the podium).
Questions must be directed to the Chair of the meeting and not to individual
members of Council. The total Question Period is limited to 15 minutes.
Council reserves the right to defer responding to a question in order to obtain the
information required to provide a complete and accurate response.
Other opportunities are available to address Council including public hearings,
delegations and community forum. The public may also make their views known to
Council by writing or via email and by attending open houses, workshops and
information meetings. Serving on an Advisory Committee is an excellent way to
have a voice in the future of this community.

Mayor Daykin spoke to the passing of Mr. Fred Elder, recognizing Mr. Elder

Mayor Daykin also spoke to the large fire at the Waldun Forest Products
mill in Ruskin and reported that the mill owners have secured a temporary
site to allow the mill to continue to operate on a limited basis.

John Athey
Mr. Athey advised that he is the owner of a gravel road which passes through the proposed
development. He referred to affidavits between the previous owner speaking to a land
exchange for land for a right of way originally meant for 240 Street and indicated this land
will have to be purchased from him, referencing a contract made in 1939.
Mayor Daykin explained that Mr. Athey was speaking to Item 1 and asked that he speak with
the Acting Director of Planning following the meeting as the item was adjourned.
Chris Mundy
Mr. Mundy expressed concern with fire department access to the proposed development
and stated that the intended horse trail should serve as a fire access. He also expressed
concern with the impact of the application on the existing wildlife corridor and vegetation
and asked that these elements be protected.
Mr. Mundy inquired about the 1.2 m wall being built at the base of the property. He asked
about the intended height of the wall, whether it will meet existing regulations and what type
of backfill will be used in the construction of the wall. He expressed concern with the impact
of bio swales and backfilling on Millionaire Creek and hoped that this area will be protected.

was received from Lucie and Will Menkveld and that correspondence expressing concern
with the application was received from Debra Douglas and Dan, Debra, Jeremy & Corbin
DuBois.

Will Menkveld
Mr. Menkveld expressed concern with the impact of the proposed townhouse complex on
existing parking in the neighbourhood. He felt that the tandem garages proposed for six
units within the townhouse complex will negatively impact parking as these types of garage
layouts are more often used for storage than for parking. He wondered where current
residents of the neighbourhood will park should residents living in the townhouse complex
choose to park in front of the existing houses.
Melanie Goodman
Ms. Goodman is concerned with the impact on parking as well as the increase in traffic flow
due to the proposed townhouse complex. She requested clarification on how the proposed
building will be situated and how far back the buildings are from the greenbelt.
The Acting Director of Planning advised on the setback of the buildings from the greenbelt.
Ms. Goodman is opposed to the application and would prefer to see single family homes,
expressing concern with the impact of the proposed townhouse complex on property values.
She asked for clarification to the changes in the conservation area.

The Acting Director of Planning explained the changes in the conservation area, indicating
that more green space was being provided as a result of the proposed changes.
Lynda Russbueldt
Ms. Russbueldt is opposed to the application as the neighbourhood is a single family area
with a cul de sac. She expressed concern with increased traffic as well as the impact on
parking in the neighbourhood particularly within the cul de sac. Ms. Russbueldt asked
whether a retaining wall will be built and whether the proposed townhouses will be set down
or up. She stated that no one has approached her with information about the application.
The Acting Director of Planning spoke to the placement of the proposed townhouses as well
as the placement of retaining walls.
Ms. Russbuelt asked how retaining walls to be put in will affect her property. She felt that
the area has not quite been finished as paving has not yet been completed and trees have
not been planted and requested that these be completed prior to the start of something
else.
John Goodman
Mr. Goodman expressed concern over the impact of the proposed subdivision on his
property. He requested more time to look at information as he received notice of Public
Hearing while on vacation. He also expressed concern over the proposed landscaping and
the clear cut done on the property.
Fred Formosa – Builder – Falcon Homes
Mr. Formosa addressed concerns of residents. He explained the design of the development
and spoke to parking in the area. He advised that a townhouse site had always been in the
plans for the site and that this information was available in the existing show home.
Will Melkveld
Mr. Melkveld felt that single family residences would be better suited for this particular
parcel of land.
Fred Formosa - Builder – Falcon Homes
Mr. Formosa indicated that a request for a zoning change was always intended and that it
has always been known that the property was planned to be a townhouse site by the
applicant.

The Acting Director of Planning provided a history on the phased development of the site,
advising that the developer indicted in 2006 that the proposed development would be a
townhouse site.
Chris Mundy
Mr. Mundy would like the District to require that solar panels, green roofs and closed gutters
be components of future developments.
John Goodman
Mr. Goodman spoke to the comments put forward by the developer relating to parking. He
reiterated his statement that more information should have been provided prior to this
development going in.
Lynda Russbueldt
Ms. Russbueldt expressed concern with the parking in the cul de sac as well as the lack of
completion of the retaining wall.

Ms. Elferink expressed concern with the possibility of a negative impact on drainage in the
area as a result of the clearing of the land for the proposed development. She asked when
fencing and drainage for the development will be put in. Ms. Elferink referred to recently
built houses in the neighbourhood which remain unsold and asked whether the proposed
subdivision will include a better quality of home.
The Acting Director of Planning advised that the applicant and the engineer on record are
responsible for dealing with drainage on the site. He also advised on the potential fencing
for the development.
There being no further comment, the Mayor declared this item dealt with.

EXECUTIVE SUMMARY:
Bylaws 6731 - 2010 and 6732 - 2010 have been considered by Council and at Public Hearing and
subsequently were granted Third Reading. The applicant has requested that Final Reading be
granted. The purpose of the rezoning is to permit the construction of about 159 townhouses.
RECOMMENDATION:
That Official Community Plan Amending Bylaw No. 6731- 2010 be adopted; and
That Zone Amending Bylaw No. 6732- 2010 be adopted.
DISCUSSION:
a) Background Context:
Council considered this rezoning application at a Public Hearing held on March 15, 2011. On May
25, 2010, Council granted Third Reading to Maple Ridge Official Community Plan Amending Bylaw
No. 6731 – 2010. On March 22, 2011, Council granted Third reading to Maple Ridge Zone
Amending Bylaw No. 6732 - 2010 with the stipulation that the following conditions be addressed:
i. Approval from the Ministry of Transportation;
ii. Registration of a Rezoning Servicing Agreement as a Restrictive Covenant and receipt
of the deposit of security as outlined in the Agreement;
iii. Amendment to Schedules "B" & “C” of the Official Community Plan;
iv. Registration of a geotechnical report as a Restrictive Covenant which addresses the
suitability of the site for the proposed development;
v. Registration of a Restrictive Covenant for the protection of the Environmentally
Sensitive areas (wetlands) on the proposed development;
vi. Road dedication as required;

vii. Consolidation of the development site;
viii. Removal of the existing buildings;
ix. Inclusion of the site into Fraser Sewer Area;
x. Park dedication as required;
xi. Registration of a Statutory Right-of-way to allow municipal access from 240 Street to
the Park;
xii. Registration of a Restrictive Covenant protecting the Visitor Parking.
The following applies to the above:
1. Approval was granted by the Ministry;
2. The required Rezoning Servicing Agreement has been registered.
3. The necessary OCP Amending Bylaw and associated schedules were prepared as
instructed.
4. It has been determined that the Geotechnical Restrictive Covenant is not required.
Registration of such a covenant is usually at the discretion of the Approving Officer at the
time of a subdivision. However, there is no subdivision, only a consolidation of the site,
and Building is satisfied that the studies submitted have provided an appropriate level of
assurance that the site is suitable for the proposed development.
5. The required Habitat Protection Restrictive Covenant has been registered.
6. The necessary plan for road dedication has been registered.
7. The necessary plan for lot consolidation has been registered.
8. Existing buildings have been removed.
9. The site is within the Fraser Sewer Area.
10. The necessary plan for park dedication has been registered.
11. The required Statutory Right-of-way for Park access has been registered.
12. The required Visitor Parking Restrictive Covenant has been registered.

CONCLUSION:
As the applicant has met Council’s conditions, it is recommended that Final Reading be given to
Maple Ridge Official Community Plan Amending Bylaw No. 6731 - 2010 and Maple Ridge Zone
Amending Bylaw No. 6732 - 2010.

EXECUTIVE SUMMARY:
Bylaws 6763 - 2010 and 6764 - 2010 have been considered by Council and at Public Hearing and
subsequently were granted Third Reading on October 11, 2011. The applicant has requested that
Final Reading be granted. The proposal is to rezone the subject property from RS-3 (One Family
Rural Residential zone) to RS-2 (One Family Suburban Residential zone) to permit a future
subdivision of 13 single family residential parcels not less than 0.40 hectares each in area.
The proposed RS-2 (One Family Suburban Residential) zone complies with the OCP designation of
“Suburban Residential” for the subject site. Council reviewed a Development Variance Report at the
September 10th Committee of the Whole meeting. The environmentally sensitive areas on site will
be dedicated as “park” and placed under a “conservation covenant” for protection, requiring an
Official Community Plan amendment to adjust the conservation boundary.
RECOMMENDATION:
That Official Community Plan Amending Bylaw No. 6763 - 2010 be adopted; and
That Zone Amending Bylaw No. 6764 - 2010 be adopted.
DISCUSSION:
a) Background Context:
Council considered this rezoning application at a Public Hearing held on September 20, 2011. On
October 11, 2011 Council granted Third Reading to Maple Ridge Official Community Plan Amending
Bylaw No. 6763 - 2010 and Maple Ridge Zone Amending Bylaw No. 6764 - 2010 with the stipulation
that the following conditions be addressed:
i. Amendment to Schedule “C” of the Official Community Plan;
ii. Registration of a Geotechnical Report as a Restrictive Covenant which addresses
the suitability of the site for the proposed development;
iii. Registration of a Habitat Protection Covenant on conservation areas outside the
park dedication areas;
iv. Approval from the appropriate authorities for septic disposal and water quality;

v. Park dedication as required, including construction of walkways and equestrian trail.
The following applies to the above:
Item i above will be completed after final approval from Council.
Items ii, iii and v will be executed, as per the “Letter of Undertaking” from the applicant’s solicitor.
Regarding item iv, District has received the appropriate copies of septic feasibility report and
notification to the Fraser Health. A Septic Field Restrictive Covenant will be registered on each newly
created lot, as a condition of final subdivision approval.
b) Additional Information:
The subject site is 39.97 acres in size and an estimated 22.7 acres is anticipated to be added to
conservation park lands through a combination of dedication and conservation covenant. The
applicant is working towards satisfying all the conditions of the “Preliminary Review Letter” and it is
anticipated that the final subdivision approval will occur within a couple of months.
CONCLUSION:
Significant area on the subject site acres is anticipated to be added to conservation park lands,
including cleaning and enhancement works around McFadden Creek. The development proposal is
in compliance with the Official Community Plan. As the applicant has met Council’s conditions, it is
recommended that Final Reading be given to Maple Ridge Official Community Plan Amending Bylaw
No. 6763 - 2010 and Maple Ridge Zone Amending Bylaw No. 6764 - 2010.

A Bylaw to exempt from taxation, certain properties within
the Corporation of the District of Maple Ridge
WHEREAS, pursuant to provisions of the Community Charter, S.B.C., 2003, Chapter 26, a
Municipal Council may exempt certain land and improvements from taxation, where, in the
opinion of the Municipal Council, the use of the land and improvements qualifies for
exemption;
AND WHEREAS, the Municipal Council deems it expedient to exempt certain land and
